HINUTES OF AN ADJOURNED KEETING
OF THE DISTRICT BOARD OF CENTRAL
CONTRA COSTA SANITARY DI3TRICT
HELD JUNE 29. 1950
The District Board of Central Contra Costa Sanitary District
convened in adjourned session at its regular place of meeting lo-
cated at 1822 Mt. Diablo Boulevard, City of Walnut Creek, County
of Contra Costa, State of California, on June 29, 1950, at 8:00
o'clock p.m.
The meeting was called to order by President Wadsworth and the
following roll was called:

READING OF MINUTES OF PREVIOUS MEETING
The Minutes of the previous meeting were read and were approved
as entered.

DISTRICT NO. 14
Messrs. Morris, Montgomery, Arighi and Mrs. Repp vigorously
protested their assessments. After some discussion the President
advised the protestants that the. Board had given consideration to
the assessments and had reached a decision.
Member Toland, Aeconded by Member Cornwall, moved the adoption
of Resolution No. 608:
RESOLUTION NO. 608
CONFIm~ING PROCEEDINGS AND ASSESSMENT
. LOCAL IMPROVD1ENT DISTRICT NO. 14
WHEREAS the District Engineer of Central Contra Costa Sanitary
District of Contra Costa County" State of California, filed with the
Secretary of said District, on MaY 5, 1950, an Assessment, together
with a Diagram and Engineer's Certificate attached thereto, to repre~
sent the costs and expenses of constructing sanitary sewers and
appurtenances pursuant to Resolution of Intention No. 470, adopted by
the District Board of said Sanit~ry District on June 23, 1940, and in
that portion of said District d~pcribed therein as Local Improvement
Distriçt No. 14, to which Resolution of Intention reference is hereby
made for a description of said w9rk and improvement and the district
to be åssessed for the costs and expenses thereof, and for all other
purposes; and
w~EFEAS said Secretary gave ~ue notice as required by law, of the
filing of said Assessment, and tþat Thursday, the 25th day of May,
1950, àt 8:00 o'clock p.m., on s~id day, and the meeting place of said
Di strict Board at 1822 Mt. DiablÇ> Boulevard, in the City of Wa,lnut
Creek, 'in said County, had been duly fixed as the time and place for
the hearing on said Assessment; ~nd
~~E?EAS said District Board held such hearing at the time and
pl~ce ~o fixed therefor, and the~ and there, and at a continuance of
said hearing regularly had, received evidence, oral and documentary
upon sàid work done, and upon said Assessment, and Diagram and
Engineer's Certificate attached, thereto, and also then and there
considered all a~peals theretofore filed pursuant to law with said
Board by persons interested in said work and Assessment;

WfŒREAS said District Boa~d has examined said Diagram and
Assessment and is satisfied with the correctness thereof. except
as hereinafter ordered, and that no correction or-modification
thereof should be made, except as so ordered;
NOW THEFEFORE, IT IS HEREBY RESOLVED AND ORDERED by said Dist-
rict Board that all acts and determinations of said District Engin-
eer relative to said work done pursuant to said Resolution of In-
tention be and the same'R.re hereby approved, ratified, and confirmed
and said District Board does hereby approve, ratify, and confirm
said Diagram and Assessment, except as hereinafter provided.
The following assessments shall be as hereinafter corrected
and stated.

WHEREAS the District Engineer of Cent!'a1 Contra Costa Sanitary
District of Contra Costa County, State of California, filed with
the Secretary of said District, on May 22, 1950, an Assessment,
together with a DiRgram and Engineer's Certificate attached thereto.
to represent the costs and expenses of constructing sanitary sewers
and appurtenances pursuant to Resolution of Intention No. 453,
Rdopted by the District Board of said Sanitary District on May 5,
1949, and in that portion of said District described therein as
Local ImprovsQent District No.8, to which Resolution of Intention
reference is hereby made for a description of said work and improve-
ment and the district t9 be assessed for the costs and expenses
thereof, and for all other purposes; and
WHEREAS said Secretary gave due notice as required by law, of
the filing of said Assessment, and that Thursday, the 3th day of
June, 1950, at 8:00 o'clock p.m., on saiù day, and the meeting
place of said District Bo~rd at 1822 Mt. Diablo Boulevard, in the
City of Walnut Creek, in said County, had been duly fixed as the
time and place for the hearing on s.aid Assessment; and
WHERLAS said District Board held such hearing at the time and
place so fixed therefor, and then and there, and at continuances
of said hearing regu1a.rly had, received evidence, oral and documentary
upon said work done, and upon said Assessment, and Diagram and
Engineer's Certificate attached theretoo and also tben and there
considered all appeals theretofore fi¡ed pursuant to law with said
Board by persons interested in.said work and said Assessment;
WHEREAS said District Board has examined said Diagram and
Assessment and is satisfied with the correctness thereof, except as
hereinafter ordered, and th~t no correction or modification thereof
should be made, except as so ordered;

The following changes shall be made in the Diagram and the

(1) The Assessment Diagram in relation to Assessment Lot
No. 8-21-13 shall be changed to exclude the most northwesterly
133.36 feet facing Hacienda Drive therefrom, and the assessment
on said Lot No. 8-21-13 shall be $2,081.00
(2) To the Assessment Diagram shall be. added a new Assess-
ment Lot No. 8-21-39, which shall include only the most north-
westerly 133.36 feet of Assessment Lot No. 8-21-13, and the
assessment on said Lot No. 8-21-39 shall be $547.00.
(3) The Assessment Diagram in relation to Assessment Lot.
No. 8-24-1 shall be changed to include only the westerly 467
feet, plus the southerly 20 feet of the easterly 225feet~ as
measured on the northerly line of said lot, and the as6~ssment
on said Lot No. 8-24-1 shall be $657.00.
(4) To the Assessment Diagram shall be added a new Assess-
ment Lot No. 8-24-22 which shall include only the northerly 97
feet of the easterly 225 feet as measured on the north line of
said Lot, of Assessment Lot No. 8-24-1, and the assessm~nt on
said Lot No. 8-24-22 shall be $219.00.
(5) The Assessment Diagram in relation to Assessment Lot No.
8-24-11 shall be cha.nged to include only the easterly 156 feet,
as measured on the northerly line of said Lot, and the assessment
on said Lot No. 8-24-11 shall be $438.00.
(6) To the Assessment Diagram shall be added a new Assess-
ment Lot No. 8-24-23 which shall include only the westerly 112
feet of Assessment Lot No. 8-24-11, and the assessment on said
Lot No. 8-24-23 shall be $438.00.
(7) The Assessment Diagram in relation to Assessment Lot No.
8-30-33 shall be changed to exclude therefrom the parcel of 'land
bounded on the northeast 'by the most northwesterly 260 feet of
the northeastern boundary and on the northwest by the most north-

NO. 19
WHEREAS, the District Board of the Central Contra Costa San-
itary District, County of Contra Costa, State of California, did
on the 8th day of June, 1950, adopt its Resolution of Intention
No. 601 to order the therein described work and improvement to be
done and made in Local Improvement District No. 19 which Resolu-
tion of Intention was duly and legally published in the time, form
and manner as required by law, as shown by the affidavit of pub-
lication of said Resolution of Intention on file in, the office of
~the 5ecrete,ry of said Central Contra Costa Sanit ary District; and
WHEREAS, after the adoption thereof, notices of the passage
of said Resolutio;n of Intention, he~ded "Noti(je of Improvement",
were duly and legally posted in the time, form, manner, locations
and number as required by law, as appears from tHe ~ffidavit of
posting said notices, on file in the office of the Secretary of
said Central Contra Costa Sanitary District; and
WHEREAS, after the adoption thereof, notices of the adoption
of said Resolution of Intention were duly mailed to all persons
owning real prope~ty proposed to be assessed for the improvements
described in said Resolution of Intention accprding to ,the names
and addresses of such owners, as the same appear on the last
equalized assessment roll for County taxes prior to the day of
such mailing, or as knÇ>wn to the C1erl;: of the Board of the Central
Contra Costa Sanitary District, which said notices were duly mailed

WHEREAS, the District BOard of the Central Contra Costa San-
itary District having duly received and considered evidence oral
and documentary concerning the jurisdictional facts in this pro-
ceeding and concerning the necessity for the contemplated work and
improvement and the benefits to be derived therefrom, and all pro-
tests filed in relation to said proceedings were duly considered
by said District Board and are hereby ordered overruled, and said
District Board having now acquired jurisdiction to order the pro-
posed improvement, .
IT IS HEREBY RESOLVED, by the District Board of the Central
Contra Costa Sanitary District, County of Contra Costa, State of
California, that the public interest and convenience require the
improvement herein referred to, and said District Board hereby
orders that the work and improvement, as set forth and described
in said Resolution of Intention, and in the plans and specifica-
tions therein referred to, to be done and made.
RESOLVED FURTHER, that the boundaries of the assessment dist-
rict, and the grades to which said work and improvements are to
be constructed, shall be those set. forth and described in said

'Overtime and Saturday work shall be paid for at double the
normal hourly rate except as noted below for Cement Finishers
and Truck Drivers and work on Sundays and Holidays shall be paid

. The foregoing schedule of prevailing rates of wages, and
rates for overtime, Sund~y and Legal Holidays, is based, unless
otherwise specified, upon a working day of eight (8) hours.
,Overtime and Satur6.ay retes for Truck Drivers shall be at
one and .one-ha1f (1~) times the normal hourly rate.
The first two hours overtime, after a normal eight (8) hour
day, for Cement Finishers shall be at one and one-half (It) times

rate. Saturday work for Cement Finishers shall be at one and one-
half (ll) times the normal rate for the first eight (8) hours work-
ed and at double the normal rate for all further time worked on
Saturdays. '
NOTICE IS ALSO HEREBY GIVEN BIDDERS that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all
subcontractors under him, to pB.y not less than said general prevail-
ing rates of per diem wages, as above listed, to all laborers, wort-
men B.nd meche,nics employed in the execution 0 f the contract.
Anything to the contrary in the above wage scale notwithstanding,
the Contractor and all subcontractors under him shall pay all their
laborers, workmen, mechan~cs and employees on said work a salary or
wage at least equal to the prevailing salary or wage for the same
úuality of service rendered to private persons, firms or corpora-
tions under similar employment, w~thin the Central Contra Cœta
Sanitary Dictrict.
The per diem wage rate is the hourly rate hereinabove mentioned
established multiplied by the number of hours hereinabove mentioned
as constituting the working day for the prticular craft or type of
\'Ilorkman.
Before submitting proposals the bidder shall be licensed in
accordance with the provisions of Chapter 9 Division III of the
Business and Professions Code, Chapter'37 of the Statutes of 1939,
as amended, of the state of California, which provides for. the reg-
istration and licensing of contractors.
Each bidder must submit with his proposal, a statement of his
financial responsibility, technical ability and experience on the
form to be furnished prospective bidders.
Each bidder shall submit with his bid on the form provided, the
name and address of each subcontractor including the principal
suppliers of materials, and the portion of the work which each sub-
cont.ractor ,.,rill do. If the contractor fails to name the subcontract-
ors in his proposal, he shall be deemed to have agreed to perform
such portion of the work himself and shall.not be permitted to sub-
contract said portion of work without previous written permission
of the District Board.
The Contractor shEll, in the performance of the work and im-
provements, conform to the Labor Code of the State of California
and other 1a.ws of the State 6f California applicable thereto, with
the exception only of such variation as may be required under the
specie,l statutes pursuant to which proceedings hereunder are taken
and which have not been superseded by the provision~ of the Labor
Code. Preference to labor shall be given only in the manner pro-
vided and required by law. Veterans and resident local labor shall
be given preference by the Contractor wherever possible, if skill
and working ability permit withou~ increasing the ultimate cost of
the work and improvement to the Local Improvement District, the
Central Contra Costa Sanitary District and its officers.
All proposals or bids shall be accompanied by a check payable
to said Central Contra Costa Sanitary District and certified by a
responsible bank for an amount which shall not be less than ten
(10%) per cent of the' aggregate of the proposal, or by a bond for
said amount and so payable, signed by the bidder and two sureties,
who shall justify. before any officer competent to a~~inister an
oath, in double the said amount and over and above all statutory
exemptions. The proposal shall be made out on the form to be fur-
nished prospective bidders, a copy of which is incorporated with the
specifications.
Said proposals or bids shall be delivered to the Clerk of the
District Board of the Central Contra Costa Sanitary District on or
before July 20, 1950, at the hour of 8:00 o'clock p.m., of said date
at the office of said Central Contra Costa Sanitary District at

1822 Mt. Diablo Blvd., Walnut Creek, Contra Costa County, State
of California, said time being not less than ten (10) days from
the time of the first publication or posting of said Notice.
Bids will be opened on said day and hour. The District Board
reserves the right to reject any and all proposals or bids,
should it deem this necessary for the public good, and also the
bid of the bidder who h~s been delinquent or unfaithful in any
former contract with the Central Contra Costa Sanitary District.
All bids shall be submitted on the understanding that all
work thereunder shall be done pursuant to the Improvement Act
of 1911 and that all of the applicable requirements thereof

IT IS HEREBY RESOLVED by the District Board of the Central
Contra Costa Sanitary District that the necessity, as a health
meaSure, for sewers in that area and for those proceedings des-
cribed in the letter of Dr. H. L. Blum, Health Officer of Contra
Costa County, addressed to this Boar(~ and dated 28 day of June,
1950, is by this Board similarly found to exist. Said letter is
hereby referred to and made a part hereof, and ordered spread
upon the ~1inutes of this Body.
IT IS FURTHER RESOLVED that such sewers the installation there-
of and as~essment proceedings therefor are found and declared to
be necessary as a health measure.

RESOLVED by the District Board of the Central Contra Costa
Sanitary D~strict that John L. Mason be and he is hereby appointed
Engineer of Work for the proposed ãoing of all necessary engineer-
ing work and exercis~1g all of the functions provided for the office
of Engineer of Work and Superintendent of Streets in the "Improve-
ment Act of 191111 in connection with the improvement work known,
anQ to be known, as the improvement of Local Improvement District
No. 21 by the, construction of sewers and appurtenances there in, and
BE IT FURTHER RESOLVED that said John L. Mason shall act as
Enginee~ of Work and Superintende~t.of Streets and is hereby em-
ployed and appointed to furnish all surveys, original drawings,
maps and blue prints. including any and all such maps necessary
and incident to the rights of way contemplated in the improvement
work herein involved; all plans and specifications, all inspection
work, preparation of assessment rolls, aasessment diagram and warrant
and any and all other services which shall be required from the
Engineer of wor'k under the provisions of. the IIImprovement Act of

BE IT F'JRTHER RESOLVED, that the Central Contra Costa Sanitary
District has engaged a full time engineering staff including the
services of the said John L. Mason and it is resolved that there
shall be charged to the Local Improvement District No. 21 the cost
of the services to the District of Mr. John L. Mason and the engineer-
ing staff of the District, together with materials supplies by the
District to the Local Improvement District and the administrative
costs of supplying such engineering services, labor and material.
Together with the services of John A. Nejed1y who is herewith dir-
ected to prepare all proceedings in connection with said Local Im-
provement District the expense of which similarly shall be charged
to the Local Improvement District. As all of such costs shall be
determined by the District Board to be devoted to such Local Im-
provement District.
RESOLVED further that such costs shall be included as inc~dental
expenses and be charged to the Local Improvement District as the
charges of eng~neering and legal services authorized by law.

RESOLVED by the District Board of the Central Contra Costa San-
it&ry District that it is the intention of said District Board
to order the following work to be done and improvements to be
made in above Local Improvement District in the Central Contra
Costa Sanitary District, County of Contra Costa, State of Ca1if-
ornie_, to-wit:
Construction of sanitary sewers and appurtenances.
Such above mentioned work being more particularly and spec-
ifically set forth and described in the plans, profiles and spec-
ifications for said work heretofore adopted by the District Board
,of the Cer.tral Contra Costa Sanitary District by its Resolution
No. 613, which plans, profiles and specifications are hereby re-
ferred to for all pa_rticulars in connection t,.-¡erewith and by

The public streets, rights-of way, easements and reserves in
which said work is to be done are shown and de1ineated'in detail

BE IT FURTHER RESOLVED that such sanitary sewers and appurt-
enances be constructed in said streets, easements, reserves,
avenues, roads, lanes., courts, places anà/or public ways herein-
above described, of the dimensions, materials, and in the part-
icular locations set forth and shawn on the plans and specifica-
tions and detailed drawings hereinabove and hereafter referred to;
together with the construction of all appurtenances thereto, in-
cluding necessary fittings, trenchings, grading and regrading,
excavation and fill, removal of obstructions, connections to
existing services, back filling, reconstruction of existing
ground surface as required to conditions existing prior to' com-
mencement of construction, all in the manner, of the materials
and to the dimensions and to the grades, and in the particular
locations as the same are more fully snOTrm on the plans and
specifications and detailed drawings hereinabove and hereafter
referred to; .
That the structures and work and improvements herein des-
cribed shall be constructed to the grades, sub~grades and eleva-
tions severally shown upon the plans and profiles and detailed
drawings thereof in the respective locations thereof, to which
plans .and profiles reference is hereby expressly made for a des-
cription of the grades to which all of the work and improvements
under this Resolution of Intention shall be done, which said
grades are hereby adopted and established as the official grades
therefor for all purposes in connection with proceedings pursuant
to this Resolution of Intention; notice is hereby further given
that said grades are or may be, in part, new and different from
those heretofore established or existing, or may be, and in some
cases are, different from existing ground levels; .
. All of said work and improvements shall be done to the lines
and grades as shown on the plans and profiles and in accordance
with the plans and specifica,tions heretofore referred to for the
doing of said work and improvement, and which are now on file in
the office of the Secretary of the District Board.
Excepting from all of the herein described work all of said
work that has already been done to the lines and grades shown on
said plans and profiles, and in accordance with said plans and
specifications;
The attentioù of all persons is directed to the fact that all
of said classes of work above described may ~ot be constructed
upon all of the streets and/or public ways above described in
their entirety, but only upon the particular locations as shown
on the plans and specifications, to which the attention of all
persons is directed for a description of the work, location of
the several classes of work, a description of the classes of wo~k
to be done upon each of the several public streets or rights-of-
way named, a description of the streets and rights-of-way, and
for all other information contained in the said plans Ind spec-
ifications pertinent to the doing and completion of the work and
improvements herein proposed; and

of Contra Costa has recommended in writing to said Board thRt said
proceedings for sa.id work be instituted a.s a nsces8ary. health
measure, am sai~ Board heretofore ordered said recommendation
spread upon the Minutes of said Board and by Resolution adopted by
the affirmative vote of four-fifths of the members of said Board
found and determined that such necessity exists.
That serial bonds shall be issued pursuant to Part 5 of Div-
ision 7 of said Streets and fiighways Code (Improvement Act of 1911)
to represent the unpaid asse ssìnents of Twenty-Five Dollars ($25..00)
or over f6r the cost of said work, seid bonds to bear interest at
the rate of six per cent (6%) per annum, to extend for a period of
nine (9) years from the second day of January next succeeding the
next October 15th following their date, and to be payable in annual
installments the last installments thereof to mature nine (9) years
from the second dRY of January next succeeding the next 15th day of
October following their date, said bonds and the interest thereon
to be payable as provided in said Code.
That Thursday, the 20th day of July, 1950, at the hour of 8:00
o'clock p.m., of said day, and at the meeting place of said Board,
1822 Mt. Diablo Boulevard, City of Walnut Creek, in the County of
Contra Costa, State of California, be and the same are hereby fixed
as the time and plBce, when Rnd where any and all persons having
any objection to the proposed work and improvement, the grades
thereof, o~ to the extent of the district to be assessed, or all
thereof, may appear before said Boarë. and show cause why said pro-
posed work should not be carried out in accordance with this Res-
olution of Intention, and may present ~ritten protest, not later than
the hour hereinabove set for hearing, against the doing of said work,
the grades thereof, or to the extent of the territory to be assessed
to pay the cost and expenses thereof.
That the Engineer of said District shall cause to be conspicu-
ously posted p10ng the line of said work and improvement, in the

Resolution.
. That the Secretary of said Board shall certify to the passage
of this Resolution and shall cause the sa~e to be published twice,
as requTI'ed by law, in tte Orinda Sun, a newspaper published and
circulated within said District and hereby designated for that
purpose by said Board. The first publication of said notice shall
be net less than ten (10) days prior to the date herein fixed for
hearing on this Resolu~ion of Intention.

notices of the adcption of this Resolution of Intention postage
prepaid to all pe~sons owning real property proposed to be assessed
