HomeMy WebLinkAboutBOARD MINUTES 08-26-65 1.32 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HELD AUGUST 26, 1965 The District Board of Central Contra Costa Sanitary District convened in an Adjourned Regular Session at its regular place o£ meeting located at 1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of California, on August 26, 1965, at 8:00 o'clock P.M. The meeting was called to order by President Mi tchel L I. ROLL CALL PRESENT: Membe rs: Gibbs, Howard, Roemer and Mitchel L ABSENT: Member: Rustigian Member Rustigian arrived at 8:12 o'clock P.M. II. APPROVAL OF MINUTES The Minutes of the meeting of August 19, 1965, were approved as presented. III. APPROVAL OF EXPENDITURES None. IV. BIDS None. V. OLD BUSINESS SEWER SERVICE TO THE CITY OF MARTINEZ Mr. Horstkotte, District Manager-Engineer, stated that the City of Martinez has a service area of approximately 13,000 acres--an assessed valuation of about $25,000,000.00, and a population of 10,300; there being 970 acres now sewered within the City limits. A relatively small percentage of the service area is considered developable due to the steep terrain. The Martinez Study prepared by Mr. Dalton, dated August, 1965, was related to the John Carollo Engineer's Report dated May, 1965, prepared for the City of Martinez. The District Board, after review of the Martinez Sewage Study prepared by the District, discussed the various sections and tables presented with Mr. Horstkotte and Mr. Dalton. President Mitchell stated that the Board accepts the engineering study presented by Mr. Horstkotte with the main consideration of the District Board being the cost and effect on the District taxpayers. Items under particular discussion were: Shell Oil Company's old and new facilities, City of Martinez service charge, City of Martinez and District connection charges, Federal funds under Law 660 for the City of Martinez and the timing necessary to obtain them, City of Martinez service from the District and its effect on accelerating District expansion of facilities, 08 26 65 1~1 Cannery flows in the City of Martinez and Walnut Creek, Personnel problems, Full annexation, Limited annexation, and Service contract. President Mitchell asked if Mt. View Sanitary District entered into the picture to which Mr. Horstkotte answered, No. President Mitchell stated that no figures were presented as to the effect service to Martinez would have on District costs. Mr. Horstkotte stated that this is to be covered in the report and study now being prepared by Brown and Caldwell for the District. Member Gibbs stated that, if sewer service is to be given the City of Martinez, he felt it should be kept simple by full annexation. Mr. Bohn, Counsel for the District, stated that there should be a memorandum of discussion with the City of Martinez and a check list prepared prior to final negotiations. President Mitchell stated that the next step should be for the District staff to get together with the City of Martinez staff. CREEKSIDE INVESTOR'S REQUEST TO PAY CONNECTION CHARGE OVER A PERIOD OF TIME Mr. Horstkotte, District Manager-Engineer, asked the District Board to make a determination whether the monthly service charge should be reduced if payments are made on the 90% balance of the connection charge due. Mr. Bohn, Counsel for the District, stated that, if monthly service charges are reduced by partial payment, the 90% balance due on any connection charge would require a change in the District Code. After discussion, it was moved by Member Howard, seconded by Member Rustigian, that the District Code be amended to provide for paying the 90% balance due on any connection charge in two equal payments and a reduction in the monthly service charge of 1% per month of the amount paid. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Members: Gibbs, Rustigian, Howard, Roemer and Mitchell None None VI. NEW BUSINESS SETTLEMENT OF EASEMENT PARCEL 45-1-15. BASSETT Mr. Horstkotte, District Manager-Engineer, presented a list of trees and shrubs removed from the Bassett property as a result of the sewer in- stallation and stated it was the staff recommendation to settle for $1,000.00. It was moved by Member Howard, seconded by Member Rustigian, that the easement Parcel 45-1-15, Bassett, damage be settled for $1,000.00. REPORTS DISTRICT MANAGER-ENGINEER None. 08 26 .65 1 ~" COUNSEL FOR THE DISTRICT CORNELISON LITIGATION Mr. Bohn, Counsel for the District, reported on the Cornelison litigation. EXECUTIVE SESSION The District Board adjourned to an Executive Session to discuss personnel matters. After the Executive Session, the District Board reconvened to the Regular Session. RESOLUTION NO. 1523. AUTHORIZING EXECUTION OF AGREEMENT BETWEEN THE STATE PERSONNEL BOARD OF THE STATE OF CALIFORNIA AND THE CENTRAL CONTRA COSTA SANITARY DISTRICT It was moved by Member Gibbs, seconded by Member Rustigian, that Resolution No. 1523 be adopted.
