OF THE DISTRICT BOARD OF CENTRAL
CONTRA COSTA SANITARY DISTRICT HELD
JULY 13. 1950
The District Board of Central Contra Costa Sanitary District
convened in adjourned session at its regular place of meeting lo-
cated at 1822 Mt. Diablo Boulev8.rd, on July 13, 19.50, at the hour
of 8:00 o'clock p.m.
The meeting ~s called to order by President Wadsworth, and
the following roll was called:

The Minutes of the previous meeting were read and were approved
as entered.
ANNEXATION TEffi~S FOR LIPPERT AND
KESSLER - DRIVE-IN THEATRE. .
The Manager was instructed to reply to Messrs. Lippert and
Kessler's letter of July 7, 19.50, requesting terms of annexation,
to the effect that the District would approve annexation on the
basis of $750.00 per acre, they to pay their own expenses.

HEARING ON AHENDHENT OF RESOLUTION OF
INTENTION - LOCAL IMPROVEMENT DISTRICT 13
There were no written or oral protests to the proposed amend-
ment to Resolution of Intention No. .583, Local Improvement Distriot
No. 13.
Member Johnson, seconded by Member Smitten, moved the adoption
of Resolution No. 620:

~VHEREAS, the District Board of the Central Contra Costa Sani-
tary District did on the 22nd day of June, 1950, adopt Resolution
No. 606, and
mŒREAS, said Resolution proposed to modify said Resolution of
Intention No. .583 and ordered that the 13th day of July, 19.50, be
the day and 8:00 o'clock p.m., be the time and the meeting place
of the District Board of the Central Contra Costa Sanitary District
located at 1822 Mt. Diablo Boulevard, Walnut Creek, be the place
where and when all persons having any objection to such proposal to
amend said Resolution of Intention might protest such proposed.
amendment and notice thereof was given by publication in the Orinda
Sun at least ten (10) days prior to said date, and

tary District met at such time and place and no protests to such
amendment being received,
IT IS HEREBY RESOLVED by the District Board of the Central
Contra Costa Sanitary District that the statement of Present Pro-
visions referred to in said Resolution No. 606 which are herein re-
ferred to and by reference made a part hereof be and the same hereby
are ordered removed from the said Resolution of Intention and the
Revised Provisions referred to in said Resolution No. 606 which are
hereby referred to and by reference made a part hereof be included

RESOLUTION NO. 621
ORDERING ì'¡ORK, DETERlvIINING PREVAILING RATE
OF ~';AGES, AND DIRECTING NOTœCE TO BIDDERS IN
LOCAL IMPROVEMENT DISTRICT NO. 13
WHEREAS, the District Board of the Central Contra Costa Sanitary
District, County of Contra Costa, State of California, did on the 4th
day of May, 1950, adopt its Resolution of Intention No. 583 to order
the therein described work and improvements to be done and made in
Local Improvement District No. 13 which Resolution of Intention was
duly and legally published in the time, form and manner as required
by law, as shown by the affidavit of publication of said Resolution
of Intention on file in the qffice of the Secretary of said Central
.Contra Costa Sanitary District; and
WHEREAS, after the adoption thereof, notices of the passage of
said Resolution of Intention, headed "Notice of Improvement", were
duly and legally posted in the time, form, manner, locations and
number as required by law, as appears from the affidavit of posting
said notices, on file in the office of the Secretary of said Central
Contra Costa Sanitary District; and'
WHEREAS, after the adoption thereof, notices of the adoption of
said Resolution of Intention were duly mailed to all persons owning
real property proposed to be assessed for the improvements described
in said Resolution of Intention according to the names and addresses
of such owners, as the same appear on the last equali?ed assessment
roll for County taxes prior to the day of such mailing, or as known
to the Clerk of the Board of the Central Contra Costa Sanitary Dist-
rict, which said notices were duly mailed in the time, form and manner
as required by law; and
WHEREAS, the District Board of the Central Contra Costa Sanitary
District having duly received and considered evidence oral and docu-
mentary concerning the jurisdictional facts in t~is proceeding and
concerning the necessity for the contemplated work and improvement
and the benefits to be derived therefrom, and all protests filed in
relation to said proceedings were duly considered by said District
Boerd and are hereby ordered overruled, and said District Board
having now acquired jurisdiction to order the proposed improvement,
IT IS HEREBY RESOLVED, by the District Board of the Central
Contra Costa Sanitary District, County of Contra Costa, State of
California, that the public interest and convenience require the
improvement herein referred to, and said District BoRrd hereby orders
that the work and improvement, as set forth and described in said
Resolution of Intention, and in the plans and specifications therein
referred to, to be done and made, as amended.

RESOLVED FURTHER, that the boundAries of the assessment dist-
rict, and the grades to which said work and improvements are to
be constructed, shall be those set forth .a.nd described in said
Resolution of Intention, and in the plans and specifications
therein referred to, reference to which is hereby made for all
further particulars, as amended.
RESOLVED FURTHER, that the time hereby fixed for receiving
sealed proposals or bids for the doing of said work and making of
said improvement herein ordered is the 3rd day of August, 1950, at
the hour of 8:00 o'clock p.m.. and the Secretary of the District
Board is hereby ordered to give notice inviting such sealed bids
in the following time, form and manner and as provided by law.
RESOLVED FURTHER, that the Secretary of said District BoarÀ
shall post conspicuously for five (5) days, on or near the main
entrance door to the regular meeting place of said Board at 1822
Mt. Diablo Boulevard, Walnut Creek, California, a Notice to Bidders,
in the form hereinafter stated, inviting sealed proposals or bids
for doing said work and referring to said Plans and Specifications
on file; and shall publish said Notice twice in The Orinda Sun, a
newspaper published and circulated in Central Contra Costa Sanitary
District and hereby designated for that purpose.
All such proposals or bids shall be submitted, received, and
publicly opened, examined and declared, and shall be accompanied
by a certified check or bond, all as stated in said Notice to Bid-
ders, which Notice shall be as follows:

Pursuant to the provisions of "Improvement Act of 191111 and to
Resolution ordering the Work of the District Board of the central
Contra Costa. Sanitary District, County of Contra Cos1:;a, State of
Ca.lifornia, directing this Notice, said District Board hereby in-
vites sealed bids and proposals for doing the work andimprovement
described in Resolution of Intention No. 583 as amended in the
above-entitled matter, of the District Board of the Central Contra
Costa Sanitary District, Co~nty of Contra Costa, State of California,
adopted May 4th, 1950, and said Resolution of Intention as amended
is hereby referred to for a description of said work and improvement,
the grades to which it is to be done, a description of the district
to be assessed to pay the costs and expenses thereof, the bonds to
be issued, and for all further particulars contained in said Resolu-
tion of Intention No. 583. Reference is hereby further made to the
plans and specifications and detailed drawings for said work on file
in the office of the Secretary of said Central Contra Costa Sanitary
District, in accordance with which said work shall be done. As said
resolution has been amended.
Said plans and specifications may be examined at 1822 Mt. Diablo
Boulevard, Walnut Creek, and may be obtained upon the deposit of
$10.00 which will be returned.
Notice is further given that the District Board of the Central
Contra Costa Sanitary District, County of Contra Costa, state of
California, has established a prevailing rate and scale of wages in
accordance with law, which rate and scale is as follows, to-wit:

Overtime and Saturday work shall be paid for at double the normal
hourly rate except as noted below for Cement Finishers and Truck
Drivers and work on Sundays and Holidays shall be paid for at double
the normal hourly rate.
. The foregoing schedule of prevailing rates of wages) and rates
for overtime, Sunda.y and Legal Holidays, is based, unless otherwise
specified, upon a working day of eight (8) hours. .

Overtime and Saturday rates for Truck Drivers shall be at one
and one-half (li) times the normal hourly rate.
.The first two hours overtime,' after a normal eight (8) hour day,
for Cement Finishers ~hall be at one and one-half (l~) ~imes the
normal rate and further overtime shall be at double the normal rate.
Saturday work .for. Cement Finishers shall be at one and one-half (Ii)
times the normal rate for the first eight (8) hours worked and at
double the normal rate for all further time worked on Saturdays.
NOTICE IS .ALSO HEREBY GIVEN BIDDERS that it shall be mandatory
upon the contractor to whom the cf)ntract is awarded, and upon all
subcontractors under him, to pay not less than said general pre-
vailing rates .of per diem wages, as above listed, to all laborers~
workmen and mechanics employed in the execution of the contract.
.Anything to the contrary in the above wage scale not~i thstand-
ing,' the Contractor and all subcontractors under him shall pay all
their laborers, workmen, mechanics and employees on said work a
salary or wage at least equal to the prevailing salary or wage for
the ,same quality of service rendered to privB.te persons.,. firms or
corporations under similar employment, within the Central Contra
Costa Sanitary District.
The per diem wage rate is the hourly rate hereinabove mentioned
esta~lished multiplied by the number of hours hereinabove mentioned
as constituting the working day for the pa.rticule.r craft or type of
workman.
Before submitting proposals the bidder shall be licensed in
accorè,ance with the provisions of Chapter 9 Division III of the
.Business and Professions Code, Chapter 37 of the Statutes of 1939,
as amended, of the State of Cp,lifornia, which provides for the reg-
i stratton and ,licensing of contractors.
Each bidder must submit with his proposal, a statement df his
fina.ncial . responsibi1i ty, technioÐ,l ability and experience on the
form to be furnl shed prospective bidders.

E~ch bidder shall submit with his bid on the form provided, the
name. and addres s of each subcont racto-r including the principal
suppliers of materials, and the portion of the work which each sub-
contractor will do. If the contractor fails to name ~he subcon-
tractors in hi.s proposal, he shall be deemed to have agreed to per-
form such portion of the work himself and shall not be permitted to
subcontract said. portion of work without pevious written permission
of the District Board.
The Contractor shall, in the performance of the work and im-
provement s, conform to the labor. Code of the State 0 f Cs.lifornia
and .othe I' laws of the Ste.te of Ca.1ifornia applicable thereto, with
the exception only of such variation a-s may be required under the
special statutes pursuant to' wñich proceedings hereunder are taken
and which have not been superseded by the provisions of the Labor~
Code,. Preference to la.bor shall be given only in the mp..nner pro-
vided and required by law. Veterans and resident local labor shall
be given preference by the Contractor wherever possible, if skill
B.nd working ability permit without increasing the ultimate cost of
the work and improvement to the Local Improvement Distriot, the'
Central Contr~ Costa Sanitary District and its officers.
All proposals or bids shall- be accompanied by a check payable
to said Central Contra Costa Sanitary Distriot and certified by a
responsible bank for an amount which shall not be less than ten
(10%) per cent of the aggregate of the proposal, or by a bond for
said amount and so payable, signed by the bidder and two sureties,
who shall justify, before any officer competent to administer an
oath, in double the said amount and over and above all statutory
exemptions. The proposal shall be made out on the form to be fur-
nished prospective bidders, a. copy of which is incorporated with
the speoifications~

Said proposals or bids shall.be delivered to the Clerk of the
District Boarð of the Central Contra Costa Sanitary District on or
before August 34d, 1950, at the hour of 8:00 p.m., of said date, at "
the office of said Central Contra Costa Sanitary District at 1822
Mt. Diablo Blvd., Ttlalnut Creek, Contra Costa County, State of Ca.lif-
ornia, said time being not less than ten (10) days from the time of
the first publication or posting of said Notice. Bids will be opened
on said day and hour. The District Board reserves the right to
reject any and all proposals or bids, should it deem this necessary
for the public good, and also the bid of the bidder who has been
delinquent or unfaithful in any former contract with the Central
Contra Costa Sanitary .District.
All bids shall be submitted on the understanding that all work
thereunder shall be done pursuant to the Improvement Act of 1911 and
that all of the applicable requirements thereof shall be made a part.

District No. 18, from P. & J. Artukovich, Inc. The bid was opened,
read and referred to the Engineer for tabulation.
The Engineer advised acceptance of the bid, which WB.S in the
amount of $4~Oði,'Ð. The Engineer's estimate was $46,4.59.20.

open, examine and declare all sealed proposals or bids for doing the
work and' improvement described in Resolution of Intention No. 594 for
the construction of sewers and appurtenances in Local Improvement
District No. 18 in the Central Contra Costa Sanitary District, adopted
on the lst day of June, 1950, which Resolution of Intention is hereby
expressly referred to for a ãescription of said work and improvement
and for all particulars relative to the proceedings under said Reso-
lution of Int ention;
NO~'7, THEREFORE, IT IS H~R~BY RESOLVED, that the District Board
of the Central Contra Costa Sanit ary District hereby re jects all of
said .proposals or bids except that herein mentioned, and hereby awards
the contract for doing said work and making said improvements to the

OVER THE REAL PROPE~TY OF POWELL ET AL
LOCATED IN THE CENTRAL CONTRA COSTA SANITARY

BE IT RESOLVED, by the District Board of the Central. Contra
Costa Sanitary District as follows:
That the public interest, convenience and necessity require
the construction of a sanitary sewer from Gregory Gardens, Unit
No.6, to Gregory Gardens, Unit No.3, such units being units of
a subdivision within the boundaries of the Central Contra Costa
Sanitary District and within the County of Contra Costa, State of
California, and that the easements over the parcels of real prop-
erty hereinafter described are necessary for the construction and
maintenance of such sanitary sewer; such easements being more
pArticularly described as follows: . .
. Perpetual easement to be used by said Sanitary District for
the purpose of constructing, laying, maintaining and operating
sewer pipes therein and thereupon, together with appurtenances and
appliances and with the right of ingress thereto and egress there-
from over the following described parcel of real property; and a
temporary easement twenty (20) feet in width located immediately
to the east and adjoining the perpetual easement hereinafter des-
cribed, said eásements located in the County of Contra Costa,
State of California, described as follows:
A strip of land 10 feet in width, the center line of which is des-
cribed as follows:
Commencing at a point on the southern .boundary line of Lot .538, as
the said Lot is shown on that certain map entitled "Gregory Gardens
Unit No.3, Contra. Costa County, California, II etc., filed November
29, 1949 in Volume 38 of Maps, at page 37, in the office of the
County Recorder of the said County of Contra Costa, located thereon
south 890 41' 27" west' 37.50 feet from the southeastern corner of
said Lot .538; thence from said point of commencement, leaving said
southern boundary line of Lot .538, south 00 20' 14" east, 240.89
feet to a point on the southern boundary line of that certain

of Official Records, at page 40, in the office of the County Recorder
of Contra Costa County, California, located thereon south 890 39' 46"
west. 1139.20 feet from the western line of the state Highway leading
from Pacheco to Walnut Creek.
BE IT FURTHER RESOLVED that the Attorney for said District be and
he is hereby authorized and directed to commence and maintain actions
and proceedings of eminent domain in the Superior Court of the state
of California, in and for the County of Contra Costa, for the purpose
of condemning and acquiring said easements over, upon and through
said hereinabove described parcels of real property for the uses and
purposes aforesaid.
BE IT'FURTHER RESOLVED, and said Board does hereby find and de-
termine, that the reasonable value of the above7described easements
proposed to be taken in the sum of Seventy Dollars ($70.00) and the
President and Secretary are hereby authorized and directed to execute
a warrant payable to the County Clerk of the County of Contra Costa,
to be deposited as security to the owners for the value of the ease-
ments herein proposed to be condemned.

CONNECTION FEE - ACALANES VALLEY
The Manager was instructed to reply to Boies, Soule' and Bardell,
Inc. giving terms of connection to the District's sewers as follows:
$85.00 per lot plus permit and inspection fees, and no rebate for
l8ter connections.
CONNECTION FEE - ROBB O. BROWN
PLEASANT HILLS GARDEN TRACT
The Manager was instructed to notify Mr. Robb O. Brown that ex-
tension of sewer in Elliott Drive to serve Lots 3, 4, 39 and 40 of
Pleasant Hills Garden Tract, and the properties on Hill Lane owned
by Messrs. Rossi and Hansen, would be on the terms of $60.00 per lot
connection fee plus cost of construction, and permit and inspection
fees.

By letter of July 12, 1950, the Hidden Valley Improvement Assoc-
iation complained 2bout the condition of the roa~s.
The Manager was instructed to make demand on the contractor to
return and complete the paving work, and to so inform the Improvement
Association.

WHEREAS, the District Board of the Central Contra Costa San-
itary District did on the 22nd day of June, 1950, adopt Resolution
No. 607, and
WHEREAS, said Resolution proposed to modify said Resolution of
Intention No. .$9 and ordered that the .J..J.th da.y of July, 19.50, be
the day and 8:00 o'clock p.m., be the time and the meeting 'place
of the District Board of the Central Contra Costa Sanitary District

where and when all persons having any objection to such proposal to
amend said Resolution of Intention might protest such proposed
amendment and notice thereof was given by publication in the Walnut
Kernel at least ten (10) days prior to said date, and
WHEREAS, the District Board of the Central Contra Costa Sanitary
District mat at such time and plAce and protests to such amendment
being considered and àenied,
IT IS HEREBY RESOLVED by the District Board of the Central
Contra Costa Sanitary District that Resolution of Intention No. 569
be amended to exclude from the area to be bsnefited by such im-
provement and assessed to pay the cost and expense thereof,
Lots 1 to 90 inclusive of "Diablo Gardens", Contra Costa
County, California, as delineated on Map of said subdiv-
ision of record in Volume 3.5 of Maps at page 23 in the
office of the Recorder of Contra Costa County, Oalifor~ia.
IT IS HEREBY RESOLVED that such territory so described be ex-
cluded from the assessment district heretofore created.
IT IS FURTHER RESOLVED that the work proposed to be done exclude
tha.t within:
IIYoung's Valley Road from MH 18 to be located at the inter-
section of Rudgea.r Road and Young's Valley Road to FI 23 to
be located therein 370 feet southerly from said intersection
with Ruàgear Road".
and the same hereby is excluded from the work to be done pursuant
to such Resolution of Intention such work consisting of three hun-
dred and seventy feet of six inch vitrified clay sewer pipe and one
flushing inlet.
IT IS FlffiTHER RESOLVED that said Resolution of Intention No.
.569 be amended to exclude. such territory and such work as herein-
above stated.
IT IS FURTHER RESOLVED that the Central Contra Costa Sanitary
District contribute to Local Improvement District No.9 the sum of
$4.500.00 to be paid from general funds of the Central Contra Costa
Sanitary District.
PASSED AND ADOPTED by the District Board of the Central Contra
Costa Sanitary District, County of Contra Costa, State of California,
this 13th day of July, 19.50, by the following vote:
