MINUTES OF A SPECIAL MEETING
OF THE DISTRICT BOARD
CENTRAL CONTRA COSTA SANITARY DISTRICT
HELD MARCH 29,1966
The District Board of Central Contra Costa Sanitary District convened
in a Special Session at its regular place of meeting located at 1250 Spring-
brook Road, Walnut Creek, County of Contra Costa, State of California, on
March 29, 1966, at 8:00 o'clock P.M., called at the request of the Attorney
General of the State of California to adopt a Resolution relative to concrete
pipe price fixing which is to be adopted on or before March 31, 1966.

Mr. Horstkotte, District Manager-Engineer, stated that he had received
a call from the Attorney General's Office requesting that the District Board
act on a Resolution relative to concrete pipe price fixing on or before
March 31, 1966.
Mr. Horstkotte stated that the price fixing period was from 1946 to date.
Mr. Horstkotte further stated the action involved approximately 10 million
dollars in contracts of which approximately 4 million dollars of pipe would be
involved.
Mr. Horstkotte estimated that an out-of-court settlement without penalties
could mean a payment to the District of from $100,000 to $120,000.
Mr. Horstkotte stated that the only expense to the District would be the
time of the staff and District Counsel spent in obtaining from the District
records the contracts and figures required by the Attorney General's Office.
President Mitchell questioned Mr. Horstkotte and Mr. Carniato, representing
Mr. Bohn, Counsel for the District, relative to the clause in the Resolution
which provides for the District's sharing in the cost.
Mr. Horstkotte and Mr. Carniato stated they had received informal assur-
ances that the cost to the District only involved the time of the staff and
Counsel for the District in preparing the information requested by the Attorney
General's Office.
Member Roemer stated that he objected to the type of form presented to
the District.
RESOLUTION NO. 1540, A RESOLUTION AUTHORIZING THE ATTORNEY GENERAL OF
CALIFORNIA TO CONDUCT LEGAL PROCEEDINGS
After discussion, it was moved by Member Roemer, seconded by Member Gibbs,
that Resolution No. 1540 be adopted with the stipulation that District Counsel
receive confirmation in writing from the Attorney General's Office as to the
District's fair share of the costs to be advanced. Carried by the following
vote:
