MINUTES OF AN ADJOURNED REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA CœTA SANITARY DISTRICT HEW FEBRUARY 15, 1962 ---j The District Board of Central Contra Costa Sanitary District convened in an Adjourned Regular Session at its regular place of meeting located at 1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of California, on February 15,1962, at 8:00 o'clock P.M. The meeting was called to order by President Mitchell. ~ I. ROLL CALL PRESENT: Members: Roemer, Sali'ingere, Bowman and l'1itchell ABSENT: Member: Gibbs II. APPROVAL OF MINUTES The Minutes of the meeting of February 1,1962, were approved as presented. III. APPROVAL OF EXPENDITURES It was moved by Member Roemer, seconded by Member Bowman, that the expenditures, as audited by the Auditing Committee and as submitted by the District Manager-Engineer, be approved, reference being specifical¡Y made to Sewer Construction Voucher Number 1376 and Running Expense Vouchers Numbers 9000 to 9023, inclusive. OLD BUSINESS ORDINANCE ~ AN ORDINANCE AMENDING ORDINANCE h5 ENTITIED "AN ORDINANCE DEFINING G AGE AND REGUIATING THE COLLECTÌON. ANDD!SPOSAL OF GARBAGE; FIXING THE RATES FOR COLtEcTION AND DISPOSAL OF GARBAGE.. PRESCRIBING PENALTIFß ~ AND REPEALING ORDINANCE 38 AND ALL OTHER ORDiNANCES IN CON- FLICT HE ITH" The District Board discussed the proposed Ordinance with Mr. C. Terence Ring, attorney for the garbage collection firms, and deterndned that the Ordinance as proposed was satisfactory, subject to the following changes: For residential collection of an extra container, the rate should be 35~ per container or $1.Ot:Jpër-~Jñ6nth, whichever is the lesser amount. For commercial collection of an extra container, the rate should be 35~ per container or $1.00 per month, whichever is the lesser amount. ~ It was moved by Member Salfingere, seconded by Member Bowman, that Ordinance 46 be adopted subject to changing the extra container pickup charge as agreed. Mr. Horstkotte, District Manager-Engineer, presented to the District Board a memorandum dated February 14,1962, relative to the District staff's recommendation for a policy to be observed in designated watersheds inside and outside of the District. ~ After discussion, it was moved by Member Roemer, seconded by Member Salfingere, that the recommended policy to be observed for watersheds inside and outside of the District be in conformance with the memorandum to the District Board dated February 14,1962. NEW BUSINESS RESOWTION NO. l~ AMENDING THE DESCRIPTION IN RESOWTION NO. 1264.1 AUTHORIZING CONDEMNATION OF THE 14 ACRE PARCEL TO BE PURCHASED FOR ADDITION TO THE TREATMENT PLANT SITE . r1r. Horstkotte, District Manager-Engineer, stated that the shape of the parcel to be acquired was changed. It was moved by Member Salfingere, seconded by Member Roemer, that Resolution No. 1310 be adopted. Carried by the following vote: AYES: NOES : ABSENT: Members: Members: Member: Roemer, Salfingere, Bowman and Mitchell None Gibbs ~ ACCEPTANCE OF DEED TO 14 ACRE PARCEL ADDITION TO TREATMENT PLANT Mr. Horstkotte, District Manager-Engineer, stated that the Title Company was ready to conclude the purchase of the 14-acre site at the Treatment Plant from V. P. Baker and associates for $30,800.00 plus title insurance of $218.00 less the sale to them of 2.85 acres for $8,550.00. The net. amount to be paid to the Title Company is $22,468.00. The saleiD the Contra Costa County Flood Control & Water Conser- vation District was previously closed and the sum of $14,826.00 paid to the Sanitary District. It was moved by Member Roemer, seconded by Member Salfingere, that the Deed from V. P. Baker and associates be accepted and the sum of $22,468.00 from Sewer Construction Expansion Funds be paid to the Western Title Guaranty Company. ORDINANCE NO. 46 AN ORDINANCE AMENDING ORDINANCE NO. 45 ENTITLED "AN ORDINANCE DEFINING GARBAGE laND REGUU"TING THE COLLECTION AND DISPOSAL OF GARBAGE; FIXING THE RATES FOR COLLECTION AND DISPOSAL OF GARBAGE; PRESCRIBING PENiìLTIES; ¡aND REPFJU.ING ORDINANCE NO. 38 AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH". The