MINUTES OF THE REGULAR MEETING
OF THE SANITARY BOARD OF CENTRAL

HELD NOVEMBER 13. 1947
The Sanitary Board of the Central Contra Costa Sanitary
District convened in regular session at its regular place of
meeting located at 1335 Commercial Lane, in the City of Walnut
Creek, County of Contra Costa, State of California, on the 13th
day of November, 1947 at the hour of 8:00 p.m.
The meeting was called to order by President Weill.
The

CONCORD ANNEXATION INQUIRY
Messrs. Blackwell, Hughes and Turner, of and for the City of
Concord appeared before the Board to be advised as to the cost to
Concord and immeð late environf, should they e.nnex to the Sanitary
District.
After the discussion, the Board instructed the Attorney
to write the following letter to the City of Concord:

The Sanitary Board, at its meeting of November 13, 1947,
gave further consideration to your proposals of annexation
as presented by you at that meeting.
Because the annexation of Concord would interfere with the
construction program now in progress, the Board decided not
to give further consideration to the proposed annexation,
and its enfineer was accordingly instructed.

WHE!ì.EAS, in pursuance of Article 1 and 2 of Chapter 1 of Part
7 of Division 2 of the Labor Code of the State of California, be-
fore the SanitAry Board of the Central Contra Costa, SAnitary Dist-
rict mAY award any contre,ct for public work on behalf of said
Sani ta.ry District, the Sa,ni tary BoB"rd mußt a.scertain the general
prevailing rate of per diem we.ges in the locality in which the
work is to be performed, to-wit: within the limits of the Central
Contra Costa Sanitary District for each craft or type of workman
or mechanic needed to execute the contract, and must specify in
the call for bids for said contract and in the contract itself
what the general prevailing rate of per diem wages in said locality
is for each craft or type of workman or mechanic needed to execute
the contract A nel al so the general prevB.ilin[. rate for legal holiday
and over-time work;
NOW, THEREFORE, BE IT RESOLVED, that the said genera,l prevail-
ing rate of per diem wages 'and the general prevailing rate of per
diem wages for legal holiday and overtime work within the limits
of said Sanitary District for each craft or type of workman or
mechanic needed to execute a contract for the construction of the
main trunk sewer between the point of intersection of First Street
and Moraga Boulevard in Lafayette, California, to the easterly side
of Charles Hill, as specified in the plans and specifications
heretofore approved by this Sanitary Board, shall be and the same

Overtime and Saturday work shall be paid for at double the
normal hourly rate except as noted below for Cement Finishers and
Truck Drivers and work on Sundays and Holidays shall be paid for
a t double the normal hourly ra,te.
The foregoing shcedule of prevailing rates of wages, and rates
for overtime, Sunday and Legal Holidays, is based, unless otherwise
specified, upon a working day of 8 hours.
Overtime and Saturday rates for Truck Drivers shall be at 1*
times the normal hourly re.te.
The first two hours overtime, after a normal 8 hbur day, for
Cement Finishers shall be at It times the normal rate and further
overtime shall be at double the normal rete. Saturday work for
Cement Finishers shall be at lt times the normal rate for the first
8 hours worked R.nd at double the normal rate for all further time
worked on Saturdays.

Notice is also hereby given bidders that it shall be mandatory
upon the contractor to whom the contract is awarded,and upon all
subcontractors under him, to pay not less than said general pre-
vailing rates of per diem wages, as a,bove listed, to 09.11 leborers,
workmen, and mechanics employed in the execution of the contract.
Befor'? submitting proposa,ls the bidder she.ll be licensed in
accordance with the provisions of Chapter 9 of Division III of the
Business and Professions Code, Chapter 37, of the Statutes of 1939,
as ~~ended, of the State of California, which provides for the
registration and licensing of contractors.
Each bidder must submit with his proposal, a statement of his
financial responsibility, technical ability and experience on the
form to be furnished prospective bidders.
Each bidder shall submit with his bid on the form provided
the nsJpe and address of each subcontractor including the principal
suppliers of materials, and the portion of the work which each
subcontra,ctor will do. If the contractor fails to name the sub-
contractors in hi$ proposal he shall be deemed to have agreed to
perform such portion of the work himself and shall not be permitted
to subcontract sa~d portion of work without previous written per-
mission of the Sanitary District Board.
The proposal shall be made out on the form to be furnished
prospective hidders, a copy of which is incorporated with the spec- '
ifications, and must be accompanied by B. certified or cashiers I
check or Bidderls bond for an amount not less than ten (10 per
cent of the a,ggregate of the proposal, made payable to the Central
Contra, Costa Sanitary District, sealed and filed with the Secretary
thereof on or before the day and hour first above set forth, and
thereafter will be publicly opened and read before said Sanitary
Board.
The above mentioned check or bond shall be given as a guar-
antee that the bidder will enter into contract if awarded the work,
within,ten (10) days after notice of the award has been sent to
him by,mail at the address given by him in his proposal and said
check or bond shall be declared forfeited if the bidder refuses
or neglects to enter into said contract within said time.
The successful bidder will be required to furnish labor and
material bonds in,the amount of 50 per cent of the contract price
and a faithful performance bond in an amount equal to 100 per cent
of the contract price.

