The District Board of the Central Contra Costa Sanitary District
convened in special session at its regular place of m~eting located
at 1822 Mt. Diablo Boulevard, in the City of Walnut Creek, County of
Contra C.osta, State of California, on the 14th day of October, 1948,
at the hour of 8:00 o'clock p.m.
The meeting was ~alled to order by President Johnson, and the
followin~ roll was called:

It was moved by Member Smitten, seconded by Member Toland that
the reading of Minutes of the previous meeting be waived, and that
they be approved as entered.

The following resolution was offered by Member Wadsworth, seconded

RESOLUTION NO. 379
~mEREAS, the Central Contra Costa Sanitary District is acquiring
by Deeds of Dedication for sewer easements, numerous rights-of-way
within which to pIece sanitary sewers; and
~ŒEREAS, it is necessB,ry that such Deeds of Dedication be recorded
promptly in the office of the rtecorder of the County of Contra Cost~,
and
HHEREAS, the title to many of sA,id easements and rights-of-way
are encumbered by deeds of trust, mortgages and other liens, and it
is necessary to subordinate such liens to said easements and rights-
of-way,
NOV1, THEREFORE, BE IT RESOLVED that ell subordine,tion agreements
and deeds of partial reconveyance relating to such easements and
rights-of-way be and they are hereby accepted, and the Recorder of
the County of Contra Costa be and he is hereby authorized and directed
to record said agreements and reconveyances with the certificate of
acceptance on behalf of this B08rd executed by the Secretary of this
District endorsed thereon and without further action by the District
Board of the Central Contra Costa Sanitary District.

RESOLVED that the District Board of Central Contra Costa Sanitary
District, Contra Costa County, State of California, having in open
session on the 14th day of October, 1948, opened, examined and public-
ly declared all sealed proposals or bids offered for doing the work
hereinafter mentioned;

PURCHASE OF PICKUP TRUCK
It was moved by Member Weill, seconded by Member Smitten that
all the biö.s for the pu::'chase of a half ton pickup truck that were
submitted at the meeting of October 7, 1948 be rejected. Carried
unanimously.
It was moved by Memb.:or Toland, seconded by Member Weill that the
Boprd purchase, on the open market, one GMC half-ton pickup truck,
from Rector Motor Company at a cost of $1,~85.25 plus State license
fees, as per their letter of October 13, 1948. Ca~ried unanimously.

It was recommended by the Engineer, moved by Member Smitten and
seconded by Member Wadsworth, that the Board approve the sewer
connection charge of $500 for the restaurant knmvn as IIPlanter' s
Dock". Carried unanimously.
PAYMENT OF ARCHITECT.
It was moved by Member bmitten, seconded by Member Weill that
the Board authorize the payment of the bill for architectural services
rendered by Mr. ¡¡ayne A. Little john for construction of the office

building, in the final amount of $683.63.

PURCHADE OF POWER DRIVE
It wes moved by Member Tole.nd, seconded by Hember Wadsworth that,
in accordance with the Engineer's recommendation, the Board authorize
the Engineer to purchase a power drive for sewer cleaning equipment
at an approximate amount of $350. Carried unanimously.

w~EREAS, this Sanitary Board on the 24th day of June, 1948, did
order a special election to be held on the 27th day of July, 1948, in
the territory annexed to Central Contra Costa Sanitary District by
Resolution and order of the Board of Supervisors of Contra Costa County,
adopted January 19, 1948, for the purpose of submitting to the oualified
electors of said annexed territory the following proposition, towit:
PROPOSITION: Shall Central Contra Costa Sanitary District,
Contra Cost a County, California, issue $70,000
principal amount of bonds for the purpose of raising money
for the acquisition and construction of sewers, drains and
sewerage collection, outfall, treatment works and sanitary
disposal system in the territory known as Pachpco and Highway
Junct ion area, flnnexed to said Central Cont re Costa Sanitary
District by resolution and order of the Bo!:rd of Supervisors
of Contra Costa County dated January 19, 1948, both the prin-
cipal of and interest on said bonds to be payable from taxes
limited to the property in said annexed territory subject to
taxation by said District?
and
WHEREAS, notice of said election was duly and regularly given and
said election was duly and regularly held on July 27, 1948, in and
throughout said annexed territory, and the result thereof was duly and
regularly canvassed ene, more than two-thirds of the votes cast at said
election were in favor of issuing said bonds; and

declares, that all acts, conditions and things required by law to exist,
happen end be perfoy'med precedent to and in the calling of and the
conduct of said election, and the determining of the result thereof,

