CONTRA COSTA SANITARY DISTRICT HELD

The District Board of Central Contra Costa Sanitary District
convened in adjourned session at its regular place of meeting lo-
cated at 1822 Mt. Diablo Boulevard, City of Walnut Creek, County
of Contra Costa, State of California, on June 8, 1950, at the hour
of 8:00 o'clock p.m.
The meeting was called to order by President Wadsworth and the
following roll was called:

READING OF MINUTES OF PREVIOUS MEETING
The Minutes of the previous meeting were read and were approved
as entered, with the exception of addition of "complete, including
equipment" ordered to Motion on page 112 entitled "Drilling Wells
at Moraga Pumps I and II."
OPENING HEARING ON LOCAL IMPROVEMENT
DISTRICT NO.8. ASSESSMENT AND WORK

The President asked the Engineer to explain the method of assess-
ment.
The Engineer also reported on the sewer near the lake, that all
seepage had been corrected by the contractor.

of Resolution No. 596:
RESOLUTION NO. 596
IT IS HEREBY RESOLVED by the District Board of the Central Contra
Costa Sanitary District that the necessity, as a health measure, for
sewers in that area and for those proceedings described in the letter
of Dr. H. L. Blum, Health Officer of Contra Costa County, addressed
to this Board and dated the 18th day of May, 1950, is by this Board
similarly found to exist. Said letter is hereby referred to and made
a part 1Breof, and ordered spread upon the Minutes of this Body.
IT IS FURTHER RESOLVED that such sewers the installation thereof
and assessment proceedings therefor are found and declared to be nec-
essary as a health measure.

Gentlemen:
IIA recent invest'1gation of conditions existing in the area hereinafter
described in the Central Contra Costa Sanitary District in the County
of Contra Costa, disclosed such ccnditions to be unsanitary, unhealth-
ful, and in my opinion, dangerous to the health of the people living
therein. Said area is bounded and described as follows: that certain
area referred to as IIBoundary Description of Local Improvement District
19' which description is attached hereto and by reference made a part
hereof.
'11 As Health Officer of the County of Contra Costa, I recommend as a'
necessary health measure that your Honorable Board institute proceed-
ings at an early date for the construction of a sanitary sewer system
for said area to abate the unsanitary conditions therein.

RESOLUTION NO. 597
BE IT RESOLVED by the District Board of the Central Contra Costa
Sanitary District that the said District Board proposes to cause to
be constructed in and for Local Improvement District, No. 19 Central
Contra Costa Sanitary District, County of Contra Costa, State of
California, the following improvements, construction of sewers and
appurtenances, and
BE IT FURTHER RESOLVED by the District Board of the Central
Contra Costa Sanitary District, that John L. Mason, Engineer of the
District be and he is hereby directed to prepare plans and specif-
ications for said proposed work, together with careful estimates of
the costs and expenses of such work, and
BE IT FURTHER RESOLVED that the proceedings for such work shall
be taken in accordance with the provisions of the "Improvement Act
of 1911" under Resolution of Intention to be hereafter adopted, and
BE IT FUHTHER RESOLVED that the said John L. .Mason be and he is
hereþy directed to prepare a map showing the boundaries and the
district to be assessed for the said proposed work and improvement.

Costa Sanitary District, County of Contra Costa, State of Calif-
ornia, thet the plans and specifications submitted by John L. Mason,
Engineer of Work for Local Improvement District No. 19 in the Central
Contra Costa Sanitary District, be and they are hereby adopted as
the plans and specifications for the doing of said work and improve-
ment. The estimate of said engineer for said work being given to
this Board as $56,384.00. '

APPROVING ASSESSMENT DISTRICT MAP '
LOCAL IMPROVEMENT DISTRICT NO. 19
IT IS HEREBY RESOLVED by the District Board of the Central Contra
Costa Sanitary District, Contra Costa County, State of California,
that the Assessment District Map submitted by the Engineer, which
indicates by a boundary line the extent of the territory included in
the District proposed to be assessed for constructing a sanitary sewer
system for the areas within the following described boundaries, to-wit:
Beginning at a point on the center line of Boyd Avenue and also
on the northern line of Local Improvement District No.1, said point
being on the southern extension of the eastern line of Lot 9 as said
lot is designated on that map entitled "Highway Junction Subdivision,"
filed in Map Book 17, at page )77. in the office of the Recorder of
the County of Contra Costa, State of California; thence from said
point of beginning northerly along said extension and eastern line to
the southwestern corner of Lot 7 of said subdivision; thence easterly
along the southern line of said Lot 7 and said southern line extended
easterly to the eastern boundary of the State highway commonly known
as'State Highway No. 24; thence northerly along said eastern boundary
and its extension northerly to a point on the eastern line of the
State highway commonly known as State Highway No. 21, said point being
at the northeastern corner of the junction of aforesaid State Highways
No. 21 and No. 24; thence continuing northerly along said eastern line
of said State Highway No. 21 to the eastern extension of the northern

of Resolution No. 600:
RESOLUTION NO. 600
APPOINTING ENGINEER DIRECTING PREPARATION
OF PROCEEDINGS AND FIXING COMPENSATION AND CHARGES
LOCAL IMPROVEMENT DISTRICT 19
,RESOLVED by the District Board of the Central Contra Costa San-
itary District that John L. Mason be and he is hereby appointed
Engineer of Work for the proposed doing of all necessary engineer-
ing work and .exercising all of the functions provided for the office
of, Engineer of Work and Superintendent of Streets in the "Improve-
ment Act of 191111 in connection with the improvement work known,
and to be known, as the improvement of Local Improvement District
,~o. 19 by the construction of sewers and appurtenances therein, and
BE IT FURTHER RESOLVED that said John L. Mason shall act as
Engineer of Work and Superintendent of Streets and is hereby em-
ployed and appointed to furnish all surveys, original drawings,
maps and blue prints, including any and all such maps necessary and
incident to the rights of way contemplated in the improvement work
herein involved; 8,11 plans and specifications, all'inspection work,
preparation of assessment rolls, assessment diagram and warrant and
any and all other services which shall be required f~om the Eng1neer
of work under the provisions of the IIImprovement Act of 1911"; and
BE IT FURTHER RESOLVED, that the Central Contra Costa Sanitary
District has engaged a full time engineering staff including the
services of the said John L. Mason and it is resolved that there
shall be charged to the Local Impro~ement Distriot No. 19 the cost
of the services to the District of Mr. John L. Mason and the engin-
eering staff of the District, together with materials supplied by
the District to the ,Local Improvement District and the administra-
tive costs of supplying such engineering services, labor and mater-
ial. Together with the services of John A. Nejedly who is herewith
directed to ,prepare all proceedings in connection with said Local
Improvement District the expense of which ,similarly shall be charged
to the Local Improvement District. As all of such costs shall be
determined by ,the District Board to be devoted to such Local Im-
provement District.
RESOLVED further that such costs shall be included as incidental
expenses and be charged to the Local Improvement District as the
charges of engineering and legal services authorized by law.

RESOLVED by the District Board of the Central Contra Cos'ta San-
itary District that it is the intention of the said District' Board

to order the following work to be done and improvements to be made
in above Local Improvement District in the Central Contra Costa San-
i tary District, County of Contra Costa, State of California" towi t:
Construction of sanitary sewers and appurtenances.
Such above mentioned work being more particularly and specifically
set forth and described in the plans, profiles and speci,fications for
said work heretofore adopted by the District Board of the Central
Contra Costa Sanitary District by its Resolution No. 598, which plans,
pr,ofiles and specifications are hereby referred to, for all particulars
in connection therewith and by reference made a part hereof.
The public streets, rights-of-way, easements and reserves in which
said work is to be done are shown and delineated in detail and spec- ,
ifically located on the plans hereinabove referred to, and reference
is hereby specifically made to said plans" and notice is hereby given
to all parties that specific locations thereof are contained in said
plans;
Such locations being:
In the following streets, right of way and easements in said San-
itary District as they and the proposed work in relation thereto are
shown on Sheet 2 of said plans and specifications:
TREADWAY LANE from its northern extremity to FI 1, to be located
in Treadway Lane 245 feet northerly from its intersection with Gregory
Lane.
CROSSING UNDER A PORTION OF STATE HIGHWAY NO. 21 located 830 feet
northerly from the intersection of said State Highway and Gregory Lane.
15 FOOT RIGHT-OF-WAY for its entire length excepting the westerly 160
feet; said right-of-way intersecting the aforementioned State Highway
at a point located 830 feet northerly from the aforementioned inter-
section of said State Highway and Gregory Lane and extending westerly
parallel to said Gregory Lane a distance of 1,320 feet.
EASEMENT (Parcell) in that real property in Rancho Las Juntas as
described in the deed recorded in the office of the County Recorder of
Contra Costa County, State of California, on November 17,1947, under
Recorder's serial number 46051, in Volume 1147, of Official Records,
at page 477, said easement being a strip of land 5 feet wide and also
being the entire northern 5 feet of said real property, excepting the
eastern 20 feet thereof.
EASEl-lENT (Parcel 2), in that real property in Rancho Las Juntas as
described in the deed recorded in the office of said Recorder on
August 5,1944, under Recorder's serial number 17008 in Volume 793,
of Official Records, at page 435, said easement being a strip of land
5 feet wide and also being the entire eastern 5 feet of said real
property.
ALSO, in the following streets, rights of way and easements in
said Sanitary District as they and the proposed work in relation
thereto are shown on Sheet 3 of said plans anà specifications.
TRELANY ROAD for its entire ~ength.
IRVING COURT for its entire length.
PRICE LANE for its entire length.
CHARLES AVENUE for its entire length.
JACKSON WAY for its entire length excepting
the southern 110 feet.
THEO DRIVE from ,its eastern extremity at MH 13 to FI 9, to be
located in Theo Drive 40 feet westerly from its intersection with
Jackson Way.
CODY LANE from its western intersection with Gregory Lane to its
southern extremity.

