President Mitchell stated that other changes in Ordinance 28 should be considered at this time, in particular the Local I1IIprovement District 10. 30 asse8sment equivalent cbarp JROdification. Mr. Horstkotte, District Manager-Engineer, stated that other suggested changes would be prepared and mailed to each Director prior to the next meeting ror consideration at that _eting. Terence Ring, attorn8T for the several garbage collection firms licensed b,. the District, was read, along with application for exclusive rranchise. Mr. Ring was asked to further explain the request. 10 19 61 130 Mr. Ring stated that" with the amending of Health and Safety Code Section 6515.5 by the State Legislature at the last session" the District is now able to grant exclusive franchises without calling ror competitive bids. Mr. Bohn" Counsel ror the District" explained that" prior to 1961, like a lot of other matters" exclusive rranchises ror garbage collection granted by a sanitary district had to go out to bid. The 1961 Legislature made the law substantially the same as for cities and franchises can now be granted by the District without the necessity or public bids. Hr. Bohn stated that the Ordinance will have to be amended. Mr. Ring stated that his clients were asking for an exclusive rranchise for five years. With the high investment required, his clients need a certain amoWlt of security;- they can then make plans ror better equipment and service. President Mitchell stated that a change to a five-year rranchise would have tc be justified on the basis of some benerit to the public" and asked Mr. Ring if his clients had any specific plans as to service and equipment. '--'" Mr. Bohn" Counsel for the District" stated that, Wlder an exclusive franchise" a more detailed contract would have to be negotiated than under the present one-year license. Member Gibbs asked Mr. Ring about rates during the five-year period. Mr. Ring stated that the District Board sets the rates and any changes in rates set forth in the contract would be determined by the Board after a hearing. Mr. Ring suggested a study of exclusive contracts now in existence in the area. The District Board referred the matter to the District starr ror suggested changes in the Ordinance and proposals from the present licensees for beneri ts to the public over and above the present service.. These suggestions and proposals to be sent to the Members prior to the next meeting at which t.iJae they will be considered. CLAIMS ~ Mr. Horstkotte, District Manager-Engineer" read the claims presented by Allen J. Gould ($12.50), Mrs. J. J. Jaeger ($36.00), and G. J. R08ati ($18.75) ror plumbing bills incurred ror plugged sewers" and also the Maintenance Department reports. ~. Horstkctte stated that, in all ca8es, the main sewer was plugged and not the house sewer and the District should have been called rirst. He stated the staff re1 t there was justification to pay the Gould claim in the sum of $12.50 but not the others. After discussion" it was moved 'Qy Member Roemer, seconded by Member Salfingere, that the claim of Allen J. Gould in the sum of $12.50 be paid after receipt of a signed release from him and the claims of M~ J. J. Jaeger and G. J. Rosati be denied. Carried by the following vote: AYES: Members: Gibbs" Roemer" Sa1fingere and Bowman NOES: Member: Mitchell ABSENT: Members: None ACCEPTANCE OF EASEMENTS It was moved by Member Bowman" seconded by Member Salf'ingere" that ease- ments from Danville Gardens Shopping Center and Hilp & Rhodes Realty Corpora- tion be accepted and their recording ordered. Carried by the following vote: AYES: Members: Gibbs, Roemer" Salfingere, Bowman and Mitchell NOES: Members: None ABSENT: Members: None ~ REIDCATION OF EASEMENT LINE OFF FIRST STREET, LAFAYETTE Mr. Horstkotte, District Manager-Engineer" read a letter from Mr. Stanley Pedder of Robscn & Malott, attorney for Mr. Charles Huppe, rêlative to the 10 19 61 131 District's having no easement at the rear of the property at the corner or Moraga Road and Moraga Boulevard, Larayette~ Mr. Horstkotte stated that this was a section or line of the old Larayette sewer system tied into the District system when Local Improvement District No. .3 work was done. He stated that the line is along a row of trees and the old type pipe joints have allowed roots to penetrate, requiring frequent cleaning. He recommended moving the line to the adjacent school property and reconnecting the ten properties tied into the old line, along with replacing about 150 feet in Monroe Street, at an estimated cost of $4,000.00. ~ After discussion, it was moved by Member Sallingere, seconded by Member Roemer, that $4,000.00 be authorized rrom Sewer Construction General Funds to replace the line in the rear of the properties fronting on Moraga Boulevard between First Street and Moraga Road, along with 150 feet in Monroe Stlteet, Carried by the rollowing vote: AYES: Members: Gibbs, Roemer, Salringere, Bowman and Mitchell NOES: Members: None ABSENT: Members: None Mr. Horstkotte stated that the line on the prcperty of Mr. Huppe was only to serve that property although a rodding inlet had been installed several years ago. It was moved by Member Roemer, seconded by Member Bowman, that Mr. Bohn, Counsel for the District, answer the letter from Mr. Stanley Pedder, attorney for Mr. Charles Huppe, and that up to the amount of $40.00 be authQrized to settle his demand. CœPANY ~ Letter requesting permission and setting rorth conditions for parking air testing equipment on the Outfall Line property northerly of the Southern Pacific Railroad was presented. Upon the recommendation of Mr. Horstkotte, District Manager-Engineer, it was moved by Member Bowman, seconded by Member Salf1ngere, that Mr. Honstkotte be authorized to countersign the letter dated October 2, 1961, from Tidewater