MINUTES OF AN ADJOURNED REGULAR MEETING OF
THE DISTRICT BOARD OF CENTRAL CONTRA COSTA
SANITARY DISTRICT HELD ON JUNE 23 J 1949
The District Board of Central Contra Costa Sanitary District
convened in adjourned regular session at its regular place of meet-
ing located at 1822 Mt. Diablo Boulevard, in the City of Walnut
Creek, County of Contra Costa~ State of California, on June 23, 1949,
at the hour of 8:00 o'clock p.m.
The meeting was called to order by President Wadsworth, and the
following roll was called:

The Minutes of the previous meeting were read by Secretary Corn-
wall, and were approved as entered.
PAYMENT OF CONNECTION FEE FOR MONTECITO
SCHOOL IN LAFAYETTE
Member Johnson, seconded b~ Member Toland, moved that the Board
extend time of payment of the $550 connection fee for the Montecito
School in Lafayette until the School District receives their tax
money subsequent to October 15, 1949. Carried by the following vote:

The Engineer advised the Board that the change would add to the
cost, and the Board denied the request.

of the following resolution:

FINDING OF NECESSITY FOR CONSTRUCTION OF SANITARY SEWERS
AND DIRECTING DISTRICT ENGINEER TO PREPARE PLANS AND
SPECIFICATIONS, LOCAL IMPROVE~lliNT DISTRICT NO. 14
WHEREAS the County Health Officer has filed with this District
Board a report stating that the conditions in the hereinafter
described area in Central Contra Costa Sanitary District, in the
County of Contra Costa, are unsanitary, unhealthful and dangerous
to the health of the people living therein, and recommending as
necessary as a health measure that the District Board institute
proceedings at an early date for the construction of a sanitary
sewer system to abate such unsanitary conditions, said area being
bounded and described as follows:

THEREFORE, BE IT RESOLVED by the District Board of Central
Contra Costa Sanitary Dist~lct, County of Contra Costa, State of
California, that it is hereby found that the construction of a
sanitary sewer system for the abae described area as necessary as
a health measure does exist, and hereby orders that proceedings
be instituted and appropriate resolutions be prepared for adoption
by this Board for the construction of such sewers, as recommended
by the Health Officer, said proceedings to be as prOVided in Div-
ision 7 of the Streets and Highways Code of the State of California,
the "Improvement Act of 1911, n with bonds to be issued to represent
unpaid assessments as provided therein; said area for which such
sewers are to be constructed to be known as Local Improvement
District No. 14.
BE IT FURTHER RESOLVED that the report and recommendation of
the Health Officer is hereby ordered spread upon the Minutes of
this meeting.
BE IT FURTHER RESOLVED that the District Engineer is hereby
directed to prepare and submit to this Board maps, diagrams, plans
and specifications, together with a careful estimate of the cost
and expense of constructing a sanitary sewer system for said Local
Improvement District No. 14.

District of Contra Costa County, State of California, that the Plans
and Specifications submitted by the District Engineer providing for
cqnstructing a sanitary sewer system for Local Impro~emant District
No. 14, the area within the following described boundaries, viz:
The area within the boundaries set forth in Resolution No. 467 of
said District Board passed and adopted the 23rd day of June, 1949,
finding necessity for construction of such sanitary sewers and
directing District Engineer to prepare plans and specifications.
in said Central Contra Costa Sanitary District, be and the same are
hereby approved and adopted; and
BE IT FURTHER RESOLVED that the grades as shown on said Plans
be and the same are hereby adopted as the official grades.

Member Johnson, seconded by Member Toland, moved the adoption
of the following resolution:
RESOLUTION NO. 469
RESOLVED by the District Board of Central Contra Oosta Sanitary
District, Contra Costa County, State of California, that the Assess-
ment District Map submitted by the Engineer, which indicates by a .
boundary line the extent of the territory included in the District
proposed to be.assessed for constructing a sanitary sewer system
for Local Improvement District No. 14, the area within the following
described boundaries, viz:
The area within the boundaries set forth in Resolution No. 467 of
said District Board passed and adopted the 23rd day of June, 1949,
finding necessity for construction of such sanitary sewers and

District recorded in Volume l193 of Official RecordS, page 40.
GLORIETTA BOULEVARD from point thereon 890 feet northeasterly
from its intersection wi~h Moraga Highway to M.H. 90 to be located
in said Boulevard 1250 feet northeasterly from said intersection.
The expense of said work and improvement hereinabove described
in Section 1, Second, hereof, and on Sheets 1 and 6, shall also be
chargeable upon said assessment district hereinafter established.
THIRD: The office of the Recorder referred to hereinabove is
the of~ice of the Recorder of the County of Oontra Costa, State of
California, and Official Records and file numbers hereinabove re-
ferred to are Official Records and file numbers of said Recorder.
The letters M.H. and F.I. herein used refer to and mean Manhole and
Fl~shing Inlet, respectively.
In the foregoing description, wherever right of way, easement,
street, or other public way is describe~ wherein work is to be done,
it is the intention that said work shall also pe extended so as to
connect the same with existing sewers or with the sewer work ~o be
constructed nearest to said right of way, easement, street or other
public way, and at the point where a manhole, flushing inlet, or
other construction is shown on said Plans therefor, unless otherwise
shown thereon.
In the foregoing descriptions, the width of all easements de-
scribed by reference to a center line is measured at right angles.
FOURTH: Said work shall include the refilling, compacting and
resurfacing of the trench in which said, sewer and appurtenances are
constructed.
SECTION 2. All of said improvements and work Shall be done of
the sizes, dimensions, and materials and in the positions and loca-
tions as shown upon, and all in acoordance with, the Plans and Spec-
ifications therefor heretofore adopted by said District Board and
now on file with the Secretary of said Board, which said Plans and
Specifications are hereby referred to and made a part hereof by
reference.

SECTION 3. That in the opinion of said Board, said work is of
more than local or ordinary public benefit, and said Board hereby
orders that the cost and expenses of said work and improvement shall
be chargeable and charged upon a district, which district is hereby
declared to be the district benefited by said work and improvement
and which is to be assessed to pay the cost and expenses thereof.
The exterior boundaries of said assessment district and the ex-
tent of the territory included therein are shown ~pon the map of
said district approved and adopted by said Board on the 23rd day
of June, 1949, and now on file in the office of the Secretary of
said Board, to which map reference is hereby made for a particular
description of said boundaries and the extent of said territory
included therein to be so assessed; saving and excepting therefrom
the area of all public streets and other public ways included
therein.
There Shall be paid out of the treasury of said Sanitary Dist-
rict and from the Sewer Construction Fund therein, the sum of
$25,000.00 toward the cost and expense of any and all of said work
and improvement.
SECTION 4: That the prooeedings for said work and improvement
shall be had and taken under and in accordance with Division 7 of
the Streets and Highways Code of the State of California. ( II Improve-
ment Act of 19l1").
NOTICE IS HEREBY GIVEN that the Health Officer of said County
of Cont.ra Costa has recommended. in wr.iting to said Board that said
proceedings for said work be instituted as a necessary health meas-
ure and said Board heretofore ordered said recommendation spread
upon the Mtnutes of said Board and by Resolution adopted by the
affirmative vote of four-fifths of the members of said Board found
and determined that. such necessity exists.
SECTION 5: That serial bonds shall be issued pursuant to Part
5 of Division 7 of said Streets and Highways Code (Improvement Act
of 1911) to represent the unpaid assessments of Twenty-five Dollars
($25.00) or over for the cost of said work, said bonds to bear
interest at the rate of SIX PER CENT (6%) per annum, to extend for
a period of nine (9) years from the second day of January next
succeeding the next October l5th following their date, and to be
payable in annual installments, the last installment thereof to
mB_ture nine (9) years from the second day of JanuB~Y next succeed-
ing the next l5th day of October following their date, said bonds
and the interest thereon to be payable as provided in said Code.
SECTION 6: That Thursday, the 14th day of July, 1949 , at the
hour of 8:00 o'Clock. p.m., of said day, and the meeting place of
said Board! l822 Mt. Diablo Boulevard, City of Walnut Creek, in the
County of uontra Costa, State of California, be and the same are
hereby fixed as the time and place, when and where any and all
persons having any objection to the proposed work and improvement
or to the extent of the district to be assessed, or both, may appear
before said Board and show cause why said proposed work should not
be carried out in accordance with this Resolution of Intention.
SECTION 7: That the Engineer of said District shall cause to
be con~icuously posted along the line of said work and improve-
ment, in the manner and form required by law, notices of the
passage of this Resolution.
SECTION 8: That the Secretary of said Board shall certify to
the passage of this Resolution and shall cause the same to be
published twice, as required by law, in the Courier-Journal, a
newspaper published and circulated within said District and hereby
designated for that purpose by said Board.

NOTICE IS ALSO HEREBY GIVEN BIDDERS that it Shall be mandatory
upon the contractor to whom the contract is a~arded, and upon all
subcontractors under him, to pay not less than said general prevail-
ing rates of per diem wages, as above listed, to all laborers, work-
men, and mechanics employed in the execution of the contract.
Before submitting proposals, the bidder shall be licensed in
aooordance with the ~visions of Chapter 9, Division III, of the
Business and Professions Code, Chapter 37 of the Statutes of 1939,
as amended, of the State of.California, which provides for the regis-
tration and'licensing of contractors.
Each bidder must submit with his proposal a statement of his
financial responsibility, technical ability and experience 'on the
form to be furnished prospective bidders, and a state~ent as to
whether the b1dder is an individual, .a partnership, a Joint venture,
or a corporation.
Each bidder shall submit with his bid, on the form provided, the
name anft address of each suboontractor, including the principal
suppliers of materials, and the portion of the work which each sub-
contractor will do. If the contractor fails to name thesubcont~actors

Member Toland reque sted further information for Mr. ':"~.erry
regard1ng the $200 connection fee granted by motion of the Board
at the Meeting of May 12, 1949. Mr. Perry was under the 1Dpres-
s10n that the $200 fee would exclude all of his property from
future assessments. It was explained to Mr. Perry that such
would not be the case, but that the property would be sUbJect
to assessment in accordance with benefit. received by future sewer
constructio~ and that the $200 fee applied only to the existing
residence on the property.
HEARING PROTESTS AGAINST ASSESSMENTS IN
LOCAL IMPROVEMENT DISTRICT NO. II
The Secretary read protest letters from Edward G. Weiss and
Frederick K. Beeson. Both protests were against the amount of
assessment, as being too high in comparison with the other assess-
ments.
After a lengthy discussion, and an explanation by the Engineer,
the President continued the hearing of further protests until the
~eeting of July 7. 1949.
AUTHORIZING ANNUAL AUDIT OF DISTRICT BOOKS
It was moved by Member Weill, seconded by 'Member Toland that
the Board engage the services of Mr. Eldo Ewert, CPA, to make an
annual audit of the District's accounts for the fiscal year to
June 30, 1949 at a cost of $120.00, with a complete financial
report furnished at additional cost of 830.00. Carried by the

recommended aoceptance o~ the work.
A Complaint was filed with the Board by Glenn T. and Lois C.
Gleason, Claiming damages, and requesting that the Board withhold
further payment to Stockton Construotion Company until reparation
had been made.
The Board instructed the ~ngineer to investigate, and withheld
acceptance of the contract until advised further by the Engineer.
EMPLOYMENT OF H. B. MUNGER. JR.
The Manager requested approval by the Board for the employment
of H. B. Munger, Jr., as Assistant Sewer Inspector at a salary of
$400 per month to be increased to $425. after a period of 90 days
if his serv1ces are satisfactory. The Chairman adv1sed the Manager
that he had prev10us authorization to employ the necessary personnel.

ACCEPTANCE OF FINAL REPAVING OF ROADS
LOCAL IMPROVEMENT DISTRICT NO. 2
The District Engineer, by letter of June 23, 1949, informed
the Board that inspection of the area in Looal Improvement Dist-
rict No.2, in which sewer had been installed under cont~act by
Stolte, Inc., had be~n made, and that the roads and streets.had
been repaired in accordanoe with specifications, and recommended
that the deposit of $25,000 made by Stolte, Inc. be returned.
The Manager informed the Board that the area had been in-
spected by Mr. George Berry, and Mr.. Sid Smith of the County
Surveyor's Office, and himselfL .between the hours of 10:00 and
ll:30 A.M., June 23. Messrs. ~erry and Smith stated that they
considered that the contractor had done all work required of him
in the restoration of trench cuts and paving disturbed in the
construction operations.
It was moved by Member Toland, seconded by Member Weill that
the Board aooept the repaving work in Local Improvement District
No. 2,and authorize the release to Stolte, Inc. of the $2.5,000

Mr. O. T. Brown requested the Board t.o again consider consent

The Manager was instructea to notify the owners that the annex-

A GENERAL REGULATION AND ORDINANCE AMENDING REGULATION
AND ORDINANCE NO.3, BEING AN ORDINANCE REGULATING THE
INSTALLATION AND MAINTENANCE OF SEWAGE COLLECTING SYS-
TEMS AND FIXING THE FEE TO BE CHARGED FOR INSPECTION
AND PROVIDING A PENALTY FOR THE VIOLATION OF THE PRO-
VISIONS THEREOF AND PROVIDING FOR THE PAYMENT OF A
CONNECTION FEE AND THE DEPOSIT OF A PERFORMANCE BOND
The District Board of Central Contra Costa Sanitary District
of Contra Costa County, State of California, does hereby regulate
and ordain as f~llows:
SEOTION I
Section 8 of Article II of General Regulation and Ordinance
No. ) is hereby amended to read as fol~ows:
Sec. 8 - Fees.
(a) The following fees shall be paid to said District for
the following:

ings and the area to be serv.ed by the proposed system
lies entirely outside the boundaries of such improvement
district~ a connection fee shall b.e p.aid before a
permit shall be issued therefor. The amount of such
fee shall be fixed in each case by the Distric.t Board.
SECTION II
Section l5 is hereby added to Article III of Regulation and
Ordinance No. ), reading as follows:
Sec. 15 - Performance Bond or Cash Deposit. Before any permit
shall issue authorizing the construction of a sewage
collecting system as herein defined, a surety bond. or
cash in 'lieu thereof shall be depOSited with the District
guaranteeing the construction of such sewers as to work-
manship and materials for one year atter its completion
and acoeptance, said bond or cash deposit to be in an
amount equal to ten per cent (10%) of the construction
cost of such sewer, but in no event to be less than the
sum ~f Five Hundred and No/lOOths Dollars ($SOO.OO).
SECTION III
This Ordinance shall be entered in the Minutes of the District
Board, Shall be published once in tbe Lafayette Sun, a newspaper
published in said District, and Shall take effeot upon .the expira-
tion of the week of such publication.

WHEREAS, subsequently the Central Contra Costa Sanitary District
changed the location of the sewer line, and has no need for the
easement,
