MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE DISTRICT BOARD
CENTRAL GONTRA. GœTA SANITARY DISTRICT
HELD DECEMBER 15, 1960

The District Board of Central Contra Costa Sanitary District convened
in an Adjourned Regular Session at its regular place of meeting located at
l250 Springbrook Road, Walnut Creek, County of Contra Gosta, State of
California, on December 15,1960, at 8:00 o'clock P.M.

The Minutes of the meeting of December 1, 1960, were approved as presented.

IV . HEARINGS '
DISTRICT ANlæXÄTION No.5
President Mitchell opened the Hearing for District Annexation No.5 and
asked for any protests.

There being no protests, the Hearing was ordered closed. Thereupon,
it was moved by Member Roemer, seconded by Member Salfingere, that Resolution
No. 1250 be adopted. Carried by the following vote:

President Mitchell and Member Bo'WIllaIl stated that, prior to further
consideration of the purchase of the State of Galifornia excess parcel
fronting on the freeway access road adjacent to the District office site,
the District staff should prepare a report for the Members of the Board
which Will justify the purchase by showing the need by the District Wi thin
the next 10 to 25 years.

VI. NEif BUSINESS
Mr. Dalton, District Administrative Engineer, acting for Mr. Horstkotte,
District Manager-Engineer, reported that the State of California had offered
the District another parcel of land adjacent to the recent purchase at'the .
northeast corner of the District office site proper~.
The parcel consists of 21,777 square feet, and the price established
is 10; a square foot, or a total of $2,177.70.

Mr. Dalton stated that another owner of property contiguous to the
parcel for sale had been notified of its availability.
After discussion and recommendation of the staff£or the'.purchase, it
was moved by Member Salfingere, seconded by Member Bowman, that the District
purchase the State of California excess parcel, consisting of 21,777 square
feet contiguous to the recent purchase, for $2,177.70 from Sewer Construc-
tion General Fund, if available to the District. Carried by the following
vote:

1242 of the Sanitary District Board, opposing Federal Law No.- 660 pro-
viding aid to Districts, to their Board on November 16, 1960, was read., ~

easements from Alvin K. Goodmundson, Kay-Vee Company, Ray Serra, and
Western Title Guaranty Co. be accepted and their recording ordered.

REQUEST OF MC GUIRE AND HESTER FOR ADDITIONAL PAYMENT II TRUNK SDIER D,

Mr. Dalton, representing Mr. Horstkotte, District Manager~ngineer,
stated that an addendum to the Standard Specifications was sent out at the
time bids were being received for Trunk Sewer D, Sections 11 through 15,
(Lafayette). The section relative to pipe bedding requirements apparently
caused confusion in the McGuire and Hester bid for the work.
McGuire and Hester were halted on the first day of trench work by the
inspector on the job because they were not meeting the requirements for
proper bedding of the pipe. McGuire and Hester were instructed to use
proper bedding, as required by the plans and specificatiens for the work,
and to keep a record of the costs for a determination at the completion
of Trunk Sewer D, Sections II through 15 (Lafayette)..

The staff recommended denial of the extra cost claim, stating that
the plans and specifications were clear, and that the item in question
was specific in the contract special provisions.
Mr. Aldrich, speaking for McGuire and Hester, stated that they had
made test borings and in certain areas they felt import material was

necessary, as indicated in their letter to the District Board dated
December 14, 1960. He stated that, when they received the addendum to
the District's Standard Specifications four days prior to the day bids
were to be submitted, they did not provide in their bid for rock under
the pipe as the District required.. ,

After discussion, the problem was referred to Mr. Bohn, Counsel for
the District, who asked that the McGuire ,and Hester representative have
their attorney contact him.

It was moved by Member Salfingere, seconded by Member Bowman, that
Trunk Sewer D, Sections 11 Through 15 (Lafayette) work be accepted, as
recommended by the District staff, and the filing of a Notice of Completion
be authorized. Carried by the following vote:

CLAIM OF A. G. PAXSON FOR DAMAGES
Upon the recommendation of the District's insurance carrier and the
District staff, it was moved by Member Roemer, seconded by Member Gibbs,
that the claim of A. G. Paxson, in the amount of $113.07, for damage
caused by sewage backing up into his home on September 26, 1960, be paid.

terms for annexing the Lee property on Creekside Drive in Pleasant Hill
be $191.00 per acre plus processing costs along with engineering require-
ments and Watershed 24 charges. Carried by the following vote:

Mr. Carlson was informed that the District would contact Dr. Engelbert,
owner from whom the easement to serve Bonnie Brae Highlands, Tract 2155, is
required, and notify him that, if settlement is not reached, the matter would
be placed on the Agenda .for the January 5, 1961, meeting.

DmTRICT MANAGER-ENGINEER
STATUS OF VARIOUS JOBS
Mr. Dalton, District Administrative Engineer, representing Mr.
Horatkotte, District Manager-Engineer, reported that Line A is progressing
satisfactori¡y, Line D is completed, the Orinda Grossroads and Moraga
Pumping Stations are operating satisfactorily with needed minor adjustments
from time to time, and engineering was proceeding on the line 11> San Ramon.

Mr. Bohn, Counsel for the District, reported that the jury for the
Thomson easement condemnation came up with an inequitable award and he felt

the decision should be appealed and motion for a new trial be made.
It was moved by Member Roemer, Beconded by Member Salfingere, that the
Thomson easement judgment not be pàid and that Mr. Bohn, Counsel for the
District, be authorized to appeal the decisiGn and move for à new trial.
