The meeting was called to order by President Hitchell. 1. HOLL CALL PRESENT: r1embers: Gibbs, Roemer, Fisher, Bo"Man and Mitchell ABSENT: l1embers : None II. APPROVAL OF HINUTES The flinutes of the meeting of December 6,1962, were approved as presented. III. APPROVAL OF EXPENDITURES None. IV. BIDS None. v. HEARINGS DISTRICT ANN&XATION ffí President Hitchell opened the Hearing for District Annexation #7 and asked for any protests. P..ESOLU'l'ION NO. 13h7' AUTHORIZING DISTRICT ANNEXATION NO. 7' AND PETITION TO THE BOARD OF SUP~RVISOl/S TO ALTER TIrE DISTRICT BOUNDARIES There being no protests, the hearing was declared closed, and it Has moved by Hember Fisher, seconded by Member Bowman, that Resolution No. 131.17 be adopted. Carried by the following vote: AYES : NOES ~ ABSENT: Hembers: Nembers: Members: Gibbs, Roemer, Fisher, BoHman and Mitchell None None VI. OLD BUSI~'ESS None. VII. NEW BUSINESS CONTHACT AND GRANT OF EASEI1ENT FROH UNITED STATES BUREAU OF RECLANATION, '/:fA TERSHED 21.1 SOUTH hr. Horstkotte, District Eanager-Engineer, explained that the easement \Jas for two crossings of overflmJ lines from the Contra Costa canal to the creek channel in.vatershed 24 South. It was moved by Nember BovJman, seconded by JVlember Gibbs, that the President and Secretar;)' be authorized to execute the easement agreement vli th the United States Bureau of Reclamation for the crossing of tvw overflow lines in the Watershed 24 South area. Carried by the following vote: AYES: Hembers: Hembers: lVlembers: Gibbs, Roemer, Fisher, Bowman and I'1i tchell None None NOES: ABSENT: 12 13 62 .19 CLAn¡ OF EARL HULKINS llr. Horstkotte, District Manager-Engineer, explained that Mr. Hulkins har connected to an abandoned line and it was necessary to reconnect to a ne"r line at an e~tra expense of $128.26, which the District staff recommends be paid. It was moved by hember Bowman, seconded by Member Fisher, that the claim of Hr. Earll'lulkins be paid after receipt of a signed Release in Full Settlement and Compromise. Carried by the following vote: AYES: Hembers: Members: Members: Gibbs, Roemer, Fisher, Bowman and Ni tchell None None NOES: ABSENT~ VIII . REPO R'rs DISTRICT ~lliNAGER-ENGINEER TREA TNENT PLANT SITE TIvIPROVEHENTS Mr. Horstkotte, District Hanager-Engineer, reported that the bid for the grading work at the Treatment Plant on a unit basis Has $33,617.40 and, when the final quanti ties "Here in, the final cost was $39,397.53. I-ir. Horstkotte stated that Lines D and E ,\'ere to be done next year, as scheduled, and, being in the same area, bids may be asked for both as one job or alternate proposals for each. TRUNK SE'tlER G, SECTIONS II THRU l7, EASEl/JENT PARCEL II Nr. Horstkotte requested that the District staff be authorized to offer to settle easeìoont Parcelll of Trunk Sewer G, Sections II Thru l7, in the amount of ;~J50. 00 Hi th the property O"I-mer reserving the right to build over the easement area. He stated that the property owners have not as yet committed themselves to a settlement. It vas moved by Member Roemer, seconded by Nember Fisher, that the District staff be authorized to offer $350.00 in settlement for Parcel II of Trunk Sewer G, Sections II Thru l7, with the property o~~er reserving the right to build over the easement area. Bohn, Counsel for the District, stated that the California Supreme Court denied a hearing in the Hobbs Shore case. 12 13 62 50 n.