The following resolution calling for bids on Section III
was presented by Director Toland, seconded by Director Smitten:
RESOLUTION NO. 80
~JHEREAS, in the judgment of the Sanital"y Board of the Central
Contra Costa Sanitary District, it is necessary to secure all labor,
materials, equipment, mechanical workme.nship, transportation and
services required for the construction of the main trunk sanite.ry
sewer between the point of intersection of First Street and Moraga
Boulevard in Lafayette, California, end the easterly side of, -
Chrorles Hill, in accordance with the plans and specifications for
the same prepared by the District Engineer, heretofore approved
by this Se,nitery Board and which are on file in the Office of the
Se,nitary District, located at 1335 Cornmercia,l Lane, Walnut Creek,
California;
NOW, THEREf'ORE, BE IT i-\ESOLVED that the general prevailing
rates of wages as heretofore ascertained and determined by this
Board in its Resolution No. 79, adopted on the 13th day of Novem-
ber, 1947, in pursuance of Articles 1 and 2 of Chapter I of Part 7
of Division 2 of the L8,bor Code of the State of Ce,lifornia, shall
be the genere,l prevailing rates per diem wages for each craft or
ty,pe of 'workman or mechanic needed for the construction of said
main trunk sanitary sewer; and
BE IT FURTHER RESOLVED, that the Secretary of this Board be
and he is hereby Authorized to advertise for proposals for the
cmstruct10n and completion of said work by publishing the sa,Iì1e
once a week fortwo successive weeks in the WlANUT KERNEL, a news-
paper of general circulation, publiohed in the Central Contra Costa
San:..tary District.
BE IT FURTHER RESOLVED thet the Notice inviting sealed pro-
posals shall be in the form as follows:
Notice 1s hereby given that the Sanitary Board of the Central
Contra Costa Sar:i tary District, Walnut Creek, Cali fornie., invites
and will receive sealed proposals until 8 o'clock P.M. December 13,
1947, for furnishing all labor, materials and services for the con-
structinn of Main Trunk Sewer, Section III for the Central Contra
Co sta Sanitary District in accordance with the planr a,nd specifica-
tions adopted therefore.
The plans and specifications for the proposed work may be seen
and examined at the office of the Centrel Contra Costa Sanitary
District, 1335 Commercial Lane, Walnut Creek, California, or at the
Engineering Office of Clyde C. Kennedy, Room 504, 604 Mission
Street, San Francisco, California, or may be secured at the Engin-
eering Office of Clyde C. Kennedy by making a payment of ten dollars
(~lO.OO). There will be no refund on returned plans ôr specifications.
Pursuant to the statutes of the State of California, the Sani-
tary Board of the Central Contra Costa Sanitary District has ascer-
te.ined and determined t116 general prevailing rate of per diem wages
and rates for overtime and legal holidays in the locality in which
this work is to be performed for each craft or type of workman or

will be publicly opened and read before said Sanitary Board.
The above mentioned check or bond shall be given as a. gua,rantee
that the bidder will enter into contract if awarded the work, within
ten (10) days after notice of the award has been sent to him by mail
at the address given by him in his proposal and said check or bond
shall be declared forfeited if the bidder refuses or neglects to
enter into said contrAct within said time.
The successful bidder will be required to furnish labor and
material bonds in the amount of 50 per cent of the contract price
and a faithful performance bond in an amount equal to 100 per cent
of the contract price.
The Sanitary Board reserves the right to reject any or all
proposals and to waive any informality in proposals received.

certain real property situated in the County of Contra Costa,
State of California, described as follows:-

line of main line track and opposite this corpora-

Central Contra Costa Sanitary District for the purpose of con-
structing, laying, maintaining and operating sewer pipes therein
and thereupon together with appurtenances and appliances.
NOW, THEREFORE, BE IT RESOLVED that said Deed of Dedication
be, and same is hereby accepted, and the Recorder of Contra Costa
County be, and he is hereby authorizeã and directed to record said
deed.
