MINUTES OF A SPECIAL MEETING OF
THE DISTRICT BOARD OF CENTRAL CONTRA
COSTA SANITARY DISTRICT HELD
OCTOBER 21, 1948
The District Board of the Central Contra Costa Sanitary District
convened in special session at its regular place of meeting located
at 1822 Mt. Diablo BoulevF\rd, in the City of Walnut Creek, County of
Contra Costa, State of California, on the 21st day of October, 1948,
at the hour of 8:00 o'clock p.m.
The meeting was called to order by Member Wadsworth, in the ab-
sence of President Johnson, and the following roll was called:

It was moved by Member Smitten, seconded by Member Weill that

It was moved by Member Smitten, seconded by Member Toland that
the reading of Minutes of the previous meeting be waived, and that
they be aoproved as entered.

HEARING OF PROTESTS
LOCAL IMPROVEMENT DISTRICT NO. II
There were no written protests received against the work of Local
Improvement District No. II. President Pro Tem Wadsworth called for
protests from the floor. There were no protests from the floor. The
following resolution was offered by Member Smitten, seconded by Member
Toland:
RESOLUTION NO. 382
ORDERING WORK IN LOCAL IMPROVEMENT DISTRICT
NO. 11
WHEREAS the District Board of Central Contra Costa Sanitary District,
County of Contra Costa, State of California, passed and adopted on
September 23, 1948, its Resolution of Intention No. 371, to do the
work and improvement therein described, to wit: The construction of
Sanitary Sewer and appurtenances for the area within the boundaries
described in said Resolution of Intention to the extent, with the

materials and in the manner set forth in said Resolution of Intention
and according to Plans and Specifications heretofore adopted therefor,
and
vlHEREAS all wrl tten protests filed in rela,tion to said proceedinp:s
were duly considered by said District Board,
RESOLVED by said District Board that said protests be and the same
are hereby overruled, and
RESOLVED that the public interest and convenience require and the
said District Board hereby orders, that said work and improvement be
done, to wit: The construction of Sawntary Sewers and appurtenances
for the area within the boundaries described in said Resolution of
Intention, to the extent, with the materials and in the manner set
f,orth in said Resolution of Intention, and according to said Plans
and Specifications, reference to which Reso~ution of Intention and
Plans and Specifications is hereby made for a description of said
work and improvement and the terms and conditions under which the
Same is to be done.
The Secretary of this Board is hereby directed to post conspicuous-
ly for five (5) days, on or near the main entrance door to the regular
meeting place of the said District Board at 1822 Mt. Diablo Boulevard,
Walnut Creek, California, Notice hereof inviting sealed PROPOSALS or
BIDS for doing said work and to publish twice a Notice hereof inviting
sealed PROPOSALS or BIDS for doing said work and referring to the plans
and specifications on file; the said publication to be in the Lafayette
Sun, a daily newspaper, published and circulated in the Central Contra
Costa Sanitary District and hereby designated for that purpose.
All such proposals shall be received by the Secretary at the Office
of the District Board at 1822 Mt. Diablo Boulevard, Walnut Creek, Cal-
ifornia, on the 18th day of November, 1948, up to the hour of 8:00
o'clock p.m., and said day is hereby designated as the day on which,
at the hour of 8:15 o'clock p.m., said PROPOSALS or BIDS shall be
opened, all of which shall be specified in said Notice, and said
Notice shall require with said PROPOSALS or BIDS a check certified
without qualification by a responsible bank, payable to the Central
Contra Costa Sanitary District for an amount not less than TEN PER
CENT (10%) of the aggregate of the proposal or by a bond for the said
amount, and so payable signed by the bidder and two (2) sureties, all
as prescribed by law.

WHEREAS, in pursuance of Article 1 and 2 of Chapter 1 of Part 7
of Division 2 of the Labor Code of the State of California before
the District Board of the Central Contra Costa Sanitary District may
award any award any contract for public work on behalf of said Sanitary
District, the District Board must ascertain the general pervailing rate
of per diem wages in the locality in which the work is to be performed,
to wit: Within the limits of the Central Contra Costa Sanitary District
for each craft or type ow workman or mechanic needed to execute the
contract, and must specify in the call for bids for said contract and
in the contract itself what the general pervailing rate of per diem wages
in said locality is for each craft or type of workman or mechanic needed
to execute the contract and also the general pervai1ing rate for legal
holiday and overtime work;
NOW, THEREFORE, BE IT RESOLVED, that the said general pervailing
rate of per diem wages and the general pervailing rate of per diem
wages for legal holiday and overtime work within the limits of said
Sanitary District for each craft or type of workman or mechanic needed
to execute a contract for the construction of sanitary sewers and
appurtenances in accordance with the plans and specifications therefor,
heretofore adopted and approved for doing of said work as the same is
described in Resolution of Intention No. 371, in the Central Contra
Costa Sanitary District shall be and the same are hereby ascertained,
approved and adopted by this Board after a full investigation, to be