GREGORY LANE from FI 2, to be located therein 75 feet westerly
from the western boundary of the aforementioned State Highway No.
21, to MH 12, to be located in Gregory Lane at its intersection
with Price Lane.
STATE HIGHWAY NO. 21, from MH 14, to be located therein at its
intersection with Trelany Road, to its intersection with State
Highway No. 24. '
STATE HIGHWAY NO. 24, from its aforementioned intersection with
State Highway No. 21, to FI 4, to be located in State Highway No.
24, a distance of 60 feet northerly from its intersection with the
eastern extension of the southern line of Lot 7 as said Lot is des-
ignated on that map entitled "Highway Junction Subdivision," filed
in Map Book 17', at page 377, in said office of the Recorder.
20 FOOT RIGHT-OF-WAY, from its intersection with Cody Lane to
FI 8,' to be located in said right-of-way 205 feet westerly from its
eastern extremity; said right-of-way intersecting said Cody Lane 75
feet northerly from the southern extremity of said Cody Lane and'
running easterly parallel to Gregory Lane a distance of 450 feet.
12 FOOT RIGHT-OF-WAY, from its western extremity to FI 3, to be
located in said right-of-way 390 feet westerly from the western
bo~ndary of the aforementioned State Highway No. 24; said right-ot-
way intersecting State Highway No. 24 ,near its intersection with
State Highway No. 21 and extending westerly a distance of 620 feet.
EASEMENT (Parcel, 3) in that real property in Lot 21 of said
Highway Junction Subdivision as described in the deed recorded in
the office of said Recorder on March 22,1948, under Recorder's
serial number 11363 in Volume 1184, of Official Records, at page
596, said easement being a strip of land 5 feet wide and also being
the entire eastern 5 feet of said real property.
EASEMENT (Parcel 4) in that real property in Lot 21 of said
Highway Junction Subdivision as described in the deed recorded in
the office of said Recorder on September 5,1945, under Recorder's
serial number 21110 in Volume 819, of Official Records, at page 467,
said easement being a strip of land 5 feet wide and also being the
entire eastern 5 feet of said real property.
EASEMENT (Parcel 5) in that real property in Lot 21 of said
Highway Junction Subdivision as described in the deed recorded in
the office of said Recorder on September 5,1945, under Recorder's
serial number 21113 in Volume 821, of Offic~al Records, at page 301,
said easement being a strip of land 5 feet wide and also being the
entire eastern 5 feet of said real property.
, EASEMENT (Parcel 6) in that real property in Lot 21 of said
Highway Junction Subdivision as described in the deed recorded in
the office of said Recorder on April 18,1947, under Recorder's
serial number 15487 in Volume 1083, of Official Records, at page
188, said easement being a strip of land 5 feet wide and also being
the entire eastèrn 5 feet of said real property.
EASEMENT (Parcel 7) in that real property in Lot 9 of said
Highway Junction Subdivision as described in the deed recorded in
the office of said Recorder on September 21, 1936, under Recorder's
serial number 11726 in Volume 423, of Official Records" at page 194,
said easement being a strip of land 5 feet wide the ,western line of
which is 5 feet westerly, measured at right angles, from the eastern,
line and which eastern line is described as follows: Beginning at
'the northeastern corner of Sàid Lot 9; thence, from said point of
beginning, south 00 27' east, 80.0 feet to MH 7.
EASEMENT (Parcel 8) in' that real property in Lot 6 .of said
Highway Junction Subdivision as described in the deed recorded in
the office of said Recorder on October 22, 1947, under Recorder's

serial number 42449 in Volume 1139, of Official Records, at page
508, said easement being a strip of land 5 feet wide and also being
the entire northern 5 feet of said real property.
EASEMENT (Parcel 9) in that real property in Lot 13 of said High-
way Junction Subdivision as described in the deed recorded in the
office of said Recorder on June 4,1948, under Recorder's serial
number 21081 in Volume 1206, of Official Records, at page 314, said
easement being a strip of land 5 feet wide the eastern line of which
is 5 feet easterly, measured at right angles, from the western line
and which western line is described as follows: Beginning at the
southwestern corner °b said real property; thence, from said point
of beginning, north 0 271 west, 375.0 feet to FI 13.
The office of the Recorder referred to hereinabove is the office
of the Recorder of the County of Contra Costa, State of California,
and Official Records and file numbers hereinabove referred to are
Official Records and file numbers of said Recorder. The letters M.H.
and F.I. herein used refer to and mean Manhole and Flushing Inlet,
respectively.
In'the foregoing descriptions, the width of all easemenmdescribed
by reference to a center line is measured at right angles.
In the foregoing descriptions, wherever right of way, easement,
street, or other public. way is described wherein work is to be done,
it is the intention that said work shall also be extended so as to
connect the same with existing sewers or sewer work to be constructed
nearest to said right of way, easement, street, or other public way,
and at the point in said proposed work where a manhole, flushing in-
let, or other construction is shown on said Plans therefor, unless
otherwise shown thereon.
BE IT FURTHER RESOLVED that such sanitary sewers and appurten-
ances be constructed in said streets, easements, reserves, avenues,
roads, lanes, courts, places and/or public ways hereinabove described,
of the dimensions, materials, and in the particular locations set
forth and shown on the plans and specifications and detailed drawings
hereinabove and hereafter referred to; together with the construction
of all appurtenances thereto, including necessary fittings, trench-
ings, grading and regrading, excavation and fill, removal of obstruc-
tions, connections to existing services, backfilling, reconstruction
of existing ground surface as required to conditions existing prior to
commencement of construction, all in the manner, of the materials and
to the dimensions and to the grades, and in the particular locations
as the same are more fully shown on the plans and specifications and
detailed drawings hereinabove and hereafter referred to;
That the structures and work and improvements herein described
shall be constructed to the grades, sub-grades and elevations severally
shown upon the plans and profiles and detailed drawings thereof in the
respective locations thereof, to which plans and profiles reference is
hereby expressly made for a description of the grades to which all of
the work and improvements under this Resolution of Intention shall be
done, which said grades are hereby adopted and established as the
official grades therefor for all purpos~s in connection with proceed-
ings pursuant to this Resolution of Intention; notice is hereby further
given that said grades are or may be, in part, new and different from
those heretofore established or existing, or may be, and in some cases
are, different from existing ground levels;
All of said work and improvements shall be done to the lines
grades as shown. on the plans and profiles and in accordance with
plans and specifications heretofore referred to for the doing of
work and improvement, and which are now on file in the office of
Secretary of the District Board.

, The attention of all persons is directed to the fact that all
of said classes of work above described may not be constructed
upon all of the streets and/or public ways above describe~ in
their entirety, but only upon the particular locations as shown
on the plans and specifications, to which the attention of all
persons is directed for a description of the work, location of
the several classes of work, a description of the classes of work
to be done upon each of the 'several public streets or rights-of-
way named, a description of the streets and rights-of-waY, and for
all other information contained in the said plans and specifica-
tions pertinent to the doing and completion of the work and im-
provements herein proposed; and
WHEREAS, said contemplated work and improvements, in the
opinion of this District Board, is of more than local or ordinary
public benefit, said District Board hereby makes the expenses and
costs of said work and improvements chargeable upon a district,
which said district said District Board hereby declares the dist-
rict benefited by the work and improvements herein described; and
which is to be assessed to pay the cost and expenses thereof; said
district shall include that territory in the Central Contra CostÁ
Sanitary District, County of Contra Costa, State of California,
which is shown on that certain plat lor map on file in the office
of the Secretary of the District Board, and which is set forth as
the uMap Showing Proposed Assessment District Boundary for the Im-
provement of Local Improvement District No. 19 in Resolution 599
of the District Board", and which said map or plat indicates, by a
boundary line, the extent of the territory included in the proposed
district and covers all details as to the extent of the area to be
assessed; said map or plat is, by this reference incorporated here-
in and made a part hereof;
Excepting from the area shown and delineated on said map or
plat, hereinabove referred to, the area of all public streets,
avenues, lanes, roads, drives, courts, places, public parks, and
all easements and rights-of-way therein contained belonging to the
public.
That the proceedings for said work and improvement shall be had
and taken under and in accordance with Division 7 of the Streets
and Highways Code of the State of California ("Improvement Act of
191111).
NOTICE IS HEREBY GIVEN that the Health Officer of said County
of Contra Costa has recommended in writing to said Board that said
proceedings for said work be instituted as a necessary health meas-
ure, and said Board heretofore ordered said recommendation spread
upon the Minutes of said Board and by Resolution adopted by the
affirmative vote of four-fifths of the members of said Board found
and determined that such necessity exists.
That serial bonds shall be issued pursuant to Part 5 of Div-
ision 7 of said Streets and Highways Code (Improvement Act of 1911)
to represent the unpaid assessments of Twenty-Five Dollars ($25.00)
or over for the cost of 'said work, said bonds to bear interest, at
the rate of Six Per Cent (6%) per annum, to extend for a period Œ
nine (9) years from the second day of January next succeeding the
next October 15th following their date, and to be payable in annual
installments the last installment thereof to mature nine (9) years
from the second day of January next succeeding the next\15th day of
October following their date, said bonds and the interest thereon
to be payable as provided in said Code.
That Thursday, the 29th day of June, 1950, at the hour of 8:00
o'clock p.m., of said day, and at the meeting place of said Board,
1822 Mt. Diablo Boulevard, City of Walnut Creek, in the County of
Contra Costa, State of California, be and the same are hereby fixed
as the time and place, when and where any and all persons having
any objection to the proposed work and improvement, the grades
thereof, or to the extent of the district to be assessed, or all
thereof, may appear before said Board and show cause why said pro-
posed work should not be carried out in accordance with this Res-

