MINUTES OF AN ADJOUFUJED MEETING OF
THE DISTRICT BOARD OF CENTRAL CONTRA
COSTA SANITARY DISTRICT HELD JULY 20. 1950
The District Board of Central Contra Costa Sanitary District
convened in adjourned session at its regular place of meeting lo-
cated at 1822 Mt. Diablo Boulevard, Walnut Creek, County of Contra
Costs, State of California, on July 20,1950, at 8:00 o'clock p.m.
The meeting was called to order by President Wadsworth, and the
following roll was called:

The Engineer recommended that all protests be over-ruled, and
that the sewer plans remain unchanged.

AND DIRECTING NOTICE TO BIDDERS IN LOCAL IMPROVE-
MENT DISTRICT NO. 21
vmEREAS, the Distr~ct Board of the Central Contra Costa Sanitary
Di strict, County of Contra Costa, State' of Ca.lifornia, did on the
29th day of June, 1950, adopt its Resolution of Intention No. 616
to order the therein described work and improvemen~ to be done and
made in Local Improvement District No. 21 which Resolution of Inten-
tion was duly and legally published in the time, form and manner as
required by law, as shown by the affidavit of publication of said
Resolution of Intention on filé in the office of the Secretary of
said Central Contra. Costa Sanitary District; and

WHEREAS, after the adoption thereof, notices of the passage of
saiÖ Resolution of Intention, headed "Notice of Improvement", were
duly and legally posted in the time, form, manner, locations and
number as required by law, as appears from the affidavit of posting
said notices, on file in the office of the Secretary of said Central
Contra Costa Sanitary District; and
~VHE?EAS, after the adoption thereof, notices of the adoption of
said Resolution of Intention were duly mailed to all persons owning
real property proposed to be assessed for the improvements described
in said Resolution of Intention according to the names and addresses
of such owners, B.S the same appear on the last equalized assessment
roll for County taxes prior to the day of such mailing,.or as known
to the Clerk of the Board of the Central Contra Costa Sanitary Dist-
rict, which said notices were duly mailed in the time, form and manner
as required by law; and .
WHEREAS, the District Board of the Central Contra Costá Sanitary
District having duly received and considered evidence oral and docu-
mentary concerning the jurisdictional facts in this proceeding and
concerning the necessity for the contemplated work and improvement
and the benefits to be derived therefrom, and all protests filed in
relation to said proceedings were duly considered by said District
Board and are hereby ordered overruled, and said District Board having
now acquired jurisdiction to order the proposed improvement,
IT. IS HEREBY EE:SOLVED, by the District Board of the Central Contra
Costa Sanitary District, County of Contra Costa, State of California,
that the public interest and convenience require the improvement herein
referrßd to, and said District Board hereby orders that the work and
improv.ement, as set forth and described in said Resolution of Inten-
tion, .and in. the plans and specifications ther-ein referred to, to be
done and made.
RESOLVED FURTHE~, that the boundaries of the assessment district,
and the grades to which said work and improvements are to be constructed,
shall be those set. forth and described in said Resolution of Intention,
and. in the plans and specifications therein referred too reference to
which is hereby made for all further particulars.
RESOLVED FlBTHER, that the time hereby fixed for receiving sealed
proposals or bids.for the doing of said work and making of said im-
provement herein ordered is the 10th day of August, 1950, at the hour
of 8:0.0 o'clock p.m., and the Secretary of the District Board is hereby
ordered to give notice inviting such sealed bids in the following time,
form and, manner and as provided by law.
RESOLVED FURTHER, that the Secretary of said District Board shall
post conspicuously for five (5) days, on or near the main entrance
door to the regula.r meetinp: place of said Board at 1822 Mt. Diablo
Boulev.&.rd, Vial nut Creek, Celifornia, a Notice to Bidders, in the form
.hereinafter stated, inviting sealed proposals or bids for doing said
work and referring. to said Plans and Specifications on file; and shall
publish said Notic.e twice in Orinda Sun, a newspaper published and
circule.ted in Cent.rel Contra CostE Sanitary Di strict and hereby desig-
nated .for that purpose.
All such proposals or bids shall be submitted, received, and
public.ly opened, e.xamined and declared, and shall be accompanied by a
certif.ied check or bond, all as stated in said Notice to Bidders,
which .Notice shall be as follows:

Pursuant to the provisions of "Improvement Act of 1911" and to
Resolution ordering the Work of the District Board of the Central
Contra Costa Sanitary District, County ~. Contra Costa, State of Calif-
ornia,. directing this Notice, said District Board hereby invites

sealed bids and proposals for doing the work and improvement des-
cribed in Resolution of Intention No. 616 in the above-entitled
matter, of the District Board of the Central Contra Costa Sanitary
District, County of Contra Costa, State of California,adopted
June 29th, 1950, and said Resolution of Intention No. 616 is hereby
referred to for a description of said work and improvement, the
grades to which it is to be done, a description of the district to
be assessed to pay the costs and expenses thereof, the bonds to be
issued, and for all further particulars contained in said Resolu-
tion of Intention No. 616. Reference is hereby further made to the
pla.ns and specifications and detailed drawings for said work on file
in the office of the Secretary of said Central Contra Costa Sanitary
District, in accordance with which said work shall be done.
Said plans and specifications may be examined at 1822 Mt. Diablo
Blvd., Walnut Creek, and may be obtained upon the payment of $10.00
which will be returned.
Notice is further given that the District Board of the Central
Contra Costa Sanitary District, County of Contra Costa, State of
.Ca1ifornia, has established a prevailing rate and scale of wages in
accordance with law, which rate and scale is as follows, to-wit:

Overtime and Saturday work shall be paid for at double the normal
hourly rate except as noted below for Cement Finishers and Truck
Drivers and work on Sunda.ys and Holidays shall be paid for at double
the normal hourly rate,
The foregoing schedule of prevailing rates of wages, and rates for
overtime, Sunday and Legal Holidays, is based, unless otherwise spec-
ified, upon a working day of eight (8) hours.
Overtime and Saturday rates for Truck Drivers shall be at one and
one-half (It> times the norma.l hourly rate.

The first two hours overti~e, after a normal eight (8) hour day,
for Cement Finishers shall be at one and one-half (It> times the. nor-
mal rate and further overtime shall be at double the normal rate.
Saturday work for Cement Finishers shall be at one and one-half (l~)
times the normal rate for the first eight (8) hours worked and at
double the norma.l rate for all further time worked on Saturdays.
NOTICE IS ALSO HEFEBY GIVEN BIDDERS that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all sub-
contractors under him, to pay not less than said general prevailing
rates of per diem wages, as above listed, to all laborers, workmen
and mechanics employed in the execution of the contract.
Anything to the contrary in the above wage scale notwithstanding,
the Contractor and all subcontractors under him shall pay all their
laborers, workmen, mechanics and employees on said worl';: a salary or
wage at least equal to the prevailing salary or wage for the same
quality of service rendered to private persons, firms or corporations
under simill:œ employment, within the Central Contra Costa. Sanitary
District.
The per diem wage rate is the hourly rate hereinabove mentioned
established multiplied by the number of hours hereinabove mentioned
as constituting the working day for the particular craft or type of
workman.
Before submitting proposals the bidder shall be licensed in
accordance with the provisions of Chapter 9 Division III of the
Business and Professions Code, Chapter 37 of the Statutes of 1939,
aE amended, of the State of California, which provides for the regis-
tration and licensing of contractors.
Each bidder must submit with his proposal, a statement of his
fine.ncia.l responsibility, technicP..y ability and experience on the
form to be furnished prospective bidders.
Each bidder shall submit with his bid on the form provided, the
name and address of each subcontractor including the principal sup-
pliers of materials, and the portion of the work which each subcon-
tractor will do. If the contractor fails to name the subcontractors

in his proposal, he shall be deemed to have agreed to perform such
portion of the work himself and shall not be permitted to subcon-
tract. said portion of worlc without previous written permission of
the District goard
The Contractor shall, in the performance of the work and im-
provements, éonform to the labor Code of the State of California
and other laws of the State of California applice.ble thereto, with
the exception' only of such variation as may be required under the
special st~tutes pursuant to ~hich proceedings. hereunder are taken
and which have no.t been super.seded by the prov,isions of the Labor
Code.. Preference. to labor shall be given only. in the manner pro-
vided and required by law. Veterans and resident local labor shall
be given preferen.ce by the Contract.or wherever. possible, if skill
and working ability permit without increasing the ultimate cost of
the work and improvement to the Local Improvement District, the
Central Contra Co.sta Sani te.ry District and its officers.
All proposals- or bids shall be accompanied by a check payable
to said Central Contra Costa Sanitary District and certified by a
responsible bank for an amount which shall not be less than ten
(10%) of the aggregate of the proposal, or by a bond for said amount
and so payable, signed by the bidder and two sureties, who shall
justify, before any officer competent to administer an oath, in
double the said amount and over and above all statutory exemptions.
The proposal shall be made out on the form to be furnished pros-
pective bidders, a copy of which is incorporated with the specifica-
tions. '
Said proposals or bids shall be delivered to the Clerk of the
District Board of the Central Contra Costa Sanitary District on or
before August 10, 1950, at the hour of 8:00 p.m., of said date, at
the office of said Central Contra Costa Sanitary District at 1822
Mt. Diablo Blvd., Walnut Creek, Contra Costa County, State of Cal-
if~rnia, said time being not less than ten (10) days from the time
of the first publication or posting of said Notice. Bids will be
opened on said day and hour. The District Board reserves the right
to reject any and all proposals or bids, should it deem this neces-
sary for the public good, and also the bid of the bidder who has
been delinquent or unfaithful in any former contract wlththe
Central Contra Costa Sanitary District. '
All bids shall be submitted on the understanding that all work
thereunder shall be done pursuant to the Improvement Act of 1911
and that all of the applicable requirements thereof shall be made a
part h~reof, of the Local Improvement District proceedings, the
bonds and the contract.

