THE DISTRICT BOARD OF CENTRAL CONTRA
COSTA SANITARY DISTRICT HELD AUGUST 10,1950
The District Board of Central Contra Costa Sanitary District
convened in ad.lourned session at its regular place of meeting lo-
cated at 1822 Mt. Diablo Boulevard, Walnut Creek, County of Contra
Costa, State .of California on August 10,1950 at the hour of 8:00
o'clock p.m.
The meeting was called to order by President Wadsworth and
the following roll was called: .

CALLING FOR ELECTION OF OFFICERS
Member Toland, seconded by Member Cornwall, moved the adoption
of Resolution No. 633:
RESOLUTION NO. 633
RESOLUTION AND ORDER CALLING FOR ELECTION
OF OFFICERS OF THE CENTRAL CONTRA COSTA
SANITARY DISTRICT OF CONTRA COSTA COUNTY,
STATE OF CALIFORNIA
WHEREAS, Central Contra Costa Sanitary District of Contra Costa
County, California, was organized on the 15th day of July, 1946,
and ever since said date has been and now is a duly organi2'.ed,
established and existing Sanitary District in the County of Contra
Costa, State of California; and
iVHEREAS, Section 6484 of the Health and Safety Code of the
State of California. provides that:
"The members of the Board elected at the election as a
result of which the District was organized or, if the
district is reorganized under this part, then the five
members in office at the time of the reorganization,
shall at their first meeting or as soon thereafter as
may be practicable, so classify themselves, by lot,
that they shall go out of office as follows:
(b) Two shall serve until the second even-numbered
year after the district is formed or reorganized, and.
until the election and qualification of their successors."

WHEREAS, the ye~r 1950 is the second even numbered year after
the year in which the said Central Contra Costa Sanitary District
was organized; and
WHEREAS, the terms of members Elliott Johnson and Neill C.
Cornwall of this District Board w~ll expire in September 1950; and
~EEREAS, Section 6580 of the Health and Safety Code of the
State of California provides that:
"All election of officers, after the formation of the
District shall be held on the first Monde.y after the
second Tuesday in September"; and
WHEREAS, September 18, 1950, is the first l-londe.y after the
second Tuesday in September 1950; and
vlliEREAS, Section 6494 of the Health and Safety Code of the
State of California provides that:
"There shall be an election for aSsessor in each even
numbered year in which members of the Board are elec~ed
and at the same time, place and manner"; and
HHEREAS, the year 1950 is an even numbered year in which members
of the District Board are being elected;
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED:
1. That an election be held on September 18, 1950, to elect
two (2) persons as members of the District Board of said Central
Contra Costa Sanitary District to hold office for a term of four (4)
years, and to elect one (1) person to the office of aSsessor of the
said Sa.ni tary Di strict to hold. office for a term of two (2) years;
2. That said election be and the same is hereby called to be
held and the same will be held in said Sanitary District on the da.te
and in accordance with the provisions of the notice for said election
hereinafter set forth;
3. That said election be called and notice thereof be given by
posting notices in the form hereinafter provided, signed by a majority
of the members of said District Boar~, for not less than twenty (20)
days before the day of the election in three (3) public pIeces in
said Sanitary District, to-wit:
(1)
One on the telephone pole immediately in front of the
Post Office at Walnut Creek, California, in said San-
itary District; and
One on the telephone pole immediately in front of the
Post Office at La.fayette, Ce.lifornia, in said Sanitary
District; and
(2)

One on the telephone pole immediately in front of the
Post Office at Orinda, California., loca.ted near the
intersection commonly referred to as the Orinda Cross-
roads, in said Sanitary District; said places being
three (3) public places in said Central Contra Costa
Sanitary District; and the Secretary of this Board is
hereby directed to cause said notice to be posted as
hereinabove provided;
4. That said election shall be conducted as nearly as prac-
ticable in accordance with the general laws of the State, except
that the requirements as to the form of ballots and the nomination
of candidates shall not apply, and every voter resident within said
Sanitary District for the period requisite to enable him to vote at
a general election shall be entitled to vote at said election;

5. That the ballot to be used at said election shall be in
substantially the following form:

exceed, however, the number of candidates who are to be elected.
To vote for a person not on the h~llot, write his riame under the
title of the office in the blank Space left for that. purpose. All
ma.rks except the C"DSS (x) are forbidden. All distinguishing marks
or erasures are forbidden and make the hallot void. If you wrongly
stamp, tear or deface this ballot, return it to the Inspector of
Election and obtain another. On absent voter's ballots mark cross
(x) with pen or pencil.

