HomeMy WebLinkAboutBOARD MINUTES 03-22-51 129 MINUTES OF AN ADJOURNED MEETING OF THE DISTRICT BOARD OF CENTRAL CONTRA COSTA SANITARY DISTRICT HELD MARCH 22.1951 The District Board of Central Contra Costa Sanitary District con- vened in adjourned session at its regular place of meeting located at 1822 Mt. Diablo Boulevard, in the City of Walnut Creek, County of Contra Costa, State of California, on March 22,1951, at 8:00 o'clock p.m. The meeting was called to order by President Johnson, and the roll was called: PRESENT: ABSENT: Members Malott, Smitten, Wadsworth and Johnson Member Toland. Member Toland arried immediately after roll call. READING OF MINUTES OF PREVIOUS MEETING The Minutes of the previous meeting were read and were approved as entered. OPENING HEARING ON WORK AND IMPROVEMENT OF LOCAL IMPROVEMENT DISTRICT NO. 22 President Johnson opened the Hearing of protests against the work of Local Improvement District No. 22. Letters of protest were received and considered from the follow- ing persons: B. Perle Rowley; C. C. McCreery; Geo. W. Russell; Charles W. Merrill, by Herbert S. Shuey, Attorney in Fact; Margaret B. Merrill, by Clar- ence A. Shuey; Thomas Telfer. The Board over-ruled the protests from Mrs. Rowley and MesBrs. McCreery, Merrill and Mrs. Merrill. Mr. Herbert Bartholomew, an Associate of Mr. Clarence Shuey, spoke in behalf of Mrs. Merrill. The Engineer stated that the property had a gravity flow to the sewer. It was moved by Member Smitten that the protest be òver-ruled, motion seconded by Member Toland and unanimously carried. The Board instructed the Engineer to revise the sewer plans to properly serve the lot owned by Mr. Russell, and to notify Mr. Russell of the change. Mr. Telfer was advised that his type of protest was not applicable to the business at hand. The President asked if anyone present wished to enter oral protests; there was no response from the floor. Member Smitten, seconded by Member Wadsworth, moved the adoption of Resolution No. 681: RESOLUTION NO. 681 ORDERING WORK, DETERMINING PREVAILING RATE OF WAGES, AND DIRECTING NOTICE TO BIDDERS IN LOCAL IMPROVEMENT DISTRICT NO. 22 WHEREAS, the District Board of the Central Contra Costa Sanitary District, County of Contra Costa, State of California, did on the 1st 03 22 51 ,so day of March, 1951, adopt its Resolution of Intention No. 679 to order the therein described work and improvements to be done and made in Local Improvement District No. 22 which Resolution of In- tention was duly and legally published in the time, form and man- ner as required by law, as shown by the affidavit of publication of said Resolution of Intention on file in the office of the Sec- retary of said Central Contra Costa Sanitary District; and WHEREAS, after the adoption thereof, notices of the passage of said Resolution of Intention, headed "Notice of Improvement", were duly and legally posted in the time, form, manner, locations- and number as required by law, as appears from the affidavit of posting said notices, on file in the office of the Secretary of said Central Contra Costa Sanitary District; and WHEREAS, after the adoption thereof, notices of the adoption of said Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention according to the names and addresses of such owners, as the same appear on the last equal- ized assessment roll for County taxes prior to the day of such mailing, or as known to the Clerk of the Board of the Central Contra Costa Sanitary District, which said notices were duly mailed -in the time, form and manner as required by law; and WHEREAS, the District Board of the Central Contra Costa Sani- tary District having duly received and considered evidence oral and documentary concerning the Jurisdiotional facts in this proceeding and concerning the necessity for the contemplated work and improve- ment and the benefits to be derived therefrom, and all protests filed in relation to said proceedings were duly considered by said District Board and are hereby-ordered overruled, and said District Board having now acquired jurisdiction to order the proposed im- provement, IT IS HEREBY RESOLVED, by the District Board of the Central Contra Costa Sanitary District, County of Contra Costa, State of California, that the public interest and convenience require the improvement herein referred to, and said District Board hereby orders that the work and improvement, as set forth and described in said Resolution of Intention, and in the plans and