DISTRICT BOARD OF CENTRAL CONTRA COSTA
SANlïARY DISTRICT HELD SEPT. 16. 1948
The District Board of the Central Contra Costa Sanitary District
convened in special session at its regular pIece of meeting located
at 1822 Mt. Diablo Boulevard, in the City of Walnut Creek, County of
Contra Costa, State of California, on the 16th day of September,
1948, at the ~our of 8:00 o'clock p.m.

APPOINTMENT OF SECRETARY PRO TEM
It was moved by Member Wadsworth, seconded by Nember Toland that
~he Board appoint Mrs. Phillips Secretary Pro Tern.
Carried.
It was moved by Member Wadsworth, seconded by Member Toland that
the reading of the Minutes of the previous meeting be waived, and
they be approved as entered.
Carried.
RIGHT OF WAY AGENT L.I.D. No. II
It was moved by Member Toland, seconded by Member Wadsworth that
the Board appoint Mr. Lee J. Rothgery as right of wày agent for
Local Improvement District No. II.

APPROVAL OF DISTRICT EMPLOYEE
MELVIN KLEIvlMICK
It was moved by Member Wads\'lortn, seconded by Member Toland that
the Board approve the employment of Melvin Klemmick as Assistant
Sewage Treatment Plant Operator at $275.00 per month, to be advanced
to $300.00 per month at the end of 90 days if his services are satis-
factory.

It was moved by Director Toland, seconded by Member Wadsworth
that the Board approve payment for easement, Parcel 19 of Section III
of the Main Trunk Sewer in the amount of $5.25.

It was moved by Member Toland, seconded by Member Wadsworth that
the Boa::'d approve progress pElyment (fi-ne.l) to Manuel Smith for work
on Section II of the Main Trunk Sewer in the amount of $5,421.04.

The following resolution was offered by Member Wadsworth, seconded
by Member Toland:
RESOLUTION NO. 35~
BE IT RESOLVED that plans and specifications on file with this
Board for the construction of Orinda Pumping Plants be and the same
are hereby approved and the President and Secretary be and they are
hereby authorized and directed to endorse the same showing such
approval thereof.

ESTABLISHING PREVAILING WAGE RATES
FOR ORINDA PU~œING PLANTS
The following resolution was offered by Member Wadsworth, seconded
by Member Toland:
RESOLUTION NO. 359
w~REAS, in pursuance of Article 1 and 2 of Chapter 1 of Part 7
of Division 20f the Labor Code of the State of California, before
the District Board of the Cent-al Contra Costa Sanitary District may
award any contract for public work pn behalf of said Sanitary Dist-
rict, the District Board must ascertain the general prevailing rate
of per diem wages in the locality in which the work is to be performed,
to-wit: within the limits of the Central Contra Costa Sanitary
~istrict for each craft or type of workman or mechanic needed to
execute the contract, and must specify in the call for bids for said
contra.ct and in the contract itself what the genere.l prevailing rate
of per diem wages in said IGcality is for each craft or type of work-
man or mechanic needed to execute the contract and also the general
prevailing rate for legal holiday and overtime work;
NOW, THE~EFORE, BE IT RESOLVED, that the said general prevailing
rate of per diem wages and the general prevailing rate of per diem
wages for legal holiãay and overtime work within the limits of said
Sanitary District for each craft or type of workman or mechanic needed
to execute a contract for the construction of the Orinda Pumping Plants,
as specified in the Plans and Specifications heretofore approved by
this District Board, shall be and the same are hereby ascertained,
approved and adopted by this District Board after a full investigation
to be as follows:

Notice is also hereby given bidders that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all sub-
contractors under him, to pay not less than said general prevailing rates
of per diem wages, as above listed, to all laborers, workmen, and
mechanics employed in the execution of the contract.

