"sr.,...fe D f Creek, County~of California, on thellth day of September, 1947 at the hour of 8:00 p.m. The meeting waS called to order by President Weill. following roll was called: The PRESENT: ABSENT: Directors Johnson, Smitten, Weill. Directors Toland and Wadsworth. SECRETARY PRO TEM Due to the absence of Secretary Cutler, Director Smitten offered the motion, seconded by Director Johnson that Mrs. Phillips be appointed Secretary pro tem. Carried by the following vote: AYES: NOES: Directors Johnson, Smitten, Weill. None ABSENT: Directors Toland and Wadsworth. READING OF MINUTES. It was moved by Director Johnson, seconded by Director Smitten that. the reading of the minutes of the previous meeting be waived, and be approved as entered. Carried by the following vote: AYES: Directors Johnson, Smitten and Weill. NOES: None ABSENT: Directors Toland and Wadsworth. WAGE SCALE DISPUTE A letter from the firm of. CR.rlson, Collins & Gordon, attor- ney's for Laborers Union Local 324 was presente~ and read by the secretary. The letter offered evidence in support of the Union statements that $1.50 waS the prevailing wage scale in Contra Costa County. 09 11 47 ---------- 1 .... 'h .' 4 t' A list of contractors was submitted in support of statement in paragraph (1) of the above letter. Dispatch books were offered supporting statement in paragraph (8), showing that Local 324 had cleared 2,318 laborers at $1.50 and 1,320 laborers at $1.40 per hour wage between June 1, and September 10, 1947. Director Johnson asked why there were two rates in this area. Mr. Gordon answered there was a contract between the International Union and Associated General Contractors at $1.40, providing the contractor did. not have individual contract at $1.50. Director Johnson asked Mr. Gordon, that in the event the contre.ct W13.S awarded to an A. G. C. contractor, and if the rEtte had been determined by the Board to be $1.50, would that contractor be deprived of the benefit of the A.G.C. contract with the Union providing for general labor at $1.40. Mr. Gordon replied that in Contra Costa County he would be obliged to pay $1.50. Mr. Carlson, attorney for Local 324, stated in substance that it was the duty of the Board to determine the prevailing wage scale in this area, regardless of contractural obligations between the A.G.C. and International Headquarters. Director Smitten said that of the nine bids received, seven were A.G.C. contractors, who had contracts at $1.40. What would the taxpayers think if the,Board set the rate at $1.50, when the evidence showed that labor was being hired in this area at $l.LW. DIRECTOR TOLAND ARRIVED. Mr. Wright, representing Local 324 Saidhe had checked with five of the bidders, and they had stated they would pay the $1.50 rate. They were: T. & J. Artukovich Artukovich Bros. Tom Gogo Steve Re.dos M~rtin Bros. (did not bid) President Weill then asked the union representatives if they had any further evidence to present. There appearing to be none, the President A. G. C. to present what wage rate controversy. then called upon the representatives of evidence they had with relation to the 09 11. 4 ~' 1, "".; 7' ,.' , Mr. Gardner Johnson and Mr. Perry Taft represented the Associated General Contractors. Mr. Johnson referred to the constitution of American Federation of Building Trades, page 8 of Section 18, showing that the State of California had est- ablished $1.4,,0 as the prevailing wage on highway and heavy construction. He quoted from a telegram from the East Bay Municipal Utility District - II contra,ct involving installs,tion of cast iron weter mains paid $11. 20 per day for common labor and,,$12.20 for jackhammer operators. II He al so read in pa.rt, a letter from the International Union president who said the International Union does not enter lightly into contracts, and ~ ¡~ the Union will s~and back of the contract furnishing men at ~ """;) rc <= $1.40. Director Smitten moved that the board go on record estab- lishing the prevailing wage rate at $1.40, seconded by Director Johnson, and carried by the following vote: AYES: DirectGrs Johnson, Smitten and Weill. NOES: None . ABSENT: Director Wadsworth. Director Toland, having come late and not having heard all the evidence indicated that he did not feel qualified to vote, and therefore did not vote on the foregoing motion. ,Director Smitten introduced the following resolution, sec- onded by Director Johnson: RESOLUTION NO. 56 ,WHEREAS, in 'pursuance of Article 1 and 2 of Chapter 1 of Part 7 of Division 2 of the Labor Code of the State of California before the Sanitary Board of the Central Contra Costa Sanitary Dist.rict may award any contract for public work on behalf of said Sani.tary District, the Sanitary Board must ascertain the general prevailing rate of per diem wages in the locality in which the work is to be performed, to-wit: within the limits of the Central Contra Costa Sanitary District for each craft or type of workman or mechanic needed to execute the contract, and must specify in the ~all fo~bids ~or said contract and in the contract itself what the general prevailing rate of per diem wages in said locality is for each craft or type of workman or mechanic needed to execute the contract and also the general prevailing rate for legal holiday and over-time work; " NOW, THEREFORE, BE IT RESOLVED, that the said general pre- vailing re.te of p~r diem wages and the general prevailing rate of per diem wages fo~ legal holiday and overtime work within the limits of said Sanitary District for each craft or type of work- man or mechanic-needed to execute a contract for the construction 09 11 47 ..---..-...,.. The foregoing schedule of prevailing rates of wages, and rates for overtime, Sundays and Legal Holidays, is based, unless otherwise specified, upon a working day of 8 hours. Overtime and Saturday rates for Truck D~ivers shall be at 1-1/2 times the normal hourly rate. The first two hours overtime, after ~ normal 8 hour day, for Cement Finishers shall be at 1-1/2 times the normal rate and further overtime shall be at double the normal rate. Saturday work for Cement Finishers shall be at 1-1/2 times the normal rate for the first 8 hours worked and at double the normal rate for all further time worked on Saturdays. ~ C'~ ~ -. ...' ....,.. -.