FIRST:
That all recitals herein set forth are true and correct.
SECOND: That bonds be issued by Central Contra Costa. Sanitary
District of Contra Costa. County in pursuanc e of the aforesaid election

end provisions of law applicable thereto, and as provided by said
proposition a'oove set fort!], in the aggregate principal sum of
Seventy Thousand Dollars ($70,000). Said bonds shall be designated
"Pacheco end riighway Junction Annexation Issue of 1948", shall be of
the denomination of One Thousand Dollars ($I,OOO) each, numbered from
I to 70, both inclusive, and shall beer interest at a. rate not t.o
exceed five per cent. (5.%) per annum, payable semi-annually. The
exact rate of interest to be paid on saidbonds, or any portion thereof,
shall be designated at the time of determining the best bid and making
the award after advertising for sealed proposals for the purchase
thereof. Said bonds shall be dated December 15, 1948; shall be of the
character known as "serial"; and shall mature in consecutive nwnerical
order, from lower to hipper, as follows, to wit:
$3,000 principBl amount of said bonds shall mature and be
payable on December 15 in each of the years 1949
to 1958, both inclusive; and
$4,000 principal amount of said bonds shall mature and be
payable on December 15 in each of the years 1959 to
1968, both inclusive.
Interest accruing on said bonds shall be payable semi-annually on
the 15th day of June and the 15th day of December of each and every
year until said bonds are redeemed and paid. Such interest prior to
maturity shall be evidenced by interest coupons attached to said bonds
and each of such coupons shall represent six months' interest accruing
on the bond to which it is attached. Both the principal of B.nd int erest
on said bonds shall be payable in lawful money of the United Statæof
America at the office of the Treasurer of the County of Contra Costa,
in MaI'tinez., California.

annexed January 19, 1948, to be indebted and for value received
promises to pay, exclusively from the fund hereinafter mentioned,
to the bearer (or if this bond is registered, to the registered holder
hereof) on the 15th day of December, 19--,

This bond is one of a series of bonds of like tenor and date
(except for such verie.tions, if any, as may be required to designate
v8.rying numbers, maturities or interest rates) numbered from 1 to 70,
both inclusive, amounting in the aggregate to the sum of Seventy
Thousand Dollars (~70,000), and is issued and sold by the Sanitary
Board of Central Contra Coste. Sanitary District of ContrA Costa County,
State of California, forthe purpose of raising money for the acquis-
i tion and construct ion of se'vvers, drain s and sewerage collection,
outfall, treatment works and sanitary disposal system in the territory
annexed to said Central Contra Costa Sani ts.ry District by resolution
and order of the Board of Supervisors of Contra Cos~a County passed
and adopted on January 19, 1948, all in pursuance of and in strict
conformity with the provisions of the Health and Safety Code of the
State of California, and the Constitution of the State of California,
and is B.uthorized by a vote of more than two-thirds of the oualified
3lectors resident within said annexed territory voting at an election
duly and legally called and held and conducted in said annexed
territory.
The Sanitary Board of Central Contra Costa Sanitary District of
Contra Costa County, State of California, hereby certifies and declares
that said election was duly and legally called, held And conducted,
and thRt notice thereof was duly and l~gally given and published,
and the result thereof was duly and legally canvassed and declared
in the manner and as reQuired by law, and tœt all acts, conditions
and things reQuired by law to exist, happen and be performed precedent
to B.nd in the issuance of said bonds have existed, happened and been
performed in regular and in due time, form and manner and in strict
accordance with the provisions of the law authorizing the issue of
sanitary district bonds.
It is fu:-ther certified and declared that the total amount of
indebtedness of the said territory annexed to said Central Contra
Costa Sanitary District of Contra Costa County by resolution and
order of the Board of Supervisors of Contra Costa County passed and
adopted on Jammry 19, 1948, including this issue of bonds, is
within the limit provided by law, and that due provision has been
made for the levy and collection of an annual ad velorem tax upon
all the taxable property in the territory annexed to said District
by resolution and order of the Board of Supervisors of Contra Costa
County, passed and adopted on January 19, 1948, sufficient to pay
the prinbipal and interest on this bond as the same shall fall due
and to provide a sinking fund f or the redempt ion 0 f thi s bond on
maturity. For the punctual payment of tHis bond, with interest
he reon a.s aforesaid, Emd for the levy and collect ion of taxes suff-
icient for that purpose the full faith and credit of that portion
of the Central Contra Costa San it ary District of Contra Costa County

