The District Board of Central Contra Costa Sanit~ District convened
in a Regular Session at its regular place of meeting located at 12,0
Springbrook Road, Walnut Creek, County: of Contra Costa, State of California,
on June 7, 1962, at 8:00 o'clock P.M.
The meeting was called to order by' President Mitchell.
I. ROLL CALL
PRESENT: Members: Gibbs, Roemer, Salfingere, Bowman and Mitchell
ABSENT:
Members: None
II . APPROVAL OF MIRUTES
It was moved by Member Bowman, seconded by' Member Gibbs, that the Minutes
of the Mq 11, 1962, meeting be approved, subject to changing the paragraph
entitled "CODIFICATION OF ORDIlfAICES" under "VII. REPORTS, COUNSEL FOR THE
DISTRICT" to read as follows: .

"Inquiry was u.de regarding progress on recodification of the District
Ordinances which was undertaken by CQUIlsel and management some time ago.
Counsel explained that this program had been t-.porarily set aside because
of a large vQlume of more urlent District matters d~anding Counsel's
attention. Counsel offered to endeavor to estimate the current and future
volume of legal matters requiring attention and to advise the Board at the
June 7,1962, meeting as to the probability: that a proposed recodification
could be submitted by' October 15, 1962, without the necessity: of employing
additional help."
Motion changing the Minutes carried by the following vote:
AYES: Members: Gibbs, Roemer, Salfingere, Bollman and Mitchell
NOES: Members: None
ABSENT: Members: None
III. APPROVAL OF EXPENDITURES
It was moved by: Member Gibbs, seconded by'Member Bowman, that the
expenditures, as audited by the Auditing CODDittee and as submitted by the
District Manager-Engineer, be approved, reference being specifical1y made
to Sewer Construction Vouchers Numbers lh04 to 1419, inclusive, and Running
Expense Vouchers Numbers 9548 to 9749, inclusive. Carried by' the following
vote:
AYES: Members: Gibbs, Roemer, Salfingere, Bowman and Mitchell

V. OID BUSINESS
CODIFICATION OF ORDItWlCES
Mr. Bohn, Counsel for the District, reported that the codification of
all District Ordinances and regulations had turned out to be a larger job
than anticipated.
He stated that the work was time consuming and was pushed aside when
more important business comes up.

He stated that at the present time the Miller case is taking considerable
time. Miller's deposition, just completed, took two weeks and it is anticipated
that the trial could probably last four months.
Mr. Bohn stated that, with additional help and added compensation, the
codification could be completed in a reasonable time, probably 90 to 120 d~s.
President Mitchell suggested that a cost figure be submitted for considera-
tion in the 1962-1963 Budget.

It was moved by M_ber Roemer, seconded by'Member Gibbs, that Resolution
No. 1322 be adopted. Carried by the following vote:

The District Board took no action on the request.
REFUND .OF REBATE OVERPA1MENT TO WALLACE H. COOK, M.D.
Mr. Hòrstkotte, District Manager-Engineer, explained that Dr. Cook had
been charged for a direct connection when it should haTe been an indirect
connection, and recODlended that the $404.00 diff.rence be refunded.
It was moved by Member Gibbs, seconded by Member Roemer, that $404.00
be ref'unded to Wallace H. Cook, M.D. as a result of onrcharge .on rebate
line. Carried by' the following Tote:

After discussion, Mr. Bohn, Counsel for the District, stated that he

It was mOTed by'Maber Bowman, seconded by Maber RoUler, that the final
p~ent of $12,313.80 be made to A. C. Bashnick, that a Hotice of Completion
be filed and the 10% retention be paid at the expiration of the lien period
if no claw have been filed. Carried by the following vote:

MATTERS FROM THE FLOOR
PERMIT REQUESTS FROM THE STATE
Member Roemer reported that during the past week he had been on a trip
to one of P.G. It E.'s projects at which time he met Mr. Frank A. Oyorgy who
commended Jack Best, Chief Designer, and Gerry A. Horstkotte, Jr., District
Manager-Engineer, for the manner in which all permit requests from the State
were handled for the District.

VII. REPORTS
DISTRICT MANAGER-ENGINEER
OUTFALL SJ!1iER MAIHTIKANCE PROBU:MS
Mr. Horstkotte, District Manager-Engineer, reported on the maintenance
of the OIltfall Sewer, stating that the 1962-196,3 Budget would provide for
maintenance of the Ou.tfall Sewer for the first time.
OUTFALL SEWER RISERS
Mr. Horstkotte reported that, upon receiv1n¡ fabrication figures for the
risers to be installed on the land section of the Ou.tfall Sewer, the cost may
run over the $3,$00.00 pr.vious~ authorized.
AUTHORIZATIOB FOR PURCHASE OF VALVES FOR THE LOWER ORIHDA PUMPIIG
STATION MODD'ICATION

Mr. Horstkotte requested authorization to purchase certain valves for
the Lower Orinda Pumping Station Modification that require a long delivery
t~e; estimated cost $$,000.00.
It was moved b,. Member Bowman, seconded by Member Gibbs, that the
purchase of certain valves requiring a long delivery time be author1sed
from Sewer Construction Bond Funds and bids be called for on others.

1962-1963 BUDGET COMMITTEE
President Mitchell appointed Members Roemer and Bowman to be the 1962-
1963 Budget Committee.

M. MILLER COHPJJIY LITIGATION
Mr. Bohn, Counsel for the Di8trict, reported that the deposition of
M. Miller had been taken and would probably run to over 1,000 pages.
