MINUTES OF A SPECIAL MEETING OF THE
DISTRICT BOARD OF CENTRAL CONTRA COSTA
SANITARY D+STRICT~ HELD ON APRI~ 28. 1949
The District Board of the Central Contra Costa Sanitary District
convened in special ses'sion at its regular place of meeting located
at 1822 Nt. Diablo Boulevard, in the City of Walnut Creek, County of
Contra Costa, State of California, on April 28,1949, at the hour of
8:00 o'clock p.m.
The meeting was called to order by President Wadsworth, and the
following roll was called:

Improvement District No. 14, at a fee of $13.00 per parcel. Carried

adoption of the following resolution, seconded by Member Smitten:
RESOLUTION NO. 44
ORDERING WORK, DETERMINING PREVAILING RATE
OF WAGES, AND DIRECTING NOTICE TO BIDDERS IN
LOCAL IMPROVEMENT DISTRICT NO. 12
WHEREAS the District Board of Central Contra Costa Sanitary District,
County of Contra Costa, State of California, passed and adopted, on
April 7, 1949, its Resolution of Intention No. 439, to do the work and
improvement therein described; and
WHEREAS all written protests filed in relation to said proceedings
were duly considered by said District Board;
RESOLVED by said Distriot Board that Said protests be and the
same are hereby overruled, and
RESOLVED that the public interest and convenience require, and said
District Board hereby orders, that said work and improvement be done as
set forth in. said Resolution of Intention, and according to said Plans
and Specifications, reference to which Resolution of Intention and
Plans and Specifications is hereby made for a description of said work
and improvement and the terms and conditions under which the same is
to be done;
RESOLVED that said District Board hereby determines the general
prevailing rate o~ per diem wages, and rates for overtime and legal
holidays, in. the locality in which said work is to be performed, for
each craft or type of workman or mechanic needed to execute the con-
tract therefor, to be as stated in the Notice to Bidders hereinafter
set forth to be posted and published; and
RESOLVED that the Secretary of said District Board shall post
conspicuously for five (5) days, on or near the main entrance door to
to the regular meeting place of said Board at 1822 Mt. Diablo Boulevard,
Walnut Creek, California, a Notice to Bidders, in the form hereinafter
stated, inviting sealed propo~als or bids for doing said work and re-
ferring to said Plans and Specifications on file; and shall publish
said Notice twice in the Orinda Sun, a newspaper published and circulate~
in Central Contra Costa Sanitary District and hereby designated for
that purpose.
All such proposals or bids shall be submitted, received, and pub-
liclyopened, examined and declared, and shall be accompanied by a
certified check or bond, all as 'stated in said Notice to Bidders, which
Notice shall be as follows:
NOTICE TO BIDDERS
Pursuant to law and Resolution No. 445 of the District Board of
Central Contra Costa Sanitary Distriot of Contra Costa County, State
of California, passed and adopted April 28,1949, Ordering Work, Deter-
mining Prevailing Rates of Wages, and Directing this Notice, said
Distriot Board invites sealed proposals or bids for the following work
to be done, to-wit: The construction of sanitary sewers and appurten-
anoes for the area, to the extent, with the materials and in the
manner set forth in Resolution of Intention No. 439 passed and adopted
by said District Board April 7, 1949, and in accordance with Plans and
Specifications adopted therefor, to which Resolution of Intention,
Plans and Specifications, and Resolution Ordering Work reference is
hereby made for a description of said work and improvement and the
terms and conditions under which the same is to be done.
The Plans and Specifications for tRe proposed work may be seen
and examined at the office of Central Uontra Costa Sanitary District,
1822 Mt. Diablo Boulevard, Walnut Creek, California, or at the Engin-
eering Office of Clyde C. Kennedy, Room 504, 604 Mission Street, San
Francisco, California, or may be secured at the Engineering Office of

Clyde C. Kennedy by making a payment of Twenty and No/100ths Dollars
($20.00). There will be no refund on returned Plans or Specifications.
Pursuant to law, the District Board of Central Contra Costa Sani-
tary District has determined the general prevailing rate of per diem
wages, and rates for overtime and legal holidays, in the locality in
which this work is to be performed, for each craft or type of workman
or mechanic needed to execute the contract. The prevailing rates so

Overtime and Saturday work shall be paid for at double the normal
hourly rate except as noted below for Cement Finishers and Truck
Drivers, and work on Sundays and Holidays shall be paid for at double
the normal hourly rate.