Board of Directors of the Central Contra Costa Sanitary District does ordain as follows: Section:..l. Section 10 of Ordinance No. 45 is amended to read as folloW9: "~ General requi rements ~& 2a~þa£e ~ All garbage removed and conveyed on or along streets in the District shall be hauled in an all-metal, water-tight bodied motor truck, and conveyed in a manner so that the contents do not sift through or fall upon the streets and do not blow upon the streets or adjacent properties. The truck body shall be constructed of metal of sufficient strength to withstand fire within, without endangering persons or property. The truck body in which garbage io regularly hauled shall be washed as often as necessary to keep it clean"bUt at least once each week. Bach truck shall be equipped with a tarpaulin or other suitable covering which shall be drawn over the load as completed to full depth. Garbage in the truck shall be completely covered between points of collection and disposal." Section 2. Section 15 of Ordinance No. 45 is amended to read as follows: ..~ n Before revoking an exclusive contract under section 14, the Board shall hold a hearing on the question of revocation and give the contractor at least 20 days notice of the hearing. If after the hearing, the Board finds that the contractor has violated (1) the contract, or (2) this orc:l1nance or (3) a rule or regulation of the District applicable to the contractor, the Board may revoke the. contract. It Section 3. read as follows: Section 17 of Ordinance No. 45 is amended to 1. 02 15 62 "§ec~on ~ 7 .. Max Except as provided in sections 18 and 19 the maximum rates are as follows: a. Zone 1. A person from whom garbage is collected in Zone 1 shall pay a monthly rate not to exceed .-.., the following: ( 1) Basic residential rate: 1 collection a week of 32 gallons or less, $1.75 a month; For each additional eollection of 32 gallons or fraction of 32 gallons made at the same ttme, $.35 for each collection, or not Inore than $1.00, whichever is less, shall be added to the basic monthly rate. (2) Commercial rate: (a) 1 collection a week of 32 gallons or less, a basic rate of $2.50 a month; -... For each additional collection of 32 gallons or fraction of 32 gallons made at the same time, $.35 for each collection, or not more than $1.00, whichever is less, shall be added to the basic monthly rate. (b) For each collection of bulk matter, $1.50 for one cubic yard or fraction of one cubic yard. b. "ARTICLE VI Sections 26 through 30 are ð¿ded as follows: Non-Exclusive Franch\se Section 26. hlternate Procedure. If the board has not granted an exclusive franchise under Article III, or if an exclusive franchise ceases to exist, the board may elect to make the collection and .-.., disposal of garbage non-exclusive within a geographical service area and may grant licenses in the manner provided in this Article. Sect ion 27. ADDlication for License. An applicant for a non- exclusive license shall apply in writing to the district on forms provided by the district. Section 2~ Issuance and duration Qf License. If the board determines that the applicant is able to comply with this ordinance and the rules and regulations adopted under this ordinance, the board may issue a license to the applicant for the conduct of a garba~e collection and disposal service within the service area for which the license is requested. The license gives the licensee ...-... the privilege of collecting and disposing of garbage in the area specified for the period prescribed by the board. Section 29. L on-e e The license issued under this Article is non-exclusive and does not confer upon the licensee any exclusive right or privilege. The board may at any time terminate the license and grant an exclusive franchise as provided in Article Ill. Section 30. SusDension or ~evocat~on of License. The board may revoke or suspend a license if the licensee violates the license, this ordinance or a rule or regulation of the district. Before revoking or suspending a license, the board shall hold a