specifica- tions therein referred to, to be done and made. RESOLVED FURTHER, that the boundaries of the assessment-dist- rict, and the grades to which said work and improvements are to be constructed, shall be those set forth and described in said Reso- lution of Intention, and in the plans and specifications therein referred to, reference to which is hereby made for all further particulars. RESOLVED FURTHER, that the time hereby fixed for receiving sealed proposals or bids for the doing of said work and making of said improvement herein ordered is the 12th day of April, 1951, at the hour of 8:00 o'clock p.m., and the Secretary of the District Board is hereby ordered to give notice inviting such sealed bids in the following time, form and manner and as provided by law. - RESOLVED FURTHER, that the Secretary of said District Board shall post conspicuously for five (5) days, on or near the main entrance door to the regular meeting place of said Board at 1822 Mt. Diablo Boulevard, Walnut Creek, California, a Notice to Bidders, in the form hereinafter stated, inviting sealed proposals or bids for doing said work and referring to said Plans and Specifications on file; and shall publish said Notice twice in the Orinda Sun, a newspaper published and circulated in Central Contra Costa Sanitary District and hereby designated for that purpose. The foregoing schedule of prevailing rates of wages, and rates for overtime, Sunday and Legal Holidays, is based, unless otherwise specified, upon a working day of eight (8) hours. Overtime and Saturday rates for Truck Drivers shall be at one and one-half (Ii> times the normal hourly rate. The first. two hours overtime, after a normal eight (8) hour day, for Cement Finishers shall be at one and one-half (It) times the normal rate and further overtime shall be at double the normal rate. . Saturday work for Cement Finishers shall be at one and one- half (Ii) times the normal rate for the first eight (8) hours work- ed and at double the normal rate for all further time worked on Saturday s . NOTICE IS ALSO HEREBY GIVEN BIDDERS that it shall be mandatory upon the contractor to whom the contract is awarded, and upon all subcontractors under him, to pay not less than said general pre- vailing rates of per diem wages, as above listed, to all laborers, workmen and mechanics employed in the execution of the contract. . Anything to the contrary in the above wage scale notwithstand- ing, the Contractor and all subcontractors under him shall pay all their laborers, workmen, mechanics and employees on said work a salary or wage at least equal to the prevailing salary or wage for the Same quality of service rendered to private persons, firms or corporations under similar employment, within the Central Contra Costa Sanitary District. The per diem wage rate is the hourly rate hereinabove mention- ed established multiplied by the number of hours hereinabove men- tioned as constituting the working day for the particular craft or type of workman. 03 22 51 133 Before submitting proposals the bidder shall be licensed in accordance with the provisions of Chapter 9 Division III of the Business and Professions Code, Chapter 37 of the Statutes of 1939, as amended, of the State of California, which provides for the reg- istration and licensing of contractors. . Each bidder must submit with his proposal, a statement of his financial responsibility, technical ability and experience on the form to be furnished prospective bidders. Each bidder shall submit with his bid on the form provided, the name and address of each subcontractor including the principal sup- pliers of materials, and the portion of the work which each subcon- tractor will do. If the contractor fails to name the subcontractors in his proposal, he shall be deemed to have agreed to perform such portion of the work himself and shall not be permitted to subcontract said portion of work without previous written permission of the District Board. The Contractor shall, in the performance of the work and improve- ments, conform to the labor Code of the State of California and other laws of the State of California applicable thereto, with the exception only of such variation as may be required under the spec1al statutes pursuant to which proceedings hereu~der are taken and which have not been superseded by the provisions of the Labor Code. Preference to labor shall be given only in the manner provided and required by law. Veterans and resident local