The foregoing schedule of prevailing rates of wages, and rates
for overtime, Sunday and Legal Holidays, is based, unless otherwise
specificed, upon a working day of eight (8) hours.
Overtime and Saturday rates for Truck Drivers shall be at one
and one-half (Ii) times the normal hourly rate.
The first two hours overtime, after a normal eight (8) hour day,
for Cement Finishers shall be at one and one-half (;i) times the
normal rate and further overtime shall be at double the normal rate.
Saturday work for Cement Finishers shall be at one and one-half (li)
times the normal rate for the first eight (8) hours worked and at
double the normal rate for all further time worked on Saturdays.
NOTICE IS ALSO HEREBY GIVEN BIDDERS that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all
subcontractors under him, .to pay not less than said general prevail-
ing rates of per diem wages, as above listed, to all laborers, work~
men, and mechanics employed in the execution of the contract.
Before submitting proposals, the bidder shall be lxensed in
accordance with the provisions of Chapter 9, Division III, of the
Business and Professions Code, Chapter 37 of the Statutes of 1939,
as amended, of the State of California, which provides for the regis-
tration and licensing of contractors.
Each bidder must submit with his proposal a statement of his
financial responsibility, technical ability and experience on the
form to be furnished prospective bidders, and a statement as to
whether the bidder is an individual, a partnership, a joint venture,
or a corporation.
Each bidder shall submit with his bid, on the form provided, the
name and address of each subcontractor, including the principal
suppliers of materials, and the portion of the work which each sub-
contractor will do. If the contractor fails to name the subcontractors
in his proposal, he shall be deemed to have agreed to pertorm such
portion of the work himself and shall not be permitted to subcontract
said portion of work without previous written permission of the Sani-
tary District Board.
All proposals or bids must be delivered to the undersigned Sec-
retary of said District Board at its office at 1822 Mt. Diablo Boule-
vard, Walnut Creek, California, on the 26th day of May, 1949, up to
the hour of 8:00 o'clock p.m., on which day at the hour of 8:15 o'clock
p.m., in said office of said District Board said proposals or bids
shall be publicly opened, eX~nined and declared, and each proposal or
bid must be accomplanied by a check certified without qualification by
a responsible hank, payable to Central Contra Costa Sanitary District
for an amount not less than TEN PER CENT (10%) of the aggregate of the
proposal or by a bond for said amount and so payable signed by the
Bidder and two Sureties, all as prescribed by law.