FOURTH: ThAt said bonds shall be signed by the President
of the Sanit!Jry Board of Central Con"cra Costa Sanitary District
of Contra Costa County, State of California, and countersigned by
the Secretary of said Sanitary Board, and shall have the seal of
the Sanitary Board of said District attached; that the aforesaid
officers be, and they are hereby, authorized from time to time a.s
required by this Board to sign, seel, countersign and number said
bonds and to insert therein the proper dates in the manner pre-
scribed by law and by this order; that said coupons shall be signed
by said President and Secretary by printed or lithographed fac-
simile signature; t11at said President and Secretary be, and they
hereby are authorized from time to time as required by this Board
to sign and number said coupons and to insert therein all necessary
numbers and dates in the manner provided by law and by this reso-
lution and order, or any applicable resolution hereafter a.dopted
by this Board prescribing the interest rates which such bonds

for safekeeping.
FIFTH: The Sanitary Board of said Central Contra Costa Sani-
tary District of Contra Costa County shall annually levy a tax
upon the taxable property in the said territory annexed to said
Central Contra Co sta. Sanitary Di strict of Contra Cos ta County,
State of California, by resolution and order of the Board of Sup-
ervisors of Contra Costa County passed and adopted on the 19th day
of January, 1948, sufficient to pay the interest on said bonds for
the year and such portion of the principal as is due or is to
become due during such year, so thet the entire amount of principal
and interest of said bonds shall be pa.id at the respective dates of
maturity thereof. The taxes herein required to be levied and
collected shall be in addition to all other taxes levied for
sRni tary purposes in said District and. shall be collected at the
time fI..nd in the same ma.nner and by the same officers as other
district tc9.xes are collected and shall be used for no other pur-
pose than the payment of said bonds and accruing interest. Said
taxes, when collected, shall be forthwith deposited by the County

ISSUE: *40,000, consisti~g of 40 bonds of the denomination of
~1,000 each, all dated December 15, 1948. Said bonds
constitute the initial portion of an ~uthorized issue of $70,000
principal amount of bonds. The remAining $30,000 principal amount
of bonds of said authorized issue may be hereafter issued and sold
whenever in the ju6gment of the Sanitary Board additional funds
are required. It is not contemplated that said remaining i30,000
principal amount of' bonCis of said authoriz.ed issue will be sold
prior to July 1, 1949.
INTEREST ?ArE: Maximum five (5) per cent. p"'r annum, payable semi-
annually on June 15 and December 15 in each year.
Bidders must specify the rate of interest which the bonds hereby
offered for sale shall be9r. Bidders will be pe~litted to bid
different rates of interest and to split rates irrespective of the
maturities of said bonds. The interest rate stated in the bid must
be in a multiple of one-quarter of one per cent. per annum, payable
semi-annually.

Coupon bonds will be issued by the District. Such

PUrPOSE OF' ISSUE: Said $70,000 princ ipa.l amount of bonds was auth-
orized by two-thirds vote of the oualified elec-
tors of said annexed territory at a special bond election held in
said annexed territory for the purpose of raising money for the
acquisition and construction of sewers, drains and sewerage collec-
tion, outfall, treatment works and sanitary disposal systèm in the
terrl tory annexed to Central Contra Costa Sa;.' it,ary District by
resolution and order of the Board of Supervisors of Con~ra Costa
County, adopted January 19, 1948.
S:::CUBITY: Said bonds are not obligations of Central Contra Costa
Sanitary District, as such, but taxes for the payment

TERNS OF SALE

bidder considering the interest rate or rates
specified and the premium offered, if any. The higbest bid will
be determined by deducting the amount of the premium bid (if Rny)
from the total amount of interest which the District would be
required to pay from the date of said bonds to the respective

and the award will be made on the basis of the lowest net interest
cost to the District. The lowest net interest cost shall be com-
puted betweenthe dates aforesaid according to standard bond
interest tables. The purchaser must pay accrued interest from

printing the bonds will be borne by the District.
RIGHT OF REJECTION: The District reserves the right, in its dis-
cretion, to reject any and all bids and to
waive any irregularity or informality in any bid.
PROMPT AWARD: The Sanitary board will take action awarding the
bonds or rejecting all bids not later than 24 hours
after the expiration of the time herein prescribed for the receipt
of proposals; provided, that the award may be made pfter the ex-
piration of the specified time if the bidder shall not have given
to the Board notice in writing of the withdrawal of such proposal.
