, The District Board of Central Contra Costa Sanitary Distrlct
convened in adjourned session at its regular place of meeting lo-
cated at 18)2 Mt. Diablo Boulevard, in the City of Walnut Creek,
County of Contra Costa, ,State of California, at the hour of 8:00
o'clock p.m.
, The meeting was called to order by President Wadsworth and the
following roll was called:

,The Minutes of the previous meeting were read and were approved

HEARING LOCAL IMPROVEMENT DISTRICT]
. Messrs. Healy, Cohan and Booth again requested the Board to see
tha.t Bickerstaff and Crescent Drive were restored by the Contractor.

,The Board continued the hearing on Assessment for Local Improve-
men,t District No. ) to May 25, 1950, ,because of uncompleted work.

HEARING ON RESOLUTION O.F INTENTION,
LOCAL IMPROVEMENT DISTRICT NO.9
, The' Engineer explained tó the attending property owners the
met.hod of proceedings for a local improvement district', and the
reasons for undertaking the work; that the County Health Officer
had. recommended that sewers be. installed as a necessary health
measure, that petitions from a majority of property owners had been
rec~ived requesting the work. ,That there were approximately 624
separate parcels and at the estimated cost of $192,706.00 the cost
per. lot should be less than $)00. '

,Letters of protest against the line A-I) on Youngs Valley Road
wer,e filed by the following: Duncan F. King; Al Wegars; Mrf'. Dean
Whe.rton; W. R. Platt; Mrs. L. Jenkins; Robert J. Hill; Mrs. Ethel
Mork; and Roberta B. Rowe.
Mrs. Duncan F. King, K. J. Mork, D. Wharton and Al Wegars pro-
tested the exclusion of land bounded by Rancho Homes, Diable Gardens
and Rudgear Road, and Sans Crainte Unit No.5.
Idylewood Improvement Association protested ag~inst the number
of lots to be assessed.
Young's Valley Improvement Association 'exclusion of certain
properties and Line A-I) construction.
Mrs. Augusto protested the prox1mi ty of sewer easement to her
walnut trees"and was informed by the Attorney that he had been in
conference with her Attorney and that she would be notified by him
shortly. The Board informed Mrs. Augusto that the easement would
be resurveyed for a possible better location.
Member Toland, seconded by Member Smitten, moved the adoption

RESOLUTION O~DERING WORK, DETEF~INING PREVAILING
RATE OF WAGES, AND DIRECTING NOTICE TO BIDDERS
IN LOCAL IMPROVEMENT DISTRICT NO.9
~
WHEREAS, the District Board of the Central Contra Costa Sanitary
District, County of Contra Costa, State of California, did on the 18th
day of April, 1950, adopt its Resolution of Intention No. 569 to order
the therein described work and improve~ents to be done and made in
Local Improvement-District No.9 which Resolution of Intention was
duly and legally published in the time, form and manner as required
by law, as shown by the affidavit of publication of said Resolution
of Intention on file in the office of the Secreta.ry of said Central
Contra Costa Sanitary District; and
WHEREAS, after the adoption thereof, notices of the passage of
said Resolution of Intention, headed "Notice of Improvement", were
duly and legally posted in the tille, form, manner, locations and
number as required by law, as appears from the affidavit of posting
said notices, on file in the office of the Secretary of said Central
Contra Costa Sanitary District; and
WHEREAS, after the adoption thereof, notices of the adoption of
said Resolution of Intention were duly mailed to all persons owning
real property proposed to be assessed for the improvements described
in said Resolution of Intention according to. the names and addresses
of such owners, as the Same appear on the last equalized assessment
roll for County taxes prior to the day of such mailing, or as known
to the Clerk of the Board of the Central Contra Costa Sanitary Dist-
. rict, which said notices were duly mailed in the time, form and
manner as required by law; and
WHEREAS, the District Board of the Central Contra Costa Sanitary
District having duly received and considered evidence oral and docu-
mentary concerning the jurisdictional facts in this proceeding and
concerning the necessity for the contemplated work and improvement
and the benefits to be derived therefrom, and all protests filed in
relation to said proceedings were duly considered by said' District
Board and are hereby ordered overruled, and said District Board
having now acquired jurisdiction to order the proposed improvement,
IT IS HEREBY RESOLVED, by the District Board of the Central Contra
Costa Sanitary District, County of Contra Costa, State of California,
that, the public interest and convenience require the improvement
herein referred to, and said District Board hereby orders that the
work,and improvement, as set forth and described in said Resolution
of Intention, and in, the plans and specifications therein referred
to, to be done and made. .
RESOLVED further, that the boundaries of the assessment district,
and the grades to which said work and improvements are to be construc-
ted, shall be those set forth and described in said Resolution of
Intention, and in the plans and specifications therein referred to,
reference to which is hereby made for all further particulars.
RESOLVED FURTHE~ that the time hereby fixed for receiving sealed
proposals or bids for the doing of said work and making of said
improvement herein ordered is the 1st day of June, 1950, at the hour
of 8:00 o'clock p.m., and the Secretary of the District Board is
hereby ordered to give notice inviting such sealed bdds in the
following time, form ,and manner and as provided by law.
RESOLVED FURTHER. that the Secretary of said District Board shall
post.conspicuously for five (5) days, on or near the main entrance
door,to the regular meeting place of said Board at 1822 Mt. Diablo
Boulevard, Walnut Creek, California, a Notice to Bidders, in the form
hereinafter stated, inviting sealed proposals or bids for doing said
work and referring to said Plans and Specifications on file; and shall

publish said Notice twice in the Walnut Kernel, a newspaper pub-
lished and circulated in Central Contra Costa Sanitary District
and hereby designated for that purpose.
All such proposals or bids shall be submitted, received, and
publicly opened, examined and decla~ed, and shall be accompanied
by a certified check or bond, all aà stated in said Notice to
Bidders, which Notice shall be as follows:

Pursuant to the provisions of "Improvement Act of 1911" and to
Resolution ordering the Work of the Distriot Board of the Central
Contra Costa Sanitary District, County of Contra Costa, State of
California, directing this Notice, said District Board hereby
invite.s sealed. bids and proposals for doing the work and improve-
ment 'described in Resolution of Intention No. 569 in the above-
entitled matter, of the District Board of the Central Contra Costa
Sanitary District, County of Contra Costa, State of California,
adopted April 18,1950, and said Resolution of Intention No. 569 is
hereby referred to for a description of said work and improvement,
the grades to which it is to be done, a description of, the district
to be assessed to pay the costs and expenses thereof, the bonds to
be issued, and for all further particulars contained in said Reso-
lution of Intention No. 569. Reference is hereby further made to
the plans and specifications ,and detailed drawings for said work on
file in the office of the Secretary of said Central Contra Costa
Sanitary District, in accordance with which said work shall be done.
Said plans and specifications may be examined at 1822 Mt. Diablo
Blvd., Walnut Creek, and may be obtained upon the payment of $20.00
which may be returned.
Notice is further given that the District Board of the Central
Contra Costa Sanitary District, County of Contra Costa, Státe of
California, bas established a prevailing rate and scale of wages
in accordance with law, which rate and scale is as follows, to-wit:

Overtime and Saturday work shall be paid for at double the normal
hourly rate except as noted below for Cement Finishers and Truck Drivers
and work on Sundays and Holidays shall be pa~d for at double the normal
hourly rate.
The foregoing schedule of prevailing rates of wages, and rates
for overtime, Sunday and Legal Holidays, is based, unless otherwise
specified, upon a working day of eight (8) hours.
Overtime and Saturday rates for Truck Drivers shall be at one and
one-half (Ii> times the normal hourly rate.

. The first two hours overtime, after a normal eight (8) hour day,
for Cement Finishers shall be at one and one-half (It) times the
normal rate and further overtime shall be at double the normal rate.
Saturday work for Cement Finishers shall be at one and one-half (It)
times the normAl rate for the first eight (8) hours worked and at
double the normal rate for all further time worked on Saturdays.
NOTICE IS ALSO HEREBY GIVEN BIDDERS that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all
subcontractors under.him, to pay not less than said general prevail-
ing rates of per diem wages, as above listed, to all laborers, workmen
and mechanics employed in the execution of the contract.
Anything to the contrary in the above wage scale notwithstanding,
the Co~tractor and all subcontractors under him shall pay all their
laborers, workmen, mechanics and employees on said work a salary or
wage at least equal to the prevailing salary or wage for the same

quality of service rendered to private persons, firms or oorpora-
tions under similar employment, within the Central Contra Costa
Sanitary District.
The per diem, wage rate is the hourly rate her9inabove mention-
ed established multiplied by the nember of hours hereinabove men-
tioned as constituting the working day for the particular craft or
type. of workman.,

Before submitting proposals the bidder shall be licensed in
accordance with the provisions of Chapter 9 Division III of the
Business and Professions Code, Chapter 37 of the Statutes of 1939,
as amended, of the State of California, which provides for the
registration and. licensing of contractors.
Eaoh bidder must submit with his proposal, a statement of his
financial responsibility, technical ability and experience on the
form to be furnished prospective bidders.
Each bidder shall submit with his bid on the form provided,
the name and address of each subcontractor including the principal
suppliers of materials, and the portion of the work which each
subcontractor will do. If the contractor fails to name the sub-
contractors in his proposal, he shall be deemed to have agreed to
perform such portion of the work himself and shall not be permitted
to subcontract said portion of work without previous written per-
mission of the District Board.
The Contractor shall, in the perf.ormanoe of the work and im-
provements, conform to the labor Code of the State of California
and other laws of the State of California applicable thereto, with
the exception only of such variation as may be required under the
special statutes pursuant to which proceedings hereunder are taken
and which have not been superseded by the provisions of the Labor
Code. Preference to labor shall be given only in the manner pro-
vided and required by law. Veterans and resident local labor shall
be given preference by the Contractor wherever possible, if skill
and working ability permit without increasing the ultimate cost of
the work and improvement to the Local Improvement Distriot, the
Central Contra Costa Sanitary Distriot and its officers.

All proposals or bids shall be accompanied by a check payable
to said Central Contra Costa Sanitary District and certified by a
responsible bank for an amount which shall not be less than ten
(10%) per cent of the aggregate of the proposal, or by a bond for
said amount and so payable, signed by the bidder and two sureties,
who shall justify, before any officer competent to administer an
oath, in double the said amount and over and above all statutory
exemptions. The proposal shall be made out on the form to be fur-
nished prospective bidders, a copy of which is incorporated with
the specifications.
Said proposals or bids shall be delivered to the Clerk of the'
Distriot Board of the Central Contra Costa Sanitary District on or
before June 1, 1950, at the hour of 8:00 p.m., of said date, at the
office of said Central Contra Costa Sanitary District at 1822 Mt.
Diablo Blvd. Walnut Creek, Contra Costa.County, State of California,
,said time being not less than ten (10) days from the time of the.
first publication or posting of said Notice. Bids will be opened
on said day and hour. The District Board reserves the right to
reject any and all proposals or bids, should it deem this necessary
for the public good, and also the bid of the bidder who has been
delinquent or unfaithful in any former contract with the Central
Contra Costa Sanitary District.
All bids shall be submitted on the understanding that all work
thereunder shall be done pursuant to the Improvement Act of 1911

and that all of the applicable requirements thereof shall be made a
part hereof, of the Local Improvement 'District proceedings, the
bonds and the contract.

AGRE~lENT WITH WALNUT CREEK SCHOOL
It was moved by Member Johnson, seconded by Member Toland, and
unanimously carried, that if the agreement with the Walnut Creek
School District for assessment in Loc~l Improvement District No.9
is in order, that the Board authorize the President and Secretary
to execute said agreement.
PAYMENT FOR PARCEL 33
LOCAL IMPROVEMENT DISTRICT NO.9
It was moved by Member Johnson, seconded by Member Cornwall, and
unanimously carried, that the Board allow payment in the amount of
$75.00 to C. B. Fancher, et ux for easement Parcel 33, in Local Im-
provement District No.9.
ADJOURNMENT
President Wadsworth adjourned the meeting to Tuesday, May 16,
1950 at 8:00 o'clock p.m.