NOTICE IS HEREBY GIVEN to the voters. of Central Contra Costa
Sa.ni tary Distrlct of Contra Costa County, State of California, that.
in accordance with the provisions of the Health and Safety Code of
the State of California, governing such elections, an election has
been called to be held a.t the pla.ces hereinafter desigm ted in said
Central Contra Costa Sanitary District on Monday the 18th day of
September 1950, from the hour of seven (7) o'clock a.m., of said
day until the hour of seven (7) o'clock p.m., of said day, during
which period of time the polls will be kept continuously open, for
the purpose of electing two (2) persons to serve as members of the
District Board of said Central Contra Costa Sa.ni tary District of
Contra Costa County, state of California, for a term of four (4)
yea.rs each, and one (1) person to the office of assessor of the
Central Contra Costa Sanitary District of Contra Costa County, State
of California., for a term of two (2) years, at which election every
voter resident within the said Sanitary District for the period
requisite to enable him to vote at a general election may vote for
persons to fill said offices.
For the conduct of said election Central Contra Costa Sanitary
-District shall constitute six (6) voting precincts. The State and
. County general election precincts lying in whole or in part within
said Central Contra Costa Sanitary District are hereby consolidated
for the purposes of said election, and each of said State and County
general election precincts is hereinafter referred to by name or
number immediately following the consolidated precinct number of
which it forms a part.
The polling places and officers of election to conduct said

Member Toland, seconded by Member Smitten, moved the adoption
of Resolution No. 634:

WHEREAS, FRANK P. NEGUS and DOROTHY E. NEGUS granted a Deed of
Dedication for Sewer Easement over a portion of Lot 2, asàesignated
on the map entitled "Moraga del Rey, Unit No.1, Contra Costa County,
California, II whlch is identified as Parcel 16 of Local Improvement
District No. 17, and
. WHEREAS, subsequently the Central Contra Costa Sanitary District
changed the location of the sewer line and has no need for said'
easement, .
NOW, THEREFORE, BE IT RESOLVED that the aforesaid easement be
conveyed to the Grantors.

CONNECTION FEE FOR H. BOGHOSIAN
PROPERTY IN LAFAYETTE
It was moved by Member Cornwall, seconded by Member Toland,
and unanimously carried, that the Board set connection fee in
the amount of $266.00, limited to one connection, for connection.
of Mr. H. Boghosian's property in Dolores Drive, Lafayette, plus
all costs of installing a six inch sewer.
FENCING STORAG5 LOT AT OFFICE BUILDING
It was moved by Member Johnson, seconded by Member Smitten,
and unanimously carried, that the Board authorize the Manager to
fence the storage lot at th~ office building with a .6-foot chain
link fence plu~ a one foot barbed wire overhe8.d at a cost not to
exceed $834.00.
FENCING FOR PIPE LINE AT CASCADE LAKE
It waS moved by Member Toland, seconded by Member Johnson,
and unanimously carried that the Board ~uthorize the Manager to
take steps to put a barbed wire fence around the Sewer pipe at
Cs.scade Lake in the Orinda Country Club property at a cost to be
approximately $300.00.
LOWER BYPASS AND FILL AROUND TANK AREA
It was moved by Member Toland, seconded by Memb~r Cornwall,
and unanimously carried that the Boay'ä authorize the Engineer to
lower the bypass a~ tþe entrance manhole to the sewage treatment
plant by the addition of a bypass line at elevation ~ 6; and to
fill area between sludge 4igestion tanks and sludge drying beds
and the dikes of the newest oxidation pond.

