CENTRAL CONTRA COSTA SANITARY DISTRICT
HELD AUGUST 24, 1961

The District Board of Central Contra Costa Sanitary District convened in
an Adjourned Regular Session at its regular place of meeting located at 1250
Springbrook Road, Walnut Creek, C.ounty or Contra Costa, State or California,
on August 24,1961, at 8:00 o'clock P.M.
The meeting was called to order by President Hi tchell.

Mr. Bohn, Counsel ror the District, stated that the Local Iaprove.nt
District No. 30 assessment equivalent charge is a normal District charge for
the Local IJaprovement District Ho. 30 area as provided in Ordinance 28, and
there are no cirCUJll8tances under which relief of payment -1' be allowed.
It was moved by Member Roemer, secomed by Meaber Saltingere, that the
request of Mrs. C. W. Hutchinson for Teller fro. the Local Improvement District
No. 30 assessaent equivalent charge be denied. Carried by the rollowing vote:

Mr. Horstkotte, District Manager-Engineer, stated that the staff was
waiting for an F.H.A. report pertaining to Elderly Housing projects before
making a starf recommendation and to date it has not been received.
Continued to a future meeting when the stafr has received the necessary
information to determine if modification of the connection charge for Elderly
Housing projects is warranted.

Mr. Horstkotte, District Manager-Engineer, stated that Lincoln Enter-
prises, Inc. had been billed ror $1,500.00 for design of a syphon and pipe
line to be constructed between Walnut Blvd. and Main Trunk Sewer on Ygnacio
Valley Road which they were prepared to install to provide adequate service
for IIUltiple dwelling units at Ygnacio Valley Road and Walnut Blvd.
The District, in the interim, adopted Ordinance 144 providing for a
IIUltiple use charge to provide funds ror the District to provide capacity
in areas that will need more capacity due to properties being developed
for IIUltiple residential use.
Lincoln Enterprises, Inc. will now be paying the JRUl tiple use charge
and the District will be providing adequate capacity.
After discussion Mr. Horstkotte was instructed to review the plans
and determine if the $1,500.00 cost ie.reasonable after estimating what it
would have cost if the District's engineering staff had done the design work.
Continued to September 7,1961.
LINE G, SOUTH OF DANVILLE
Mr. Horstkotte, District Manager-Engineer, stated that the District
Board had previously authorized the preparation of plans and specifications
for Line G to San Ramon. He recommended that the Board authorize proceeding
with final plans and specifications and call ror bids to install the line
as far as Kelly. Lane scuth or Danville to clear the area in1hich the State
Division or H;i:ghways, the County, and the Flood Control District will be
doing major work in the near future. He also read a letter rrom Mr. Tije88ling
request1ngthat this line be extended 700 feet south or Kelly Lane to serve
approXltEtely 160 acres he was planning to develop immediately if his request
was granted.

Mr. Tijessling and Mr.. MUI'p!v', engineer ror Mr. Tijessling, stated that,
if they were assured the line would go in, they would start :1:IImediately to
develop the property.
In answer to Member Bowman, Mr. Horstkotte stated that he recommended
advertising immediately ror bids and extending the coapletion date into the
spring or 1962.
President Mitchell asked Mr. Horstkotte if the rebate area had been
determined and what the anticipated acreage charge would be to reimburse
the District.
Mr. Horstkotte stated that the rebate area was not finalized and it
was expected the unit charge would be about $250.00 per acre.
After discussion, it was moved by Member Salfingere, seconded by Member
Bowman, that final plans and specifications and the call for bids for Line
G work to Kelly :r.ne be authorized and, if Mr. Tijessling annexes his 160
acres :immediately, the line shall be extended approximately 700 feet to
serve his property. Carried by the rollowing vote:

REQUEST OF LA GONDA WAY PROPERTY OWNERS FOR CONTRIBUTION TœARD SEWER

After considerable discussion with the La Gonda Way, Danville,
property owners, the District Board instructed Hr. Horstkotte, District
Manager-Engineer, to submit a report at the next meeting for the Board
to consider in determining if a contribution by the District can be made
in exchange for their assigning to the District their rebate rights.
Mr. Bohn, Counsel for the District, stated that, upon a final deter-
mination, a rorm of written agreement will be required..