CALLING FOR BIDS - ORINDA PUMPING PLANTS
The following resolution was offered by Member Wadsworth, seconded
by Member Toland:
RESOLUTION 360
WHER~~S, in the judgment of the District Board of the Central
Contra Costa Sanitary District, it is necessary to secure all labor,
materials, equipment, mechanical workmanship, transportation and ser-
vices required for the construction of Orinda Pumping Plants, in accord-
ance with the plans and specifications for the same, heretofore approved
by this District Board and which are on file in the office of the Sani-
tary District located at 1822 Mt. Diablo BoulevarQ, Walnut Creek,
California; .
NOW, THEREFORE, BE IT RESOLVED that the general prevailing rates
of 1vages as heretofore ascertained and c1etermineè" by this Board in its
Resolution No. 122 adopted on the 16th day of September, 1948, in
pursuance of Articles 1 and 2 of Chapter 1 of Part 7 of Division 2 of
the Labor Code of the State of California, shall be the general
prevailing rates per diem wages for each craft or type of \^lorkman or
mechanic needed for the construction of said Orinda Pumping Plants;
and
BE IT FURTHER RESOLVED, that the Secretary of this Board be and he
is hereby authorized to advertise for proposals for the construction
and completion of said work by ~lblishing the same once a week for two
successive weeks in the Walnut Kernel, a n-evlspaper of general circulation,
published in treCentral Contra Costa Sanitary District.

The plans and. specifications for the nroposed worlt may be seen
and examined at the office of the Central Contra Costa Sanitary
District, 1822 Mt. Diablo Boulevard, Walnut Creek, California, or
at the En~ineering Office of Clyde C. Kennedy, Room 504, 604
Mission Street, San Francisco, California, or may be secured at
the Engineering Office of Clyde C. Kennedy by making a payment
of ten dollars ($10.00). T:lere will be no refund on returned plans
or specifications.
Pursuant to t11e statutes of the State of California, the
District Board of the Central Contra Costa Sanitary District has
ascertained and determined the general prevailing rate of per diem
wages and rates for overtime and legal holidays in the locality

Overtime and Saturdav work shall be paid for at double the
normal hourly rate excep~ as noted below~for Cement Finishers and
Truck Drivers and work on Sundays and Holidays shall be paid for
at double the normal hourly rate.
The foregoing schedule of prevailing rates of \-,ages, and rates
for overtime, Sunday and Legal Holidays, is based, unless otherwise
specified, upon a working day of 8 hours.
Overtime and Saturday rates for Truck Drivers shall be at one
and one-half (1-1/2) times the normal hourly rate.
The first two hours overtime, after a normal 8 hour day, for
Cement Finishers shall be at one anët one-half (1-1/2) times the
normal rate and further overtime shall be at double the normal rate.
Saturday work for Cement Finishers shall be at one and one-half
(1-1/2) times the normal rate for the first 8 hours worked and at
double the normal rate for all further time worked on Saturdays.
Notice is also hereby given bidders that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all
subcontractors under him, to pay not less than said general pre-
vailing rates of per diem wages, as above listed, to all laborers,
workmen and mechanics employed in the execution of the contract.
Before submitting proposals the bidder shall be licensed in
accordance with the ~rovisions of Chapter 9 of Division III of
the Business and Professions Code, Chapter 37, of the Statutes of
1939, as amended, of the State of California, which provides for
the registration and licensing of contractors.
Each bidder must submit with his proposal, a statement of his
financial responsibility, technic8.l ability and experience on the
form to be furnished prospective bidders.
East bidder shall submit v,i th his bicl on the form provided,
the name and address of each subcontractor including the nrincipal
suppliers of materials, and the portion of the work which each
subcontractor will do. If the contractor fails to na~e the sub-
contractors in his proposal, he shall be deemed to have agreed to
perform each portion of the work himself qnd shall not be permitted
to subcontract said portion of work without previous vœitten per-
mission of the Sanitary District Board.
The proposal shall be made out on the form to be furnished
prospective bidders, a copy of wh~ch is incorporated with the
specifications, and must be accompanied by a certified or
cashier's check or bidder's bond for an amount not less than ten
(10) per cent of the aggregate of the nroposal, made payable to
the Central Contra Costa Sanitary District, sealed and filed
with the Secretary thereof on Jr before the day and hour first
above set forth, ~nd thereafter will be publicly opened and read
before said District Board.

The above mentioned check or bond shall be given as a guB~8_ntee
that the bidder will enter into cont~act if awarded the work, uithin
ten (10) days after notice of the award has been sent to him by
mail a~ the address given by him in his propos8.1 and said check or
bond shall be declared forfeited if the bidder refuses or neglects
to enter into said contract within said time.
The successful bidder ~ill be reQuired to furnish labor and
material bonds in the amount of fifti (50) :per cent of the contract
price and a faithful performance bond in an amount equal to one
hunQred (100) percent of the contract price.
The District Board reserves the right to reject any or all
proposals and to waive any informality in proposals received.
