HomeMy WebLinkAboutBOARD MINUTES 12-18-47 38 MINUTES OF A SPECIAL VÆETING OF THE SANITARY BOARD OF CENTRAL CONTRA COSTA SANITARY DISTRICT HELD DECEMBER 18. 1947 The Sanitary Board of the Central Contra Costa Sanitary Dist- rict convened in special session at its regular place of meeting located at 1335 Commercial Lane, in the City of Walnut Creek, County of Contra Costa, State of California, on the 18th day of December, 1947, at the hour of 8:00 p.m. The meeting was called to order by President Weill. The following roll was called: PRESENT: Directors Johnson, Smitten, Toland, Wadsworth and Weill. ABSENT: None SECRETARY PRO TEM Due to the absence of Secretary Cutler, it was moved by Dir- ector Smitten, seconded by Director Johnson, that Mrs. Phillips be appointed Secretary Pro Tern. Carried unanimously. READING OF MINUTES It was moved by Director Johnson, seconded by Director Smitten that the reading of the Minutes of the previous meeting be waived, and be approved as entered. Carried unanimously. PAYMENT FOR PIERSON EASEMENT It was moved by Director Johnson, seconded by Director Smitten that the Secretary be authorized to draw warrant in the amount of ~Ð.}.o $750. in favor of the Berkeley Guarantee Savings and Loan Associa- tion in lieu of payment to Walter Pierson for easements, in accord- ance with order of Mr. Pierson on file with District Secretary, provided easements are now of record. These easements were accepted by Resolutions No. 102 and No. 103. Carried by the following vote: AYES: Directors Weill. NOES: None ABSENT: None '"' * * Johnson, Smitten, Toland, Wadsworth and PURCHASE OF OFFICE SITE The following resolution was offered by Director Smitten, seconded by Director Toland: 12 18 47 39 RESOLUTION NO. 106 RESOLUTION AUTHORIZING PURCHASE OF REAL PROPERTY UPON WHICH TO CONSTRUCT A BUILD- ING TO BE USED AS AN ENGINEERING AND BUSINESS OFFICE FOR THE DISTRICT. RESOLVED by the Sanitary Board of the Central Contra Costa Sanitary District, County of Contra Costa, State of California, tha"ü WHEREAS, this Sanitary Board has under construction a Sanitary Sewer Project for which to date three separate contracts hàve been awarded for construction of portions thereof and this Board proposes to awaJ'd further contracts and to initiate and carry out Improvement District proceedings in order to make said sanitary sewer available to the residents of the District at the earliest possible date, and WHEREAS, in order to carry out this construction progrmn, the Sanitary Board does hereby find and determine that it is necessary to purchase a parcel of real property upon which to construct a building in order to provide adequate facilities to complete the necessary engineering for the proposed projects and after the con- struction to maintain and operate the Sanitary Sewer System, and that the cost of acquiring said site and constructing the building thereon is a proper charge against the sewer construction fund of the Central Contra Costa Sanitary District, and WHEREAS, this Sanitary Board has investigated several possible sites for such building and does hereby determine that the follow- ing site is best suited to its needs, Nmv, THEREFOR.E, this Sanitary Board does hereby agree to purchase from Leonard L. Richards, for a total price of FIFTEEN THOUSAND AND NO/100THS DOLLARS ($15,000.00, on the behalf of the Central Contra Costa Sanitary District, the hereinafter described real property for the purposes aforesaid; and the President of this Board be and he is hereby authorized and directed to execute a contract, on the behalf of the District, to purchase said real property accordingly. Said real property is described as follows: All those certain pieces or parcels of land situated in the City of Walnut Creek, County of Contre. Costa" State of California, to-wit: PARCEL ONE: Portion of the Rancho Canada del hambre, Southern Part, described as follows: Beginning on the north line of the State Highway from Wal- nut Creek to Lafayette, distant thereon south 890 38' west, 10 feet from the east line of the pe.rcel of land described in the deed from Maude Norton Brooks to Lyman Edgar Stod- dard, et ux, dated June 1, 1944 and recorded June 22, 1944 in Volume 793 of Official Recordsb at pa,ge 39; thence from said point of beginning, south 89 381 west along said north line, 80 feet to the west line of said Stoddard par- cel; thence north 00 221 west along said west line, 150 feet; thence north 890 381 east parallel with the north line of s~id State Highway to a point which bears north 00 581 east from the point of beginning; thence south 00 581 west to the point of beginning. IT IS FURTHER ORDERED that the President of this Board be and he is hereby authorized and directed to execute, on the behalf of the District, a warrant in the sum of TWO THOUSAND AND NO/IOOTHS ($2,000.00) drawn upon the sewer construction fund of the Central Contra Costa Sanitary District, payable to the Contra Costa County Title Company, and the Secretary be and he i8 hereby authorized to countereign the same and, thereupon, to cause the same to be de- posited with said title company on account of the aforesaid purch- ase price. 11,31'" IT IS FURTHER ORDERED that the President of this Board be and he is hereby authorized and directed to execute, on behalf of the District, a warrant in the sum of THIRTEEN THOUSAND AND NO/IOOTHS DOLLARS ($13,000.00), drawn upon the sewer construction fund of the Central Contra Costa Sanitary District, payable to the Contra Costa County Title Company, and the Secretary be and he is hereby authorized to countersign the same and to cause the same to be deposited with said title company with appropriate instructions for delivery of the total purchase price to the seller upon del- ivery of a Deed vesting an insurable title in the Central Contra Costa Sanitary District. Carried un~nimously. 12 18 47 41 DEEDS OF DEDICATION It was moved by Director Wadsworth, seconded by Director Toland that the B08,rd accept the following deeds of dedication. RESOLUTION NO. 107 WHEREAS, LAFAYETTE SCHOOL DISTRICT, for value received, has granted a Deed of Dedication for sewer easement of all that certain real property situate in the County of Contra Costa, State of Cal- ifornia, described as follows: Portion of Lots 10, 15 and 16, as designated on the map ehtitled IIMap of El Nido Rancho, a Subdivision of a por- tion of the Acalanes Rancho Contra Costa Co.
