MINUTES OF A SPECIAL MEETING
OF THE SANITARY BOARD OF CENTRAL
CONTRA COSTA SANITARY DISTRICT
HELD OCTOBER 23.1947.
The Sanitary BOard of the Central Contra Costa Sanitary
District convened in~ecial session at its regular place of
meeting located at 1335 Commercial Lane, in the City of Walnut
Creek, County of Contra Costa, State of California, on the 23rd
day of October, 1947 at the hour of 8:00 p.m.

It was moved by Director Smitten, seconded by Director Toland
that Mrs. Phillips be appointed Secretary pro tem in the absence
of Secretary Cutler.
Unanimously carried.
READING OF MINUTES
It was moved by Director Johnson, seconded by Director Smitten
that the reading of the Minutes of the previous meeting be waived
and be approved as entered.
Carried unanimously.
The following resolution was presented by Director Wadsworth:
~UTION NO. 71
WHEREAS, this Sanitary Board has heretofore approved plans and
specifications prepared by its District Engineer for the construc-
tion of a main trunk sanitary sewer between the proposed treatment
plant site south of the Arnold Highway to a point opposite Newell
Avenue on State Highway No. 21, more commonly referred to as Section
I of the main trunk sanitary sewer, and
WHEREAS, this Board proposes to award a contract for the con-
struction of the said main trunk sanitary sewer in accordance with
said plans and specifications.
NOW THEREFORE BE IT RESOLVED that this Board does hereby find
and determine that the public interest, convenience and necessity,
require the acquisition, construction and completion by this District
of the main trunk sanitary sewer as set forth in said plans and
specifications and that an easement over the real property herein-
after described, together with the right of ingress thereto and
egress therefrom, are necessary for the constructing, laying,
maintaining and operating sewer pipes therein of said main line
sewer.
BE IT FURTHER RESOLVED, that W. H. Brailsford, Jr., Attorney
for said District be and he is hereby authorized and directed to
commence and maintain an action and proceeding of eminent demain
in the Superior Court of the State of California, in and for the

County of Contra Costa, for the purpose of condemning and
acquiring said easement over, upon and through said hereinafter
described parcel of real property for the uses and purposes
aforesaid. Said real property is more particularly described
as follows:
An easement over the hereinafter described land situate in
the County of Contra Costa, State of California, together with
the right of ingress thereto and egress therefrom, to-wit:
A portion of that certain 212.30 acre parcel of land
described in the deed to Annie Loucks, dated January
9,1913, recorded January 18, 1913, in Book 197 of
Deeds, page 31, described as follows:
A strip of land 20 feet wide, the center line of said
strip being described as follows:-
Beginning at a point in the Southerly line of Arnold
Industrial Highway as described in the deed from Annie
Loucks, unmarried, to State of California, dated Sept-
ember 7, 1938, recorded October 10, 1938, ,in Book 467
of Official Records, page 90, distant thereon South 660
421 West, 906.43 feet from the Southeast corner of said
deed to State of California, (467 OR 90); thence South
60 01116" East 966.50 feet to a point in the Northerly
line of property described in the Decree of Distribution
in the matter of the Estate of Olementina Solmi, also
known as Clementa Solmi, deceased, Contra Costa County
Probate No. 12627, a certified copy thereof being re-
corded October 7, 1946, in Book 956 of Official Records,
page 247, distant thereon South 68 00 I West, 10.l4'02
feet from the Northeast corner thereof. The side lines
of said strip to be lengthened or shortened so as to
extend entirely across the property of the grantor from
the Arnold Industrial Highway, hereinabove refered to
(467 OR 90), Southerly to the Northerly line of the
property described in the said Decree of Distribution
in the matter of the Estate of Clementina SolIDi, also
known as Clementa Solmi, Deceased, Contra Costa County
Probate No. 12627, a certified copy thereof being re-
corded October 7, 1946, in Book 957 of Official Records,
page 247.

The following resolution waS presented by Director Johnson:
~SOLUTION NO. 72
WHEREAS, ANNIE LOUCKS for and in consideration of the sum
of Twenty One Thousand Five Hundred and Thirty-four and OO/loOth
($21,534.00) Dollars, has executed a deed, dated June 6, 1947,
to the Central Contra Costa Sanitary District, all that certain
real property situated in the County of Contra Costa, State of
Oa1ifornia, described as follows:
A portion of the Rancho Las Juntas, County of Contra
Costa, State of California, containing 53.835 acres,
more or less, described as follows:
Beginning at the point of intersection of the East-
erly line of that certain 212.30 acre parcel of land,
described in the deed to Annie Loucks, dated January
9,1913, and recorded January 18,1913, in Book 197
of Deeds, page 31, with the Northerly line of that
certain 6.926 more or less, acre parcel, described in
the deed from Annie Loucks to the State of California,
dated September 7,1938 and recorded October 10, 1938,
in Book 467 of Official Records, page 90, thence from
said point of beginning along the northerly line of
said State of California 6.926 more or less acre par-
cel (467 OR 90) South 660 42' West 2492.48 feet more

