HomeMy WebLinkAboutBOARD MINUTES 02-17-66 187 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HELD FEBRUARY 17,1966 The District Board of Central Contra Costa Sanitary District convened in an Adjourned Regular Session at its regular place of meeting located at 1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of California, on February 17,1966, at 8:00 o'clock P.M. The meeting was called to order by President Mitchell. 1. ROLL CALL PRESENT: Members: Gibbs, Howard, Roemer and Mitchell ABSENT: Member: Rustigian II. APPROVAL OF MINUTES The Minutes of the meeting of February 3, 1966, were approved as pre- sented. III. APPROVAL OF EXPENDITURES None. IV. BIDS None. V. HEARINGS LOCAL IMPROVEMENT DISTRICT NO. 44. SCHEDULES 6 AND 7 President Mitchell opened the informal Hearing for Local Improvement District No. 44, Schedules 6 and 7. He explained that the Board reviews any differences that might exist as to the work and restoration of property for decision. He explained that the Contractor had created problems for the District in the manner in which the work was performed. President Mitchell then asked Mr. Horstkotte, Engineer for Local Improvement District No. 44, for written protests. Prior to presenting the written protests, Mr. Horstkotte explained that the Local Improvement District proceedings were commenced by petition of the property owners and the contracts were awarded to the low bidder, H. E. Johnson Construction Co. The qualifications and investigation by the District staff gave no indication that poor work would be anticipated. Once the con- tracts had been let, it was necessary that the District make the best of a bad situation. At the request of Mr. Diamond, Mr. Horstkotte stated he would review further in the field. There being no further written protests for Local Improvement District No. 44, Schedule 6, President Mitchell asked for verbal protests. Assessment No. 44-6-9-24, Mamie H. Porter. Mrs. Porter stated the Con- tractor had agreed to come in February and restore her landscaping to the original character of improvement. This has not been done. Mr. Horstkotte stated that the Contractor would be required to restore the streets to structural standards and this summer they would be given a seal coat. There being no further protests on Local Improvement District No. 44, Schedule 6, President Mitchell asked for written protests on Local Improve- ment District No. 44, Schedule 7. Mr. Horstkotte presented the written protests for Local Improvement District No. 44, Schedule 7, as follows: Assessment No. 44-7-3-1, Ross, valid protest. Mr. Lieber explained to the Board the work he had done on the property and its present condition. Assessment No. 44-7-13-1, Almassy, general protest. Assessment No. 44-7-7-1, Schumacher, valid protest. There being no further protests, President Mitchell closed the informal Hearing for Local Improvement District No. 44, Schedules 6 and 7. V1. OLD BUSINESS ORINDA UPLANDS ASSESSMENT DISTRICT Mr. Horstkotte, District Manager-Engineer, presented a map outlining Public Sewering Areas (PSA) 8 and 9 and explained that, since the last presentation to the Board, additional petitions had been received. By not serving and leaving out certain properties whose owners did not sign petitions for sewers, on the perimeter of the previously presented area, 60% assessed valuation is now represented by signed petitions. Those properties to be eliminated were discussed with Mr. Horstkotte. After discussion and on the recommendation of Mr. Horstkotte, it was moved by Member Gibbs, seconded by Member Howard, that the District staff be authorized to proceed with proceedings for an Assessment District for Public Sewering Areas 8 and 9. ASSESSMENT NO. 45-1-11-7, ELSER President Mitchell and Member Roemer stated they had reviewed the problem in the field with Mr. Horstkotte, Engineer for Local Improvement District No. 45. President Mitchell reported that he agreed with Mr. Horstkotte that certain damage could not have been done by the Contractor for the Local Improvement District, but that shaping up the hillside and changing the ditch were in order. Mr. Horstkotte stated that, when the weather permits, further work would be done. VII. NEW BUSINESS CALL FOR CIVIL SERVICE WRITTEN AND ORAL EXAMINATION FOR ASSISTANT OPERATOR On recommendation of Mr. Horstkotte, District Manager-Engineer, it was moved by Member Roemer, seconded by Member Gibbs, that a Civil Service examination be held to establish an eligible list for Assistant Operator. FAULKNER It was moved by Member Howard, seconded by Member Roemer, that the easement from John M. Faulkner be accepted and its recording ordered. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Member: Gibbs, Howard, Roemer and Mitchell None Rustigian CORRESPONDENCE FROM CONTRA COSTA COUNTY RE PROPOSED LAND USE AND TRANSPORTA- TION STUDY FOR CONTRA COSTA COUNTY After an explanation from Mr. Horstkotte, District Manager-Engineer, President Mitchell requested copies of the memorandum of understanding and summary memorandum from Victor W. Sauer, Public Works Director of Contra Costa County, to the Board of Supervisors, be sent to each Member of the District Board. Continued to March 3,1966. 