olution of Intention, and may present written protest, not later
than the hour hereinabove set for hearing, against the doing of
said work, the grades thereof, or to the extent of the territory
to be assessed to pay the cost and expenses thereof.
That the Engineer of said District shall cause to be conspic-
uously posted along the line of said work and improvement, in the
manner and form required by law, notices of the passage of this
Resolution. '
That the Secretary of said Board shall certify to the passage
of this Resolution and shall cause the same to be published twice,
as required by law, in the Courier-Journal, a newspaper published
and circulated within said District and hereby designated for that
purpose by said Board. The first publication of said notice shall
be not less than ten (10) days prior to the date herein fixed for
hearing on this Resolution of Intention.
Said District Board does hereby direct its Secretary to mail
notices of the adoption of this Resolution of Intention postage
prepaid to all persons owning real property proposed to be assessed
for the work herein described, whose names and addresses appear on
the last equalized assessment roll for taxes of the County of Contra
Costa or as known to the Clerk, the contents of said notices and
preparation and mailing to be as required by law, and to be com-
pleted at least fifteen (15) days prior to such hearing.

of Resolution No. 602:

WHE~EAS the District Board of the Central Contra Costa Sanitary
District has heretofore approved plans and specifications prepared
by its District Engineer for the construction, under the provisions
of the Improvement Act of 1911, of a collecting lateral sanitary sewer
system in the area more particularly described in the proceedings for
the improvement of Local Improvement District No. 17, and proposes to
award a contract for the construction of said sanitary sewer in accord-
ance with the plans and specifications therefor;
NOW, THEREFORE, BE IT RESOLVED and this Board does hereby find
and determine that the public interest, convenience and necessity re-
quire the acquisition, construction and completion by this District
of said collecting lateral sanitary sewer system, as set forth in
said plans and specifications and that easements other the parcels of
real property hereinafter described are necessary for the constructing,
laying and maintaining of sewer pipes therein in said sanitary sewer
sy~tem, in accordance with said plans and specifications. Said ease-

State of California, on May 24, 1946, in Volume 29 of Maps, at
page 27, being a strip of land 5 feet in width, the center line

thereof; thence from said point of beginning, north 390 50' east,
105.06 feet to the northeast line of said Lot 40, distant thereon,

The north and south termini of said strip are the north line and
south lines respectively of said Lot 40.
BE IT FURTHER RESOLVED that the Attorney for said District be
and he is hereby authorized and directed to commence and maintain
actions and proceedings of eminent domain in the Superior Court
of the State of California, in and for the County of Contra Costa,
for the purpose of condemning and acquiring said easements over,
upon and through said hereinabove described parcels of real prop-
erty for the uses and purposes aføresaid.
BE IT FURTH&~ RESOLVED, and said Board does hereby find and
determine, that the reasonable value of the above-described ease-
ments proposed to be taken is the sum of Ten Dollars ($10.00), and
the President and Secretary are hereby authorized and directed to
execute a warrant payable to the County Clerk of the County of
Contra Costa, to be depositedàs security to the owners for the
value of the easements herein proP9sed to be condemned. '

It was moved by Member Johnson, seconded by Member Smitten and
unanimously carried, thet the District accept an amount of $4,500
from theori~inal subdividers of Diablo Gardens, to represent the
share of that subdivision in the cost of sewers for Local Improve-
ment District No.9.
