THE DISTRICT BOARD OF CENTRAL CONTRA
COSTA SANITARY DISTRICT HELD AUGUST
5, 1948
The District Board of the Central Contra Costa Sanitary District
convened in regular session at its regu18r place of meeting located
at 1335 CoIDr:1ercial Lane, in the City of Walnut Creek, County of Contra
Costa, State of California, on the 5th day of August, 1948, at the
hour of 8:00 olclock p.m.
The meeting was called to order by President Weill, and the follow-
ing roll was called:

received from E. C. Cooley Company and Fairbanks Morse Company, and
were referred to the Engineer for recommendation, on motion by Dir-
ector Sm~tten, seconded by Director Wadsworth and carried unanimously.

by the Directors.
Mr. W. E. Berk, representing the Master Plumbers Association
addressed the Boerd with the reQuest that a clause be added to the
ordinFnce restricting the instal~ation of side sewers to Master
Plumbers.

AN OI\DINANCE REGULATING THE INS-;:'ALLATION AND J.lAINTENANCE
OF SEWAGE COLLECTING SYSTENS AND FIXING THE FEE TO BE
CHARGED FOR IIJSP::::CTION AND PROVIDING A PENALTY FOR THE
VIOLATIONS OF THE P?DVISIONS H:=?~°E.~-------------
The District Board of the Central Contra Costa Sanitary District
of Contra Cos:a County, StAte of C~lifornia, toes h~reby regulate
and ordain RS follows:
ARTICLE I
Definitions
Sec. I - For the purpose of this ordinance, tl1e terms used
herein are defined as follows:
Sec. 2 - District is the Central Contra Costa Sanitary Dist-
rict of Contra Costa County, State of California.
Sec. 3 - District Board is the District Boa~d of said District.
Sec. 4 - District Secretary is the Secretary of said Board.
Sec. 5 - District Engineer is the Engineer of said District.
Sec. 6 - County is the County of Contra Costa.
Sec. 7 - Person is any person, firm, company, corporation, or
a.ssociation.
Sec. 8 -
Subdivider is any person, fir'm, coml)any, corpore,tion,
or association engaged in the construction of homes
or other buildings in a subdivision as the same is
defined in Section 11,000 of the Business and Profes-
sions Code of the State of California.
Sec. 9 - Street is B,ny public highway, :coe,d, street, avenue,
alley, way, easement, or right of way.
Sec.lO -
Side Sewer is that part of the sewer piping beginning
at the junction thereof with the house plumbing system
at not closer than two feet outside of the foundation
\.¡all of the building served and terminating in the
main sewer.

Sec.12 - Trunk Sewer is the sewer in the street constructed to
accommodate mo~e than one illRin sewer.
Sec.13 - Main Sewer is the sewer in the street constructed to
accommodate mo~e than one side sewer.
Sec.14 - House Sewer 1s that portion of the side sewer between
the street line and the connection to the house plumb-
ing system.

traps or soil waste, special waste, and vent pipes
and all sanitary sewage pipes within the property lines
of the house prem~ses.

Bec.16 -
A Sewage Collecting System is that system of side
sewers, lsteral sewers and main sewers constructed
by private contractors to provide sewer service for
two or more separate lots or pacels of real property
and to be connected to a trunl~ or main sewer of the
Central Contra Costa Sanitary District.
ARTICLE II
General Provisions
Sec. 1 - The following rules and regulations respecting the con-
struction of a sewage collecting system are hareby
adopted, and all work in respect thereto shall be per-

Sec. 2
- Permit. Any p~rson proposing to construct a sewage
collectin' system shall submit detailed plans covering
the proposed work which plans shall be reviewed for
compliance ¡vi tb this ordincmce and Bppy'oved. by- the
District Engineer before construction shall proceed.
A peDuit will be issued by the District Engineer for
the constx'uction of the "Jerk upon the presentation of
such plene Rfter their approval.
i:iec. 3 -
Penalty. Any person, firm or corporation violating the
provisions of this ordinance shall be deemed guilty of
a misdeameanor and upon conviction thereof, shall be
punished by a fine of not to exceed One Hundred Dollars
($100.00) or by imprisonment in the county jail of
Contra Costa County not to exceed one (1) mGnth, or both.
Sec. 4-
Plumbin~ Inspection. Compensation. The District Board
of said District shall employ some fit and Qualified
person to perform the duties of i~specting all plumb:ng,
sewerage and sanitary dre.inage worl~ and fé1 cili ti es in
said District subject to this ordinance or regulation to
be known as the Sewer Inspector. The person so employed
shall receive as compensation for his services for making
inspections required to be made by the ordinences, and
orders and regulations from time to time enacted and
ordered by the District Board, a sum to be fixed by the
District Board, and he shall serve during the pleasure of
said Board.
Sec. 5 - Sew~r Inspector. Certificate. The testing of plumbing
work must be made in the presence of the Sewer Inspector,
and if the test proves satisfactory he shall issue a
certificate to th~t effeet.
Sec. 6 - Previous Notice. In all cases twenty-four (24) hours
notice must be ~iven an~ filed in the office of Sewer
Inspector when ~he work is sufficiently advanced for
inspection.
Sec. 7 -
Condemned v¡ork. Notice. Vlhen any sewe=..'" has been in-
spected and the 'hTork condemned B.nd no ceI'tificate of
satisfactory completion given, a written notite to that
effect shall be [;1 ven i r.forming tte owner of the p:cemise s,
or the agent of such owner to repair the sewer to place
it in a sanitary condition.
Sec. 8 - Fees.
(a) The following fees shall be paid to said District
for the following:
For issuing permit $1.00
For inspecting a side sewer 3.00

be served.

