MINUTES OF A SPECIAL MEETING OF THE DISTRICT
BOARD OF CENTRAL CONTRA COSTA SANITARY DISTRICT
HELD DECEl.1BER 16, 1948
The District Board of the Central Contra Costa Sanitary
~istrict convened in special session at its regular place of meeting
located at 1822 Mt. Diablo Boulevard, in the City of Walnut Creek,
County of Contra Costa, State of California at the hour of 8:00
o'clock p.m., Decemb~r 16, 1948.
The meeting was called, to order by President Wadsworth, and
the following roll WAS called:

READING OF PREVIOUS MINUTES
It was moved by Member Toland, seconded by Member Weill that the
reading of Minutes of the previous meeting be waived, and that they
be a~proved as entered.
Carried unanimously.
HEARING OF PROTESTS - L.I.D. No.6
There were no written protests filed with the District against
the work of Local Improvem~nt District No.6.
President Wadsworth
called for protests from the floor; there were none.
The following

RESOLUTION NO. 407
ORD~RING WORK IN LOCAL IMPROVEMENT
DISTRICT No.6
WHEREAS the District Board of Central Contra Costa Sanitary Dist- (
rict, County of Contra Costa, State of California, passed and adopted ¿
on November 18, 1948, its Resolution of Intention No. 398, to do the
work and improvement therein described, to-wit: The construction of
sanitary sewers and appurtenances for the area within the boundaries
described in said Resolution of Intention to the extent, with the
materials and in the manner set forth in said Resolution of Intention
and according to Plans and Specifications heretofore adopted therefor,
and
WHEREAS all written protest filed in relation to said proceedings
were duly considered by said District Board,
RESOLVED by said District Board that said protests be and the same
are h~reby overruled, and
RESOLVED that the public interest and convenience require, and
the said District Board hereby orders, that said work and improvement
be done, to wit: The construction of sanitary sewers and ~lppurtena.nces
for the area within the boundaries described in said Resolution of
Intention, to the extent, with the materials and in the manner set
forth in said Resolution of Intention, and according to said Plans
and Specifications, reference to which Resolution of Intention and
Plans and Specifications is hereby made for a description of said work
And improvement and the terms and conditions under which the same is
to be done.

The Secretary of this Board is hereby directed to post conspic-
uously for five days (5), on or near the main entrance door to the
regular meeting place of the said District Board at 1822 Mt. Diablo
Boulevard, Walnut Creek, California, Notice h?reof inviting sealed
PROPOSALS OR BIDS for doing said work and to publish twice a Notice
hereof inviting sealed PROPOSALS or BIDS for doing said work and re-
ferring to the plans and specifications on file, the said publication
to be in the Walnut Kernel, a newspaper published and circulated in
the Central Contra Costa Sanitary District and hereby designated for
that purpose.
All such proposals shall be received by the Secretary at the
office of the District Board at 1822 Mt. Diablo Boulevard, Walnut
Creek, California, on the 20th day of January, 1949, at eight o' clock
p.m., and said day is hereby designated as the day on which, at the
hour of 8:15 o'clock p.m., said PROPOSALS or BIDS shall be opened,
all of which shall be specified in said Notice, and said Notice
shall reQuire with said PROPOSALS or BIDS a check certified without
oualification by a. responsible bank, payable to the Central Contra
Costa Sanitary District for an amount not less than TEN PER CENT
(10%) of the aggregate of the proposal or by a bond for the said
amount, and so payable signed by the bidder and two (2) sureties,
all as prescribed by law.

ESTABLISHING PREVAILING WAGES
LOCAL IMPROVEMENT DISTRICT No.6
The following resolution was offered by Member Johnson, seconded
by Member Weill:
RESOLUTION NO. 408
WHEREAS in pUrsuance of Article 1 and 2 of Chapter I of Part 7
of Division 2 of the Labor Code of the State of Ca.lifornie., before
the District Board of the Central Contra Costa Sanitary District
may award any contract for public work on behalf of said Sanitary
District, the District Board must ascertain the general prevailing
rate of per diem wages in the locality in which the work is to be
performed, to-wit: Within the limits of the Central Contra Costa
Sani tary District for ea.ch cre,ft or type of workman or mechanic
needed to execute the contract, and must specify in the call for
bids for said contrAct and in the contrAct itself what the general
prevailing rate of per diem wages in said locality is for each
craft or type of workman or mechanic needed to execute the contract
and also the general prevailing rate for legAl holiday and overtime
work;
NOìv, THEREFORE, BE IT RESOLVED that the said general prevailing
rate of per diem wages and the general prevailing rate of per diem
wages for legal holiday and overtime work within the limits of said
Sanitary District for each craft or type of workman or mechanic

needed to execute a contract for the construction of sanitary sewers
and appurtenances in accordance with the plans and specifications
therefor, heretofore adopted and approved for doing of said work as
the same is described in Resolution of Intention No. 398, in the
Central Contra Cos~P. Sani ta.ry District, shall be and the same are
hereby ascertained, approved and adopted by this Board after a full

Overtime and Saturday work shall be ps.id for at double the normal
hourly rate except as rated below for Cement Finishers and Truck
Drivers, A.no work on Sundays and Holidays sÎ1all be paid for at double
the hourly rate.

