HomeMy WebLinkAboutBOARD MINUTES 05-03-51 \68 MINUTES OF THE REGULAR MEETING OF THE DISTRICT BOARD OF CENTRAL ~ONTRA COSTA SANITARY DISTRICT HELD MAY 3. 1951 The District Board of Central Contra Costa Sanitary District con- vened in regular session at its regular place of meeting located at 1822 Mt. Diablo Boulevard, in the City of Walnut Creek, County of Contra Costa, State of California, on May 3, 1951, at the hour of 8:00 o'clock p.m. The meeting was called to order by President Johnson, and the roll was called: PRESENT:: ABSENT: Members Smitten, Toland, Wadsworth and Johnson Member Malott READING OF MINUTES OF PREVIOUS MEETING The Minutes of the previous meeting were read. The motion on page 166 regarding the Quentin Reynolds property annexation and connection was discussed. The phrase "normal connection charges" was ordered changed to "normal permit charges". The Board ordered clarification of the motion be presented by the Attorney for the next meeting. Approval of the Minutes was withheld pending approval of the the above mentioned motion. CONFIRMING ASSESSMENT FOR LOCAL IMPROVEMENT DISTRICT NO. 20 The President opened the hearing for the work and assessment of Local Improvement Distriot No. 20. There were no written protests received. Member Smitten, seconded by Member Toland, moved the adoption of Resolution No. 691: RESOLUTION NO. 691 WHEREAS, the Engineer of the Central Contra Costa Sanitary District, County of Contra Costa, State of California, did on the 12th day of April, 1951, file with the Clerk of said District Board, an assessment to represent the cost and expense of the work and improvement of Local Improvement District No. 20, pursuant to pro- ceedings had and taken by said District Board, under and pursuant to Resolution of Intention No. 658 adopted the 5th day of October, 1950; and WHEREAS, the Clerk of said District Board has duly given notice by publication, and mailing in the time and manner provided by law of the filing of said assessment and of the time set for hearing thereon, which time was fixed in said notices as the 3rd day of May, 1951, at the meeting place of said District Board, located at 1822 Mt. Diablo Boulevard, Walnut Creek, California, and WHEREAS, the said District Board has received evidence oral and documentary concerning said assessment and the proper completion of the work and improvement for which the same is issued, and has made its determination of any changes and corrections to be made therein. NOW, THEREFORE, IT IS HEREBY RESOLVED, by the District Board of the Central Contra Costa Sanitary District, County of Contra Costa, State of California, that the Said assessment and the diagram and 05 03 51 169' warrant attached thereto and any correction or changes therein, the proceedings leading up to the same and all acts and determinations of all officers of the Central Contra Costa Sanitary District in relation thereto be and the same are hereby ratified and confirmed, and the Engineer is hereby ordered to deliver said warrant, assessment and diagram to the contractor, forthwith upon the payment by him of the incidental expenses due thereon. It was moved by Member Smitten, seconded by Member Toland, and unanimously carried that the protest from John P. Cataline be over- ruled, and the Engineer be directed to prepare modification of the service to Lot 227. It was moved by Member Smitten, seconded by Member Wadsworth, and unanimously carried that the protest from W. E. Friberg be over-ruled and the Engineer be directed to comply with the change requested, deepening the sewer to 10 feet in Mr. Friberg's property. Member Smitten, seconded by Member Wadsworth, moved the adoption of Resolution No. 692: RESOLUTION NO. 692 ORDERING WORK, DETERMINING PREVAILING RATE OF WAGES, AND DIRECTING NOTICE TO BIDDERS LOCAL IMPROVEMENT DISTRICT NO. 23 - WHEREAS, the Distriot Board of the Central Contra Costa Sanitary District, County of Contra Costa, State of California, did on the 12th 05 03 51 110 day of April, 1951, adopt its Resolution'of Intention No. 689 to order the therein described work and improvement. to be done and made in Local Improvement Distriot No. 23 which Resolution of Intemtion was duly and legally published in the time, form and manner as required by law, as shown by the affidavit of publica- tion of said Resolution of Intention on file in the office of the Secretary of said Central Contra Costa Sanitary District; and WHEREAS, after the adoption thereof, notices of the passage of said Resolution of Intention, headed 'INotice of Improvement", were duly and legally posted in the time, form, manner, locations and number as required by law, as appears from the affidavit of posting said notices, on file in the office of the Secretary of said Central Contra Costa Sanitary District; and WHEREAS, after the adoption thereof, notices of the adoption of said Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvementg described in said Resolution of Intention according to the names and addresses of such owners, as the same appear on the last equalized assessment roll for County taxes prior to the day of such mailing, or as known to the Clerk of the Board of the Central Contra Costa Sanitary District, which said notioes were duly mailed in the time, form and manner as required by law; and WHEREAS, the