MINUTES OF THE REGULAR MEETING OF
THE DISTRICT BOARD OF CENTitAL CONTRA
COSTA SANITA~Y DISTRICT HELD SEPTEMBER 2. 1948
The District Board of the Centr81 Contra. Costa Sanitary District
convened in regular session at its regular place of meeting located
at 1822 Mt. Diablo Blvd.., in the City of Walnut Creek, County of
Contra Cos,a, SGa,te of California, on the 2nd day of September, 1948,
at the hour of 8:00 o'clock p.m.
The meeting was called to order by President Weill
and the following roll was called:

RESOLUTION NO. 348
WHEREAS MANUEL SMITH was heretofore awarded a contract for the
construction of Section II of the Main Trunk Sewer located between
the City of Walnut Creek and Lafayette, California, and
WHEREAS CLYDE C. KENNEDY as District Engineer for the Central
Contra Costa Sanitary District has certified to the completion of
the work of constructing said main trunk sewer Section II, in .
accordance with the Plans and Specifications therefor.
NOW, TIŒREFORE, BE IT RESOLVED that Section II of the Main
Trunk Sewer be and the same is hereby accepted and the President
and Secretary be and they are hereby authorized and directed to
execute on behalf of the CENTRAL CONTRA COSTA SANITARY DISTRICT a
notice of completion as provided by law and to cause the same to be
recorded in the Office of the County Recorder of the County of Contra
Costa, State of California, and said Recorder is hereby authorized
to record the same.

that the Board authorize the payment of District employees I ss.l-
aries semi-monthly.

PL & PD INSURANCE - MILEAGE PAYMENTS
It was moved by Member Smitten, seconded by Member Toland
thpt the Board authoriz,e the use of personally owned a,utomobiles
by District employees for District business, with mileage payable
at 7~ per mile, and authorize the Secretary to cover the District
and the employees'personal cars, and District-o~ned cars with
Public Liability and Property Damage insurance.

SALE OF $100~000 GENERAL OBLIGATION BONDS
The following resolution was offered by Member Smitten,
seconded by Member Wadsworth:
RESOLUTION NO. 349
WHEREAS, the 5án1tary Board of Central ContraCosta Sanitary
District, by resolution duly passed and adopted on July 10, 1947,
duly authorized the is suance of $2,4.00,000 principal amount of
bonds authorized at an election held in said District on June 3,
1947, and
WHEREAS, this Board has heretofore issued and sola bonds of
said issue in the aggregate principal amount of $2,300,000 and now
deems it advisable to sell the remaining $IOO,OOO principal amount
of said authorized issue,
NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE SANITARY
BOARD OF CENTRAL CONTRA COSTA SANITARY DISTRICT, as follows:
$100,000 principal amount of said bonds shall be sold by the

by the Sanitary Board of Central Contra Costa Sanitary District of
Contra Costa County, State of California, at the office of said

at the hour of 11: A.M. (C.D.S.T.) for the purchase of $100,000 prin-
cipal amount of bonds more particularly described below:
$100,000 consisting of 100 bonds of the denomination of
$1,000 each, all dated June 15,1947. Said bonds con-
stitute part of an authorized issue ot $2,400,000 prin-
cipal amount of bonds, whereof $2,300,000 are now issued and outstand-
ing.
ISSUE:
INTEREST
RATE:

Maximum five (5) per cent.per annum, payable semi-annually
on. June 15th and December 15th in each year. Bidders must
specify the rate of interest which the bonds hereby offered
for sale shall bear. Bidders will be permitted to bid different rates
of interest and to split rates irrespective of the maturities of said
bonds. The interest-rate stated in the bid must be in a multiple of
one-quarter of one per cent. per annum, payable semi-annually.
MA TURI TI ES:
The bonds hereby offered for sale mature serially on
June 15th in each year as follows:
$5,000 principal amount in each of the years 1950 to
1969, both inclusive, without option of prior
redemption.
PAY14ENT:
Both principal and interest payable in lawful money of
the United States of America, at the office of the Treas-
urer of Contra Costa County, in' the City of J.tartinez,
California.
REGISTRATION: Coupon bonds will be issued by the District. Such bonds
are registerable only as to both principal and interest.

TAX EXEMPT ~n the event that prior to the delivery of the bonds the

laws or by ruling of a Federal Income Tax authority or official which
is followed by the Bureau of Internal Revenue, or by decision of any
Federal Court, the successful bidder may, at his option, prior to the
tender of said bonds by the District, be relieved of his obligation
under the contract to purchase the bonds and in such case the deposit
accompanying his bid will be returned.
LEGAL
OPINION:
The legal opinion of Messrs. Orrick, Dahlquist, Neff
& Herrington, of San Francisco, California, approving the
validity of said bonds will be furnished to the successful
bidder without charge.
TERNS OF SALE
Hi~hest Bi~:The bonds will be awarded to the highest and best bidder
considering the interest rate or rates specified and the
premium offered, if any. The highest bid will be determined by de-
ducting the amount of the premium bid (if any) from the total amount
of interest which the District would be required to pay from Septem-
ber 15, 1948 to the respective maturity dates at the coupon rate or
rates specified in the bid, and the award will be made on the basis of
the lowest net interest cost to the District. The lowest net interest
cost shall be computed between the dates aforesaid according to stan-
dard bond interest tables. The purchaser must pay accrued interest
from the date of the bonds to the date of delivery. The cost of
printing the bonds will be borne by the District.

The District reserves the right, in its discretion, to
reject any and all bids and to waive any irregularity or
informality in any bid.
The Sanitary Board will take action awarding the bonds
or rejecting all bids not later than 24 hours after the
expiration of the time herein prescribed for the receipt
of proposals; provided that the award may be made after the expiration
of the specified time if the bidder shall not have given to the Board
notice in writing of the withdrawal of such proposal.
Prompt
Award:
Prompt Delivery of said bonds will be made to the successful bidder
Delivery: at the office of the Treasurer of Contra Costa County in
Martinez, California, as soon as the bonds can be prepared,
which it is estimated will be October 15, 1948.
Right of The successful bidder shall have the right, at his option,

fail to tender the bonds for delivery on or before Nov-
ember 10,1948, and in such event the successful bidder shall be en-
titled to the return of the deposit accompanying his bid.
Form of Bid: All bids must be unconditional for not less than all of
the bonds hereby offered for sale, and for not less than
the par value thereof and accrued interest to date of delivery. Such
bids, together with bidder's check must be enclosed in a sealed envelope
addressed to the Sanitary Board of Central Contra Costa Sanitary Dist-
rict of Contra Costa County and endorsed "Proposal for Central Contra
Costa Sanitary District of Contra Costa County Bonds, Issue of 1947".
Bid Check: With each bid must be submitted a certified check or
cashier's check for $5,000 drawn on a bank or trust
company authorized to transact and transacting business in the State
of California, payable to the order of the Treasurer of Contra Costa
County to secure the District from any loss resulting from the fail-
ure of the bidder to comply with the terms of his bid. In addition
bidders are requested (but not required) to supply an estimate of
the total net interest cost to the District on the basis of their res-
pective bids, which shall be considered as informative only and not
binding on either the bidder or the District. Checks of the unsuccess-

ful bidders will be returned by the District by mail upon the award of
the bonds. No interest will be paid upon the deposit made by any
successful bidder.
FINANCIAL STATEMENT
Further information relative to the financial condition of the
District will be furnished to any bidder upon request.
There is no controversy or litigation pending or threatened con-
cerning the validity of the above issue, the corporate existence of
the District, or the title of the officers to their respective offices.

