MINUTES OF THE REGULAR ~EETING
OF THE SANITARY BOARD OF CENTRAL
CONTRA COSTA SANITARY DISTRICT
HELD OCTOBER 9. 1947
The Sanitary Board of the Central Contra Costa Sanite.ry District
convened in regular session at its regular pIece of meeting located
at 1335 Commercial Lane, in the City of Walnut Creek, County of
Contra Costa, State of California, on the 9th day of October, 1947
et the hour of 8:00 p.m.
The meeting was called to order by President Weill.
The follow-

Director Smitten made the motion, seconded by Director Johnson

PAYMENT FOR RIGHTS OF WAY SECTION II

It was moved by Director Toland, seconded by Director Wadsworth
that the Board 8.pprove the payment 0 f $500. each for the Leonhart
and Gibbons right of way, due to the fact that walnut trees will
have to be removed.
Carried by the following vote:

It was moved by Dir~ctor Johnson, seconded by Director Smitten
that the Board approve acceptance of easement through the Freeman
property on the basis of permitting Mr. Freeman to connect his
home sewer to the manhole on main trunk sewer within his property.

accepted the following Deeds of Dedication:

WHEREAS, Philip F. Heraty and Elinora R. Heraty, for value
received, have granted a Deed of Dedication for sewer easement
of all thet certain real property situated in the County of
Contra Costa, State of California described as follows:
PARCEL 1: Being a portion of that certein trect of
land conveyed by J. 3. Botelho, et ux, to Philip F.
Heraty, et ux, dated August 18,1944 and recorded
October 3, 1944 in Volume 631 of Official Records,
page 276.
A parcel of land twenty feet wide lying adjacent to
and measured at right angles from the easterly line
of State Highway No. 21 leading fro~ Walnut Creek
to Alamo, the easterly line of the said State High-
way No. 21 being also the westerly line of that
certain parcel of land described in deed fro, J. J.

The following resolution was presented by Director Smitten,
seconded by Director Johnson:
RESOLUTION NO. 70

WHEREAS, this Se.nitary Board has heretofore approved plans and
specifications prepared by its District Engineer for the construc-
tion of a main trunk sanitary se\ver between the City ofWa.lnut Creek
and Lafayette, C8lifornia, commonly referred to as Section 2 of the
mein sewer, and;
WrlEREAS, this Board proposes to award a contract for the con-
struction of the said main sewer in accordance with said plans and
specifications.
NOW THEREFORE BE IT RESOLVED, and this Board does hereby find
and determine thet the public interest, convenience and necessity
require the acquisition, construction and completion by this District
of the main trunk sanitary sewer as set forth in said plans and
specifications and that an easement over the real property herein-
after described, together with the right of ingress thereto and
egress therefrom are necessary for constructin~, layin~, illRintpining
and opRrR~ing sewer pipes therein of said main line sewer.
BE IT FURTHER RESOLVED, that ~. H. Brailsford, Jr., Attorney for
said District be and he is hereby authorized and directed to commence
and maintain an action and proceeding of eminent domain in the
Superior Court of the St8,te of Ce.lifornia, in and for the County of
Contra Costa, for the pur~ose of cond~mninF and acquiring said ease-
ment over, upon and throufh said hereinafter described parcels of
real property for the uses and purposes aforesaid. Sata real property