Mr. Horstkotte, District Manager-Engineer, stated that Mr. Kemp had
come to the crrice and called attention to a letter he had written in
1956 and a reply rrom Mr. Jfejedly, Counsel for the District, which stated
that, arter Local IlIIprove.nt District No. 30 proceedings were completed,
an adjustment in his assess_nt would be _de 11' funds were available.
Hr. Horstkotte, District Manager-Engineer, stated that the assessment
for Local Improvement District No. 30 provided for $248.10 ror those"
parcels within 600 reet or the line installed and $198.48 ror those beyond.
Mr. Kemp's pro~rty was. beyond 600 feet and assessed $248.10 and he should
be reimbursed $49.62 in accordance with Mr. Nejedly's letter as .funds were
available and a Mrs. Niles, a neighbor, had previously been reimbursed
for the same reason. ~
It was moved by Member Roemer, seconded by Member Salfingere., that
Mr. Kemp be reimbursed $49.62 for over assessment on Parcel No. 30-148-8.

Mr. Horstkotte, District Manager-Engineer, requested that the President
and Secretary be authorized to execute a supplemental agreement with the
State for additional work in the &JIOut of approximately $3,000.00 for
State Highway Sewer Relocation VI to be reimbursed by the State.
It was moved by Member Bowman, seconded by Member Gibbs, that the
President and Secretary be authorized to execute the supplemental
Utilities Agreement with the State of California for additional State
Highway Sewer Relocation VI work. Carried by the following vote:

GRANT OF EASEMENT TO SHEU, OIL COMPANY FOR POŒR POLm
Mr. Horstkotte, District Manager-Engineer, stated that the Shell
Oil Company had to move an oil line pump station at Pacheco due to the
State freeway and requested a right of way in the Districtls Line A area
in Pacheco to install power poles to provide service to a new location
for their new oil line pump station.
Mr. Horstkotte recommended that the President and Secretary be
authorized to execute the grant or easement agreement without cost to
Shell Oil Company.
It was moved by Member GibbS', seconded by Member Bowman, that the
President and Secretary be authorized to execute the grant or easement
in the Dis1irict' s Jñne A area in Pacheco without cost to Shell Oil
Company, subject to approval of District's Counsel. Carried by the
following vote:

CONTRA COSTA COUNTY BILL FOR COUNTY HIGHWAY SEWER RELOCATION I WORK,
ORINDA
Mr. Bolm, Counsel for the District, stated that the County bill
should be litigated and explained his reasoning.
Mr. Horstkotte, District Manager-Engineer, explained on the black-
board the relocation of District facilities as requested by the County.
It was moved by Member Bowman, seconded by Member Sa1ringere, that
Mr. Bolm, Counsel for the District, be authorized to proceed with the
litigation of the bill presented to the District ror relocation of
District facilities under County Highway Sewer Relocation I, Orinda.

VII. REPORTS
DISTRICT MANAGER-BNGINEER
STATUS OF WATERSHED 27 WORK
Mr. Horstkotte, District Manager-Engineer, reported that Watershed
27 was complete except for minor cleanup.
NAT IONAL ASSOC IATION OF COUNTY ENGINEERS MEETING
Mr. Horstkotte reported on the National Association of County
Engineers meeting in Chicago, stating that it was a work session giving
an opportunity to work with other engineers to get the sanitation
section manual, for which he was responsible, worked out.
WATER POLWTION CONTROL FEDERATION
Mr. Horstkotte stated that his paper to be presented to the Water
Pollution Control Federation at Milwaukee was getting into final form.
COUNSEL FOR THE DISTRICT
M. MILI.ER CCl!PANI LITIGATION

Mr. Bolm, Counsel ror the District, stated that a pre-trial con-
ference for the M. Miller Comapny litigation was set for September 5,
1961, and he was hopeful or its going to trial this year.

SETTLEMENl' OF THE CHA.RU:S HARNEY CŒtPüY LITIGATION
Mr. Bohn, Counsel ror the District, stated that the Charles Harney
Company case was settled in favor of the District and he felt the award
would be paid without appeal. He reported that the basis for the award
was Harney's negligence. Mr. Bohn stated that the records of the District
used for the trial were in good shape.
Mr. Horstkotte, District Manager-Engineer, stated that it pointed out
the advantage or taking many photographs.

CALIFORNIA SANITARY DJSTRICTS ASSOCIATION
President Mitchell repcrted that the trip to Santa Monica for the
California Sanitary Districts Association meeting was instructive and
productive. He stated that it takes a lot or time in watching legislation
and that combined action can save this District a lot of money. He stated
that he fel.t the California Sanitary Districts Association's most important
function was following the legislative program.
Mr. Horstkotte stated that 50- or the bills passed originated with
this District and a lot was accomplished in a positive way.
Mr. Bohn stated that the rield of 8pecial districts I legislation
has been sa~ neglected. He explained the procedure of getting bills

At 10:00 o'clock P.M., the meeting was adjourned by President Mitchell
to September 7, 1961.
