The meeting was called to order by President Mitchell. I. ROLL CALL PRESENT: Members: Gibbs, Roemer and Mitchell ABSENT : Members: Rustigian and Howard Member Ho"ard arrived at 8 :05 0' clock P.M. APPROVAL OF EXPENDITURES It was moved by IvIember Howard) ~~('('Inded by Nember Roemer, that the expenditures, as audited by the Auditing Committee and as submitted by the District Manager-Engineer, be approved, reference being specifically made to Sewer Construction Vouchers Numbers 1852 to 1873, inclusive, and Running Expense Vouchers Numbers 5334 to 5521, inclusive. HEARINGS (A) DISTRICT ANNEXATION NO. 10 President Mitchell opened the Hearing on District Annexation No. 10 and asked for written protests. . Mr. Horstkotte, District Manager-Engineer, presented a letter from Mr. Fred 1. Donahue protesting the inclusion of 12 acres of his property in the annexation. Mr. Horstkotte presented a map of the area and explained that the Donahue property would be served by sewers in Local Improvement District No. 44 and could not be excluded from the annexation. After discussion, it was moved by Nember Roemer, seconded by Member Gibbs, that the protest of Mr. Fred L. Donahue be denied. After discussion, it was moved by Member Gibbs, seconded by Hember Howard, that the protests of Arthur Lawton, Hal Corey, Donald D. Kingman, Delmar E. Ohl, and Charles A. Johnson be denied. Carried by the followin~ vote: AYES: NOES: ABSENT: Members: Members: Hembers: Gibbs, Rustigian, Howard, Roemer and Hi tchell None None Mr. Horstkotte presented a letter from the San Damiano Retreat, Franciscan Fathers and Brothers, protesting the inclusion of 6.16 acres in District Annexa- tion No. 10. Mr. Horstkotte read an answer to them dated December 3,1964, explaining the reason for the 6.16 acres being included. The letter explained that the 6.16 acres being a portion of a larger parcel was presently being taxed for District purposef' and the annexation was only a formality. There being none, President Mitchell declared the Hearing closed. RESOlliTION NO. 1460, OVERRULING PROTESTS AND APPROVING DISTRICT ANNEXATION NO. 10 AND PETITION TO THE BOARD OF SUPERVISORS TO ALTER THE DISTRICT BOUNDARIES It was moved by Member Gibbs, seconded by Member Howard, that Resolution No. 1460 be adopted. Mr. Pansby disagreed with Mr. Horstkotte in his statement that the contrac- tor had done what was necessary to restore his property. Mr. Pansby claimed the road and fences were not restored to the character of improvement that existed prior to the work. After discussion, Member Roemer suggested that the Board Members visit the Pansby property Sunday, December 6,1964. Continued to December 17,1964. Hr. Farrer complained that the sewer line did not serve his entire property. Mr. Horstkotte explained to Mr. Farrer that the assessment on his property was lower because of the limited service. Letters from William P. Tuggle, W. W. Horison and the Vernal Area Improve- ment Association, commending the contractor for his work, were presented. There being no further protests, President Mitchell declared the informal Hearing to receive protests relative to the work on Local Improvement District No. hJ-5 closed. VI. OLD BUSINESS PAYHENT TO JOHN A. BOHN FOR SERVICES IN HE LOCAL UIPROVEIVJENT DISTRICT NO. 43 EASENENT CONDEIvINATIONS . The following statements were received from Mr. Bohn for services in regard to Local Improvement District No. 43 easement condemnations: Parcel No. Owner Fee 43-1-38 Bowater $250.00 43-1-20 Clemens-Hartin 250.00 43-1-33 Nushi 250.00 43-2-4 Strand 250.00 It was moved by Member Gibbs, seconded by Nember Hm.¡ard, tbat Mr. John A. Bohn,Counsel for the District, be paid $250.00 each for the condemnation Hork on Parcels L13-1-38, l..t3-1-20, 43-1-33 and l..t3-2-4, a total of $1,000.00, in accordance with statements presented to the District Board; these sums to 12 03 64 25 be charged to the Local Improvement District. Carried by the following vote: AYES: NOES: ABSENT: IVlembe rs : Hembers: Hembers: Gibbs, Rustigian, Howard, Roemer and Mitchell None None AUTHORIZATION TO FILE NOTICE OF COMPLETION ON DISTRICT SEWERING PROJECT 1137 ANTI FINAL PAYHENT LESS RETENTION Mr. Horstkotte, District Hanager-Engineer, stated that District Sewering Project 1137 was completed and requested authorization to file Notice of Completion and pay funds when due. It was moved by Hember Howard, seconded by Hember Roemer, that Hr. Horstkotte be authorized to file Notice of Completion for District Sewering Project 1137 and that final payment less 10% retention be made; the 10% retention is authorized for payment after the period for filing claims has expired if no claims are filed. Hoffatt dated November 25,1964, for damages in the sum of $135.00 as a result of sewer stoppage and overflow in his home, was presented. lir. Horstkotte, District i'lanager-Engineer, stated that it 1-Jas the staff's reco~~endation to pay the claim. It was moved by Nember Rustigian, seconded by Hember Howard, that the claim of Hr. Paul C. Moffatt in the sum of $135.00, as a result of damage caused by sewer overflowing in his home, be paid after receipt of a signed Release in Full Settlement and Compromise. Carried by the following vote: AYES: NOES: ABSENT: Nembers: Hembers: Members: Gibbs, Rustigian, Howard, Roemer and Mitchell None None PURCHASE OF 30.7 ACRES AT TREATMENT PLANT Hr. Horstkotte, District Manager-Engineer, stated that the escrow instruc- tions were ready for the purchase of the 30.7 acres at the Treatment Plant which the District Board had previously authorized. The purchase price being $86,118.0.0 plus $412.00 title insurance, a total of $86,560.00 less an estimatedcredit of $99.73 for taxes prorated on closing; a net amount of $86,L(60.27 to be paid to the Title Company. It 'Aas moved by Member Gibbs, seconded by Hember Howard, that the President and Secretary be authorized to execute the escrow instructions for the purchase of .30.7 Acres a+ the Treatment Plant; that $86,460.27 from Sewer Construction Funds be authorized for pa)~ent to the Western Title Guaranty Company and the Deed accepted and its recording ordered. It was moved by Member Howard, seconded by Member Gibbs, that ;ijl ,372. GO be authorized from Se1,rer Construction Funds for Shearfuser Diffusers for the Treatment Plant Enlargement - 1964. After an explanation, it was moved by Member Gibbs, seconded by Member Rustigian, that $500.00 for Watershed 27 West, $1,500.00 for District Sewering Projects 1135,1136 & 1137 and $500.00 for Watershed 29 South be authorized from Sewer Construction Funds. December 11,1964, at the Sportsman's Club and the Directors have been invited. COUNSEL FOrt THE DISTRICT PUBLICITY FOR HEARING ON GARBAGE RATES Hr. Gerald Ellersdorfer, representing Hr. Bohn, Counsel for the District, reported on the publicity being given for the Hearing on December 17,1964, to consider the application for an increase in garbage collection rates. IX.
