MINUTES OF AN ADJOURNED REGULAR HEETING
OF THE DISTRICT BOARD
CENTRAL CONTRA COS TA SANITARY DISTRICT
HELD OCTOBER 20, 1960
The District Board of Central Contra Costa Sanitary District convened
in an Adjourned Regular Session at its regular place of meeting located at
1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of
California, on October 20,1960, at 8:00 o'clock P.M.
The meeting was called to order by President Mitchell.

The Minutes of the meeting of October 6, 1960, were approved as presented.

OLD BUSINESS
LEGAL PROCEIDRE FOR CONDEMNATION OF SEWER EASEMENTS FOR OTHER THAN
DISTRICT ORIGINATED SEWER INSTALLATIONS

After discussion, it was determined that the procedure for the con-
demnation of easements shall be determined at the time they are presented
to the District Board.

Upon the recommendation of Mr. Horstkotte, District Manager-Engineer,
Mr. Bohn, Counsel for the District, and the District's insurance carrier,
it was moved by Member Bowman, seconded by Member Gibbs, that the claim of
Mrs. Irma Coles in the amount of $24.00 be paid. Carried by the following
vote:

PADIENT TO FRANK LLOYD -IVRIGHT FaJNDATION RE LAFAYETTE CENTER STRJJ>, LINE D
Mr. Horstkotte, District Manager-Engineer, explained that this was
part of the cost of installing a center strip in Lafayette in lieu of
repaving as a result of Line D work which will be a net saving to the
District.

It was moved by Member Roemer, seconded by I1ember Gibbs, that
$1,499.30 be paid from Sewer Construction Bond Funds to the Frank Lloyd
Wright Foundation for the District's share of the design of the traffic
islands in La.fayette to be installed in lieu of repaving. Carried by the
following vote:

It was moved by lv1ember Gibbs, seconded by Member Bowman, that
Ordinance 41 be adopted subject to changing the word "geographical II where
used to "topographical", after the words "shall be installed", in Section
2 shall be added "and kept in operable condition at all times", and under
Section 5 the last two words, IIprovided herein", shall be replaced with
"required by the provisions of this Ordinance II. Carried by the following

BILL FROM EAST BAY MUNICIPAL UT1LITY DISTRICT RE SURVEY OF SACRAMENTO
NOR'lHERN RAILROAD RIGHT OF WAY
Mr. Horstkotte, District Manager-Engineer, reported that the bill
received from the East Bay MUnicipal Utility District for the survey of
the Sacramento Northern Railroad right of way was larger than anticipated.
The bill was referred to the District staff for review of the costs
of the survey with East Bay Municipal Utility District.

It was moved by Member Roemer, seconded by Member Salfingere, that
Resolution No. 1248 be adopted. Carried by the following vote:

LINE A, PARCEL H, OWNER HOOK, TEMPORARY WORKING AREA AGREEMENT
After explanation, it was moved by Member Roemer, seconded by Member
Gibbs, that the President and Secretary be authorized to execute the
agreement with the Hooks for a temporary working area known as Parcel H,
Line A. Carried by the following vote:

PROTESTS OF MR. CONY MR. NICHOL MR. POWERS AND MR. CUMMING RELATIVE TO
THE EQUALIZATION CHdaE WHEN CO~TING TO AN ASSESSMENT DISTRICT SEWER LINE
After considerable discussion, the District Board determined that
the equalization of assessment section of Ordinance 33 adopted in August
of 1959 created certain inequities and charges without proper notice.

Pending further study by the District Board and staff as to amending
Ordinance 33, it was moved by Member Bowman, seconded by Member Roemer,
. that the staff be authorized to accept a promissory note in lieu of cash
payment pending the consideration of an amendment to Ordinance 33 relative
to the equalization of assessment charge. Carried by the following vote:

ACCEPTANCE OF EASEMENT FROM DOMENICA DOMPE, LINE A, PARCEL 22
It was moved by Member Roemer, seconded by Member Salfingere that
the easement from Domenica Dompe be accepted and its recording ordered.

VII. REPORTS
DISTRICT MANAGER-ENGINEER
STATUS OF VARIOUS JOBS
Mr. Horstkotte, District Manager-Engineer, reported that Line A was
expected to~be completed by the first of the year, 10 months ahead of
schedule, with the exception of that section which must wait for the
East Bay Municipal Utility District crossing.

Line D is progressing on schedule.
The Outfall Sewer line cutover is to be started this coming week.
Mr. Horstkotte stated that informal bids for work in Grayson Creek
previously authorized had been received and M.G.M. Construction Co. was
low with a bid of $2,257.00.
AUTHORIZATION TO ATTEND CALIFORNIA SANITARY DISTRICT ASSOCIATION MEETING
At the request of Ur. Horstkotte, it was moved by Member Roemer,
seconded by Member Bowman, that $25.00 each be authorized for Mr. Horstkotte,
District ~~ager-Engineer, and I1r. Bohn, Counsel for the District, to
attend a California Sanitary Districts Association Directors meeting in
Sacramento on November 4 and 5, 1960. Carried by the following vote:

AUTHORIZATION FOR ANNUAL MEMBERSHIP IN THE COUNTY ENGINEERS ASSOCIATION

A t the request of Mr. Horstkotte, it was moved by Member Salfingere,
seconded by Member Roemer, that annual membership for Mr. Horstkotte in
the County Engineers Association in the amount of $5.00 be authorized.