livestock and for domestic use for one household, from
the water main now situated on the premises hereinabove
described, and to maintain a one inch water pipe line
at its present existing location running from said water
main in a southerly direction across the lands herein-
above described to the State Highway and to the lands of
the said Annie Loucks, all as provided for in the deed
executed by the said Annie Loucks to Port Costa Water
Company, a corporation, dated September 20,1910, re-

The rights of John A. DeMartini, a tenant in possession
under an unrecorded lease of the hereinabove described
lands of the said Annie Loucks, including the hereinabove
described parcel of real property, the term of which lease
will expire on the 30th day of September, 1947, reserving
to the said Annie Loucks all rentals under said lease.

NOW THEREFORE, Bi IT RESOLVED that said deed be and the
same is hereby accepted and the Recorder of the County of Contra
Costa County be, and he is hereby authorized and direct~d to

Mr. DeLap reported to the Board on the status of the Gogo
Estatels attempt to find a contractor to take over the contract
awarded to Tom L. Gogo, deceased. They have not been successful
to date, but are still trying, and will make every attempt to
save the bond for the estate.
Mr. Brailsford state$.that returning the bond would come
under the heading of making a gift of public money, and tbat the
Board should readvertise for bids for November 13.
The Board called a RECESS to discuss Mr. Delaps statements.
Director Smitten presented the following resolution:

RESOLUTION NO. 73
WHEREAS, in the judgment of the Sanitary Board of the CENTRAL
eONTRA COSTA SANITARY DISTRICT, it is necessary to secure all
labor, materials, equipment, mechanical workmanship, transporta-
tion, and services required for the construction of the Main
Trunk Sanitary Sewer between the proposed treatment plant site
north of the Arnold Highway to a point opposite Neweli Avenue
on State Highway No. 21, hereinafter referred to as Main Trunk
Sewer Section 1, in accordance with the plans and specifications
for the same prepared by the District Engineer which have hereto-
fore been approved by this Sanitary Board and which are'on file
in the office of the Sanitary District located at 1335 Commercial
Lane, Walnut Creek, California.
NOW THEREFORE, BE IT RESOLVED that the general prevailing
rates of wages as heretofore ascertained and determined by this
Board in its Resolution No. 56 adopted on the 11th day of

September, 1947, in pursuance of Articles I and II of Chapter I
of Part 7 of Division 2 of the Labor Code of the State of Calif-
ornia, shall be the general,prevailing rates of per diem wages
for each craft or type of workman or mechanic needed for the con-
struction of said 'Main Trunk Sanitary Sewer; and

BE IT FURTHER RESOLVED that the Secretary of this Board be
and is hereby authorized to advertise for proposals for the con-
struction and completion of said work by publishing the same twice
in THE COURIER-JOURNAL, a newspaper of general circulation, pub-
lished in the CENTRAL CONTRA COSTA SANITARY DISTRICT; and
BE IT FURTHER RESOLVED THAT THE NOTICE INVITING SEALED
PROPOSALS shall be in the form as follows:
NOTICE INVITING SEALED PROPOSALS
Notice is hereby given that the Sanitary Board of the
Central Contra Costa Sanitary District, Walnut Creek, Calif-
ornia, invites and will receive sealed proposals until 8
o'clock P.M. November 13, 1947, for furnishing all labor,
materials, and services for the construction of Main Trunk
Sewer, Section I for the Central Contra Costa Sanitary Dist-
rict in accordance with the plans and specifications adopted
therefore.

The plans and specifications for the proposed work may be
seen and examined at the office of the Central Contra Costa
Sanitary District, 1335 Commercial Lane, Walnut Creek, Calif-
ornia, or at the Engineering Office of Clyde C. Kennedy, Room
504, 604 Mission Street, San Francisco, California, or may be
secured at the Engineering Office of Clyde C. Kennedy by making
a payment of ten dollars ($10.00). There will be no refund on
returned plans or specifications.

Pursuant to the statutes of the State of California the
Sanitary Board of the Central Contra Costa Sanitary District
has"ascertained and determined the general prevailing rate of
per diem wages and rates for overtime and legal holidays in
the locality in which this work is to be performed for each
craft or type of workman or mechanic needed to execute the
contract. The prevailing rates so determined are as follows:

Overtime and Saturday work shall be paid for at double the
normal hourly rate except as noted below for Cement Finishers
and Truck Drivers and work on Sundays and Holidays shall be
paid for at double the normal hourly rate.
The foregoing schedule of prevailing rates of wages, and
rates for overtime, Sunday and Legal Holidays, is based, unless
otherwise specified, upon a working day of 8 hours.
Overtime and Saturday rates for Truck Drivers shall be at
1~1/2 times the'normal hourly rate.
The first two hours overtime, after a normal 8 hour day,
for Cement Finishers shall be at 1-1/2 times the normal rate
and further overtime shall be at double the normal rate. Sat-
urday work for Cement Finishers shall be at 1-1/2 times the
normal rate for" the first 8 hours worked and at double the
normal rate for<all further time worked on Saturdays.
Notice is also hereby given bidders that it shall be mand-
atory upon the contractor to whom the contract is awarded,
and upon all subcontractors under him, to pay not less than
said general prevailing rates of per diem wages, as above
listed, to all laborers, workmen, and mechanics employed in
the'execution of the contract.
Before submitting proposals the bidder shall be licensed
in accordance with the provisions of Chapter 9 of Division III
of the Business and Professions Code, Che,pter 37, of the
Statutes of 1939, as amended, of the State of California,
which provides for the registration and licensing of contractors.

Each bidder must submit with his proposal, a statement of
his financial responsibility, technical ability and experience
on the form to be furnished prospective bidders.
i:ach bidder shall suùmi t with his bid on 1he form provided
the name and address of each subcontractor including the prin-
cipal suppliers of materials, and the portion of the work which
each subcontractor will do. If the contractor fails to name
the subcontractors in his proposal he shall be deemed to have
agreed to perform such portion of the work himself and shall
not be permitted to subcontract said portion of work without
previous written permission of the Sanitary District Board.

The proposal shall be made out on the form to be furnished
prospective bidders, a copy of which is incorporated with the
specifications, and must be accompanied by a certified or
cashiers' check or bidder's bond for an amount not less than
ten (10) per cent of the aggregate of the proposal, made pay-
able to the Central Contra Costa Sanitary District, sealed and
filed with the Secretary thereof on or before the day and hour
first above set forth, and thereafter will be publicly opened
and read before said Sanitary Board.
The above mentioned check or bond shall be given as a guar-
antee that the bidder will enter into contract if awarded the
work, within ten (10) days after notice of the award has been
sent to him by mail at the address given by him in his proposal
and said check or bond shall be declared forfeited if the
bidder refuses or neglects to enter into said contract within
said time.
The successful bidder will be required to furnish labor and
material bonds in the amounVbf 50 per cent of the contract
price and a faithful performance ~ond in an amount equal to
100 per cent of the contract price.
The Sanitary Board reserved the right to reject any or all
proposals and to waive any informality in proposals received.

REGISTERED RECEIPT FROM GOGO
The Board instructed the Secretary to make a request to
a Postal Inspector, regarding receipt for registered mail to
Tom L. Gogo, dated September 19, 1947, to determine when the
letter was delivered, and who signed for it.
Director Smitten presented the following resolution:
RESOLUTION NO. 74
WHEREAS, on September 18, 1947, this Board accepted the
bid of TOM L. GOGO in the sum of FOUR HUNDRED TWENTY-EIGHT
THOUSAND, SEVEN HUNDRED SIXTY-NINE AND NO/100THS DOLLARS
($428,769.00) for the construction of Section I of the Main
Line Sanitary Sewer to be located between the disposal plant
site north of the Arnold Highway and Newell Avenue on State
Highway No. 21, and a.uthorized the President and Secretary of
this Board to execute a formal written contract on the behalf
of the CENTRAL CONTRA COSTA SANITARY DISTRICT with the success-
ful bidder; and
WHEREAS said successful bidder did, pursuant to the spec-
ifications, instruction to bidders, and general provisions,
deposit with this Sanitary Board a bidderls bond in the penal
sum of SIXTY-FIVE THOUSAND AND NO/100THS DOLLARS ($65,000.00);
and
WHEREAS the said TOM L. GOGO received notice in writing,
on September 22,1947, of the acceptance of his bid by this
Sanitary Board and of the award of such contract to him; and
WHEREAS neither the said TOM L. GOGO nor his personal
representative or assigns has executed a contract with the
CENTRAL CONTRA COS'A SANITARY DISTRICT for the construction of
said Section I of the Main Line Sanitary Sewer,
NOW, THEREFORE, BE IT RESOLVED that said bid bond executed
by TOM L. GOGO as principal and the NATIONAL SURETY COMPANY, a
New York corporation, as surety, dated September 18, 1947, be
and the same is hereby forfeited.
BE IT FURTHER RESOLVED that W. H. BRAILSFORD, JR., as
attorney for said Sa,nitary District, be and he is hereby author-
ized to commence such legal action as may be necessary to recover
such damages as may be sustained by the Sanitary District by
reason of the failure to execute the contract as aforesaid.