Overtime and Saturday work shall be paid for at double the norMal
hourly rate except as noted below for Cement Finishers and Truck
Drivers and work on Sundays and Holidays shall be paid for at double
the hourly rate.
The foregoing schedule of prevailing rates of wages, and rates
for overtime, SUnda.y and Legal Holidays is based, unless otherwise
specified, upon a working day of eight \8) hours.
Overtime and Saturday rates for Truck Drivers shall be at one
and one-half (Ii) times the normal hourly rate.
The first two hours overtime, after a normal eight (8) hour day,
for Cement Finishers shall be at one and one-half (1~) times the normal
rate and further overtime shall be at double the normal rate. Saturday
work for Cement Finishers shall be at one and one-half (It) times the
normal rate for the first eight (8) hours worked and at double the
normal rate for all further time worked on Saturdays.
NOTICE IS ALSO HEREBY GIVEN BIDDERS that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all
subcontractors under him, to pay not less than said general pervailing
rates of per diem wages, as above listed, to all labors, workmen and
mechanics ecployed in the execution of the contract.

HEARING OF PROTESTS
LOCAL IHPROVEHENT DISTRICT NO.1
There were no ~~itten protests received against the work of Local
ImDrovement District No.1. President Pro Tem Wadsworth called for
prôt~sts from the floor. The following people addressed the Board
as follows: .
Mr. Robert Dagley, Jr., who had signed a Deed of Dedication for
Se't'ITer Easement reo_uested to know' if the 15 foot 't-Tidth he haa. seen
in the posted notice ne-t-i:e~.. applied to his property, as he understood
he had given an easement of 10 feet. Iv1r. Dagley ",as 9ssured that
the easement across his property was 10 feet in vidth.

Mr. Chas. F. Morse requested information regarding the financing
and the affect the construction would have on his property. The
Resident Engineer was asked to inform }~. Morse.
Hazel Tosh, whose property adjoins the East Bay Municipal District
Property wanted the easement which the District was requesting from
her to come UD the back of the lots instead of the side. She would
have to run ahouse line 200 feet to connect to the easement as
planned, and the telephone company are requesting a 5 foot easement
on the opposite side of her property. The Resident Engineer explained
why it was necessary to keep the easement location unchanged.
The District Engineer recommended delaying receipt of bids until
January 13,1949. The following resolution was offered by Member
Smitten, seconded by Member Weill:

AWARDING BID - ORINDA PUMPING STATIONS
The District Engineer recommended that the Board waive the
irregul~rity and accept the bid of Chas. T. Brown Company and Kiss
Crane Company. The following resolution was offered by Member Smitten,
seconded by Menber Weill:

WHEREAS this District Board, on Thursday, September 16, 1948,
authorized and caused to be nublished a call for bids for the const-
ruction of the Orinda Pumping Stations, in accordance with plans and
Specifications therefor, heretofore approved and adopted by this
Board, and.
WHEREAS, in response to call for said bids, the following bids
were received and opened on October 14, 1948, at 8:00 p.m., in
accordance with the foregoing call for bids:

WHEREAS Chas. T. Brown Co. and Kiss Crane Co. submitted a bid
bond, dated October 14 1948, in the principal sum of TEN THOUSAND
AND NO/100THS DOLLARS l$lO,OOO.OO), which was a sum not equal to ten
per cent (10%) of the total bid price, and has submitted an additional
bid bond, dated October 14, 1948, in the prinicpal sum of THREE
THOUSAND SIX HUNDRED EIGHTY-~l0 AND 50/100THS DOLLAHS ($3, 682.50), and
WHEREAS CLYDE C. KENNEDY, the District Engineer, has investigated
the oualifications of the above listed bidder and advised this Board
that -Chas. T. Brown Co. and Kiss Crane Co. have the financial respons-
ibility and experience to construct the Orinda Pumping Stations in
accordance with trenlans and specifications and has recommended that
the District Board waive the irregularity in the bid bond of Chas. T.
Brown Co. and Kiss Crane Co.,
NOW, THEREFORE, BE IT RESOLVED:
(1) The.t the irregularity in the form of Chl'!s. T. Brmm Co. and

Kiss Crane Co. bid, arising from the submission by such bidder of a
bid bond in the principal sum of TEN THOUSAND AND NO/IOOTHS DOLLARS
($10,000.00), be and the same is hereby waived; and that the additional
bid bond submitted by said bidder and dated October 14,1948, in the
principal sum of THREE THOUSAND SIX HT'NDRED EIGHTY-Tì"¡O AND 50/l00THS
DOLLARS ($3,682.50) be and the same is hereby accepted.
(2) That the bid of Chas. T. Brown Co. and Kiss Crane Co. is the
lo~lest responsible bid received and the same is hereby accepted, and
the President is hereby authorized and directed to execute a contract
on behalf of the Central Contra Costa Sanitary District with said
successful bidder, and the Secretary be and he is hereby authorized to
countersign the same on behalf of the Dißtrict.
(3) Immediately following tæexecution of the contract by the
successful bidder and the District, upon the furnishing by the bidder
of the bonds required by said contract, the Secretary is hereby author-
ized and directed to return to the successful bidder such deposit as
may have accompanied said bid or to give such release as may be request-
ed from further liability upon each respective bidder's bond.
(4) Upon the execution of the contract by the successful1::i:ìder