Oil Company', setting rorth conditions under 1ibich they would be allowed to park air sampling equipment on the Outrall Line property northerly or the Southern Pacific Railroad. Carried by the rollowing vote: AYES: Members: Gibbs, Roemer, Salfingere, Bowman and Mitchell NOES: Members: None ABSENT : Members : None REQUEST OF R'UXWWOD ~ JSSOCIATIDN FOR FULL BEBA'l'I PAYMENT BY DISTRICT PURCHASE . Letter rrom. Mr. King Parker, Jr. or the Ridgewood Sewer Association, -requesting £u11 rebate payment ror rebates paid in connection with highway- sewer crossing, was presented. ~ Mr. Horstkotte, District Manager-Engineer, explained the highway sewer crossing and the later extension by the Ridgewood Sewer Association, stating that the letter requesting rebates paid to the installer or the highway crossing be refunded must have been the result or a misunderstanding, and recommended denial. It was aoved by Member Salfingere, seconded by Member Roemer, that the request of the Ridgewood Sewer A.ssociatirm for refund of rebates paid for highway croBsing sewer line be denied. Carried by the following vote: AYES: Members: Gibbs, Roemer, Saltingere, Bowman and Mitchell BOBS: Members: None ABSENT: Members: Hone 10 19 61 . --------------.------- 1~ APPROVAL OF PLANS FOR TRACT 2966~ PALOS VERDES ~ AND OOTFALL SEWER Mr. Horstkotte, District Manager-Engineer, explained the need for the outfall sewer planned along with Tract 2966 which will serve other properties and is needed because of insufficient capacity in the area. Mr. Bohn, Counsel for the District, requested that the easements for the outfall sewer to serve Tract 2966 be obtained by the District staff at the cost of the developer of Tract 2966. It was moved by Membe~ B~wman seconded by Member Salfingere, that the plans for Tract 2966 (Palos Verdes) and the outfall sewer be approved and that easements required for the outfall sewer be obta:il'led by the District staff at the cost of the developer. Carried by the following vote: ~ AYES: Members: Gibbs, Roemer, Salfingere, Bowman and Mitchell NOES : Members: None ABSENT: Members: None WATERSHED 29 CHARGE Mr. Horstkotte, District Manager-Engineer, stated that Watershed 29, located in Walnut Heights, needed additional lines and capacity to serve properties lying outside the District, and recommended a watershed charge of $400.00 per acre to provide the capacity required. It was moved by Member Bowman, seconded by Member Roemer, that the charge for Watershed 29 be $400.00 per acre. REPORTS D IS TRIC T MANAGER-ENG INEER AUTHORIZATION FOR REIOOATION OF.SEWER IN BOTELHO AVENUE.. WALNUT CRIBK Mr. Horstkotte, District Manager-Engineer, requested $2,440.00 from Sewer Construction General Funds to complete the relocation of the sewer in Botelho Avenue, Walnut Creek, a part of which now exists in private property. ~ After an explanation, it was moved by Member Bowman, seconded by Member Gibbs, that $2,440.00 from Sewer Construction General Funds be authorized for relocating the sewer line in Botelho Avenue, Walnut Creek. Carried by the following vote: An3: Members: Gibbs, Roemer, Salfingere, Bowman and Mitchell NOES: Members: None AæENT: Members: None PROBATIONARY PERIOD FOR 'WILLIAM D. AlSTRA.ND~ JR. Mr. Horstkotte, District Manager-Engineer, stated that William D. Alstrand, Jr. had been a permanent intermittent employee until he was given permanent status on July 1, 1961, and requested that his required probationary period terminate as of September 30, 1961, and that he be given the normal one step salary increase. It was moved by Member Bowman, seconded by Member Gibbs, that the pro- bationary period for WilliamD. Alstrand, Jr., Engineering Draftsman, terminate as of September 30, 1961, and the normal one step increase in salary be authorized, effective October 1,1961. Carried by the following vote: AYES: Members: Gibbs, Roemer, Salfingere, Bowman and Hi tchell NOES: Members: None ABSENT: Members: None ~ BUCHANAN FIELD SEWER MAINTENANCE Mr. Horstkotte, District Manager-Engineer, recommended to the District Board that the District maintain the sewers at Buchanan Field as requested by 10 19 61 n . I ~ , ' \.. ) n i I I ~¡ :133 the County, and requested authority to transmit a letter to the County stating that the District would accept easements to all main gravity sewers and maintain them. The pump installations would be maintained by the District and the County would be bil~ed for the District costs. It was moved by Member Bowman, seconded by Member Roemer, that Mr. Horstkotte, District Manager-Engineer, be authorized to tramsmit a letter to the County stating that the District would enter into an agreement to accept easements to the gravity sewers at Buchanan Field and maintain them and that pwnp installations would be maintained by the District and the County would be billed for the cost. Carried by the, following vote: AYES: Members: Gibbs, Roemer, Saltingere, Bowman am Mitchell NOES : Members: None ABSENT: Members: None SERVICE PIN AWARD PROGRAM Mr. Horstkotte suggested that the Board consider, for inclusion in the next budget, an annual service pin award program £or District employees. ARTICIE FOR THE PUBLIC WORKS MAGAZIHE Members of the Board were given a ccpy of an article prepared by Mr. Horstkotte fcr the Pu.blic Works Magazine. TREA.1KENT PLAN!' ST4FF Member Roemer stated he had visited the Treatment Plant on Saturday and fcund that, at certain times, there was only one person on duty and expressed his concern. . SHOTS FOR Ð1PLOYEES Mr. Horstkotte stated the District employees who were in positions where their work was in close proximity with sewage effluent were to take a series of shots as suggested by the Health Department. COUNSEL FOR THE DISTRICT None. VIII. ADJOORNMENT At 10:15 o'clock P.M., the meeting was adjourned by President Mitchell to November 2,1961.
