MINUTES OF AN ADJOURNED MEETING
OF THE DISTRICT BOARD OF CENTRAL CONTRA
COSTA SANITARY DISTRICT HELD DECEMBER 21.1950
The District Board of Central Contra Costa Sanitary District con-
vened in adjourned session at its regular place of meeting located at
1822 Mt. Diablo Boulevard, in the City of Walnut Creek, County of
Contra Costa, State of California, on December 21, 1950, at 8:00
o'clock p.m.
The meeting waS called to ord!r by President Johnson, and the
following roll was called:

READING OF MINUTES OF THE MEETING OF
DECD~BER 7. 1950
The Minutes of the meeting of December 7, 1950 were read and the
Board ordered the word "entirely" added to Mr. Richard E. Lee's
statement regarding his property in Local Im~rovement District No. 17,
on page 57 of Minutes.
The Minutes of the meeting of December 16, 1950 were read and
were approved as entered.
CONTINUATION OF HEA~ING FOR LOCAL IMPROVEMENT
DISTRICT NO. 17
The Engineer reported that since the filing of the Assessment
for Local Improvement District No. 17 l-lr. H. R. LaFond had reque sted
a reapportionment of his property, and that this property should now
receive five units of benefit instead of four.
It was moved by lviember Wa.dsworth, seconded by lvlemb<:>r Toland and
unanimously carried that instead of spreading the amount deducted
from Mr. Draeger's property uniformly over the remaining parcelsof
the assessment district, the amount should be pla-ced on an apportion-
ment of Assessment Parcel No. 17-6-1.
Member Wadsworth, seconded by Member Malott, moved the adoption
of Resolution No. 668:

CONFIRMING PROCEEDINGS AND ASSESSMENT
LOCAL IMPROV~IENT DISTRICT NO. 17
vrnEREAS the District Engineer of Central Contra Costa Sanitary
District of Contra. Costa County, State of California, filed with the
Secretary of said District, on October 24, 1950, an Assessment,
together with a Diagram and Engineer's Certificate attached thereto,
to represent the costs and expenses of constructing sanitary sewers
and appurtenances pursuant to Resolution of Intention No. 561,
adopted by the District Board of Said Sanitary District on April 6,
1950, and in that portion of said District described therein as
Local Improvement District No. 17, to which Resolution of Intention
reference is hereby made for a description of said work and improve-
ment and the district to be assessed for the costs and expenses
thereof, and for all other purposes; and
WHEREAS said Secretary gave àue notice as required by law, of
the filing of said Assessment, and that Tuesday, the 21st day of
November, 1950, at 8:00 o'clock p.m., on said day, and the meeting
pla.ce of sa.id District Bo8_rd at 1822 I~t. Diablo Boulevard, in the
City of Walnut Creek, in said County, had been duly fixed as the
time and place for the hearing on said Assessment; and

wHEREAS said District Board held such hearing at the time and
place so fixed therefor, and then and there, and at çontlnuances
of said hearing regularly had, received evidence, oral and docu-
mentary upon said work done, and upon said Assessment, and Diagram
and Engineer's Certificate attached ther=to, and also then and
there considered all appeals theretofore fil~d pursuant to law with
said Board by persons interested in said work and said Assessment;

ment and is satisfied with the correctness thereof, except as herein-
after ordered, and that no correction or modification thereo~ should
be made, except as so ordered;

relative to said work done pursuant to said Resolution of Intention
be and the same are hersby approved, ratified, and confirmed, and

Diagram and Assessment, ex6ept as hereinafter provided.
The following assessments shall be as hereinafter corrected,
stated to be and confirmed as follows:

The follo\dng changes shall be made in the Diagram and assessments:
1. The assessment Diagram in relation to Assessment Parcel No.
17-5-1 shall be chanced to include only the following portion of
said parcel:
Beginning on the southerly line of said Assessment Parcel
(also being the southerly line of Lot 90, Moraga Woodlands
Unit 2), distant thereon north 690 29' 06" west, 150.92
feet from the southeasterly corner thereof (also being the
southeasterly corner of said Lot 90, Moraga Woodlands Unit
2); thence, from said point of beginning, north 690 291 08"
west, 174.14 feet; thence south 180 231 55" west to a point
on the northerly line of said Assessment Parcel No. 17-6-1
(alEo being the northerly line of Lot 90, Moraga 'ivoodlands
Unit 2); thence south 770 14115" west, 269.62 feet to the
northerly line of La Fond Lane; thence _southerly along the
northwester"ly line of LB. Fond Lane 298.93 feet; thence
south 210 39' 18" west, 96.06 feet to the point of begin-
ning. The assessment on said Parcel No. 17-6-1 shall be
$686.00. .
2. To the assessment Diagram shall be added a new Assessment
Parcel No. 17-6-12 which shall include only the following portion
of the original Assessment Parcel No. 17-6-1:
Beginning at the southwesterly corner of said Assessment Parcel
No. 17-6-1 (also being the southwesterly corner of Lot 90, Moraga
Woodlands Unit 2) on the easterly line of Crest View Drive; thence
north~rly along the easterly line of Crest View Drive, 15.26 feet;
thence south 690 291 08" east, 203.4 feet; thence north 180 241 east,
245.17 feet; thence 'south 770 141 15" east, 145.79 feet; thence
south 180 231 55" west to the southerly line of said Assessment
P~rcel No. 17-6-1 (also being the southerly line of Lot 90, Moraga
\'ioodle.nds Unit 2); thence north 690 29' 08" west, 345.21 feet to the
point of beginning. The assessment on said Parcel No. 17-6-12 shall
be $343.00.
3. To the assessment Diagram shall be added a new Assessment
Parcel No. 17-6-13 which shall include only the following portion of
the original Assessment Parcel No. 17-6-1:

Beginning at the northwesterly corner of said Assessment
Parcel No. 17-6-1 (also being the northwesterly corner of
Lot 90, Moraga Woodlands Unit 2) on the easterly line of
Crest View Drive; thence south 770 141 15" east, 174.2
f~et; thence south 180 24' west, 130.78 feet; thence north
730 381 west, 211.92 feet; thence northerly along the east-
erly line of Crest View Drive, 129.74 feet to the point of
beginning. The assessment on said Parcel No. 17-6-13 sr~ll
be $343.00.
4. To the assessment Diagram shall be added a new Assess-
ment Parcel No. 17-6-14 which shall include only the following
portion of the original Assessment Parcel No. 17-6-1:
Beginning at the southeasterly corner of said Assessment
Parcel No. 17-6-1 (also being the southeasterly corner of Lot 90,
Moraga Woodlands Unit 2); thence north 690 29' 08" west, 150.92
feet; thence north 210 39118" west, 96.06 feet to the southerly
line of La Fond Lane; thence northerly along the arc of the east-
erly line of La Fond Lane 96.65 feet; thence south 340 52138"
west, 144.02 feet; thence south 260 30' east, 69.90 feet to the
point of beginning. The assessment on said Parcel No. 17-6-14
shall be $343.00.
Said District Engineer is hereby directed to correct and
modify said ~iagram and Assessments accordingly.
BE IT FURTHER RESOLVED AND ORDERED that said Diagram and
Assessment as so changed and corrected ll,re hereby approved, rati-
fied and confirmed.
PASSED AND ADOPTED by the District Board of Central Contra
Costa Sanitary District of Contra Costa County, State of California,
this 21st day of December, 1950, by the following called vote:

ACQUISITION OF TEICHE PROPERTY, LID 10
It was moved by Member Wadsworth, seconded by Member Smitten,
and unanimously carried that the Board authorize drawing of warrant
in the a~ount of $1800.00 and the paying of costs incident to the
acquisition of the Teiche property in Local Improvement District
No. 10 where the small pump station has been 'constructed. '
MAINTENANCE CREW AND EQUIPMENT
It waS moved by Member Wadsworth, seconded by Member Toland,
and unanimously carried, that the Board authorize the Manager to
purchase a compressor and pneumatic tools in an amount not to
exceed $2,200, for use by the maintenance crew.
SETTLEMENT WITH W. F. McGFEGOR
It was moved by Member Toland, seconded. by lvIember ami tten,
and unanimously carried that the Board accept Mr. McGregorts
terms of $250.00 for alleged damages to his road.

FILING SUIT AGAINST G. A. RICHARDS
It was moved by Member Smitten, seconded by Member Wadsworth,
that the Board instruõt Counse1 to file suit against Mr. G. A.
Richards for the amount of damage to the sewer caused by the slide
on the premises of Mr. Richards, in Orinda Oaks. Carried by the
following vote:

NOTICE TO CONNECT - MILDRED COOK
It was moved by Member Toland, seconded by Member Smitten, and
tinanimously carried that the Board authorize the Manager to proceed
with the work of connecting the property of Mildred Cook located on
San Luis Road, to the sewers.

President Johnson adjourned the Meeting to January 4, 1951, at
8:00 o'clock p.m.