hearing and giv~ the licensee at least 20 days notice of the hearing. Warren Harrold and his attorney, Mr. John Ogden, the need for an easement across his property along with alternate locations. After discussion, the matter was continued to March 1,1962, and referred to Mr. Bohn, Counsel for the District, and the District staff for a final determination. ~ WATERSHED 24 NORTH Mr. Horstkotte, District Manager-Engineer, discussed the memorandum to the District Board dated February 7,1962, relative to Watershed 24 North. Mr. Horstkotte stated that the District Board had established a watershed charge for Watershed 24 South of $250.00 per acre and it was recommended that Watershed 24 North charges be established at the same figure in accordance with the recommendation in the memorandum. It was moved by Member Bowman, seconded by Member Salfingere, that the charge for Watershed 24 North be $250.00 per acre. Carried by the following vote: AYES: NOES : ABSENT: Members: Members: Member: Roemer, Salfingere, Bowman and Mitchell None Gibbs CLAIM FOR DAMAGES, mROTHY GARRISON ~ Mr. Horstkotte, District Manager-Engineer, stated that the sewer backed up into the Garris on hDme and caused damage as a result of sewer maintenance work being performed by District personnel, and recommended payment of the claim of Dorothy Garrison in the amount of $93.75, after receiving a signed "Release in Full Settlement and Compromise" from the claimant. It was moved by Member Roemer, seconded by Member Bowman, that the claim of Dorothy Garrison for damages in the amount of $93.75 be settled and payment made after receipt of a signed "Release in Full Settlement and Compromiseft from Mrs. Garrison. Carried by. the following vote: AYES: Members: NOES: Members: ABSENT: Member: Roemer, Salfingere, Bowman and Mitchell None Gibbs QUIT CLAIM DEEDS TO UNUSED EASEMENTS Mr. Horstkotte, District Manager-Engineer, stated that easements on the Will F. Bishop and Guy W. Masterson properties in Walnut Creek had never been used, and recommended that the District release its interest. It was moved by Member Salfingere, seconded by Member Bowman, that the President and Secretary be authorized to execute the Quit Claim Deeds to Will F. Bishop and Guy W. Masterson. REPORTS DISTRICT MANAGER-ENGINEER VISIT TO PUMPING STATIONS Mr. Horstkotte, District Manager-Engineer, stated that to avoid over- time for District personnel the planned visit to the Pumping Stations be on April 1, 1962, rather than on March 3,1962, which was agreeable. 02 15 62 ----.---------------------- ------ --. ---------------- ----------- ------------------.. ..... - . . .... ----.---------...--.-- 164 ARTICLE IN PUBLIC WORKS MAGAZINE Mr. Horstkotte reported on an article he had written for the Public Works Magazine, a national publication, which was printed in the issue of February, 1962, and stated he was obtaining copies to be sent to each Director~ CHARGES FOR SCHOOlS Mr. Horstkotte presented to each Director copies of a memorandum to himself from Mr. Dalton, District Administrative Engineer, relative to charges for schools. He stated the matter would be on the agenda for the March 1,1962, meeting for discussion. ~ LINE SIZE FOR SUBDIVJSION IN WATERSHED 35 Mr. Horstkotte stated that a subdivision was proposed in Watershed 35 in which an 8-inch line would be sufficient for their needs but the installation of an 18-inch line would be more practical and economical to serve an expanded area. He suggested that the District Board consider installing the larger line. Continued to March 1,1962. WATERSHED MAP President Mitchell requested that a watershed map be available to the Members of the Board at each meeting, showing all changes that are to be discussed such as location of subdivisions. and lines. From this pilot map the Directors can make the changes on their maps. COUNSEL FOR THE DISTRICT M. MILLER COMPANY LITIGATION Mr. Bohn, Counsel for the District, reported that preparation for the M. Miller Company trial was being finalized and it was hoped that the trial would start before summer. ~ VIII.
