HomeMy WebLinkAboutBOARD MINUTES 07-01-48 24 MINUTES OF THE REGUL.~ MEETING OF THE DISTRICT BOARD OF CENTRAL CONTRA COSTA SANITARY DISTRICT HELD ON JULY 1. 1948 The District Board of the Central Contra Costa Sanitary District convened in regular session at its regular place of meeting located at 1335 Commercial Lane, in the City of Walnut Creek, County of Contra Costa, State of California, on the 1st day of July, 1948, at the hour of 8:00 o'clock p.m. The meeting was called to order by President Weill. ing roll was called: The follow- PRESENT: Directors Toland, Wadsworth and Weill Directors Johnson and Smitten. ABSENT: SECRETARY PRO TEM It was moved by Director Wadsworth, seconded by Director Toland that Mrs. Phillips be appointed Secretary Pro Tern in the absence of Secretary Cutler. Carried by the following vote: AYES: Directors Toland, Wadsworth and Weill NOES: None ABSENT: Directors Johnson and Smitten. READING OF MINUTES OF PREVIOUS MEETING It waS moved by Director Wadsworth, seconded by Director Toland that the reading of Minutes of the previous meeting be waived, and be approved as entered and approved by the Attorney. AYES: Directors Toland, Wadsworth and Weill NOES: None ABSENT: Directors Johnson and Smitten DEEDS OF DEDICATION The following resolutions accepting deeds of dedication for sewer easements were offered by Director Wadsworth, seconded by Director Toland: RESOLUTION NO. 278 WHEREAS, CLYDE T. JOHNSON and EDITH R. The bids were referred to the Engineer for tabulation and recommendation. THEREFORE, BE IT RESOLVED by the District Board of the Central Contra Costa Sanitary District, Contra Costa County, State of Calif- ornia, that it is hereby found that such necessity for the construc- tion of a sanitary sewer system in the above described area does ex- ist, and hereby orders that proceedings be prepared for adoption by this Board for the construction of such sewers as recommended by the Health Officer, said proceedings to be as provided in Division 7 of the Street and Highway Code of the State of California, the IIImprove- ment Act of 191111, with bonds to be issued to represent unpaid assess- ments as provided therein. The following resolution was offered by Director Wadsworth, seconded by Director Toland: RESOLUTION NO. 287 RESOLUTION OF AWARD RESOLVED, that the District Board of Central Contra Costa Sanitary District, Contra Costa County, State of California, having in open session on the 1st day of July, 1948, opened, examined and publicly declared all sealed proposals or bids offered for doing the work here- inafter mentioned; HEREBY rejects a¡l of said BIDS except that hereinafter mentioned, and hereby AWARDS the Contract to the lowest, regular responsible BIDDER, to-wit: To STOLTE, INC., at the prices specified in their proposal for doing said work now on file. 07 01 48 . 32 The work herein referred to is the construction of sanitary sewers and appurtenances for that area, and to the extent, with the materials and in the manner, set forth in Resolution of Intention No. 210, adopted by said District Board on the 6th day of May, 1948, reference to which said Resolution of Intention is hereby made for a description of said work and improvement, and the terms and conditions under which the same is to be done. The Secretary of said District Board is hereby directed to pub- lish notice of this AWARD, twice in the Walnut Kernel, a weekly newspaper published and circulated in said Sanitary District as required by law. CONDEMNATION PROCEEDINGS The following resolutions were offered by Director Toland, sec- onded by Director Wadsworth: RESOLUTION NO. 288 (Easement over property of W. Lawrence Shaw and Ida Noble Shaw) WHEREAS, the District Board of the CENTRAL CONTRA COSTA SANITARY DISTRICT has heretofore approved plans a,nd specifications prepared by its District Engineer for the construction, under the provisions of the Improvement Act of 1911, of a collecting lateral sanitary sewer system in an area in and adjoining the City of Walnut Creek, County of Contra Costa, State of California, and more particularly described in Resolution of Intention No. 210, adopted by this Board May 6, 1948, and proposes to award a contract for the construction of said sani- ta,ry sewer in accordance with said plans and specifications; NO:l, THEREFORE, BE IT RESOLVED and this Board does hereby find and determine that the public interest, con venience and necessity require the acquisition, construction and completion by this District of said collecting lateral sanitary sewer system, as set forth in said plans and specifications and that easement over the real property ~O 7 01 48 ;{~~ hereinafter described is necessary for the constructing, laying and maintaining of a sewer pipe therein in said sanitary sewer system, in accordance with said plans and specifications.