ANNEXATION OF 'GREGORY GARDENS'
Member Johnson moved the adoption of the following resolution,
seconded by Member Smitten:
RESOLUTION AND ORDER DESCRIBING THE EXTERIOR BOUNDARIES
OF THE TERRITORY COMMONLY KNOWN AS "GREGORY GARDENS"
PROPOSED TO BE ANNEXED TO THE CENTRAL CONTRA COSTA SAN-
ITARY DISTRICT WITHOUT AN ELECTION.
RESOLUTION NO. 446
WHEREAS a Petition, signed by the owners of real property in
the territory commonly known as "Gregory Gardens" proposed to be
annexed to Central Contra Costa Sanitary District, which real prop-
erty represents Seventy-Five per cent (75%) of the total assessed
valuation of said territory as shown by the last equalized assess-
ment roll of the County of Contra Costa, waS presented to this
District Board on the 28th day of April, 1949, at the hour of 8:00
o'clock p.m. of said day, at the regular place of meeting of said
District Board at 1822 Mt. Diablo Boulevard, in the City of Walnut
Creek, County of Contra Costa, State of California, asking that
said territory be annexed to said Central Contra Costa Sanitary
District without an election under the provisions of Article 3,
Part I of Division VI of the Health and Safety Code of the State of
California, and an Affidavit of Publication of said Petition and of
a Notice stating the time of he~g of said Petition to be presented
to this District Board, was filed at said time and place, and
WHEREAS said Petition designates specifically the boundaries of
the territory proposed to be annexed and its assessed valuation as
shown by the last equalized assessment roll of the County of Contra
Costa and shows the amount of real property owned by each of the
peti tioners and its assessed vB.luation as shown by the last equalized
assessment roll of said county, and
WHEREAS said Petition states that the territory is not in any
other Sanitary District and that said territory is in the same county
as said Central Contra Costa Sanitary District, is contiguous thereto,
and is not within the limits of any other Sanitary District; and
requests that the territory so described be annexed to this District,
and
WHEREAS the Petition is verified by the Affidavit of one of the
petitioners, and
WHEREAS no written protests against the annexation of said
territory to said Sanitary District. have been filed with this District
Board, and
WHEREAS at said hearing no oral protests were made to this Dist-
rict Board against the annexation of said territory to said Sanitary
District, and
WHEREAS, at the time and place fixed in said Notice for said
hearing, this District Board proceeded to hear said Petition and all
persons therein who appeared, and said hearing was completed at said
time and place, and
WHEREAS, said Petition and said Affidavit show, and after a full
hearing, examination, and investigation, this District Board has
found and does hereby find and declare that said Petition is duly
verified by the Affidavit of one of the petitioners; that said Pet-
ition was duly published for at least two (2) weeks preceding its
hearing by this District Board, together with Notice that said
Petition be presented to this District Board on Thursday, the 28th
day of April, 1949, at the Hour of 8:00 o'clock p.m. of said day, in
the meeting room of said District Board located as hereinbefore

described, and that at said time and place all persons interested
therein might appear and be heard, on April II, 1949, and on April
18, 1949, in the Walnut Creek Courier-Journal, a newspaper of gen-
eral circulation, published in said District; that the Affidavit of
such publication has been presented to and is on file with this
District Board; and
WHEREAS the petitioners have paid to Central Contra Costa Sani-
tary Distric t the sum of One Hundred and 70/100ths dollars ($100.70),
being the total taxes which the territory proposed to be annexed would
have paid had said territory been a part of this Sanitary District from
the date of the original formation thereof and for those fiscal years
in which taxes were levied and collected upon property within the
original Sanitary District, and the petitioners have reimbursed the
Sanitary District far all expenses incurred by it in connection with
this proposed annexation amounting to Six hundred and no/lOOths
Dollars (!600.00);
That said petitioners are the owners of land constituting Seventy-
Five per cent (75%) of the total assessed valuation of the territory
proposed to be annexed, as shown by the last equalized assessment roll
of the County of Contra Costa; that all of the facts set forth in said
Petition are true; that all acts and conditions and things required by
law to be done precedent to the hearing of said Petition by this Dist-
riot Board have been done and have been performed in regular and due
form in. strict compliance with provisions of the law authorizing the
presentation of this petition.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED:
(1) That upon the final hearing of said Petition and after a
full hearing, investigation, and examination, this District Board does
hereby find and determine that the annexation of the territory therein
and hereafter described is for the best interests of the Distriot and
said contiguous territory.
(2) That upon such final hearing, this District Board does hereby
find and dëtermine that all of the territory described in said Petition
will, in the judgment of this District Board, be benefited by annexa-
tion to said Sanitary Dietrict.
(3) That the exterior boundaries of the territory so proposed to
be annexed to Central Contra Costa Sanitary District and specifically
described in said Petition are hereby fixed and described as follows:
That parcel of land situated in the County of Contra Costa,
State of California, described as follows:
Beginning at the most northeasterly corner of that certain
87.03 acre pprcel of land deeded to Albert T. Simmie and
described in the record thereof in Volume 351 of Official
Records at page 185, said corner being a point on the now
existi~g boundary of the Central Contra CostaSanitary Dist-
rict, and running thence westerly, southerly, easterly and
southerly along the northern, western, southern and western
boundaries of said 87.03 acre parcel and the southerly ex-
tensiqn of said western boundary to its intersection with
the exis~ing boundary of said Sanitary District in Gregory
Lane (also commonly known as Grayson Road); thence along
said existing boundary easterly and northerly to the point
of beginning. All of the hereinbefore references to deeds
are to the Official Records of Contra Costa County, Calif-
ornia.
(4) That the President and Secretary of this District Board be
and they are hereby authorized and directed to execute.on the behalf
of this Distriot Board a Petition to the Board of Supervisors of the
~unty of Contra Costa setting forth the proceedings heretofore taken
for the annexation of the above-described territory, the finding of
this Board, and requesting the Board of ,Supervisors to annex the
territory to the District.