District Board of the Central Co.ntra Costa Sani- tary District having duly received and considered evidence oral and documentary concerning the Jurisdictional facts in this pro- ceeding and concerning the necessity ,for the contemplated work and improvement and the benefits to be derived therefrom, and all protests filed in relation to said proceedings were duly considered by said District Board and are hereby ordered overruled, and said District Board having now acquired jurisdiction to order the pro- posed improvement, IT IS HEREBY RESOLVED, by the District Board of the Central Contra Costa Sanitary Distriot, County of Contra Costa, State ot California, that the public interest and convenience require the improvement herein referred to, and said District Board hereby orders that the work and improvement, as set forth and. described in said Resolution of Intention, and in the plans and specifica- tions therein referred to, to be done and made. RESOLVED FURTHER, that the boundaries of the assessment dist- rict, and the grades to which said work and improvments are to be constructed, shall be those set forth and described in said Res- olution of Intention, and in the plans and specifications therein referred to, reference to whXb is hereby made for all further par- ticulars. RESOLVED FURTHER, that the time hereby fixed for receiving sealed proposals or bids for the doing of said work and making of said improvement herein ordered is the 17th day of May, 1951, at the hour of 8:00 o'clock p.m., and the Secretary of the District Board is hereby ordered to give notice inviting such sealed bids in the following time, form and manner and as provided by law. RESOLVED FURTHER, that the Secretary of said District Board shall post conspicuously for five (5) days, on or near the main entrance door to the regular meeting place of said Board at 1822 Mt. Diablo Boulevard, Walnut Creek, California, a Notice to Bidders, in the form hereinafter stated, inviting sealed proposals or bids for doing said work and reverring to said Plans and Spec- ifications on file; and shall publish said Notice twice in the Courier~Journal, a newspaper published and circulated in Central Contra oats Sanitary District and hereby designated for that purpose. All such proposals or bids shall be submitted, received, and publicly opened, examined and declared, and shall be accompanied 05 03 51 17t by a certified check or bond, all as stated in said Notice to Bidders, which Notice .shall be as follows: NOTICE INVITING SEALED BIDS IN THE MATTER OF THE IMPROVEMENT OF LOCAL IMPROVEMENT DISTRICT NO. 23 Pursuant to the provisions of 'I Improvement Act of 1911 It and to Resolution ordering the Work of the District Board of the Central Contra Costa Sanitary District, County of Contra Costa, State of California, directing this Notice, said District Board hereby invites sealed bid8 and proposals for doing the work and improvement des- cribed in Resolution of Intention No. 689 in the above-entitled matter, of the District Board of the Central Contra Costa Sanitary District, County of Contra Costa, state of California, adopted April 12,1951, and said Resolution of Intention No. 689 is hereby referred to for a description of said work and improvement, the grades to which it is to be done, a description of the district to be assessed to pay the costs and expenses thereof, the bonds to be issued, and for all further particulars contained in said Resolution of Intention No. 689. Reference is hereby further made to the plans and specifica- tions and detailed drawings for said work on file in the office of the Secretary of said Central Contra Costa Sanitary District, in accordance with which said work shall be done. The foregoing schedule of prevailing rates of wages, And rates for overtime, Sunday and Legal Holidays, is based, unless otherwise specified, upon a working day of eight (8) hours. Overtime and Saturday rates for Truck Drivers shall be at one and one-half (Ii) times the normal hourly rate. The first two hours overtime, after a nermal eight (8) hour day, for Cement Finishers shall be at one and one-half (Ii> times the normal rate and further overtime shall be at double the normal rate. Saturday work for Cement Finishers shall be at one and one- half (It) times the normal rate for the first eight (8) hours worked and at double the normal rate for all further time worked on Saturdays. NOTICE IS ALSO HEREBY GIVEN BIDDERS that it shall be mandatory upon the contractor to whom thecontraot is awarded, and upon all subcontractors under him, to pay not less than said general pre- vailing rates of per diem wages, as above listed, to all laborers, workmen and mechanics employed in the execution of the contract. Anything to the contrary in the above wage scale notwithstand- ing, the Contractor and all subcontractors under him shall pay all their laborers, workmen, mechanics and employees on said work a salary or wage at least equal to the prevailing salary or wage for the same quality of service rendered to private persons, firms or corporations under similar employment, within the Central Contra Costa Sanitary District. . The per diem wage rate is the hourly rate hereinabove mention- ed established multiplied by the number of hours hereinabove men- tioned as constituting the working day for