MINUTES OF A SPECIAL MEETING OF THE
DISTRICT BOARD OF CENTRAL CONTRA COSTA
SANITARY DISTRICT HELD ON MAY 26~ 1949
The District Board of Central Contra Costa Sanitary District
convened in special session at its regular place of meeting located
a.t 1822 Mt. Diablo Boulevard, in the City of Walnut Creek, County of
Contra Costa, State of California, on May 26,1949 at the hour of 8:00
o'clock p.m.
Member Johnson announced that President Wadsworth had notified
him that he would be late, and suggested that the meeting proceed
with a President Pro Tem.
It was moved by Member Johnson, seconded
by Member Smitten that Memb~r Toland act as President Pro Tem.
Member Toland called the meeting to order and the following roll
was called:

It was moved by Member Smitten, seconded by Memb~r Johnson that
the Board waive reading of Minutes of the previous meeting, and
that they be approved as entered. Carried by the following vote:

HEARING PROTESTS AGAINST WORK OF
LOCAL IMPROVEMENT DISTRICT NO.8
Five written protests against the work of Looa1 Improvement
District No.8. Secretary Cornwall read a protest from Willard S.
and Sybil B. Johnson.
Mr. Johnson requested information as to distribution .of cost to
property owners. Mr. Harrison waS requested by Member Toland to
explain the procedure to Mr. Johnson.
At this point the hearing waS interrupted by Mr. Charles X.
Schmidt, who requested to be heard regarding an additional $220
which had been added to his first notice of aSsessment in Local
Improvement District No.2.
President Wadsworth arrived at 8:15 p.m.
President Wadsworth advised Mr. Schmidt that he was out of order,
and would be heard a.t a later hour, after the hearing of Local No.8.
Mr. W. S. Johnson stated that he was ~ot opposed to the work,
and if this waS not the time to protest against the cost or fairness
of distribution, he would withdraw his protest.
Hr. Hay.rlson advi sed r4r. Johnson that this was the time to pro-
test against the work, that protests would be received at a later
date against the assessments. Mr. Johnson withdrew his protest.

ignated for that purpose.
All such proposals or bids shall be submitted., received, and
publicly opened, examined and declared, and shall be accompanied by
a certified check or bond, all as stated in said Notice to Bidders,
which Notice shall be as follows:
NOTICE TO BIDDERS
Pursuant to law and Resolution No. 459 of the District Board of
Central Contra Costa Sanitary District of Contra Costa County, State
of California, passed and adopted May 26, 1949, Ordermg Work, Deter-
mining Prevail~ng Rates of Wages, and Directing this Notice, said
District Board invites sea.led proposals or bids for the following
work to be done, to-wit: The construction of sanitary set<lers and
appurtenances for the area, to the extent, with the materials and
in the manner set forth in Resolution of Intention No. 453 passed
and adopted by said District Board May 5, 1949, and in accorëance
with Plans and Specifications adopted ther~for, to which Resolution
of Intention, Plans and Specifications, and Resolution Ordering Work
reference is hereby made for a description of said work and improve-
ment and the terms and conditions under which the same is to be done.
The Plans and Specifications for the proposed work may be seen
and examined at the office of Central Contra Costa Sanitary District,
1822 Mt. Diablo Boulevard, Walnut Creek, California, or at the
Engineering Office of Clyde C. Kennedy, Room 504, 604 Mission Street,
San Francisco, California, or may be secured at the Engineering
Office of Clyde C. Kennedy by making a payment of Twenty nd No/lOoths
Dollars ($20.00). There will be no refund on returned Plans or Spec-
ifications.

Overtime and Saturday work shall be paid for at double the normal
hourly rate except as noted below for Cement Finishers and Truck
Drivers, and work on Sundays and Holidays shall be paid for at double
the normal hourly rate.
The foregoing schedule of prevailing rates of wages,and rates for
overtime, Sunday and Legal Holidays, is based, unless otherwise spec-
ified, upon a working day of eight (8) hours.
Overtime and Saturday rates for Truck Drivers shall be at one and
one-half (It) times the normal hourly rate.
The first two hours overtime, after a normal eight (8) hour day,
for Cement Finishers shall be at one and one-half (It) times the normal
rate and further overtime shall be at double the normal rate. Saturday
work for Cement Finishers shall be at one and one-half (It) times the
normal rate for the first eight (8) hours worked and at double the
normal rate for all further time worked on Saturdays.
NOTICE IS ALSO HEREBY GIVEN BIDDERS that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all sub-
contractors under him, to pay not less than.said general prevailing
rAtes of per diem wages, as above listed, to all laborers, workmen,
and mechanics employed in the execution of the contract.
Before submitting proposals, the bidder shall be licensed in
accordance with the provisions of Chapter 9, Division III, of the
Business and Professions Code, Chapter 37 of the Statutes of 1939, as
amended, of the State of California, which provides for the registration
and licensin~ of contractors.
Each bidder must submit with bis proposal a statement of his
financial responsibility, technical ability and experience on the
form to be furnished prospective bidders, and a statement as to
whether the bidder is an individual, a partnership, a joint venture,
or a corporation.
Eacb bidder shall submit with his bid, on the form provided, the
name and address of each subcontractor, including the principal
suppliers of materials, and the portion of the work which each sub-
contractor will do. If the contractor fails to name the subcontractors
in his proposal, he shall be deemed to have agreed to perform such
portion of the work himself and shall not be permitted to subcontract
said portion of work without previous written permission of the
Sanitary District Board.
ALL PROPOSALS or BIDS must be delivered to the undersigned Sec-
retary of said District Board at its office at 1822 Mt. Diablo Boule-
vard, Walnut Creek, California, on the 23rd day of June, 1949, up to
the hour of 8:00 0 clock p.m., on which day at the hour of 8:15 o'clock
p.m., in said office of said District Board said proposals or bids
shall be publicly opened, examined and declared, and each proposal or
bid must be accompanied by a check certified without qualification by
a responsible bank, payable to Central Con~ra Costa Sanitary District
for an amount not less than TEN PER CENT (lot> of the aggregate of the
proposal or by a bond for said amount and so payable signed by the
Bidder and two Sureties, all as prescribed by law.

AWARD OF CONTRACT FOR CONSTRUCTION OF
LOCAL IMPROVEMENT DISTRICT NO. 12
The District Engineer recommended award of contract to Stolte,
Inc., as the lowest responsible bidder. Member Smitten, seconded by
Member Weill moved the adoption of the following resolution:
RESOLUTION NO. 460
RESOLVED that the District Board of Central Contra Costa Sanitary
District, Contra Costa County, State of California, having in open
session on the 26th day of May, 1949, opened, exænined and publìcly
declared all sealed proposals or bids offered for doing the work here-
inafter mentioned;
HEREBY rejects all of said Bids except that hereinafter mentioned,
and hereby AWARDS the Contract to the lowest, regular responsible
bidder, towit:
To STOLTE, INC., at the prices specified in their proposal for
doing said work now on file.
The work herein referred to is the construction of sanitary sewers
and appurtenances for that area, and to the extent, with the materials
and in the manner, set forth in Resolution of Intention No. 439,
adopted by said District Board on the 7th day of April, 1949, reference
to which said Resolution of Intention is hereby made for a description
of said work and improvement, and the terms and conditions under which
the same is to be done.
The Secretary of said District Board is hereby directed to publish
notice of this AWARD, twice in the Courier Journal, a weekly newspaper
published and circulated in said Sanitary District, as required by

REQUEST FOR PURCHASE OF TWO ADDITIONAL
PICKUP TRUCKS
The President instructed the Manager to secure prices on 1/2
ton pickup trucks, and submit them to the Board for consideration.
DISTRICT CONTRIBUTION TO LOCAL
L~PROVEMENT DISTRICT NO. 16 SOUTH
OF WALNUT CREEK
It was moved by Memb9r Johnson, that the District contribute
an amount of $2500 toward the cost of construction of Local Improve-
ment District No. 16 if that was the Engineer's recommendation. The
motion was seconded by Member Toland, and carried unanimously.
ASSIGNMENT OF FINAL PAYMENT FOR SECTION V

It waS moved by Member Toland, seconded by Member Smitten and

una.nimously carried, that the Board a.pprove the assignment by lire
Floyd Martin, dba Martin Bros., of the final payment on Main Trunk
Sewer Section V to Bank of America National Trust and Savings Assoc-
iation. Said assignment is dated May 17, 1949.
VACATION ALLOHANCES
Member Johnson, seconded by Member Smitten, moved the adoption
of the following resolution:

REGULATIONS RELATIVE TO VACATIONS
AND SICK LEAVE
BE IT RESOLVED that the following regulations shall apply to the
granting of vacations and sick le~ve to employees of the Central Contra
Costa Sanitary District:
I.
Vacations.
All employees of the District whose salary is paid monthly and
who have been continuously employed by the District for at least six
(6) months shall be entitled to annual .acations with pay as follows:
(1 )
Fifteen (15) calendar days after the first six (6) months
of continuous service.
(2)
Thereafter, each such employee shall be entitled to fifteen
(15) calendar days vacation leave for each year of continuous
service.
(3)
Vacation leave may be accumulated at the rate of one and
one-fourth (1~1/4) calendar days for each completed calendar
month of service, excluding the first six (6) months, subject
to the following conditions:
( e.)
No employee shall be entitled to such vacation leave
or receive compensation therefor until he .has com-
pleted six (6) months of continuous service with the
District.
(b)
No accrual of vacation leave shall be permitted in
excess of thirty (30) calendar days.

Sick Leave
All employees of the District shall be entitled to sick leave
with pay as follows:
(1)
One working day's sick leave with pay for each calendar
month of continuous service.
(2)
In the event an employ~e does not use the full amount of
sick leave allowed in any calendar year, the amount not
taken may be accumulated from year to year to a total not
exceeding sixty (60) calendar days;
Cqmpensation for days off due to illness of the ,employee shall
be pai~ on the following conditions:
(1 )
For two (2) successive days or less, upon the sta.tement
of the employee that his absence waS due to his illness.
For more than two (2) successive days, upon the written
certification of a physician that the absence of the
employee was due to his illness.

PARTICIPATION IN COST OF REPAIRS TO
HILLSIDE AVENUE SEIER IN WALNUT CREEK
Mr. John Nejedly, Attorney fœthe City of Walnut Creek, again
appealed to the Board for the District's participation in the cost
of repairs to the Hillside sewer in the City of Walnut Creek.
It was moved by Member Smitten, seconded by Memb7r Johnson and
unanimously carried that the Sanitary District assume the amount of
$2512.13 in favor of the City of Waln~t Creek, providing that no
further claims will be made by the City for repairs to sewers prior
to the agreement between the District and the City for maintenance
of sewers,(inasmuch as the Sanitary District is legally bound to pay

It was moved by Member Smitten, seconded by Member Toland that
the Board authorize the District Engineer to enter in the records
of Local Improvement District No.2 the assignment of Werrant from
Stolte, Inc., to Stone and Youngberg, and the assignment of Warrant
from Stone and Youngberg to Bank of America. Carried unanimously.

NOTICE OF FILING ASSESSMENT AND OF .
TIME FIXED FOR HEARING APPEALS ON LOCAL
I~œROVEMENT DISTRICT NO. 11
NOTICE IS HEREBY GIVEN that the Assessment, together with a
Diagram and Engineer's Certificate attached thereto, in the matter of
the work and improvement, to-wit: The construction of sanitary sewers
and appurtenances in Local Improvement District No. 11 in Central
Contra Costa Sanitary District of Contra Costa County, State of Cal-
ifornia, was filed with the Secretary of the District Board of said
Sanitary District, and in the office thereof at 1822 Mt. Diablo.
Boulevard, City of Walnut Creek, in said County, on May 26, 1949.
NOTICE IS HEREBY FURTHER GIVEN. that the owners, the contractor,
or his assigns and all other persons interested in said work or in
said Assessment, feeling aggrieved by any act or determination of the
District Engineer in relation thereto, or who claim that the work has
not been performed according to the contract in a good and substantial
manner, or who claim that any portion of the work for any reason was
omitted or illegally included in the contract for the same, or having
or making any objection to the correctness of the Assessment or Diagram,
or other act, determination or proceedings of said District Engineer,
may, prior to the date hereinafter fixed for hearing, appeal to said
District Board by briefly stating in writing the grounds of appeal.
And the 23rd day of June, 1949, at 8:00 o'clock p.m., on said day,
and the meeting place of said District Board at 1822 Mt. Diablo Boule-
vard, in said City of Walnut Creek, have been fixed as the time and
place when and where any and all persons interested in said work or
Assessment may appear before said District Board and be heard by said
District Board upon such appeal, and show cause, if any they have, why
said Assessment should not be confirmed.
Reference is hereby made to Resolution of Intention No. 371
adopted by said District Board on the 23rd day of September, 1949,
under which said work was done, for a description of said work.

PAYMENT OF INCIDE~~AL EXPENSES FOR
LOCAL IMPROVEMENT DISTRICT NO. 10
It was moved by Member Johnson, seconded by Member Smitten, and
unanimously carried, that upon receipt of $27,872.88 from Clyde C.
Kennedy, said sum representing the incidental expenses incurred to
date on Local Improvement District No. 10, and which is to be advanced
by the successful bidder, Associated Electrical and Mechanical Company,
before execution of the contract with Associated Electrioal and Mech--
anical Company for doing the work authorized in LocB.l Improvement
District No. 10, the following aIT!ounts be disbursed from said sum for
such incidental expenses, as follows:
$11,863.90 to CLYDE C. KENNEDY for engneering services rendered
to date for Local Improvement District No. 10.
$ 1,694.84 for legal services rendered to date for Local Im-
provement District No. la, to be paid pursuant to
contract therefor, as follows:

expenses to be deposited to the credit of the

Sanitary District to reimburse said Fund for monies

Mr. Schmidt felt aggrieved due to the fact that be had received
notice of hearing of the Assessment for Local Improvement District,
which notice advised him that an amount of $350 had been assessed
against his property. Mr. Schmidt advised that he had been satisfied
with the amount, therefore had no protest. Later he received a bill
in the amount of $570, and felt that he should not have to pay it.
Mr. Harrison explained the reason to Ivlr. Schmidt; changes approved
at the hearing, and the reapportionment of the cost.
ADJOURNMENT
It was moved by Member Johnson, seconded by Member Toland and
unanimously carried that the meeting adjourn to June 2, 1949 at the
hour of 8:00 o'clock p.m.