Bids for the construction of work in Local Improvment District.
No. 10, received from the following contractors, were opened, read
and referred to the Engineer for tabulation and recommendation:

The Engineer recommended acceptance of the bid of Associated
Electrical and Mechanical Company, as being the lowest responsible
bidder.
The following resolution was offered by Member Johnson, seconded
by Member Smitten:
RESOLUTION NO. 447
RESOLUTION OF AWARD OF CONTRAC! FOR WORK IN
LOCAL IMPROVEMENT DISTRICT NO. 10
RESOLVED that the District Board of Central Contra Costa Sani-
tary District, Contra Costa County, State of California, having in
open session on the 28th day of April, 1949, opened, examined and
publicly declared all sealed proposals or bids offered for doing the
work hereinafter mentioned;
HEREBY rejects all of said BIDS except that hereinafter mention-
ed, and hereby AWARDS the Contract to the lowest, regular responsible
BIDDER, to-wit:
To Associated Electrical and Mechanical Company at the prices
specified in its proposal for doing said work now on file.
The work herein referred to is the construction of sanitary sewers
and appurtenances for that area, and to the extent, with the materials
and in the manner, set forth in Resolution of Intention No. 424,
adopted by said District Board on the )rd day of March, 1949, reference
to which said Resolution of Intention is hereby made for a desorip-
tion of said work and improvement, and the terms and conditions under
which the same is to be done.
The Secretary of said District Board is hereby directed to pub-
lish notice of this AWARD, twice in the Lafayette Sun, a weekly
newspaper published and circulated in said lanitary Distriot as re-
quired by law.
PASSED AND ADOPTED by said District Board of the Central Contra
Costa Sanitary District, Contra Costa County, State of California,
this 28th day of April, 1949.

HEARING ASSESSMENT PROTESTS L.I.D. NO.2
Mr. Harrison gave an opening talk, explaining the assessment
to the protestants. The District Engineer explained the method
by which he arrived at the assessment figures.
The Secretary began reading letters of protest, and, due to the
large overflow of people at the meeting who could not hear, there
were requests from the floor that the meeting adjourn to a larger
. room so all could hear.
It wee moved by Member Weill, seconded by Member Smitten that
the meeting on the hearing of the appeals ort the Assessments for
Local Improvement District No.2 be recessed to the Walnut Creek
Grammar School Auditorium, to 9:40 o'clock p.m. Carried unanimously.

ADJOURNMENT
Due to the late hour, 1:15 a.m., it was moved by Member Johnson,
seconded by Member Smitten, and unanimously carried, that the meeting
adjourn to May 5,1949 at 8:00 o'clock p.m. at the regular meeting
place, to continue hearing the appeals on the Assessments for Local
Improvement District No.2.