labor shall be given preference by the Contractor wherever possible, if skill and working ability permit without increasing the ultimate cost of the work and improvement to the Local Improvement District, the Central Contra Costa Sanitary District and its officers. All proposals or bids shall be accompanied by a check payable to said Central Contra Costa Sanitary District and certified by a respon- sible bank for an amount which shall not be less than ten (10%) per cent of the aggregate of the proposal, or by a bond for said amount and so payable, signed- by the bidder and two sureties. who shall justify, before any officer competent- to administer an oath, in double the said amount and over and above all statutory exemptions. The proposal shall be made out on the form to be.furnished prospective bidders, a copy of which is incorporated with the specifications. Said proposals or bids shall be delivered to the Clerk of the District Board of the Central Contra Costa Sanitary District on or before April 12,1951, at the hour of 8:00 o'clock p.m., of said date, at the office of said Central Contra Costa Sanitary District at 1822 Mt. Diablo Blvd., Walnut Creek, Contra Costa County, State of Calif- ornia, said time being not less than ten (10) days from the time of the first publication or posting of said Notice. Bids will be opened on said day and hour. The District Board reserves the right to reject any and all proposals or bids, should it deem this necessary for the public good, and also 'the bid of the bidder who has been delinquent or unfaithful in any former contract with the Central Contra Costa Sanitary District. All bids shall be submitted on the understanding that all work thereunder shall be done pursuant to the Improvement Act of 1911 and that all of the applicable requirements thereof shall be made a part hereof, of the Local Improvement District proceedings, the bonds and the contract. Thormod, et aI, resi- dents of San Miguel Drive and Hillview Terraoe petitioning for sewers in that area was read. . It was moved by Member Smitten, seconded by Member Wadsworth, and unanimously carried that the Board authorize preliminary sur- vey in the area. REQUEST OF A. S. MACHADO FOR USE OF TREATMENT PLANT. AREA LAND The District Manager was instructed to notify Mr. Machado to proceed with agricultural work on the treatment plant acreage he requested to rent at $5.00 per acre per ànnum. The Attorney was instructed to draw up a lease identifying the exact area to be rented to Mr. Machado. REQUEST OF L.I.D. 13 RESIDENTS RE PAVING OF AREA The Engineer informed the Board that the residents within Local Improvement Distriot No. 13 requested some arrangement where by the County and our contractor make some agreement for the County to do the necessary repaving. The Engineer was instructed to inform the people that their request Was being given consideration. The Attorney was instructed to make a study and report at the next meeting. ORINDA COUNTRY CLUB REQUEST FOR $100. EASEMENT - LID 22 The agreement authorized at the meeting of March 1st, with the Orinda Country Club contained an amount of $100 to be paid to the Club for easement for Local Improvement District No. 22. The Club requested an additional $100 on the ground that their understanding had been they would receive $100 for each easement. It WaS moved by Member Wadsworth, seconded by Member Smitten that the Board authorize payment of an additional $100. Carried by the following vote: AYES: Members Smitten, Toland, Wadsworth and Johnson NOES: Members - None ABSENT: Members - None. Member Malott passed the vote. REQUEST FOR SEWER SERVICE MT. DIABLO UNIFIED SCHOOL DISTRICT The Mt. Diablo Unified School District requested information regarding sewer service to property lying east of Fair Oaks Sub- division. The Manager was instructed to notify the school district to furnish further information regarding exact location and size of the property, the contours, how many pupils and from what area the pupils will be drawn.!aem. PAYMENT TO COURIER JOURNAL It was moved by Member Sm!tten, seconded by Member Wadsworth, that the District settle the matter with the Courier Journal by charging them $1326.45 in refund less any charges they have out- standing. Carried unanimously. ACCEPTANCE OF EASEMENTS FROM MESSRS. ORR) SPIEGEL AND JOHNSON) LID 22 It was moved by Member Smitten, seconded by Member Wadiwerth and un~nimously carried that the District accept the easements - from Messrs.
