Diablo Boulevard, City of Walnut Creek, County of Contra Costa, state of California, on June 13, 1950, at the hour of 8:00 o'clock p.m. The meeting was called to order by President Wadsworth and the following roll was called: PRESENT: ABSENT: Members Corn't-1all, Johnson, Smitten, Toland, and Wadsv!Orth Hembers - None READING OF MINUTES OF PREVIOUS MEETING The 1v1inutes of the previous meeting were read and. ,¡!ere a'!:mroved as entered, vIi th the exception of a correction supplementing the name of "Hurphy" for "Everest" ordered to Resolution No. 603 as it appears on page 136 entitled "Condemnation of Easement Parcel 10 Local Improvement District No. 13 - Everest." " CONTINUATION OF .HEARING LOCAL IMPROVEHENT DISTRICT NO. 14 President 1~aèeworth called on the Engineer to explain the changes which were proposed in this assessment. The Engineer read a letter from the Pacific Gas & Electric Company in regard to building homes on the vacant lots under their power line right of way to the effect that they would not permit any new building. The Engineer read the list of assess- ments tentatively proposed to be changed and gave the names of the affected property owners. All affected property owners were gl~ert an o~portunlty to be heard by the Board on the tent~tively proposed changes, the following persons were heard: Frank J. Cay thing, Earl D. Doxee, Benjamine P. Olsen, A. M. Arighi, Eugene S. Jones, Douglas C. Silva, Roy J. Niosi, Robert W. Brown, Archibald R. Moffett, Edith L. Sh~arman, Mrs. Janes Allen, Marion T. Yuvan, Galen C. Darr, Valention Pera, H. StewArd Kimball, Mrs. Frederick Repp, Horace Breed, Zachary J. Montgomery, Frederick H. Blakeney, Fred Richter, Oak Springe Home Association, George E. Jackson, Henry Reitig, Nathan Gray, and George Adelson. It was moved by Member Cornwall, seconded by Member Johnson, that the hearing on the assessment for Local ImDrovement District No. 14 be continued to June 29, 1950 in order for the Board to give further con- sideration to adjustments in the assessment. " AYES: NOES: ABSENT: Members Cornwall, Johnson, Smitten, Toland and Wadsworth , , None None Member Johnson requested that in the future the Engineer prepere a memorandum to accompany any suggested changes in assessments giving the names of the affected property owners ae well as the assessment number and original proposed assessment and proposed adjustment. PROGRESS PAYMENTS SEWER CONSTRUCTION PROJECTS It was moved by Member Smitten, seconded by Member Johnson, that statements for progress payments for Main Trunk Section VII, Moraga Pumping Plant No.1 and Moraga Pumping Plant No.2 be paid. Main Trunk Section VII - Oakland Sewer Construction Company $12,212.14 Moraga Pumping Plant No.1 - P. & J. Artukovich, Inc. Moraga Pumping Plant No.2 - P. & J. ET AL . It was moved by Member Johnson, seconded by Member Smitten, that the following resolution be adopted: RESOLUTION NO. 604 \"ŒEREAS the District Bo9.rd of the CENTRAL CONTRA COSTA SAtHTARY DISTRICT has heretofore approved plans an& apecifications Drepared by its District Engineer for the construction, under the provisions of the Improvement Act of 19l1, of a' collecting lateral s8nitary sewer system in the area more particularlY. described in the proceed- ings for the improvement of Local Improvement District No.4 and has awarded a contract for the construction of said sanitary sewer in accordance with'the plans and specifications therefor; NOW, THEREFORE, BE IT RESOLVED and this Board does hereby find and determine that the public interest, convenience and necessity require the acquisition, construction and completion by this District of said collecting lateral sanitary sewer system, as set forth in said Dlans and s~ecifications and that easements over the ~arcel of real property hereinafter described are necessary for the construct- ing, laying and maintaining of sewer pipes therein in said sanitary sewer system, in accordance with said plans and specifications. Said easements are more particularly described as follows: Perpetual easement to be used by said Sanitary District for the purpose of constructing, laying, maintaining and operating sewer pipes therein and thereupon, together with a~purtenances and appliances and with the right of ingress thereto and egress therefrom over the follow- ing described parcel of real property; said easement located in the County of Contra Co eta, state of California, described as follov!s: A portion of Lot 26, ae designated on the map entitled "R. N. Burgess Company' 8 l1ap No. l, Macdonough Subdivision," 'tV'hich map was filed in the office of the Recorder of Contra Costa County, California, July l5, 19l2 in Volume 7 of Maps, at page l72" as an appurtenance to the parcel of lanð. described in the deed from Guy L. Putnam, et ux, to James ¡'T. Saddler, et ux, recorded March 27, 1940 in Volume 543 of Official Records, at page 357, for use as a roadway for vehicles of all kinds, pedes- trians and animals, for water, gas, oil and sewer pipe lines and for telephones, electric light and pm'ler lines, together 1;";ri th the necessary poles or conduits to carry said lines over a strip of land 20 f.eet in ~"rið_thJ the south line of 1rlhich is parallel \-lith and 20 feet southerly measured at right angles from the north line thereof and which north line is the north line of the parcel of land described in the deed from Guy L. Putnam, et ux to Harold A. P~tterson, recorded March 20, 1936 in Volume 233 of Official Records, at page 273. BE IT FUHTHER REßOLVED that the Attorney fa!' eaict District be and he is hereby authorized and directed to comœence and maintain actions and proceedings of eminent do~ain in the Superior Court of the State of California, in and for the County of Contra Costa, for the purpose of condemning and acQuiring said easements over, upon and through said hereinabove described parcels of real property for the uses and pur- poses Ð.foresÐ,id. BE IT FURTHER RESOLVED, and said Board does hereby find and determine, that the reasonable value of the above-described easenents ~ro~osed to be taken in the sum of Ten Dollars ($10.00), and the President' and Secretary are hereby authorized and directed to execute a warrant ~ayable to the County Clerk of the County of Contra Costa, to be deposited as security to the owners for the value of the easements herein Dronosed to be condemned. Smitten Secretary of the District Board CONNECTION OF GLENN TAYLOR SCHOOL TO PUBLIC SEWER It ,,¡as moved by l'-1ember Johnson, seconded 'h~r Member Smitten, that the Manager be instructed to notify Mrs. Audrey T. Searle that connection of the Glenn Taylor School to the public sewer be made and that notice to make this connection is directed under the provisions outlined in Sections 119lA and 1191B of the California Code of Civil Procedure.
