HomeMy WebLinkAboutBOARD MINUTES 05-05-49 157 MINUTES OF A MEETING ADJOURNED FROM APRIL 28, 1949 TO MAY 5, 1949, OF THE DISTRICT BOARD OF CENTRAL CONTRA COSTA SANITARY DISTRICT The District Board of the Central Contra Costa Sanitary District convened in special session at ita regular place of meeting located at 1822 Mt. Diablo Boulevard, in the City of Walnut Creek, County of Contra Costa, State of California, on May 5, 1949, at the hour of 8:00 o'clock p.m. The meeting was called to order by President Wadsworth, and the following roll was called: PRESENT: Members Johnson, Smitten, Toland, Weill and Wadsworth. Serpa; John Slater. 05 05 49 158 Subsequent to April 28,1949, letters were received from John P. Jensen, C. W. Murray, and Guy L. Putnam. The Secretary asked the Chairman if the Board desired to have them read. Member Smitten moved that inasmuch as the letters were not in at the specified time they be rejected. There was no protest against the motion. CONFIRMING PROCEEDINGS AND ASSESSMENT LOCAL IMPROVEMENT DISTRICT NO.2 Member Smitten, seconded by Member Toland, moved the adoption of the following resolution: RESOLUTION NO. 448 WHEREAS the Distriot Engineer of Central Contra Costa Sanitary Distridt of Contra Costa County, State of California, filed with the Secretary of said District, on M,rch 31,1949, as Assessment, together with a Diagram and Engineer s Certificate attached thereto, to represent the costs and expenses of constructing sanitary sewers and appurtenances pursuant to Resolution of Intention No. 210, adopted by the District Board of said Sanitary Distriot on May 6, 1948, and in that portion of said District described therein as Local Improvement Distriot No.2, to which Resolution of Intention reference is hereby made for a description of said work and improve- ment and the district to be assessed for the costs and expenses thereof, and for all other purposes; and WHEREAS said Secretary gave due notice, as required by law, of the filing of said Assessment, and that Thursday, the 28th day of April, 1949, at 8:00 o'clook, p.m., on said day, and the meeting place of said District Board at 1822 Mt. Diablo Boulevard, in the City of Walnut Creek in said County, had been duly fixed as the time and place for the hearing on said Assessment; and WHEREAS said District Board held such hearing at the time and place so fixed therefor, and then and there, and at a continuance of said hearing, regularly had, -received evidence, oral and docu- mentary upon said work done, and upon said Assessment, and Diagram and Engineer's Certificate attached thereto, and also then and - there considered all appeals theretofore filed pursuant to law with said Board by persons interested in said work and said Assessment; and . ) WHEREAS said Diagram and Assessment, as filed, snow thereon three (3) separate parcels of land Nos. 23, 24 and 25, respectively, and assessments thereon as Assessments 2-40-23, for $280.00, 2-40-24 for $360.00, and 2-40-25 for $360.00, respectively, said parcels being portions of Lots 11, 12 and 13 of Block E, as designated on Map of Dewing's Park Extension, filed in office of Recorder of Contre Costa County in Map Book-15 at page 314, said parcels 23 and 25 being so shown as separate parcels by reason of an easement or right of way heretofore separating the same; and WHEREAS said District Board now finds that by agreement between the owner of said two parcels 23 ad 25 and the owner of said parcel 24, said easement or right of way has been abandoned and in place thereof another easãment or right of way has now been created, ex- tending along the southerly boundary of said paroe123, as formerly constituted, by reason whereof such separation of said former par- cels 23 aDd 25 has ceased and they now constitute in effect but one parce123; and WHEREAS said District Board now finds that by such change in location of such easement or right of way, the benefits received from said work of improvement by said parcel 23 as now constituted and by said parcel 24, respectively, has also been affected, that the assessment on said parcel 23 as now constituted should be $600.00 and be designated as Assessment 2-40-23, that the assessment .on said parcel 24 should be $400.00 and be designated as Assessment 2-40-24, and that the assessment of $360.00 on said former parcel 25, as shown on said Diagram and Assessment, as filed, should be eliminated; and 05 05 49 1 :j9 WHEREAS said District Board has examined said Diagram and Assess- ment and is satisfied with the correctness thereof, except as here- inafter ordered, and that no correction or modification thereof should be made except as so ordered; NOW, THEREFORE, IT IS HEREBY RESOLVED AND DETERMINED by said Dist- rict Board that all acts and determinations of said District Engineer relative to said work done pursuant to said Resolution of Intention be and the same are hereby approved, ratified and confirmed, and said District Board does hereby approve, ratify and confirm said Diagram and Assessment, except as hereinafter provided: (1) The two (2) parcels of land designated on said Diagram as Parcels Nos. 23 and 25, respectively, shall be designated there- on as but one parcel No. 23. (2) Assessment No. 2-40-23 on parcel No. 23 shall be changed from $280.00 to $600.00. (3) Assessment No. 2-40-24 on Parcel No. 24 shall be changed from $360.00 to $400.00. (4) Assessment No. 2-40-25 on parcel No. 25 shall be eliminated. BE IT FURTHER RESOLVED AND DETERMINED that said Diagram and Assess- ment as so changed are hereby approved, ratified and confirmed.