Smitten that plans for Main Trunk Sewer, Section III be approved,
and the President and Secretary be and are hereby authorized and
directed to signify this approval by placing their signatures upon
said Plans and Specifications.

a deed of Dedication for sewer easement of all that certain real
property situated in the County of Contra Costa, State of Calif-
ornia, described as follows:

A strlp of land ten feet in width, the side lines
of which lie 3 feet northerly and 7 feet southerly
(right angle measurements) from and parallel with,
and extending the entire length of a line described

described in the deed from Robert MacKay to Dorothy
F. Leonhart, by deed dated December 15,1928 and re-
corded March 8, 1929 in Volume 179 of Official

WHEREAS, this Sanitary Board on Thursday, September 11, 1947,
authorized and did publish a call for bids on Section II of the
Main Line Sanitary Sewer to be located between the City of
Walnut Creek and a point at the intersection of ,Moraga Avenue
and Mt. DiB.blo Boulevard in Lafayette, California, and,
WHEREAS, in response to call for bids the following bids
have been received:

NOW, THEREFORE, BE IT ~SOLVED:
(1) That the bid of MANUEL SMITH at the unit prices set
forth therein be and the same is hereby accepted, and the Pres-
ident is hereby authorized and directed to execute a contract
on the behalf of the Central Contra Costa Sanitary District with
said successful bidder and the Secretary be and he is hereby
authorized to countersign the Same on behalf of the District.
(2) Immediately f~llowing the execution of the contract by
the successful bidder and the District, and upon the furnishing
by the bidder of the bonds required by said Contract, the Sec-
retaryis hereby authorized and directed to return to the success-
ful bidder such deposit as may gave accompanied said bid, or to
give such release as may be requested from further liability upon
the bidder's bond.
(3) Upon the execution of a contract by the successful
bidder and the approval on behalf of the Sanitary District of
the accompanying bonds the Secretary is hereby authorized and
directed to return all certified checks accompanying the bids of
the unsuccessful bidders.

on Award.
The qualifications and ability of Manuel Smith to perform work
of the character involved in Section II of the Main Trunk Sewer have
been investigated and the following has been ascertained:
a.
Mr. Smith has completed all of his contracts of a similar
character during the past several years.
Mr. Smith has adequate finances in property and bank account
to carry out the contract in the amount of approximately

$200,000. The Bank of America has reported that they would
loan Mr. Smith the necessary funds to carryon this work in
the event that he needed financing beyond his own cash on hand.
Mr. Smith has two ditching machines, a back-hoe trencher,
bulldozers, compressors and other necessary equipment required
for the construction.
d.
Investigation of the performance of Mr. Smith on other con-
tracts reveals the engineers in charge of those jobs consider
that Mr. Smith performed work of good quality, particularly
as to the installation of sewers. These engineers advised
of some difficulty with Mr.Smith in the conduct of his opera-
tions, but stated that they could not disqualify Mr. Smith
from future bidding on their work, particularly since the
quality of the work performed was entirely satisfactory.
The American Surety Company, through its San Francisco rep-
resentatives advise that they will write the required faith-
ful performance and labor and material bonds for Mr. Smith
if he is awarded the contract.

My investigation discJ,.oses that Mr. Smith is qualified to
perform the work and is financially responsible, and it is there-
fore recommended that the contract for Section II of the Main
Trunk Sewer be awarded to Manuel Smith at the unit prices shown
in his bid, which give a total price for purposes of comparing
bids of $198,956.00.

01UNDA COUNTRY CLUB RIGHT OF WAY
After hearing a report from Mr. Mason on rìghts of way from
the Orinda Country Club, it was moved by Director Wadsworth,
seconded by Director Smitten that the Board approve an offer of
$5,500 as full payment for two parcels of land to be acquired in
fee for installation of pumping plants, and a further offer by
the Country Club to grant easement for installation of gravity
~ewers and sewer force mains at no cash payment for such ease-
ments, but with the consideration that the Country Club be per-
mitted to connect its existing sanitary plumbing to the main
trunk sewer system of the Sanitary District at no charge or
assessment for such connection, but with the cost of the work
of making the connection to be borne by the Country Club. The
Board instructed the Attorney to prepare a deed for the convey-
ance of the property to be acquired in fee, and to prepare the
necessary agreements for rights of way and to establish an escrow
covering these transactions. Carried unanimously.
PETTY CASH
It was moved by Director Johnson, seconded by Director
Smitten that the petty cash fund be replenished in the amount
of $50.00. Carried unanimously.
