OF THE DISTRICT BOARD OF CENTRAL CONTRA COSTA SANITARY DISTRICT HELD OCTOBER 4~ 1951 The District Board of Central Contra Costa Sanitary District convened in regular session at its regular place of meeting located at 1822 Mt. Diablo Boulevard, City of \'lalnut Creek, County of Contra Costa, State of California, October 4, 1951 at 8:00 o'clock p.m. The meeting was called to order by President Johnson and the roll was called: :RRESENT: ABSENT: Members Malott, Smitten, Toland, Wadsworth and Johnson Members - None READING OF MINUTES OF PREV.IOUS MEETING The Minutes of the previous meeting were read and were approved as entered. CONTINUATION OF HEARING ON WORK AND ASSESSMENT - LQ.CAL DiPROVE}iIENT DISTRICT NO., 21 Protest from A. E. Patterson, et aI, against condition of Roberts Road and Douglas Court. It had been determined that the County has accepted Roberts Road. It was moved by Member Toland seconded by Member l'1adsworth and ùnanimously carried that the protest be over-ruled. Protest from Earl Courtney, Assessment No. 21-20-1. It was moved by Member Toland, seconded by Member Smitten and unanimously carrjed that the protest be over-ruled. CONFIRMING ASSESSMENT FOR LOCAL IMPROVEMENT DISTRICT NO. 21 Member Smitten, seconò~d by Member Wadln10rth, moved the adoption of Resolution No. 710: RESO~UTION NO.~ ,710 WHEREAS, the Engineer of the Central Contra Costa Sanitary DiÐt- rict, County of Contra Costa, State of California, did on the 31st day of Augu~t, 1951, file with the Clerk of said District Board, an assessment to represent the cost anè ~xpense of the work and im- proveffient of Local Improvement District No. 21, pursuant to proceed- ings had and taken by said District Board, under and pursuant to Resolution of Intention No. 616 adopted the 29th day of June, 1950; and . ~Ĺ“EREAS, the Clerk of said District Board has duly given notice by publication, and mailing in the time and manner provided by law of the filing of said assessment and of the time set for hearing thereon, which time was fixed in said notices as the 25th day of September, 1951, at the meeting place of said District Board, located at 1822 Mt. Diablo Boulevard, Walnut Creek, California, and WHEREAS, the said District Board has received evidence oral and documentary concerning said assessment and the proper completion of the work and improvement for which the same is, issued, and has made its det~rmination of any changes and corrections to be made therein. NOW, THEREFORE, IT IS HEREBY RES~LVED, by the District Board of thA Central Contra Costa Sanitary District, County of Contra Costa, State of California, that the said assessment and the di~gram and warrant attached thereto and any correction or changes therein, the proce?dings leading up to the same and all acts and determinations 10 04 51 '2\6 of all officers of the Central Contra Costa Sanitary District in relation thereto be and the same are hereby ratified and confirmed, and the Engineer is hereby ordered to deliver said warrant, assess- ment and diagram to the contractor, forthwith upon the payment by him of the incidental expenses due thereon. M. Smitten, Secretary of the District Board DP~AGE TO SOUTH MOUNTAIN VIEW DRIVE LAFAYETTE - DOWNER CORP. Mr. E. H. Haase, et aI, property owners along South Mountain View Drive, by letter of September 20, 1951, complained of defective wort performed by Downer Corporation. The Engineer sts.ted that the sewer ditch had collapsed due to defective work on the part of Downer Corp., It was moved by Member Toland, seconded by Member Wadsworth, and unanimously carried, that the District pay $50.00 toward the cost of reconstrution work, and entsr this amount in the District claim against the Do",ner Corporation. CONNECTION FEES SET Lot 13, Dolores Drive, Lafayette - Raymond Salisbury. It was moved by Member Smitten, seconded by Member Wadsworth, and unan- imously carried, that connection fee be set in the amount of $100 for one building. El Rancho Diablo, 41 lots, K. L. Lincoln. It was moved by Member Smitten, seconded by Member Toland that connection fee be set in the amount of $100.00 per lot. Carried by the following vote: AYES: Members Smitten, Toland and Johnson. NOES: Members Malott and Wadsworth. Property on Springhill Road, Mrs. W. S. Ingram. It was moved by Member Wadsworth, seconded by Member Malott and unanimously carried that connection fee be set in the amount of $290.00 for one building. ~ 1. )..,1'.$ ~3~ Rose Heights Unit l,~ Sweet Drive and Dolores Way, Mr. Mortara. ~ It was moved by Member Wadsworth, seconded by Member Toland, and ~~\n unanimously carried, that connection fee be set in the amount of \ $100.00 per lot. Charles H. Monroe property near Strandwood Estates. It was moved by Member Wadsworth, seconded by Member Toland, and unan- imously carried that connection fee for one building be waived. OFFICE HOURS - SATURDAY MORNING The Manager was instructed to keep the office open on Saturday mornings from 9:00 A.M. to 12 noon. 10 04 51 .217 LAF AY5:TTE MEADmvS SEWER - W. A. GABRIEL Mr. Gabriel appeared before the Board requesting that he be allowed to collect connection fees from properties lying outside of Lafayette Meadows for connection to the sewer he installed in that subdivision, in order that he might recover some of the cost of installation. ct,.. I, './, ~a" The Board instructed Mr. Gabriel to furnish/figures on the costs incurred, and the amounts he had collected from each lot in Lafayette Meadows, and the difference in cost if he had connected to sewers in Local Improvement District No.3 instead of to the Main Trunk Section V. CO NDEMNAT ION OF PARCEL Haluck 8 L. 1. D. 23 Member Smitten, seconded by Member Malott, moved the adoption of Resolution No. 711: RESOLUT ION NO. 711 WHEREAS, the District Board of the Central Contra Costa Sanitary District has h~retofore approved plans and specifications prepared by its District Engineer for the construction, under the provisions of the Improvement Act of 1911, of a collecting lateral sani tar.:! sewer system in the area more particularly described in the proceed- ings for the improvement of Local Improvement District No. 23, and proposes to award a contract for the construction of said sanitary sewer in accordance with the plans and specifications therefor; NOW, THEREFORE, BE IT RESOLVED and this Board does hereby find and determine that the public interest, convenience and necessity require the acquisition, contruction and completion by this District of said collecting lateral sanitary sewer system, as set forth in said plans and specifications and that easements over the parcel of real property hereinafter described are necessary for the construct- ing, laying and maintaining of sewer pipes therein in said sanitary sewer system, in accordance with said plans and specifications. Said easements are more particularly described as follows: Perpetual easement to be used by said Sanitary District for the purpose of constructing, laying, maintaining and operating sewer pipes therein and thereupon, together with appurtenances and appliances and with the right of ingress thereto and egress there- from over the following described parcel of real property, and temporary easements twenty (20) feet in width located immediately on both sides and adjoining the perpetual easement hereinafter described, said easements located in the County of Contra Costa, State of California,described as follows: PARCEL EIGHT A portion of Lot 223, as designated on the map entitled IIUnit No.2, Haciendas del Orinda, Contra Costa County, California, II wh ich map was filed in the office of the Recorder of the County of Contra Costa, State of Calif- ornia, on October 15,1924, in Volum~ 19 of Maps, at pages 460 to 464, inclusive, described as follows: A strip of land 5 feet in width the center line of which is described as follows: Beginning at a point on the northwestern line of said Lot 223, said point bears south 350 5511011 west, 24.40 feet from the northwestern corner of said Lot 223; thence from said point of be~inning south 30 51' east, 72.77 feet; thence south 30 09' west, 125.35 feet to a point on a curve in the center line of La Espiral, the center of said curve, having a radius of 42 feet, bears south 230 131 5511 east from said point. The side lines of said 5 foot strip to be lengthened or shortened to extend entirely across said Lot 223. 10 04 51 218 BE IT FURTHER RESOLVED that the Attorney for said District be and he is hereby authori~ed and directed to commence and maintain actions and proceedings of eminent domain in the Superior Court of the State of California, in and for the County of Contra Costa, for the purpose of condemning and acquiring said easements over, upon and through said hereinabove described parcel of real prop- erty for the uses and purposes aforesaid. BE IT FURTHER'RESOLVED, and said Board does hereby find and determine, that the reasonable vRlue of the above-entitled Aase- ment proposed to be taken i s the sum of T~!enty and 43/100 Dollars ($20.43), and the President and Secreta,ry are hereby authorized and directed to execute a warrant payable to the County Clerk of the County of Contra Costa, to be deposited as security to the owners for the value of the easements herein proposed to be con- demned. M. Smitten, Secretary of the District Board COMPLAINT RE SEWER ALIGNMENT IN PARCEL 55 L.I.D. No.4. KAZEBEER By letter of October 2, 1951 Mr. Asa G. Kazebeer informed the Board that the sewer on his property had not been installed within the bounds of the easement granted to the District, and requested it be moved within the easement. . The Board instructed the Manager to acknowledge receipt of the letter, and to investigate the situation. PETITION FOR ANNEXATION - QUENTIN REYNOLDS The Board instructed the Attorney to have petition for annexa- tion from Quentin and Gertrude Reynolds pub11shed,setting the date of hearing as November 1, 1951. INSTALLATION OF EXTRA PUMPS AT ORINDA The I-tanager was given authority to have the pumps installed at the Upper and Lower Orinda stations immediately upon delivery. EXECUTING CONTRACT FOR SEWER SERVICE TO WASHINGTON LANE SCHOOL - ORINDA The Board authorized the President to execute the contract with the Orinda School District for sewer service to the school to be built at the end of Washington Lane, Orinda, with the stipu- lation that the work be completed by August 10,1952.
