MINUTES OF THE REGULAR MEETING
OF THE SANITARY BOARD OF CENTRAL
CONTRA COSTA SANITARY DISTRICT

The Sanitary Board of the Central Contra Costa Sanitary Dist-
rict convened in regular session at its regular place of mseting
locate~ at 1335 Comrnsrcial Lane, in the City of Walnut Creek,
County of Contra Costa, State of California, on the 4th day of
March, 1948, at the hour of 8:00 o'clock p.m.
The meeting was called to order by President Weill.
The fol-

READING OF MINUTES
Director Smitten made the motion seconded by Director Toland
that the reading of Minutes of the previous meeting be waived and
be approved as entered.
Carried unanimously.
OPENING BIDS FOR. SEWAGE TREAT~ENT PLANT
Bids for the construction of the Sewage Treatment Plant were
opened and read, and referred to the Engineer for his recommendation.
The Engineer recommended that the Board accept the bid of MacDonald,
Young, and Nelson, Inc.
Director Toland presented the following
Resolution, seconded by Director Wadsworth:
RESOLUTION NO. 127
WHEREAS, this Sanitary Board, on Thursday, January 22, 1948,
authorized and caused to be published a call for bids for the con-
struction of the Sewage Treatment Plant in accordance with plans
and specifications therefor, heretofore approved and adopted by
this Board, and
WHEREAS, in response to call for said bids the following bids
were received and opened on March 4, 1948, at 8:00 olclock p.m.,
in accordance with the foregoing call for bids:

NOw, THEREFORE, BE IT RESOLVED:

(1) TþRt the bid of MacDonald, Young & Nelson, Inc., at the
~ price set forth therein be, and the same is hereby accepted
and the President is hereby authorized and directed to execute a
contract on the behalf of the Central Contra Costa Sanitary Dist-
rict with said successful bidder and the Secretary be and he is
hereby authorized to countersign the same on behalf of the District.
(2) I~~ediately following the execution of the Contract by the
successful bidder and the District, upon the furnishing by the
bidder of the bonds required by said Contract, the Secretary is
hereby authorized and directed to return to the successful bidder
such deposit as may have accompanied said bid, or to give such
release as may be requested from further liability upon the bidder's
bond.
(3) Upon the execution of a contract by the successful bidder
and the approval on behalf of the Sanitary District of the accomp-
anying bonds, the Secretary is hereby authorized and directed to
return all certified checks accompanying the bids of the unsuccess-
ful bidders.

WELL DRILLING
At the meeting of February 19, 1948, bids for drilling and
testing the well at the plant site were opened and referred to
the Resident Engineer for his review and recommendation. The
Resident Engineer recommended that the Board accept the bid of
James P. Treadway at the unit prices shown on his bid, then
negotiate for test pumping separately.
It was moved by Director Johnson, seconded by Director Smitten
that the Board accept the bid of James P. Treadway at the unit
prices submitted in his bid, and that the Engineer be authorized
~o negotiate for test pumping. Carried unanimously.
RIGHT OF WAY AGENT - LOCAL DIST. NO.2
It .was moved by Director Toland seconded by Director Johnson
that the Board appoint Claude McPhee as right of way agent for
Local Improvement District No.2, south and southwesterly of
Walnut Creek.

illiEREAS, the necessity occasionally arises when purchases have
to be made between Board meetings,
NOW, THEREFORE, BE IT RESOLVED, that the President or Secretary
be authorized to make necessary purchases up to the sum of $200.00
prior to a resolution by the Board of Directors and issue and sign
voucher or vouchers in payment of same.

Such voucher or vouchers, with proper notation, will be given
to the Auditing Committee for their auditing at the next meeting
of the Board.

The following resolution was offered by Director Wadsworth,
seconded by Director Johnson:

ESTABLISHING WAGE RATES FOR CONSTRUCTION
OF OFFICE BUILDING

The following resolution was offered by Director Johnson,
seconded by Director Toland:
RESOLUTION NO. 130
WHEREAS, in pursuance of Article 1 and 2 of Chapter 1 of
Part 7 of Division 2 of the Labor Code of the State of Calif-
ornia, before the Sanitary Board of the Central Contra Costa
Sanitary District may award any contract for public work on
behalf of said Sanitary District, the Sanitary Board must ascer-
tain the general prevailing rate of per diem wages in the locality
in which the work is to be performed, to-wit: within the limits
of the Central Contra Costa Sanitary District for each craft or
type of workman or mechanic needed to execute the contract, and
must specify in the call for bids for said contract and in the
contract itself what the general prevailing rate of per diem
wages in said locality is for each craft or type of workman or
mechanic needed to execute the contract and also the general
prevailing rate for legal holiday and over-time work;
NOW, THEREFORE, BE IT RESOLVED, that the said generAl pre-
vailing rate of per diem wages and the general prevailing rate
of per diem wages for legal holiday and overtime work within the
limits of said Sanitary District for each craft or type of work-
man or mechanic needed to execute a contract for the construction
of an office building for the Central Contra Costa Sanitary
Dietrict, to be located in Walnut Creek, California, as specified
in the plans and specifications heretofore approved by this Sani-
tary Board, shall be and the same are hereby ascertained, approved
and adopted by this Sanitary Board after a full investigation to

CALLING FOR BIDS FOR CONSTRUCTION
OF OFFICE BUILDING
The following resolution was offered by Director Smitten,
seconded by Director Wadsworth:
RESOLUTION NO. 130-A
WHEREAS, in the judgment of the Sanitary Board of the Central
Contra Costa Sanitary District, it is necessary to secure all
labor, materials, eQuipment, mechanical workmanship, transporta-
tion and services required for the construction of an office
building for the Central Contra Costa Sanitary District, to be
located in Walnut Creek, California, in accordance with the plans
and specifications for the same prepared by Wayne A. Littlejohn,
Architect, heretofore approved by this Sanitary Board and which
are on file in the Office of the Sanitary District, located at
1335 Comm~rcial Lan~, Walnut Creek, California;
NOW, THEREFORE, BE IT RESOLVED that the general prevailing
rates of wages as h9retofore ascertained and determined by this
Board in its Resolution No. 130, adopted on the 4th day of March,
1948 in pursuance of Articles 1 and 2 of Chapter 1 of Part V of
Division 2 of the Labor Code of the State of California, shall be
the general prevailing rates per diem wages for each craft or type
of workman or mechanic needed for the construction of said office
building; and
BE IT FURTHER RESOLVED, that the Secretary of this Board be
and he is hereby authorized to advertise for proposals for the
construction and completion of said work by publishing the same
once a week for two successive weeks in The Lafayette Sun, a
newspaper of general circulation, published in the Central Contra
Costa Sanitary District.
BE IT FURTHER RESOLVED that the Notice inviting sealed pro-
posals shall be in the form as follows:

Notice is hereby given that the Sanitary Board of the Central
Contra Costa Sanitary District, Walnut Creek, California, invites
and will receive sealed proposals until 8 o'clock p.m., April 1,
1948, for furnishing all labor, materials, equipment and services
for the construction of an office building for the Central Contra

Sanitary District in accordance with the plans and specifications
adopted therefor.
The plans and specifications for the proposed work may be seen
an~ examined at the office af the Central Contra Costa Sanitary
District, 1335 Commercial Lane, Walnut Creek, California, or at
the office of Wayne A. Littlejohn, Architect, 9 Moraga Highway,
Grinda, California, or may be secured at the office of said Wayne
A. Littlejohn by making a payment of Five Dollors ($5.00). There
will be no refund on returned plans or specifications.
Pursuant to the statutes of the State of California, the Sani-
tary Board of the Central Contra Costa Sanitary District has ascer-
tained and determined the ger.e~'Hl prevailing rate of per cHern wages

Overtime and Saturday work shall be paid for at double the
normal hourly rate except as noted below for Cement Finishers and
Truck Drivers and work on Sundays and Holidays shall be paid for
at double the normal hour rate.
The foregoing schedule of prevailing rates of wages, and rates
for overtime, Sunday and Legal Holidays, is based, unless otherwise
specified, upon a working day of 8 hours.
Dvertime and Saturday rates for Truck Drivers shall be at 1-1/2
times the normal hourly rate.
The first two hours overtime, after a normal 8 hour day, for
Cement Fin~shers shall be at 1-1/2 times the normal rate and further
overtime shall be at double the normal rate. Saturday work for
Cement Finishers shall be at 1-1/2 times the normal rate for the
first 8 hours worked and at double the normal rate for all further
time worked on Saturdays.
Notice is also hereby given bidders that it shall be mandatory
upon the contractor to whom the contract is awarded and upon all
subcontractors under him, to pay not less than said general pre-
vailing rates of per diem wages, as above listed, to all laborers,
workmen, and mechanics employed in the execution of the contract.
Before submitting proposals the bidder shall be licensed in
accordance with the provisions of Chapter 9 of Division III of
the Business and Professions Code, Chapter 37, of the StB.tutes of
1939, as amended, of the State of California, which provides for
the registration and licensing of contractors.
Each bidder must submit with his proposal, a statement of his
financial responsibility, technical ability and expérience on the
form to be furnished prospective bidders.
Each bidder shall submit with his bid on the form p~ovided,
the name and address of each subcontractor including the principal
suppl;:lers of materials, and. the portion of the work which each
subcontractor will do. If the contractor fails to name the sub-
contractors in his proposal, he shall be deemed to have agreed to
perform such portion of the work himself and shall not be permitted
to subcontract said portion of work without previous written per-
mission of the Sanitary District Board.
The proposal shall be made out on the form to be furnished
prospective bidders, a copy of which is incorporated with the
specifications, and must be accompanied by a certified or
cashier's check or bidder's bond for an amount not less than ten
(10) per cent of the aggregate of the proposal made payable to
the Central Contra Costa Sanitary District, sealed and filed with
the Secretary thereof on or before the day and hour first above
set forth, and thereafter will be publicly opened and read before
said Sanitary Board.
The above mentioned check or bond shall be given as a guarantee
that the bidder will enter into contract if awarded the work,
within ten (10) days after notice of the award has been sent to
him by mail at the address given by him in his proposal and said
check or bond shall be ò.eclared forfeited if the bidder refuses
or neglects to enter into said contract within said time.

The successful bidder will be reQuired to furnish a labor
and material bond in the amount of fifty (50) per cent of the
contract price and a faithful performance bond in an amount
equal to one hundred (100) per cent of the contract price.
The Sanitary Board reserves the right to reject any or all
proposals and to waive any informality in proposals received.