RESOLUTION ESTABLISHING A CLASSIFIED CIVIL SE~VICE
AND RULES AND PROCEDURES GOVERNING SAME FOR THE CENTRAL
CONTRA COSTA SANITARY DISTRICT, CONTRA COSTA COUNTY, CALIF.
RULE I POLICY
Section 1. It is declared the policy of the Central Contra Costa
Sanitary District that employees in its service be selected on the
be.sis of merit and fi tne ss a.scertained through practic8.l and com-
pet1 tive examina.tion, and that employees be given reasQnable sec-
urity of tenure.
Section 2. Therefore, it is understood that employees of the Dist-
rict shall give their faithful and complete service and shall
understand their tenure will be dependent upon Food behavior, .
efr iciency, nece ssi ty of the work and the appropria.tion of sufficient
funds.
Section 3. Therefore, the Board of Directors of this Dis~rict create
and establish a merit system for the selection and retention of
empllyees, and it is the policy of the Board that the acts and
decisions of the Board and of its officers shall be done in accord-
s.nce with good merit system prR.ctices and policies.
Section 4. In conformance with this policy, the Board of the Central
Contra Costa Sanitary District in recognition of the benefits incurred
by the establishment of a merit system, and in accordance with the
provisions of Section 6497 of the Health and Safety code, establish
such a system for the recruitment and retention of employees in its
service.
RULE II BOARD
The Board of the district .shall have the pm"er to adopt, amend,
or repea.l rul es for the conduct of the merit system. A quorum of
the Board at any regular meeting of the Board shall be necessa.ry to
alter, amend, adopt or repeal these rules.
RULE III DEFINITIONS
Section 1.
Appointment: The offer to, and acceptance by, a person of a
position in the claasified service in accordance with these rules.
Sect ion 2.
Appointing power: The District Board is hereby designated as
the authority to make appointments.
Section 3.
Board: \fuen used alone means the District Board of the Centra.l
Contra Costa Sanitary District.
Section 4.
Class: A group of positions sufficiently similar in respect
to duties and responsibilities that the same descriptive title may
be used, substantially the same tests of fitness apply, and the same
salary range may be made to apply with equity.
'Sect ion 5.
Classified Civil Service: The classified civil service shall
include all places of employment in the District, except the follow-
ing which are exempt or non-classified:
(1)
Elective officers;

(2) Persons rendering professional¡technical or expert
services who are under contract for a definite period of time;
(3) District Manager, District Engineer, Janitor, District
Secretary and District Attorney.
Section 6.
Dismissal: The separation of an employee fdr cause; a dis-
ciplinary measure.
Sect ion 7.
District: When used alone means the Central Contra Costa
Sanitary District.
Sect ion 8.
Eligible Person: A person who legally may be appointed to a
vacant position in accordance with these rules.
Section 9.
Eligible List: A list of persons who have been examined in
a competitive examination and 9.re eligible for certification for
a class, ranked in order of the score received.
Section 10.
Examination: (1) Assembled examination: A test conducted
at specified time B.nd place where applicants B.re required to appear
for competitive examination.
(2) Unassembled examination: An appraisal
of training. experience, work history, or use of other means for
evaluating other relative factors.
. (3) Physical examination: An. appraisal of
the .physical qualifications necesss.ry to perform the duties of
the position to which appointment is sought.
Section 11.
IIShallll is mandatory, IImayll is permissive.
Section 12.
IISuspensionll: The temporary separation of an empl.oyee with-
out pay for cause; a disciplinary measure.
RULE IV
CONTRACT FOR PERFO~¡ACE OF
ADMINISTRATIVE FUNCTION
The Board may contract with any municipality or county with-
in this state or with any state department- for the purpose of con-
ducting examinations or for performance of any other service in
connection with personnel selection and administration..
RULE V
CLASSIFICATION PLAN
Section 1.
The Board shall cause to be prepared a classificat-ion plan
consisting of the classes to which positions in the classified
service are, or are to be, allocated. A written specification
for each class shall be prepared setting forth the title, descrip-
tion of typical duties and responsibilities and a statement of
the minimum qualifications necessary anddesirable for efficient

performance of the work. Class specifications are descriptive and
explanatory and not restrictive and do not modify or limit the
power of the Board or its designated representatives to assign
duties to, and to direct and control the work of the employees.
Section 2.
The classification plan may be revised by the Board in regard
to such changes of title, revision, adoption or abolishment of class
specifications as may be necessary by changes in duties and respon-
sibilities or the creation of new classes.
Section 3.
All present employees who have served B.t least six months in
their present positions at the effective date of this Resolution
shall be deemed to retain their present positions without further
examinations. All employees who have not served six months, will
retain their present positions without further examination except
that they shall be pla.ced on pr.obation until they hRve served six
months.
RULE VI COMPENSATION PLAN
The Board shall a.dopt a plan for compensation of positions in
the classified service.
RULE VII EXAMINATIONS
Section 1.
As necessary, the Board shall hold or cause to be.held, exam-
inations for the classes of positions in the service of the District.
These examinations shall be publicly announced at least three weeks
in advance of the date of the examination, and applications filed on
forms prescribed by the District at least ten days prior to the
date of the examination.
Section 2.
No person may be employed who is not a Citizen of the United
States.
Section 3.
The Board may reject any application, refuse to examine any
applicant, refuse to certify any eligible or remove his name from
any eligible list if:

He is found to lack any requirements prescribed for the
class of position.
b.
He is disabled so as to be rendered unfit for the per-
formance of the duties of the class.
c.
He is aððicted to use of narcotics Or habitual use of
intoxicating liquors to excess, or has been convicted
of crime involving moral turpitude.
He has been dismissed from any public services for delin-
quency, misconduct or similar cause.