A fee of Twenty-five Dollars ($25.00) shall
be ua id to the District for the RevieirJ' an(1
approval of plans for a sewage collecting
system.
Right of Entry. The Sewer Inspector shall wear or
carry an official badge of office or other evidence
estab¡ishing his position e.s such, end upon exhibiting
same shall have the right of entry in and upon any ar,d
all buildings and premises within said District for'
the purpose of making inspections, re-inspections,
or otherwise performing such ditues as may be necess-
ary in the enforcement of the provisions of this
ordinnnce.
Responslbili ty for Defects. All pltmÚJers s11pll be l1eld
strictly responsible for any and all acts of &?ents or
employees a.one unë..er ti1Ìs ordin~nce. Upon being not-
ified by the Sewer Inspector of any defect arising
therefrom in any sewer or of any violation of this
ordinance, the person or persons having charge of said
work shall immediately correct the same.
Sec.ll - Anything herein to the contrary notwithstanding, this
regulation and ordinance shall only apply to a sewage
collection system to be installed adjacent to and
connected with the trunk sewer.
Side Sewers
ARTICLE III
Sec. 1 - A side sewer, lateral sewer, house sewer, and main

permit therefor from the District Engineer.
Sec. 2 -
Application. Contents. In the application for a
permit to construct a side sewer, or make a connection
to any collecting sewer, the owner ~f the property, or

Trenches. Trenches for side sewers within public

County of Contra Costa, or any Department, authority
or agency of either having j~risdiction of such street.
Backfilling can only be done after lnsp~ction and
approval,of the work done.

La.terals. Bacl:fill shall be placed and thoroughly com-
pacted under end on each side of the late~al sewer to a
depth of four inches above the pipe. The balance of
the trench shall be immediately backfilled to the surface
of the adjacent ground. Where water is available, the
balance of the backfill may be compacted by flooding;
otherwise, it shall be layed in horizontal layers of one
foot ~nd compacted with a tamper having a cross-uectional
area of tamping foot of not to exceed three inches.
Pa.vement. \^Jl1ere any existing p2vement or surfacing in
any street must be cut fo: the purpose of constructing
any side sewer, the owner or his represe~tative shall
comply with all state and county laws, ordinances and
regulations pertaining to the cutting, opening, replac-
ing and repaving thereof, and shall obtain all permits
and shall pay all fees required by the state or county
or department having jurisdiction thereover. Pavement
shall be restored to the character of improvement
existinG prior to the beginning of ap]Jlicant I s wor~:.

Liability. The District and its officers and employees
shall not be answerable for any liability for injury or
death to any p::"rson or damage to any property arising
during, or growing out of, the performance of Ð.ny work
or the ope::'ation of any facilities provided by any such
applicant. The applicant shall be answerable for, and
shB.II seve the District and its officers and employees
har~less from, any such liability imposed by law upon
the District or its officers or employees, including all
costs, expenses, fees and interest incurred in defending
same or seeking to enfore this provision. Applicant
shall be solely liable for any defects in the perfor-
mance of his work or any failures 't\Thich may develop
the:1."ein.
Sewer Materials. Collecting sewers shall be constructed
of No. I vitrified c18.y sei-Jer pi})? And fittings h;:;ving
an internal diameter of not less than six (6) inches,-
side sewers shall be constructed of No.1 vitrified
sewer pipe and fitti~gs hAving an internal diam.eter of
not less tlJan four (4) inches or r2aterie.l of equal
Quality or of standard weight cast iron pipe having an
intern::Ù ò.iame-ter of not less than four (4) inches. All
joints in sewer' pipe and fittings shall be mA.de tight
against lea.1cage and/or ground water infiltration by the
use of caulked Portland cement or other suitable joint-
ing rlpterie.ls.
Depth And Level of Side Sewer. Unless it is impossible
to do so by reason of the conformation of the ground,
side sewers shall have a depth at the propErty line of
not less than three (3) feet between the top of the pipe
B.nd the gr' und surface, and shall hp-.ve a uniform slope
toward the collecting sewer of not less than one-eighth
(1/8) inch vertical to one (1) foot horizontal.

Inspection. The fact of completion and readiness for
inspection shall also be reported to the Sewer Inspec-
tor. In no case shall the sewer be rovered at eny point,
within or without the property lines, until the sane
has been inspected and accepted.

Improvement Club, requested information from thE Board as to when
lateral sewe~s would be available in that area. The residents are
anxious to expedite the work and as~ed if there was any way they could
have the sewers ins~alled privetely. The Board instructed to Engineer
to prepare plans and advised Mr. Rein that sewers would be installed as