- <!: All skilled labpr not listed above that may be employed is to be paid not less than the Union Wage Scale for su,ch labor pro- vided there is such a scale established in this løcality and in no event to be paid less than ONE AND 10/100THS DOLLARS ($1.10) per hour. It shall be mandatory upon the contractor to whom the con- tract is awarded, and upon the subcontractor under him, to pay not less than the said specified rates to all laborers, workmen, and mechanics employed by them in the execution of the contract. Properly indentured apprentices may be employed upon this work in accordance with the State Law. Such apprentices shall be properly indentured as called for by law and shall be paid not less than the standard wage paid to apprentices under the regulations of the trade at which they are employed or, in the event the same are higher, not less than the wage rates herein- above set forth for such apprentices. An apprentice shall be employed only at the work of the trade to which he is indentured. Anything hereinabove to the contrary notwithstanding, the initial wage to be paid an apprentice shall be not less than twenty-five per cent (25%) of the journeyman's wage being paid and shall be increased each six (6) months in an amount not less than fifteen per cent (15%). Anything to the contrary i~ the above wage scale notwith- standing, the Contractor and all Subcontracters under him shall pay all their laborers, workmen, mechanics and employees on said work a salary or wage at least equal to the prevailing salary or wage for the same quality of service rendered to private persons, firms or corporations under similar employment, within the Central Contra Costa Sanitary District. The per diem wage rate is the hourly rate hereinabove men- tioned established multiplied by the number of hours hereinabove mentioned as constituting the working day for the particular craft or type of workman. RESOLUTION NO. 57 WHEREAS, in the judgment of the Sanitary Board of the Central Contra Costa Sanitary District it is necessary to secure all labor, materials, equipment, mechanical workmanship, trans- portation and services required for the construction of the main trunk sewer between the proposed treatment plant site North of the Arnold Highway to a point opposite Newell Avenue on State Highway No. 21 in accordance with the plans and specifications for the same prepared by the District Engineer which are on file in the office of the Sanitary District lo- cated at 1335 Commercial Lane, Walnut Creek, California; NOW, THEREFORE, BE IT RESOLVED, that the general prevail- ing rates of wages as heretofore ascertained and determined by this Board in its Resolution No. 56 adopted on the 11th day of September, 1947 in pursuance of Articles 1 and 2 of Chapter 1 of Part 7 of Division 2 of the Labor Code of the State of Cal- ifornia, shall be the general prevailing rates of per diem wages for each craft or type of workman or mechanic needed for the construction of said main trunk sewer; and, BE IT FURTHER RESOLVED, that the Secretary of this Board be and is hereby authorized to advertise for proposals for the , construction and completion of said work by publishing the same once in the COURIER JOURNAL, a newspaper of general circulation published in the Central Contra Costa Sanitary District. BE IT FURTHER RESOLVED, that the Notice inviting Sealed proposals shall be in the form as follows: NOTICE INVITING SEALED PROPOSALS Notice is hereby given that the Sanitary Board of the Central Contra Costa Sanitary District, Walnut Creek, Cal- ifornia, invites and will receive sealed proposals until 8 o'clock P.M., September 18, 1947, for furnishing all labor, materials, and services for the construction of Main Trunk Sewer, Section I, for the Central Contra Costa Sanitary District in accordance with the plans and spec- ifications adopted therefore. The plans and specifications for the proposed work may be seen and examined at the office of the Central Contra Costa Sanitary District, 1335 Commercial Lane, Wa¡nut Creek, California, or at the Engineering Office of Clyde C. Each bidder must submit with his proposal, a statement of his financial responsibility, technical ability and experience on the form to, be furnished prospective bidders. , Each bidder shall submit with his bid on the form provided the na,me and address of each subcontractor including the principal suppliers of materials, and the portion of the work which each subcontractor will do. If the contractor fails to name the subcontractors in his,:;roposal he shall be deemed to have agreed to perform such portion of the work himself and shall not be permitted to subcontract said portion of work without previous written permission of the Sanitary District Board. , The proposal shall be made out on the form to be furnished prospective bidders, a copy of which is incorporated with the specifications) and must be accompanied by a certified or cashier's check or bidder's bond for an amount not less than ten (10) per cent of the aggregate of the proposal, made pay- able to the Central Contra Costa Sanitary District, sea¡ed and filed with the, Secretary thereof on or before the day and tlour first above set forth, and thereafter will be publicly opened and read before said Sanitary Board. The above mentioned check or bond shall be given as a guar- antee that the, bidder will enter into contract if awarded the work, within ten (10) days after notice of the award has been sent to him by mail at the address given by him in his proposal and said check or bond shall be declared forfeited if the bidder refuses or neglects to enter into said contract within said time. The success~ul bidder will be required to furnish labor and mate~ial bonds, in the amount of 50 per cent of the contract price and a faithful performance bond in an amount equal to 100 per cent of the contract price. The ianitary Board reserves the right to reject any or all proposals and to waive any informality in proposals received.