02 17 66 1~O RESOLUTION NO. 1536. ACCEPTING COMPLETION AND AUTHORIZING THE FILING OF NOTICE OF COMPLETION, LOCAL IMPROVEMENT DISTRICT NO. 44. SCHEDULE 5 Upon the recommendation of Mr. Horstkotte, Engineer for Local Improve- ment District No. 44, it was moved by Member Howard, seconded by Member Gibbs, that Resolution No. 1536 be adopted. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Member: Gibbs, Howard, Roemer and Mitchell None Rustigian TRACT 3484, CONSENT TO DEDICATION OF STREETS FOR PUBLIC USE After discussion, it was moved by Member Howard, seconded by Member Roemer, that the President and Secretary be authorized to sign the sub- division map, as requested, subject to the approval of Mr. Bohn, Counsel for the District. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Member: Gibbs, Howard, Roemer and Mitchell None Rustigian EXECUTION OF TWO QUIT CLAIM DEEDS TO UTAH CONSTRUCTION & MINING CO. Mr. Horstkotte, District Manager-Engineer, stated the Quit Claim Deeds were for sewers no longer in use. It was moved by Member Gibbs, seconded by Member Roemer, that the President and Secretary be authorized to execute the Quit Claim Deeds to Utah Construction & Mining Co. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Member: Gibbs, Howard, Roemer and Mitchell None Rustigian ADVANCE PAYMENT TO CITY OF MARTINEZ OF FUNDS COLLECTED FOR WATERSHED 24 SOUTH Mr. Horstkotte, District Manager-Engineer, stated that Mr. Frumenti had requested that the $1,875.00 collected for Watershed 24 South be paid to the City of Martinez now rather than the May 1,1966, date provided in the agreement. Upon the recommendation of Mr. Horstkotte, it was moved by Member Gibbs, seconded by Member Howard, that the $1,875.00 credit in the Watershed 24 South account be paid to the City of Martinez at this time. REPORTS DISTRICT MANAGER-ENGINEER NEW CHLORINATOR FOR LOWER ORINDA PUMP STATION Mr. Horstkotte, District Manager-Engineer, requested authorization to purchase a new chlorinator for the Lower Orinda Pump Station from Sewer Construction funds; cost to be $1,660.00, plus tax. After discussion, it was moved by Member Gibbs, seconded by Member Howard, that the purchase of a new chlorinator for the Lower Orinda Pump Station at a cost of $1,660.00, plus tax, be authorized from Sewer Construction funds. Carried by the following vote: AYES: NOES: ABSENT: 02 Members: Members: Member: 17 Gibbs, Howard, Roemer and Mitchell None Rustigian '66 191 EMPLOYEE COMPLETES DELCO TRAINING SCHOOL COURSE Mr. Horstkotte reported that Mr. Mark Ivory, Maintenance Man (Mechanical), had successfully completed the Delco Training School course and was preparing to be licensed to install smog control devices. COLLECTING CONNECTION FEES FOR GARBAGE DISPOSALS Mr. Horstkotte discussed with the District Board the problem of collecting the connection fees for garbage disposals in existing homes,many of which have been wired for them to be installed in the future. RESOLUTION NO. 1537. APPOINTMENT OF LAWRENCE LADNER. SEWER INSPECTOR It was moved by Member Gibbs, seconded by Member Howard, that Resolution No. l537 be adopted. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Member: Gibbs, Howard, Roemer and Mitchell None Rustigian ANNEXATION OF CITY OF MARTINEZ Mr. Horstkotte reported that the City of Martinez adopted a resolution to request annexation to the District. Mr. Horstkotte stated the annexation is subject to obtaining sufficient Federal Aid. CONTRACT WITH BROWN AND CALDWELL Mr. Horstkotte discussed the new contract with Brown and Caldwell, Engineers, for the next stage of the Treatment Plant enlargement. President Mitchell questioned the section providing for independent power equipment. Mr. Horstkotte stated that this is a Civilian Defense suggestion in case of failures. After discussion, it was moved by Member Gibbs, seconded by Member Howard, that the President and Secretary be authorized to execute the agreement with Brown and Caldwell, Engineers, for the next stage of the Treatment Plant en- largement, subject to a final determination of the economic value of an in- dependent power plant and subject to Office of Civilian Defense grant. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Member: Gibbs, Howard, Roemer and Mitchell None Rustigian PROPOSED INTERNATIONAL TELEPHONE & TELEGRAPH OFFICE INTERCOM SYSTEM Mr. Horstkotte discussed with the Members of the Board a proposed International Telephone & Telegraph office intercom system. Members of the Board who have had experience with such systems did not favor them. COLLECTION OF MONIES DUE THE DISTRICT Mr. Horstkotte explained that Mr. Ralph Christie, several years ago, left the area owing the District a bill for sewers the District installed to serve property owned by Mr. Glick. He is now back in the area. Mr. Horstkotte requested that Mr. Bohn, Counsel for the District, be given authority to proceed to collect the $205.37 still owing the District. 02 '17 c.. ,, vb l!)2 It was moved by Member Gibbs, seconded by Member Howard, that Mr. Bohn be authorized to proceed to collect the $205.37 Mr. Ralph Christie owes the District.