He has taken part in preparation or administra.tion 0 f the
examination or has obtained information regarding the
examination to which he, as an applicant, waS not entitled.
Has practiced or attempted to practice fraud or deception
in his application or in securing his eligibility for
appointment. ~ .

Section 4.
In the discretion of the BoRre, examinations shall be assem-
bled or unassembled. They may be written or oral, or in the form
of a practica.l demonstration 0 f skill or ability or any combina-
tion of these. Examinations shall be practical and relate to
those matters which fairly test the relative capacity of the
applicants to discharge the duties of the class to which they
seek appo~ntment. '
Section 5.
In the' discretion of the Board, examìnations for the cla.ss
of laborer may be confined solely to tests of physical fitness.
All applicants 'shall file an application prior to the time
of the examination.
Section 6.
The Board shall have the power to determine any'controversy
regarding examina,tions.
RULE VIII CERTIFICATION
Section 1.
In the discretion of the Board, candidates will be ranked in
the order of their score, and the highest three successful candi-
dates shall be certified for appointment.
Section 2.
Eligible lists shall be effective on approval of the Board
and lists shall be effective for not less than one year or more
than two years unless extended by the Board. Eligible lists may
be abolished by the Board after one year.
Section 3.
The Board may remove the name of any eligible from an elig-
ible list for any cause for which it may refuse to examine, and
for the following:
a.
Failure to respond to notice within five days of mail-
ing notice.
b.
Upon receipt of notice from eligible declining appoint-
ment and asking that his neme be removed.
c.
If the eligible has been offered and refused appointment
three t'imes.
Section 4.
In the discretion of the Board, the certification of.laborers
may be made in order of date, and time within date, of applicatipn.

Section 1.
The designated appointing power, may appoint to positions in

If the needs of the District indicate there should be positions
in a class requiring performance of duties on an irregular, inter-
mi ttent or seasone.l basis, an intermittent appointment shall be made
from those on the eligible list wishing to accept such work. In
case no eligible accepts such an appointment a temporary appointment
may be made.
RULE X PROBATIONARY PERIOD
All persons appointed to positions in the service of the
District shall serve a probationary period of six months. The
probationary period is a definite pa.rt of the examination and sat-
i8f~ctory performance on the job during the probationary period
shall be a requirement of any examination.
RULE XI DISCIPLINARY ACTION

Section 2.
The District Manager may suspend an employee subject to
approval of the Board as a disciplinary measure. Suspension may be
made up to thirty days in any c8.lendar year.
Section 3.
The District Manager may suspend an employee and recommend
dismissal to the Board. If the Board sustains the recommendation
for dismissal, the dismissal is effective as of the date of suspen-
sion.
Section 4.
If the Board, in its discretion, believes a lesser discipli-
nary action or no disciplinary action should be taken, the Board
shall so order. In the event no suspension is ordered,. the employee
will be reinstated as of the date of suspension, and shall receive
compensation from that date less what the employee has earned or may
have reasonably earned in other employment during the suspension.
Section 5.
The District Manager may file charges and take disciplinary
action against any employee for inefficiency, misconduct, or for
habitual use of intoxicating liquors in excess or for addiction to
the use of nRrcotics.
Section 6..
Any employee dismissed or suspended shall have the right to
present his evidence to the Board or designated hearing represent-
ative, concerning the events leading to the disciplinary action. In
the Board's discretion, it may secure the services of an impartial
person or persons to hear such evidence and to recoômend suitable
action to the Board.
Sect ion 7.
The decision of the Board regarding disciplinary actions shall
be final.

RULE XII
AT'rENDANCE
Employees in the classified service shall be in attendance
during the hours prescribed by the Board. 'Sick and vacation
leave may be granted by the Board B.t it s discretion.
RULE XIII INCOMPATIBLE
An officer or employeè in the classified service shall not
engage in any other activity or enterprise, inconsistent, incom-
patible, or in conflict with his duties as an officer or employee
or with the principles of a merit system.
RULE XIV LAYOFF
IVhenever it becomes necessary because of lack of work or
funds or whenever it. is advisable in the interests of economy to
reduce the number of employees, the Board shall determine the
. classes where layoff is to be made. Layoff shall be made accord-
ing to length of service in a class, with those persons being laid
off given an opportunity to a position in a lower class if their
seniority in the service is greater than that of any person in the
lower class, and such persons so laid off shall be found to be
qualified for such position in such løwer class.

The District Board of Central Contra Costa Sanitary District,
County of Contra Costa, State of California, does resolve as
follows:
In the Central Contra Costa Sanitary District the classified
employees shall be paid as compensation for all services required
of them by law or by virtue of their offices, the salaries and
other compensation hereinafter set forth:
1. There is hereby created a classification plan consisting
of the classes to which positions are to be allocated.. The spec-
ifications for each class, setting forth the title, description of
tY~ical duties and a statement of minimum qualifications n~cessary
ana desirable for efficient performance of the work, on file in
~he office of the Central Contra Costa Sanitary District are de-
clared to be necessary to and included with the classification

COJ.1PENSATION FOR TE~1PORARY EMPLOYMENT
Persons employed in temporary positions shall be compensated
at the hourly rate which is the equivalent of the minimum step of
the salary range to which the particular class of position is
allocated except in cases where the District Board has determined
that it is not possible to secure persons for such temporary em-
ployment at such hourly rate, and has authorized payment for such
temporary employment of an hourly rate which is equivalent to one
of the higher steps of the range to which the particular class is
allocated, then at such hourly rate.

Any person employed in a permanent position under the merit
system who works less than any full calendar month, except when
on earned vacation or authorized sick leave, shall receive as
compensation for such calendar month only an amount which is in
the same ratio to his established monthly salary as the number
of. days worked is to the number of actual working days in such
employee's normal work schedule for such month, provided, how-
ever, if the employment is intermittent, compensation shall be
on an hourly basis. .
6.
TERMS OF EMPLOYMENT:
The' following conditions shall apply to àll employees in
positions under the merit system. .
APPOINTMENTS All appointments under the merit system shall
be made by the District Board.
7.
EXEMPT OR NON-CLASSIFIED ~œLOYEES
Exempt or non-classified employees and officers shall be
entitled to the benefits of vacation and sick leave the same as
herein provided for classified employees.

8. . ADNINISTRATION:
The salary plan shall be administered in accordance with the
following provisions:
A. NEW EMPLOYEES Except as otherwise approved by the Board,
new employees shall be appointed at the minimum steps of salary
range adopted for the particular class of position to which the
appointment is made.
B. INCREMENTS WITHIN RANGE The salary of each employee under
the merit system except the salary of persons already at the maximum
step in the appropriate range, may be reviewed annually on the first
day of the month one year after the month of permanent appointrr:ent
to the particular class of position for the pur-pose of determining
whether the employee shall be advanced to the next higher step of the
range. Such advancement shall be given on the recommendation of the
District Manager and such recommendation may be made only on the
basis of continued satisfactory performance of the job.
C. SALARY ON PRONOTION. Any employee who is appointed to a
position of a class allocated to a higher salary range than the class
of the position which he formerly occupied shall receive the nearest
higher monthly salary in the new salary range as of the date upon
which the appointment becomes effective. For the purposes of further
annual increments within the salary range, the first day of the month
following promotion on a permanent basis shall be deemed the employee's
new anniversary date.
D. SALARY ON DEMOTION. An employee who is demoted to a class
of position having a salary schedule lower than the class of position
having a. salary schedule lower than the class of position from which
he was demoted. shall hs.ve his salary reduced to the monthly salary in
the range for the class of position to which he has been demoted next
lower than the salary he received before demotion. For the purposes
of further annual increments within the salary range, the first day
of the month following demotion on a permanent basis shall be deemed
the employee's new anniversary date.
E. FREQUENCY OF INCREMENTS Increments within the range shall
not be given more frequently than once a year, nor shall more than
one step within range increment be given at one time. No provision
in this section shall be construed as making the giving of increments
mandatory upon tbe, District Board.
9. SALARY PAYMENT PROCEDURE. The salaries of all officers and
employees of the District herein provided for shall be paid by the
District monthly, and where annual salaries are provided, they shall
be paid in equal monthly installments. Salaries shall be paid in
accordance with a schedule to be established by the order of the
Board. It is provided, however, that at the election of the employee,
indicated by written instructions of such employee, filed by him with
the District, a portion of his salary may be paid on his behalf direct
to his insurer, to cover the amount of the monthly premium on any
insuranc e contre.cted for him under any group insurance plan arranged
by him in conjunction with any other employees.
All resolutions or parts of resolutions in conflict with this
Resolution are hereby repealed.