the particular craft or type of workman. . Before submitting proposals the bidder shall be licensed in accordance with the provisions of Chapter 9 Division III of the Business and Professions Code, Chapter 37 of the Statutes of 1939, as amended, of the State of California, which provides for the registration .and licensing of contractors. Each bidder must submit with his proposal, a statement of his financial responsibility, technical ability and experience on the form to be furnished prospective bidders. Each bidder shall submit with his bid on the form provided, the name and address of each subcontractor including the princi- pal suppliers of materials, and the portion of the work which each subcontractor will do. If the contractor fails to name the sub- contractors in his proposal, he shall be deemed to have agreed to perform such portion of the work himself and shall not be permitted 05 o~ 51 Iii to subcontract said portion of work without previous written per- mission of the District Board. The Contractor shall, in the performance of the work and im- provements, conform to the labor Code of the State of California and other laws of the State of California applicable thereto, with the exception only of such variation as may be required under the special statutes pursuant to which proceedings hereunder are taken and which have not been superseded by the provisions of the Labor Code. Preference to labor shall be given only in the manner pro- vided and required by law. Veterans and resident local labor shall be given preference by the Contractor wherever possible, if skill and working ability permit without increasing the ultimate cost of the work and improvement to the Local Improvement District, the Central Contra Costa Sanitary District and its officers. All proposals or bids shall be accompanied by a check payable to said Central Contra Costa Sanitary District and certified by a responsible bank for an amount which shall not be less than ten (10%) per cent of the aggregate of the proposal, or by a bond for said amount and so payable, signed by the bidder and two sureties, who shall justify, before any officer competent to administer an oath, in double the said amount and over and above all statutory exemptions. The proposal shall be made out on the form to be fur- nished prospective bidders, a copy of which is incorporated with the specifications. Said proposals or bids shall be delivered to the Clerk of the District Board of the Central Contra Costa Sanitary District on or before May 17, 1951, at the hour of 8:00 o'clock p.m., of said date, at the office of said Central Contra Costa Sanitary District at 1822 Mt. Diablo Blvd., Walnut Creek, Contra Costa County, State of California, said time being not less than ten (10) days from the time of the first publication or posting of said Notice. Bids will be opened on said day and hour. The District Board reserves the right to reject any and all proposals or bids, should it deem this necessary for the public good, and also the bid of the b1dder who has been delinquent or unfaithful in any former contract with the Central Contra Costa Sanitary District. , . ' All bids shall be submitted on the understanding that all work thereunder shall be done pursuant to the Improvement Act of 1911 and that all of the applicable requirements thereof shall be made a part hereof, of the Local Improvement District proceedings, the bonds and the contract. They were informed to have a proper petition submitted to the Board at the meeting of May 17, 1951. REQUEST FOR ANNEXATION INFORMATION W. F. OSTRANDER By letter of April 18, 1951, Mr. W. F. Ostrander requested procedure for annexation of the southwest corner of Monument Blvd. and Oak Grove Road. It was moved by Member Smitten, seconded by Member Wadsworth, that the Board not consider annexation of Mr. Ostrander's property. Carried by the following vote: AYES: NOES: ABSENT: Members Malott, Smitten, Wadsworth and Johnson Member Toland Members - None REQUEST FOR LEAVE OF ABSENCE LEONARD WALD It was moved by Member Smitten, seconded by Member Wadsworth and unanimously carried, that the Board grant the requested yearls leave of absence to Leona'rd Wald, and appoint Luther Clinton on a peDmanent basis at the same salary until Mr. ,Wald's return, which return must be with one year, otherwise the appointment to be with- out reservation. LOCAL IMPROVEMENT,DISTRICT NO. 22 DEPOSIT FOR PLANS REFUNDABLE It was moved by Member Wadsworth, seconded by Member Toland, and unanimously carried, that the deposits paid by contractors for plans for L.I.D. No. 22 be refundable. BOIES AND SOULE REQUEST TO RETAIN CONTROL OF SEWERS - ACALANES VALLEY By letter of April 25, 1951, Boies and Soule requested permis- sion to retain control of sewers contemplated for Acalanes Valley Units 2,3 and 4. It waS moved by Member Smitten that the request be denied. There was no second. It was moved by Member Wadsworth, seconded by Member Toland that the matter be held over to the next meeting. It was so ordered by the President. REQUEST FOR 90 DAY EXTENSION OF TIME MARTIN BROS. INC. L.I.D. 21 By letter of May 3, 1951, Floyd E. Martin requested a 90 day extension of time to complete the work of Looal Improvement Dist- rict No. 21, and stated he had opened the area for side sewer conne ctl ons.
