HomeMy WebLinkAboutBOARD MINUTES 11-16-61 138 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY DISTRICT HEW NOVEMBER 16, 1961 The District Board of Central Contra Costa Sanitary District convened in an Adjourned Regular Session at its regular place of meeting located at 1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of California, on November 16,1961, at 8:00 o'clock P.M. The meeting was called to order by President Mitchell. ~ I. ROLLCALL PRESENT: Members: Gibbs J Salfingere J Bowman and Mitchell ABSENT : Member: Roemer II. APPROVAL OF MINUTES " The Minutes of the meeting on November 2, 1961, were approved as presented. III. APPROVAL OF BILIS None. IV. BIœ None. V. OLD BUSINESS ORDINANCE 28 Mr. Horstkotte, District Manager-Engineer, stated that the recommendation of the District staff was set forth in the memorandum to the District Board which suggested the elimination of the equivalent Local Improvement District No. 30 charge for subdivided parcels and adjusting the annexation fee for the Local Improvement District No. 30 area. ~ After discussion, Members of the Board' agreed that the Local Improvement District No. 30 equivalent charge should be eliminated and the annexation fee for the area adjusted in accordance with the memorandum to the District Board. The District Board also requested that, in the codification of the District Ordinances and regulations, specifications should be set forth for annexation fees in the various areas. VI. NEW BUS !NESS LINE D EASEMENT FROM THE COUNTY OF CONTRA COSTA (OLD SACRAMENTO NORTHERN RAIlWAY RIGHT OF WAY) Mr. Horstkotte, District Manager-Engineer, explained that the District had condemned the Sacramento Northern Railway right of way and, in the agree- ment with the County and Pacific Gas & Electric Company, the County would proceed to acquire the property and the Pacific Gas & Electric Company and the District would pay their share as agreed. Correspondence rrom the County set forth all the costs, showing the District's share to be $12,124.60, the Pacific Gas & Electric Company's share to be $19,289.81, and the County share to be $41,690.05. ~ After discussion, it was moved by Member Salfingere, seconded by Member Bowman, that $12,124.60 plus title insurance costs be authorized from Sewer Construction Bond Funds for Line D easement parcel ftom the County of Contra Costa in the old Sacramento Northern Railway right of way from the city limits of Walnut Creek to 4th Street in Lafayette am that Mr. Bohn, Counsel for the District, work out the legal details, particular¡Y the question of a possible 11 16 61 139 future relocation request by the County and who would pay the cost. by the following vote: Carried AYES: Members: Gibbs, Salfingere, Bowman and Mitchell NOES: Members: None ABSENT: Member: Roemer ACCEPTANCE OF EASEMEN'lS ~ It was moved by Member Gibbs, seconded by Member Bowman, that easements from Sidney E. Wallace and Frank E. Principe, John J. Graham, Albert Hann, Everest M. Ashley, Joseph Mansueto, George Brazil, Fred H. Venker, Harold R. Sproul, Clarence G. Nelson, Richard A. Malott, and Department of Veterans' Affairs of the State of California and George J. Horr¡ be accepted and their recording ordered. Carried by the following vote: ) ) AYES: Members: Gibbs, Salfingere, Bowman and Mitchell NOES: Members: None ABSENT : Member: Roemer REQUEST OF MRS. MARY STEWART BROUSSARD FOR REFUND OF REBATE PAYMENT Mr. ßorstkotte, District Manager-Engineer, explained that Mrs. Broussard had connected her home to a rebate manhole on Diablo Road and paid to the District $224.00 rebate fee when she could have connected to a manhole fifteen feet away without cost. He reconunended that the $224.00 paid by Mrs. Broussard be refunded and the rebate charge be declared invalid. ~ It was moved by Member Salfingere, seconded by Member Bowman, that the rebate fee of $224.00 paid by Mrs. Mary Stewart Broussard be refunded due to having connected to a rebate manhole when another, at no rebate cost, was available, and that the rebate charge be declared invalid. Carried by the following vote: AYES: Members: Gibbs, Salfingere, Bowman and Mitchell NOES : Members: None ABSENT: Member: Roemer . J ANNEXATION TEmfJ FOR 356 ACRES IN THE ORINDA AREA, OIINER G & L INVESTMENT CO. Mr. Horstkotte explained that the property was located between Lombardy Lane in Orinda and Happy Valley Road in Lafayette and annexation fees for the area have been established at $277.00 per acre. It was moved by Member Gibbs, seccnded by Member Bowman, that terms fcr annexing the 356 acres lying between Lombardy Lane in Orinda and Happy Valley Road in Lafayette be $277.00 per acre plus processing costs under Ordinance 24. Carried by the following vote: AYES: Members: Gibbs, Salfingere, Bowman and Hi tchell NOES: Members: None ABSENT: Member: Roemer AUTHORIZATION TO CALL FOR TRUCK BIOO ~ Mr. Horstkotte, District Manager-Engineer, requested authorization to call for bids for two trucks as provided for in the Budget. It was moved by Member Bowman, seconded by Member Salfingere, that the call ror bids for two trucks be authorized. Carried by the following vote: AYES: Members: Gibbs, Salfingere, Bowman and Mitchell NOES : Members: None ABSENT: Member: Roemer D. K.YOU~ INC. REQUFST FOR PAYMENT OF INTEREST ON CASH BOND ON DEPœIT w ~'.1'H THE D TRIC'l' Letter from D. K. Young, Inc., requesting that interest be paid on $1,000.00 cash bond on deposit with the District, was read. After discussion, it was moved by Member Salfingere, seconded by Member Bowman, that the request of D. K. Young, Inc. for the payment of 11 16 61 ~40 interèst on the cash bond on deposit with the District be denied. the £ollowing vote: Carried by AYES: Members: NOES: Members: ABSENT: Member: Gibbs, Sal!ingere, Bowman and Mitchell None Roemer CLAIM OF JOHNSON CLARK ~ INC. Mr. Horstkotte, District Manager-Engineer~ explained the claim o£ Johnson Clark, Inc. Some work the District required them to do resulted in damage to a District sewer. Continued to December 7,1961, £or review o£ Mr. Bohn, Counsel for the District, and further investigation. '"-----' VII. REPORTS DISTRICT MANAGER-ENGINEER STATUS OF LINE A WORK Mr. Horstkotte, District Manager-Engineer, reported that Line A pipe was now all in place and back£ill would be completed next week. ARTICLE FOR PUBLIC WORKS MAGAZ INE Mr. Horstkotte stated that his article £or the Public Works magazine was to be printed. COUNSEL FOR THE DISTRICT None. VIII.