FIXING TAX RATE FOR 1950-195l
Member Johnson, seconded by Member Smitten, moved the adoption
of Resolution No. 626: .
RESOLUTION NO. 626
WHEREAS, the District Board of Central Contra Costa Sanitary
District is required to estimate the amount of money needed and fix
the rate of taXation for District purposes and for the payment of
principal and interest on outstanding bonds for the fiscal year 1950-
51;
NOW, THEREFORE, BE IT RESOLVED as follows:
1. ThR.t Eighty Eight Thousand and Seven Hundred Forty B,nd No/lOOthe
Dollars ($88,740.00) is estimated as the sum needed for running ex-
penses of said District for the fiscal year 1950-51; and that Twenty
Nine Cents ($0.29) on each One Hundred Dollars ($100.00) of assessed
valuation of taxable property in the tistrict be levied to raise said
sum and that the proceeds of such levy be paid into the Running Ex-
pense Fund of said District.
2. That One Hundred Twenty Eight Thousand Five Hundred Twelve
and 50/l00ths Dollars ($128,512.50) is estimated as the sum needed for
the payment of principRl and interest, including interest on coupons
due and unpaid, upon outstanding bonds of 6entral Contra Costa Sani-
tary District (Issue of 1947) for the fiscal year 1950-51; that Forty
Two Cents ($0.42) on each One Hundred Dollars ($100.00) of assessed
vR.luation of taxable property be levied to raise said sum and that
the proceeds of such levy be paid into the Bond Fund of said District.
3. That the sum of Four Thousand Three Hundred Twenty Three and
No.lOOths Dollars ($4,323.00) is estimated as the sum needed for the
payment of principal and interest that will become 'due during the
fiscal year 1950-51 on bonds of Central Contra Costa Sanitary District
(Pacheco-Highway Junction Annexation, Issue of 1948); that Seventy
Eight Cents ($0.78) on each One Hundred Dollars ($100.00) of assessed
valuation in the territory covered by such annexation and within the
District be levied to raise. said sum and the proceeds of such levy be
paid into the Bond Fund of said District.
BE IT FURTHER RESOLVED that the President and Secretary be and
they are hereby authorized and oirected to certify to the Board of
Supervisors of the County of Contra Costa the sums of money herein
declared to be necessary for District purp.oses and the rates of tax-
ation to be levied to raise such sums.

It was moved by Member Johnson, seconded by Member Smitten, and
unanimously carried that the Board authorize the President and

Secretary to execute agreements with Pacific GaS and Electric
Company and Arlington Properties Company, Ltd., allowing construc-
tion of sewers for Local Improvement District No. 13 within their
properties.
RENEWAL OF LEASE WITH HOOPER COMPANY
It was moved by Member Toland, seconded by Member Johnson, and
unanimously carried'the.t the Board authorize the Manager to notify
Hooper and Company of the District's intention to renew the lease
for the 106 acres on which the Oxidation Ponds are located. '
AUTHORIZING PAYMENT TO OAKLAND SE"~R
CONSTRUCTION CO. FOR REALIGNMENT OF SECTION

It was moved by Member Toland, seconded by Member Cornwall,
that the Board authoriz.e ps.yment in the total amount of $5988.00
to Oakland Sewer Construction Company for realignment of Section

APPEAL OF ANNEXATION CHARGES PROPOSED
FOR DRIVE-IN THEATRE PROPERTY
Mr, Kessler appealed to the Board to reconsider the charge of
$750.00 per acre for annexation of the Drive-in theatre on the
He.rtinez Highway.
Mr. Kessler was informed that the Board would take the matter
under advisement.

Member Johnson, seconded by Member Toland moved the adoption
of Resolution No. 627:

AWARD OF CONTRACT
WHEREAS, the District Board of the Central Contr~ Costa Sanitary
District did in open session, on the 20th day of July, 1950, public-
ly open, examine and decla.re all sealed proposals or bids for doing
the work and improvement described in Resolution of Intention No.
601 for the construction of sewers and appurtenances in Local Im-
provement District No. 19 in the Central Contra Costa Sanitary Dist-.
rict, adopted on the 8th day of June, 1950, which Resolution of
Intention is hereby expressly referred to for a description of said
work and improvement and for all particulars relative to the pro- .
ceedings under said Resolution of Intention;

NOW, THEF£FORE, IT IS HEFEBY RESOLVED, that the District Board
of the Central Contra Costa Sanitary District hereby rejects all of
said proposals or bids except that herein mentioned, and hereby.

STRANDWOOD ESTATES
Mr, T. B, Strand requested that the Board consider a proposal
that in lieu of pe.yment by Mr. Strand of $9700.00 for connection of
Strandwood Estates to the sewers of the District, he be allowed to
construct the line himself, with the District furnishing the engineer-
ing work and pe,ying the costs of easements required, and thst he
only be required to connect Unit 2 of Strandwood Estates.
It was moved by Member Smitten, seconded by Member Toland that
consideration of the matter of Strandwood Estates be held over to
the next meeting. Carried unanimously.