The foregoing schedule of prevailing rates of wages, and rates
fpr overtime, Sunday and Legal Holidays, is based, unless otherwise
specified, upon a working day of eight (8) hours.
Overtime and Saturday rates for Truck Drivers shall be at one
and one-half (Ii) times the normal hourly rate.
The first two hours overtime, after a normal eight (8) hour day,
for Cement Finishers shall be at one and one-half (It) times the
normal rate. amd further overtime shall be at double the normal rate.
Saturday work.for Cement Finishers shall be at one and one-half (Ii>
times the normal rate for the first eight (8) hours worked and at
double the normal rate for all further time worked on Saturdays.
NOTICE IS ALSO HEREBY GIVEN BIDDERS that it shall be mandatory
upon the contrActor to whom the contract is awarded, and upon all
subcontractors under him, to pay not less than said general pre-
vailing rates of per diem wages, as above listed, to all laborers,
workmen and mechanics employed in the execution of the contract.

PUBLISHING NOTICE TO BIDDERS
It was moved by Member Weill, seconded by Member Toland thAt
the Notice to Bidders be published in which ever newspaper is
the next in line for the District's business. The secretary to
check. Carried unanimously.
PUECHASE OF MAINTENANCE EQUIPNENT
The Board authorized the Assistant Secretary to rent Stolte's
water truck, ~nd purchase the necessary materials to make the needed
repairs to the existing sewers.
PETITION FOR ANNEXATION - J. R. HANSEN
A petition for annexation was presented to the Board by Mr.
A. J. Mascore¡la for annexation of the Jeanne R. Hansen property
at the Monument. Inasmuch as the territory included only 1.718 acres,
it was requested that the petition not be acted upon until Mr.
J..iescorella att;empteà to have a larger area annexed.
MACDCNALD, YOUNG & NELSON CON~?ACT
EXTRA - TRE NrJ.'lENT PLANT
It was moved by Member Johnson, seconded by Member Smitten
that the Board approve the extra work recommended under the contract
for the Sewage Treatment Plant at a cost of $621.24 in accordance
with quotatiön of December 14, 1948 from MAcDonald, Young and Nelson.
Carried unanimously.

REQUEST FOR EX~ENSION OF TIME - MARTIN BROS.
By letter of December 10, 1948, M~rtin Brothers, contractors
for Section V Main Trunk Sewer, requested an extension of time
of 85 days. The Board directed the Secretary to advise Martin
Brothers to wait until the contrAct was completed, and clean up
the other conditions before the Board would consider an extension
of time.
INCIDENTAL EXPENSE FOR LOCAL IMPROVEMENT DIST. NO. II
It was moved by Member Smitten, seconded by Member Toland and
unanimously carried that upon receipt of $2,084.38 from CLYDE C.
Kennedy, said sum representing the incidental expenses incurred to
date on Local Improvement District No. 11 and which is to be ad-
vanced by the successful bidder OAKLAND SEWER CONSTRUCTION COMPANY,
before execution of the contrAct with OAKLAND SE~~R CONSTffiTCTION
CONPANY for doin¡¿ the work authorized in Local Improvement District
No. II, the following amounts be disbursed from said sum for such
incidental expenses, as follows:
$770.15 to CLYDE C. KENNEDY for engineering services rendered
to date for Local Improvement District No. II.
$110.02 for legal services rendered to date for Local Improve-
ment District No. II, to be paid pursuant to contract,
therefor, as follows:

KENNEDY, said sum representing the incidental expenses incurred to
date on Local Improvement District No.1 and which is to be advanced
by the successful bidder, STOLTE INCORPORATED, before execution of
the contract with Stolte Incorporated for doing the work authorized
in Local Improvement District No.1, the following amounts be dis-
bursed from said sum for such incidenta,l expenses, as follows:

LEASE PAYlvlENT TO SOU'rHERN PACIFIC Cm'lPANY
It was moved by Member Johnson, seconded by Member Smitten
and carried unanimously that the Board authorize the annual lease
payment of $220 due January 22, 1949 to the Southern Pacific
Company.
REQUEST FOR SE~œR - STANLEY PARK
The Board instructed the Assistant Secretary to notify the
o,mers of Stanley Park that their request to be permitted to
construct a sewer line in their subdivision, to connect to a
mAnhole to be constructed in the area under Local Improvement
District No. I would be held in abeyance until such time as
the District's sewer was constructed.
SALE OF FLOURESCENT LAMP
It ,vas moved by Memb:,r Smitten, seconded by Member Johnson
that the District sell the lighting fixture purchased for the old
office building at the bid price of iIO.OO to Clyde M. Hopkins.
Carried unanimously.
ENGINEERING CONTRACT DISCUSSION
The following notice was read by President Wadsworth:
'From the time of the formation of the Sanitary District, its
Directors have considered performing the engineering for various
projects with a staff directly employed by the District.
"In order that the sewage treatment plant, main trunk sewer
and intial collecting sewer systems might be most expeditiously
handled, the District Board contracted with Mr. Clyde C. Kennedy
for engineering services to serve at the pleasure of the Board.
Mr. Kennedy's engineering work forthe District has been most
satisfactory.
"Current studies for engineering cost for collecting sewers
in other districts and in various California cities have shown
that the costs under the present contract are considerably in
excess of the average throughout the State. The lowest engineer-
ing costs were found to be had in cities where the engineering
staff were direct employees of the municipality.
liThe general average engineering expense for collecting sewers
installed md.er the Improvement Act of 1911 was found to be less
than 11% of construction cost where the engineering was performed
under contract, and less than 9% where the engineering was done
by direct city employees.
liThe progralIl of main trunk sewers is nearing completion, with
ten construction contracts awarded, five of which are completed,
or nearly completed. This aggregates approximately $2,000,000 in
construction cost.
liThe progra.m of installing collecting sewers has been under way
for less than six months, with five construction contracts awarded,
none of which are complete. These contracts aggregate approxim-
ately $1,213,000 in construction costs. This represents only a
fair start of this prog~am, as these se~erS will bring service to
less than one-fifth of the District's area.
liThe future ¡rogram for collecting sewers is expected to total
in excess of $4,000,000 before the areas of the District now
needing and desiring sewer service may have their needs met.

"In view of the foreging facts and in the interests of economy
in serving the residents and property owners of the District, the
BoFœd he.s decided that it is no,"-' imperative to establish its own
6irectly employed staff."
Members Johnson and Smitten objected to the first paragraph,
stating that the had never had considered performing the work with
a directly employed steffe President Wadsworth revised the state-
ment to read "some of the Directors".
After a discussion pro and con by the Board Members the follow-
ing people addressed the Board:
¡Vir. O. 'i-J. Jones, of Lafayette, who s':ated that a change in
engineers would be a mistake, inasmuch as the Board Members were
not Qualified ~ to operate an engineering staff.
Captain Sandford of Lafayette stated that group of people were
forming in order to study the problem and requested that the Board
delay any contemplated action until they could investigate. He
stated he could see no reason why the District should terminate
the contract with Mr. Kennedy.
Mr. George B. Sturgeon, Civil Engineer, Lafayette stated that
the reason the .District Board had done a creditable job for the
past two years was because they were under the guidance of one of
the greatest engineers in the country, and his contrpct should not
be terminated; that his information was that the Board proposedto
hire a discredited engineer thet 1-1r. Kennedy had fired for unethical
practice.
My'. Leo J. Coleman, Lafayette, desired to have Mr. Kennedy retained
?s District Engineer and stated that the District should be respon-
sible for replacing survey monuments which had been removed by the
contractors.
Mr. Rasmussen, Pleasant Hill Construction Company stated that
he had done a great deal of work for the State, and their engineering
cost ran 16%, higher than the Sanitary District, and he felt that
Nr. Kennedy should be retained. .
Member Smitten moved that the meeting be adjourned.

COSTA SANITARY DISTRICT can more economically operate and maintain
an engineering department staffed by employees of the District with
a resulting financial benefit to the District and i ts taxpa.yers; and

Contract dated November 29, 1946, and said Contract continues at the
please of the CEN'~RAL CONTRA COSTA SANITARY DISTRICT and until Notice
of the discontinuance, termination, or suspension of said Contract
and employment is given in writing by said Sanitary District, said
Notice to be sufficient and complete twenty-four (24) hours after
the same is deposited in the United St8.tes mail, postap;e prepeid,
addressed as follows:
