MINUTES OF THE~REGULAR MEETING
OF THE SANITARY BOARD OF CENTRAL
CONTRA COSTA SANITARY DISTRICT
HELD DECEMBER 11. 1947
The Sanitary Board o~ the Centra1 Contra Costa Sanitary Dist-
rict convened in regular session at its regular place of meeting
located at 1335 Commercial Lane, in the City of Walnut Creek,
County of Contra Costa, State of California, on the 11th day of
December, 1947, at the hour of 8:00 p.m.
The meeting was called to order by President Weill.

Due to the absence of Secretary Cutler, Director Smitten made
a motion, seconded by Director Johnson that Mrs. Phillips be
appointed Secretary Pro Tem.
Carried unanimously.
READING OF MINUTES
It was moved by Director Toland, seconded by Director Smitten
that the reading of the Minutes of the previous meeting be waived,
and be approved as entered.
Carried unanimously.

At 8:05 p.m. Manuel Smith's representative handed in a bid,
and Director Toland made the motion, seconded by Director Smitten

LOCAL IMPROVEMENT DISTRICTS
It was moved by Director Johnson, seconded by Director Smitten
that the following be the declared policy of the Sanitary Board
with respect to Improvement
Districts:
THE NECESSARY ENGINEERING AND PROCEEDINGS ARE AUTHORIZED FOR
THE SETTING UP OF LOCAL IMPROVEMENT DISTRICTS, WITHOUT WAIT-
ING PETITION OF THE AFFECTED PROPERTY OWNERS, TO PROVIDE
SERVICE IN THE FOLLOWING LISTED AREAS WHERE A CRITICAL HEALTH
HAZARD EXISTS:

Lafayette, including Lafayette Oaks, Lafayette Manor,
Lafayette Homesites, Lafayette Heights, Lafayette
Terrace, Lafayette Acres, Bickerstaff, Hough and Sunset
Village tracts, and various adjacent small subdivisions.
Pleasant Hill area northwesterly of East Bay Municipal
Utility District aqueduct.

RESOLUTION AND ORDER OF THE SANITARY BOARD
CHANGING REGULAR MEETING DATE.
BE IT RESOLVED that the regular meeting date of the Sanitary
Board of the Central Contra Costa Sanitary District of Contra
Costa County of the State of California, be and same is herAby
estab11shAd as the fi~st Thursday of each month, at the hour of
8:00 o'clock p.m., at 1335 Commercial Lane, Walnut Creek, Calif-
ornia, beginning with February, 1948.
BE IT FURTHER RESOLVED that if the first Thursday of the
month falls on a holiday, the meeting will be held on the next
regular business day.

PACHECO - HIGHWAY JUNCTION ANNEXATION PETITION
It was moved by Director Wadsworth, seconded by Director Smitten,
that the Board accept the petition for annexation of the Pacheco-
Highway Junction area, and that the clerk be instructed to prepare
the necessary notice for publication setting the hearing date for
January 8, 1948, and that the petition and notice be delivered to
the petitioners for publication in a newspaper of general circula-
tion within the district.

received, have granted a Deed of Dedication for sewer easement of
all that certain real property situate in the County of Contra
Costa, State of California, described as follows:

A strip of ls.nd, 10 feet in width, the north line of which
is parallel with and 3 feet northerly, measured at right
angles, from the hereina,fter described line and the south

The District Engineer reported that the tabulation of bids
showed that the lowest bid was submitted by Baldwin Straub Corp.
and Mario Bottini as a joint venture, but that the bid bond
accompanying the proposal of this bidder was invalid, and that
the conditions of the notice inviting proposals had not been
complied with. The District Engineer therefore recommended that
the Board a.ccept the bid of Stolte, Inc. as the lowe st regular
bid submitted.

authorized and did publish a c8.l1 for bids on Section III of the
Main Trunk Sanitary Sewer, in accordance with plans and specifi-

and to be located between the point and intersection of First
Street and Moraga Boulevard in Lafayette, California, and the
easterly side of Charles Hill; and
WHEREAS, in response to call for bids, the following bids

comply with the terms and conditions as contained in the call for
bids for the reaSon that it was not accompanied by a good and
sufficient bid bond due to the condition contained therein and
hereinabove quoted and that said bid be and the same is hereby
rejected.
'(2) That the bid of Stolte, Inc., is the lowest responsible
bid received and th~t bid of Stolte, Inc., at the unit prices set
forth therein be and the same is hereby accepted and the President
is hereby authorized and directed to execute a contract on the
behalf of the Central Contra Costa Sanitary District with said
successful bidder and the Secretary be and he is hereby authorized
to countersign the same on behalf of the District;
(3) Immediately following the execution of the Contract by
the successful bidder and the District, and upon the furnishing by
the bidder of the bonds required by said Contract, the Secretary
is hereby authorized and directed to return to the successful bidder
such deposit as may have accompanied said bid, or to give such re-
lease as may be requested from further liability upon the bidder's
bond.
(4) Upon the execution of a contract by the successful bidder
and the approval on behalf of the Sanitary District of the accom-
panying bonds, the Secretary is hereby authorized and directed to
return all eertified checks accompanying the bids of the unsuccess-
ful bidders.

REQUEST BY DISQUALIfIED BIDDER.

allowed 24 hours in which to re-check their bid and furnish a