The following letter was addressed to the District Board, from
the County Health Department:

Gentlemen:
August 18, 1948
A recent investigation of conditions existing in the area herein-
after described in the Central Contra Costa Sanitary District in the
County of Contra Costa, disclosed such conditions to be unsanitary,
unhealthful, and in my opinion, dangerous to the health of the people
living thereon. Said area is bounded and described as follows:
Beginning at the northeast corner of Hidden Valley Estates Unit
No.1 as designated on the map filed in Map Book 23 at page 720 in
the Office of the Recorder of Contra Costa County; thence westerly and
southerly along northern and western boundary of said Unit No.1 and
continuing westerly, southerly, westerly, southerly and easterly along
northern, western, northern, western and southern boundary of Unit
No.2 of Hidden Valley Estates as said subdivision is recorded in map
Book 24 at pages 750 to 753,inclusive, to the most southerly corner
of Lot 100 of said subdivision; thence southeasterly in a direct line

to the most northerly corner of Lot 4 as said lot is designated on the
map or the Subdivision of Portion of Acalanes Rancho filed in map
book 2 at page 44 in the Recorder's Office of Contra Costa County,
California; thence southerly and easterly along the western and southern
boundary of said Lot 4 and its extension southeasterly to the eastern
boundary of a County Road commonly known as Acalanes Road; thence
northerly along the eastern boundary of said road to its intersection
with the northern boundary of King Estates, extended easterly, as
said subdivision is filed of record in Map Book 23 at page 733; thence
westerly along said eastern extension and along said northern boundary
of King Estates to its intersection with the eastern boundary of said
Hidden Valley Estates Unit No.1; thence northerly along said east-
ern boundary of Hidden Valley Estates Unit No.1 to the point of
beginning.
As Health Officer of the County of Contra Costa, I recommend as
a necessary health measure that your Honorable Board institute pro-
ceedings at an early date for the construction of a sanitary sewer
system in the said area to abate the unsanitary condition.

RESOLUTION NO. 350
WHEREAS the County Health Officer has filed with this DISTRICT
BOARD a report stating that the conditions in the hereinafter described
area in the CENTRAL CONTRA COSTA SANITARY DISTRICT, in the COUNTY OF
CONTRA COSTA, are unsanitary, unhealthful and dangerous to the
health of the people living herein, and recommending that the
DISTRICT BOARD institute proceedings at an early date for the con-
struction of a sanitary sewer system to abate the unsanitary conditions,
said area being bounded and described as follows:
Beginning at the northeast corner of Hidden Valley Estates Unit
No 1 as designated on the map filed in Ma~ Book 23 at page 720
in the Office of the Recorder of Contra Costa County; thence
westerly and southerly along northern and western boundary or
said Unit No.1 and continuing westerly, southerly, westerly,
southerly and easterly along northern, western, northern, western
and southern boundary of Unit No.2 of Hidden Valley Estates as
said subdivision is recorded in map Book 24 at ~ages 750 to 753
inclusive, to the most southerly corner of Lot 100 of said sub-
division; thence southeasterly in a direct line to the most
northerly corner of Lot 4 as said lot is designated on the map
of the Su'bdivision of Portion of Acalanes Rancho filed in map
book 2 at page 44 in thè Reoorder's Office of Contra Costa
County, California; thence southerly and easterly along the
western and southern boundary of said Lot 4 and its extension
southeasterly to the eastern boundary of a County Road commonly
known as Acalanes Road; thence northerly along the eastern bound-
ary of said road to its intersection with the northern boundary
of King Estates, extended easterly as said subdivision is filed
of record in Map Book 23 at page 733; thence westerly along said
eastern extension and along said northern boundary of King
Estates to its intersection with the eastern boundary of said
Hidden Valley Estates Unit No.1; thence northerly along said
eastern boundary of Hidden Valley Estates Unit No.1 to the point
of beginning.
THEREFORE, BE IT RESOLVED by the DISTRICT BOARD of the CENTRAL
CONTRA COSTA SANITARY DISTRICT, Contra Costa County, State of Calif-
ornia, that it is hereby found that the necessity for the construction

of a sanitary sewer system in the above described area does exist,
and hereby orders that proceedings be prepared for adoption by this

Health Officer, said proceedings to be as provided in Division 7 of
the Street and Highway Code of the State of California, the "Improve-
ment Act of 1911", with bonds to be issued to represent unpaid assess-
ments as provided therein.
BE IT FURTHER RESOLVED that the report and recommendation of the
Health Officer is hereby ordered spread upon the Minutes of this
meeting.

tary District, County of Contra Costa, State of California, that the
District Engineer is hereby directed to prepare and submit to this
Board maps, diagrams, plans and specifications, together with a
careful estimate of the costand ex~ense of constructing a sanitary
sewer system within or adjacent to the following described boundaries,
namely:
Beginning at the northeast corner of Hidden Valley Estates
Unit No.1 as designated on the map filed in Map Book 23 at
page 720 in the Office of the Recorder of Contra Costa County;
thence westerly and southerly along northern and western boun-
dary of said Unit No.1 and continuing westerly, southerly,

ACALANES ROAD from manhole on Main Trunk Sewer in said Road
located approxiIT~tely 375 feet south of the center line of State High-
way from Orinda to Lafayette to the said intersection of the easterly
extension of the north line of the said "King Estates".
The expense of said work B.nd improvement hereinbefore described
in Section 1, Second, hereof, and on Sheet 2 of said Plans and Spec-
ifications relating thereto, shall be chargeable upon said assessment
district hereinafter established.
Third: Official Records referred to hereinabove are the Official
Records of the Recorder of the County of Contra Costa, State of Calif-
ornia, and File numbers referred to are the File numbers of said
Recorder.
. In the foregoing description, wherever right of way, easement,
street or other public way is described wherein work is to be done,
it is the intention that said work shall also be extended so as to
connect the same with the sewer work to be constructed nearest to
said right of way, easement, street or other public way, and at the
point in said proposed work where a manhole or other connection is
shown on said plans therefor, unless otherwise shown thereon.
Fourth: Said work shall include the refilling and resurfacing of
the trench in which said sewer and appurtenances are constructed.
SECTION 2: All of said improvement and work shall be done of the
sizes, dimensions, and materials and in the positions and locations
as shown upon, and all in accordance with, the Plans and Specifications
therefor heretofore adopted by said District Board and now on file with
the Secretary of said Board, which said Plans and Specifications are
hereby referred to and made a part hereof by reference.

SECTION 3: That in the opinion of said Board, said work is of
more than local or ordinary public benefit, and said B02rd hereby
orders that the co st and expenses of said work a.nd improvement shall
be chargeable and charged upon a district, which district is hereby
declared to be the district benefited by said work and improvement
and which is to be assessed to pay the cost and expenses thereof.

said district approved and adopted by said Board on the 2nd day of
September, 1948, and now on file in the office of the Secreta~ of
said Board, to which map reference is hereby made for a particular

SECTION 4: Thet the proceedings for said work and improvement
shall be had and taken under and in accordance with Division 7 of the
Streets and Highways Code of the State of California. ("Improvement
Act of 191111).
NOTICE IS HEREBY GIVEN th2t the Health Officer of said County of
Contra Costa has recommended in writing to said Board that said pro-
ceedings for said work be instituted as a necessary health measure
and said Board h~retofore ordered said recommendation spread upon the
Minutes of said Board and by Resolution adopted by the a!firmative
vote of four-fifths of the members of said BoB.rd found and determined
that such necessity exists.
SECTION 5: That serial bonds shall be issued pursuant to Part 5
of Division 7 of said Streets and Highways Code (Improvement Act of
1911) to represent the unpaid assessments of Twenty-five dollars($25.00)
or over for the cost of said work, said bonds to bear interest at the
rate of SIX PER CENT (6%) per annum, to extend for a period of nine
(9) years from the second day of JanUAry next succeeding the next
October 15th following their date, and to be payable in annual in-
stallments, the last installment thereof to mature nine (9) years
from the second day of January next succeeding the next 15th day of
October following their date, said bonds and the interest thereon to
be payable as provided in said Code.
SECTION 6: That Thursday, the 23rd day of Sept ember, 1948, at
the hour of 8:00 o'clock p.m., of said day, and the meeting place of
said Board, 1822 Mt. Diablo Blvd., City of Walnut Creek, in the
County of Contra Costa, State of California, be and the same are
hereby fixed as the time and place, when and where any and all persons
having any objection to the proposed work and improvement or to the
extent of the district to be assessed, or both, may appear before
said Board and. show cause why said proposed work should not be carried
out in Accordance with this Resolution of Intent ion.
SECTION 7: That the Engineer of said District shall cause to be
conspicuously posted along the line of said work and improvement, in
the manner and form required by law, notices of the passage of this
Re sol ut ion.
SECTION 8: That the Secreta.ry of se.id Board shall certifY to the
passage of this Resolution and shall cause the same to be published
twice, as required by law, in the La.fayette Sun, a newspaper published
and circulated within said District and hereby designated for that
purpose by said Board.
SECTION 9: Said District Board does hereby direct its Secretary
to .mail notices of the adoption of this Resolution of Intention to
all persons owning real property proposed to be assessed for the
work herein described, whose names and addresses appeared on the last
equalized assessment roll of the County of Contra Costa or as known

WHEF~AS, a Petition, signed by the owners of real property in
the territory proposed to be annexed to the CENTRAL CONTRA COSTA
SANITARY DISTRICT, which real property represents Seventy-five per
cent (75) of the total assessed valuation of the territory as shown
by the last equali~ed assessment roll of the County of Contra Costa,
was presented to this District Board on the 2nd day of September,
1948, at the hour of 8:00 o'clock p.m. of said day, at the regular
place of meeting of said District board at 1822 Mt. Diablo Boulevard,
in the City of Walnut Creek, County of Contra Costa, State of Calif-
ornia, asking that said territory be annexed to said CEN'rRAL CONTRA
COSl'A SANITA~Y DISTRICT without an election under the provisions of
Article 3, ParI I, of Division 6, of the Health and Safety Code of
the State of California, and an Affidavit of Publication of said
Petition and of a Notice statin~ the time of hearing of said Petition
to be presented to this District Board, was filed at said time and

WHEREAS, said Petition designates specifically the boundaries of
the territory proposed to be annexed and its assessed valuation as
shown by the last equalized assessment roll of the County of Contra
Costa and shows the amount of real property owned by each of the
petitioners and its assessed valuation as shown by the last equalized
assessment roll of said county, and
WHEREAS, said Petition states that the territory is not in any
other Sanita,ry District and that said territory is in the same county
as said CENTRAL CONTRA COSTA SANITARY DISTRICT, is contiguous thereto,

quests that the territory so described be annexed to this District,

WHEREAS, at said hearing no oral protests were made to this Dis-
trict Board against the annexation of said territory to said Sanitary
District, and
WHEREAS, at the time and place fixed in said Notice for said hes.r-
lng, this District Board proceeded to hear said Petition and all persons
therein who appeared, and said hearing was completed at said time and
place, and
WHEREAS, said Petition and said Affidavit show, and after a full
hearing, examination, and investigation this District Board has found
and does hereby find and declare, that said Petition is duly verified
by the Affidavit of one (1) of the petitioners; that said Petition was
duly published for at least two (2) weeks preceding its hearing by
this District Board, together with Notice that said Petition be pre-
sented to this District Board on Thursday, the 2nd day of September,
1948, at the hour of 8:00 o'clock p.m. of said day, in the meeting
room of said District Board, located as hereinbefore described and
that at said time and place all persons interested therein might

NOW, THEREFOaE, BE IT FURTHER RESOLVED AND O~DERED:
1. ~hat upon the final hearing of said Petition and after a
full hearing, investigation, and examination, this District Board
does hereby find and determine that the annexation of the territory
herein described is for the best interests of the District and said
contiguous territory.
2. That upon such final hearing, this District Board does hereby
find and determine that all of the territory described in said Pet-
ition will, in the judgment of this District Board, be benefited by
annexation to said Sanitary District.
3. That the exterior boundaries of the territory so proposed to
be annexed to the CENT~AL CONTRA COSTA SANITARY DISTRIDT and specif-
ically described in said Petition, are hereby fixed and described as
follows:
That parcel of real property in the County of Contra Costa,
State of California, described a8 follows:
Beginning at the point of intersection of the eastern line
of the State Highway between Walnut Creek and Me.rtinez with
the southern line of that certain parcel of land deeded to
Clifford R. and Marion T. Ruscoe, and Clifford M. and Iris
R. Ruscoe, which deed is. of record in Recorder's File No.
44731 in the office of the Recorder of the County of Contra
Costa, State of California, said point of intersection being
on the original and now existing boundary of Central Contra
Costa Sanitary District, and running thence easterly, north-
erly and westerly along the southern, eastern and northern
boundaries of said Ruscoe parcel to the intersection thereof
with the eastern boundary of that certain parcel of land
deeded to George M. and Vera De Groft which deed is of record
in Recorder's File No. 32716 in the office of the Recorder of
the County of Contra Costa, State of Ca.lifornia, and running
thence northerly and westerly along the eastern and northern
boundaries of said De Groft parcel to the intersection thereof
with the eastern line of said State Highway, which point of
intersection is a point in the boundary of said Sanitary
District, and running thence southerly along the boundary of
said Sanitary District to the point of beginning.
4. That the President and Secretary of this District Board be
and they are hereby authorized and directed to execute on the behalf
of this District Board a P~tition to the Board of Supervisors of the
County of Contra Costa setting forth the proceedings heretofore taken
for the annexation of the above-described territory, the findings
of this Board and requesting the Board of Supervisors to annex the
territory to the CENTRAL CONTRA COSTA SANITARY DISTRICT.

RESOLUTION NO. 356
EASEMENT OVER PROPiRTY OF R. A. BURNS.
WHEREAS, the District Board of the CENTRAL CONTRA COSTA SANITARY
DISTRICT has heretofore approved plans and specifications prepared
by its District Engineer for the construction, under the provisions
of the Improvement Act of 19l1, of a collecting lateral sanitary
sewer system in an area in and adjoining Lafayette, County of Contra
Costa, State of California, and more particularly described in Reso-
lution of Intention No. 276, adopted by this Board June 24, 1948,
and proposes to award a contract for the construction of said sanitary
sewer in accordance with said plans and specifications;
~OW, THEREFORE, BE IT RESOLVED and this Boa~d does hereby find
and determine that the public interest, convenience and necessity
require the acquisition, construction and completion by this District
of s~id collecting lateral sanitary sewer system, as set forth in
said plans and specifications and that easement over the real property
hereinafter described is necessary for the constructing, laying and
mE1intaining of a sewer pipe therein in said sanitary sewer system, in
accordance with said plans and specifications. Said easement is more
pertlcularly described as follows:
Perpetual easement for installation of a sewer pipe by trench
excavation together with the right of ingress thereto and egress there-
from over the following described real property located in the County
of Contra. Co sta, State of California, described as follm.¡s:
Portion of Lot 12, as designated on the map entitled "Lafayette
Gardens, Contra Costa County, California", which map was filed
in the office of the Recorder of the County of Contra Costa,
State of California, on November 21, 1941 in Volume 25 of Maps,
at page 859, being a. strip of land 5 feet in width, right angle
measurements, the center line of which is described as follows:
Beginning on the line between ~ 11 and 12, distant thereon
south 15 12' west, 66.35 feet from the southerly line of
Elizabeth Avenue; thence from said point of beginning north
650 30' west, 45.30 feet; thence south 630 471 west, 46 feet
to a poigt on the west line of said Lot 12, distant thereon
north 16 10' 35" west, 82.31 feet from the south line thereof.
BE IT FURTHER RESOLVED that W. H. BRAILSFORD, JR., Attorney for
said District be and he is hereby authorized and directed to commence
and maintain an action and proceeding of Eminent Domain in the Superior
Court of the State of Ca.lifornia in and for the County of Contra Costa,
for the purpose of condemning and acquiring said easement over, upon
and through said hereinabove described parcel of real property for the
uses and purposes aforesaid.
BE IT FURTHER RESOLVED and said Board does hereby find and deter-
mine that the reasonable value of the easement proposed to be taken
is the sum of ONE HUNDRED AND NO/IOOTHS DOLLARS ($100.00) and the
President and Secretary are hereby authorized and directed to execute
a wB.rrant in said sum, pa.yable to the County Clerk of the County of
Contra Costa to be deposited as security to the owners for the value
of the property herein proposed to be condemned.

tary sewer in accordance with said plans and specifications;

Willow Drive and the west terminus thereof being a line drawn
