HELD JANUARY 18, 1962

The District Board of Central Contra Costa Sanitary District convened in
an Adjourned Regular Session at its regular place of meeting located at 1250
Springbrook Road, Walnut Creek, County of Contra Costa, State of California,
on January 18,1962, at 8:00 o'clock P.M.
The meeting was called to order by President Mitchell.

After an explanation and recommendation from Mr. Horstkotte, District
Manager-Engineer, it was moved by Member Roemer, seconded by Member Bowman,
that the claim of Frank Dwinnell be denied. Carried by the following vote:

Upon the recommendation of Mr. Horstkotte, District Manager-Engineer, it
was moved by Member Bowman, seconded by Member Gibbs, that the claim of Mrs.
L. LaRossa in the amount of $50.00 be paid following the receipt of a signed
Release in Full Settlement and Compromise. Carried by the following vote:

Upon the recommendation of Mr. Horstkotte, it was moved by Member Roemer,
seconded by Member Gibbs, that the claim of Mr. J. Fitzpatrick in the amount
of $111.50 be paid following the receipt of a signed Release in Full Settlement
and Compromise. Carried by the following vote:

RESOLUTION NO. 1306, CONSENTING TO THE APPOINTMENT OF GERRY A. HORSTKOTTE~
AS ENGINEER OF WORK FOR WCAL IMPROVEMENT DISTRICT NO. Gï1ëõ'NTRA COSTA C
ASSESSMENT DISTRICT 1961-7, SAN RAMON HEIGHTS)
President Mitchell stated that he wished to make it known to the Board
of Supervisors of Contra Costa County that this action is not to be considered
as a policy of the Sanitary District Board and refers only to a developed
tract where there is a health hazard with circumstances which are unique, and
does not establish policy.
It was moved by Member Salfingere, seconded by Member Bowman, that
Resolution No. 1306 be adopted. Carried by the following vote:

Mr. Horstkotte, District Manager-Engineer, was directed to prepare a
letter of transmittal to the Board of Supervisors, with a copy to Mr. John
A. Nejedly, District Attorney, and send copies to the Board Members for
review and comment.
INVITATION FROM VALIEY DISPOSAL TO ATTEND OPEN HOUSE

Mr. Horstkotte presented an invitation to the Board Members to attend
an open house at Valley Disposal's new location in Walnut Creek on January
20,1962.
ACCEPTANCE OF EASEMENT FROM THE LAFAYETTE SCHOOL DJSTRICT AND AUTHORIZING
PAYMENT OF $24.04 FOR PUBLICATION (MORAGA BLVD. REIDCATION)
It was moved by Member Salfingere, seconded by Member Bowman, that
the easement from the Lafayette School District be accepted, its recording
ordered, and payment of $24.04 from Sewer Construction General Fund be
made to the Lafayette School District to cover costs of advertising.

AUTHORIZATION FOR PRESIDENT AND SECRETARY TO EXECUTE DEED TO JOHNNE BURNETT
AND PAYMENT OF $3,250.00 IN EXCHANGE FOR DEED TO PARCEL 7, LINE A
After an explanation from Mr. Horstkotte, it was moved by Member
Roemer, seconded by Member Gibbs, that the President and Secretary be
authorized to execute a deed to Johnne Burnett for a triangular portion
" of property formerly purchased from Gianelli as Parcel 8, Line A, and
that payment of $3,250.00 from Sewer Construction Bond Fund be made to
Mrs. Burnett, in exchange for deed from Johnne Burnett for Parcel 7, Line
A. Carried by the following vote:

DISTRICT MANAGER-ENGINEER
AUTHORIZATION FOR DISTRICT EXPENSE IN RE MORAGA BOULEVARD REIDCATION
Mr. Horstkotte, District Manager-Engineer, requested $1,200.00 from
Sewer Construction General Fund to cover District expense in re the Moraga
Boulevard Relocation.

It was moved by Member Bowman, seconded by Member Salfingere, that
$1,200.00 from Sewer Construction General Fund be authorized for District
expense in re the Moraga Boulevard Relocation. Carried by the following vote:

TEMPORARY APPOINTMENT OF PHILLIP SAUER, UTILITY MAN
Mr. Horstkotte reported that Phillip Sauer's appointment as Permanent
Intermittent Utility Man would expire January 31,1962, and requested that
he be given a temporary appointment until August 31, 1962.
It was moved by Member Gibbs, seconded by Member Roemer, that Phillip
Sauer be appointed as a temporary Utility Man, which appointment will
terminate August 31, 1962. Carried by the following vote:

CALIFORNIA SANITARY DISTRIC'IS ASSOCIATION

Mr. Horstkotte reported that he attended a meeting of the California
Sanitary Districts Association at the Sheraton Palace Hotel on Friday,
January 12, 1962; the primary purpose of the meeting was to appoint cormni ttees
to take care of off-year sessions of the State Legislature and for the con-
vention in San Francisco. He stated that he had been appointed convention
chairman and would like all Members of the Board to attend the meeting in
July.
REIDCATION OF SIDE SEWER SERVING THE $. C. FERGUSON RESIDENCE
Mr. Horstkotte explained the necessity of relocating the side sewer
serving the S. C. Ferguson residence at 140 Bales Road, Walnut Creek, and
requested authority to have the relocation done at District expense and with
District forces at a cost of about $350.00.
It was moved by Member Bowman, seconded by Member Salfingere, that the
side sewer serving the S. C. Ferguson residence at 140 Bales Road, Walnut
Creek, be relocated by District forces and at District expense at an approxi-
mate cost of $350.00. Carried by the following vote:

President Mitchell suggested that a release be obtained from Mr. Ferguson.

COUNSEL FOR THE DISTRICT
WESTERN CONCRETE PIPE COMPANY LITIGATION
Mr. Charles Williams, on behalf of Mr. Bohn, Counsel for the District,
requested authorization to appeal a judgment against the Sanitary District
in the case of Western Concrete Pipe Co. vs. Central Contra Costa Sanitary
District.
It was moved by Member Salfingere, seconded by Member Gibbs, that
Counsel for the. District be authorized to institute appeal proceedings in

the Western Concrete Pipe Company litigation.
Carried by the following vote:

MALONEY LITIGATION
Mr. Williams and Mr. Horstkotte explained in detail the circumstances
surrounding the Maloney litigation.

At 9:45 o'clock P.M., the meeting was adjourned by President Mitchell
to February 1,1962.
