HomeMy WebLinkAboutBOARD MINUTES 06-26-61 96 ., ',:;W MINUTES OF A SPEC IAL MEETING OF THE DISTRICT BOARD CENTRAL CONTRA CœTA SANITARY DISTRICT HELD JUNE 26, 1961 The District Board of Central Contra Costa Sanitary District convened in a Special Meeting at its regular place of meeting located at 1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of California, on June 26,1961, at 7:30 o'clock P.M. The meeting was called to order by President Mitchell. ~ I.. ROLL CALL PRESENT: Members: Gibbs, Roemer, Salfingere, Bowman and Mitchell ABSENT : Members : None II. APPROVAL OF MINUTES Approval of the Minutes of the meeting of June 15,1961, was continued to July 6, 1961. III. RANCHO SAN RAMON HEIGHTS SEWERS President Mitchell called the Special Meeting in order to discuss with representatives of the "Rancho San Ramon Heights" area the methods of obtaining sewers for the area. Mr. Horstkotte, District Manager-Engineer, stated that the staff has had discussions with several residents in the area over the past several weeks. Member Roemer stated that this meeting was called at the request of County Supervisor Me1 Nielsen to discuss the pros and cons of the problem as the property owners were uncertain as to what they should do. A committee was appointed to meet with the Board. ~ Present at the meeting were: County Supervisor Me1 Nielsen District Attorney John A. Nejedly E. Green, County Health Department R. F. Mr. W. H. Moore stated that the committee had four objectives: 1. Details of least expensive method -- private financing or assessment district. ~ 2. Cost of obtaining sewers -- annexation fees, connection fees, assessments, etc. 3. 4. Details of financing sewer installation. Proceedings. 06 26 61 97 President Mitchell stated that it would be preferable that these costs be given to the group by letter. ~ Mr. Bohn, Counsel for the District, stated that all the problems were technical and spelled out in the law. The letter to the committee will specify what can be done. Mr. Horstkotte explained the assessment district procedure under the 1911 Improvement Act, stating that the area was outside of the District boundaries and, prior to forming an assessment district by this Board, it would require annexation to the District by a petition signed by owners of 75% of the assessed value of a specii'ied area. He stated that the proper petitions would be furnished by the District. Mr. Nejedly, District Attorney :for Contra Costa County, upon being questioned, stated that, when a petition was signed to annex, it could only be set aside on the basis of fraud. Mr. Horstkotte stated that once a proper and sufficient ~etition was presented to the District Board it would take approximately 42 months to get the proceedings under way :for an assessment district. Mr. Horstkotte stated that, if the project was to be privately financed, it would be necessary that those wishing service must first annex to the District and the group would engage an engineer to prepare the plans and specifications. The group would arrange for financing to pay for engineering and a contractor to install the sewers along with $25.00 to be paid to the District for review of plans i:f done by an engineer other than the District and 30' per foot for inspection of the main line. Pennit fees would be $1.00 :for the main line. Permit for each house connection would be $22.00 if a saddle was re- quired, or $15.00 if no saddle was required. """I Mr. Nejed1y stated that an assessment district could be fonned outside of the District boundaries which could allow properties to remain outside the District until sewer connection was made and save District taxes. Mr. Nejedly stated that whoever is to conduct the proceedings should carry them through to conclusion. Mr. Nejedly, upon being questioned, stated that, depending upon the properties, the market and interest rates, bonds issued to cover the assessments might be sold above or below par. Mr. Horstkotte stated that 6% was the maximum interest rate allowed under the Improvement Act of 1911. Member Gibbs questioned whether it would be equitable to other properties in the District to allow properties that participated in the installation of sewers under County procedures to remain out o:f the District and annex only when they wished to connect. Mr. Horstkotte estimated the cost to property owners for sewers under an assessment district to be: ~ Annexation fee, per acre Two-bath home with minimum fixtures Assessment, rough estimate Processing annexation House sewer eighty-foot set back, $3.00 per foot estimate Pennit Taxes to District per year $191.00 145.00 700.00 20.00 240.00 22.00 50.00 Mr. Horstkotte estimated that, if' connected, the first year's cost to the property owner would be approximately $750.00 if the assessment went to bond or $1,415.00 if the assessment was paid in full during the cash payment period (within thirty days a:fter confirmation o:f the assessment). 06 26 61 -------- --- . 98 Mr. Horstkotte stated that, if privately financed and connecting immediately, the total cost should not vary appreciably from the $1,415.00 first year all cash cost under an assessment district. Supervisor Mel Nielsen stated that, if requested, the Board of Supervisors would work along with the property owners and the District to facilitate the sewer installation. Mr. Burns stated that the County procedure would be slow and they wanted a solution as quickly as possible. The District Board instructed Mr. Horstkotte, District Manager-Engineer, to set forth in a letter to the committee for sewering Rancho San Ramon Heights all the estimated costs for obtaining sewers. ~ President Mitchell stated that the Board had yet to determine if sewering of the area would be allowed without annexation of all properties to be sewered, without exception. The committee thanked the District Board for the time taken in a Special Meeting to help them solve their problems. IV. ADJOURNMENT At 10:10 o'clock P.M., the meeting was adjourned by President Mitchell to July 6,1961.
