MINUTES OF THE REGULAR MEETING
OF THE DISTRICT BOARD OF CENTRAL
CONTRA COSTA SANITARY DISTRICT
HELD APRIL 6. 1950
The District Board of Central Contra Costa Sanitary District
convened in regular session at its regular place of meeting located
at 1822 Mt. Diablo Boulevard, in the City of Walnut Creek, County of
Contra Costa, State of Celifornia, at the hour of 8:00 o'clock p.m.
on April 6. 1950.
The meeting was called to order by President Wadsworth and the
following roll was called:

of Resolution No. 554:

CONFIffi1ING PROCEEDINGS AND ASSESSMEN~
LOCAL IMPROVEMENT DISTRICT NO.4
WHEREAS the District Engineer of Central Contra Costa Sanitary
District of Contra Costa County, State of California, filed with the
Secretary of said District. on March 10, 1950, an Assessment, together
with a Diagram and Engineer's Certificateattache.d thereto. to repre-
sent the costs and expenses of constructing sanitary sewers and
appurtenances pursuant to Resolution of Intention No. 432, adopted
by the District Board of said Sanitary District on March 31, 1949,
and in that portion of said District described therein as Local Im-
provement District No.4, to whic,h Resolution of Intention reference
is hereby made for a description of said work and improvement and
the district to be assessed for the costs and expenses thereof, and
for all other purposes; and .
WHEREAS sa.1d Secretary gave due notice, as required by law, of
the filing of said Assessment, and that Thursday, the 30th day of
March, 1950, at 8:00 o'clock p.m., on said ,da.y, and the meeting place
of said District Board R t 1822 Mt. Diablo Boulevard. in the, City of
Walnut Creek, in said County. had been duly fixed as the time and
place for the hearing on said Assessment; and
WHEREAS said District Board held such hearing at the time and
place ,so fixed therefor, and then and there, anð. at a continuance
of said hearing regularly had, recèived evidence, oral and documen-
tary upon said work done. and upo.n said Assessment, and Diagram and
Engineer's Certificate attRched thereto. and also then and there
c.onsidered all a.ppeals theretofore filed pursuant to law with said
Board by persons interested in said work and said Assessment;
WHEREAS said District Board has examined said Diagram and Assess-
ment and is satisfied with the correctness thereof, except as herein-
after ordered. and that no correction or modification thereof should
be made, except as so ordered;

NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED by said Dist-
rict Board that all acts and determinations of said District Engin-
eer relative to said work done pursuant to said Resolution of Inten-
tion be and the same are hereby approved, ratified, and confirmed,
and said District Board does 'hereby approve, ratify. and confirm
said Diagram and Assessment, except as hereinafter provided:

The following changes shall be made in the Diagram and the
Assessments:
(1) The Assessment Diagram in relation to Assessment Lot No.
4-30-19 shall be changed to include only the southerly 161 feet of
. Assessment Lot No. 4-30-19 and Assessment No. 4-30-19 shall be
reduced to $304.00. .
(2) To the Aåsessment Diagre~ shall be added a new Assessment
Lot No. 4-30-29, which shall include only the northerly 100 feet'
of Assessment Lot 4-30-19 and the Assessment on said Lot No. 4-30-29
shall be $152.00.
(3) The Assessment Diagram in relation to Assessment Lot No.
4-32-12 shall be changed to include only the northerly 100 feet of
said Assessment Lot No. 4-32-12 and the Assessment on said Lot No.
4-32-12 shall be reduced to $334.00.
(4) To the Assessment Diagram shall be added a new Assessment
Lot No. 4-32-15. which shall include only the southerly 100 feet
of the northerly 200 feet of Assessment Lot No. 4-32-12 and the
Assessment on said Lot No. 4-32-15 shall be $334.00.
(5) To the Assessment Diagram shall be added a new Assessment
Lot No. 4-32-16, which shall include only the southerly 100 feet
of the northerly 300 feet of Assessment Lot No. 4'-32-12 and the
Assessment on said Lot No. 4-32-16 shall be $334.00.
(6) To the Assessment Diagram shall be added a new Assessment
Lot No. 4-)2-17, which shall include only the southerly 157.86
feet of said Assessment Lot No. 4-32-12 and the Assessment on said
,Lot No. 4-32-17 shall be $426.00.
(7) The Assessment Diagram in relation to Assessment Lot No.
4-56-6 sha,ll be changed to include also Assessment Lot No. 4-45-5
and Assessment Lot No. 4-45-5 and the Assessment thereon shall be
e.liminated.
Said District Engineer is her~by directed to correct and modify
said Diagram and Assessment accordingly.

Messrs. Sprague. ~onro, Macktinger, Krebs and Lesnick, and
Mesdames Carney and Spaits complained of road damages. The. Board
directed the Engineer to inspect the various roads.

of Resolution No. 555:
RESOLUTION NO~ 555
WHEF~AS, the District Board on Thursday, March 2. 1950 authorized
and did publish a call for bids on Main Trunk Section VII and Moraga
Pumping Station No.1 to be loca.ted between a point northwesterly of
St. Ma.ry' s College and a point on Jonas Hill Road at the south prop-
erty line of the D. L. Rheem property; and
WHE,=~EAS, in response to the c8,ll for bids, bids were duly opened
and entered into the Minutes of the meeting of March 30, 1950 as
received;
AND, WHEREAS, the bid of each of the following contrBctors is the
lowest responsible bid received for the portion of the work as spec-
ified and as follows:
Oakland Sewer Construction Company at total bid price .of $24,192.90
for construction of Main'Trunk Section VII. and
P. &. J. Artukovich. Inc., at a total biã,price of $22,946.00 for
construction of Moraga Pumping Station No.1.
NOW, THEREFORE. BE IT RESOLVED:
1.
That the bid of Oakland Sewer Construction Company at the
Unit prices set forth therein be and the same is hereby
accepted; and
2.
The bid of P. & J. Artukovich, Inc., at the total bid price
set forth therein be and the same is hereby accepted for
the construction of Moraga Pumping Station No.1; and
The President is hereby authorized and directed to execute
the contract on the behalf of the Central Contra Costa
Sanitary District with each of the said successful bidders.
and the Secretary be and he is hereby a.uthor~zed to counter-
sign the same on the behalf of the District;

Immediately following the execution of the contract by each
of the successful bidders and the District upon the furnish-
ing by the bidders of the bonds required by each said contract,

the Secretary is hereby authorized and directed to return
to the succe.ssful bidders such depo si ts as may have accom-
panied said bids or to give such release as may, be request-
ed, from further liability upon the bidders bond;
Upon the execution of a contract by 'the successful bidders
and the approval on behalf of the Sanitary District of the
accompanying bonds, the Secretary is hereby authorized and
directed to'return all certified checks accompanying the
bids of the unsuccessful bidders.

CONNEOTION FOR COUNTY JUVENILE HOME.
It was moved by Member Johnson, seconded by Member Cornwall,
that the Board give the President and Secretary authority to enter
into an agreement with the County of Contra Costa covering install-
ation of sewer to 'serve the County Juvenile Home. Carried by the
following vote:

RESOLUTION NO. 556
IT IS HEBEBY RESOLVED BY THE District Board of the Central
Contra Costa Sanitary District that the 'necessity, as a health
measure, for sewers in that area and for those proceedings described
in the letter of .Dr. H. L. Blum. Health Officer of Contra Costa
County. addressed to,this Board and dated March 13, 1950, is by
this Board similarly found to exist. Said letter is hereby re- -
ferred to and made a part hereof, and ordered spread upon the
Minutes of this Body. .

Gentlemen:
A recent investigation of conditions existing in the area herein-
after described in the Central Contra Costa Sanitary District in
the County of Contra Costa. disclosed ,such conditions to be un san-

itary, unhealthful, and in my opinion, dangerous to the health of
the people living therein. Said area is bounded and described as
follows:
IIBeginning on the northeAst boundary of the Moraga Highway at the
.southeast corner of Moraga Midlands as said corner and subdivision
is designated on map of record in Map Book 28 on page 2 in the office
of the Recorder, Contra Costa County, California; thence from said
point of beginning northerly, westerly and southerly along the east-
ern, northern and western boundaries of said Moraga Midlands to the
northwest corner of Lot 19 of said subdivision; thence easterly 8long
northern line of said Lot 19 and continuing easterly along northern
line of Lot 18 to the northeast corner thereof; thence southerly
along the eastern line of said Lot 18 to the southeastern corner

liAs Health Officer of the County of Contra Costa, I recommend as
a necessary health measure 'that your Honorable Board institute
proceedings at an early date for the construction of a sanitary
sewer system for said area to abate the unsanitary conditions
therein.

APPROVING ASSESSMENT DISTRICT MAP
It is hereby resolved by the District Board of the Central
Contra Costa Sanitary District, Contra Costa County, State of Cal-
ifornia, that the Assessment District Map submitted by the Engineer,
which indicates by a boundary line the extent of the territory in-
cluded in the District proposed to be assessed for constructing a
sanitary sewer system for the areas within the following described
boundaries, to-wit:
Beginning on the northeast boundary of the Moraga Highway
at the southeast corner of Moraga Midlands as said corner
and subdivision is designated on map of record in Map Book
28 on page 2 in the office of the Recorder, Contra Costa
County. California; thence from said point of beginning
northerly, westerly and southerly along the eastern, .north-
ern and western boundaries of said Moraga Midlands to the
northwest corner of Lot 19 of said subdivision; . thence east-

RESOLUTION DIRECTING PREPARATION
,OF PLANS AND SPECIFICATIONS AND DES-
IGNATING ENGINEER TO PREPARE PLANS
Member Johnson, seconded by Member Toland, moved the adoption
of Resolution No. 558:
RESOLUTION NO. 558
BE IT RESOLVED by the District Board of the Central Contra
Costa Sanitary District that the said District Board proposes to
cause to be constructed in Local Improvement District 17 Central
Contra Costa Sanitary District, County of Contra Costa, state of
California, the following improvementE!, 'construction of sewers
and appurtenances, and'
BE IT FURTHER RESOLVED by the District Board of the Central
Contra Costa Sanitary District, that John L. Mason, Engineer of
the District be and he is hereby directed to prepare plans and
specifications ror said proposed work, together with careful
estimates of the costs and expenses of'~uch work, and
BE I'¡' FURTHER RESOLVED that the proceedings for such work shall
be taken in accordance with the provisions of the IIImprovement Act
of 1911" under Resolution of Intention to be hereafter adopted,
and
BE IT FURTHER RESOLVED that the said John L. Mason be and he
is hereby directed to prepare a map showing the boundaries and the
district. to be assessed for the said proposed work and improvement.

PREPARATION OF PROCEEDINGS AND FIXING
COMPENSATION AND CHARGES

RESOLUTION NO. 559
RESOLVED by the District Board of the Central Contra Costa Sani-
tary District that John L. Mason be and he is hereby appointed Engineer
of Work for the proposed doing of all necessary engineering work and
exercising all of the functions provided for the office of Engineer of
Work and Superintendent of Streets in the "Improvement Act of 1911" in
connection withrthe improvement work known, and to be known, as the
improvement of Local Improvement District No. 17 by the construction
of sewers and appurtenances therein, and
BE IT FURTHER RESOLVED that said John L. Mason shall act as
Engineer of Work a.nd Superintendent of Streets and is hereby employed
and appointed to furnish all surveys, original drawings, maps and
blue prints, including any and all such maps necessary and incident
to the rights of way contemplated in the improvement work herein
involved; all plans and specifications, all inspection, work prepara-
tion of assessment rolls, assessment diagram and warrant and any and
all other services which shall be required from the Engineer of Work
under the provisions of the "Improvement Act of 1911"; and
BE IT FURTHER RESOLVED, that the Central Contra Costa Sanitary
District has engaged a full time engineering staff including the
services of the said John L. Mason and it is resolved that there
shall be charged to the Local Improvement District No. 17 the cost
of the services to the District of Mr. John L. Mason and the engineer-
ing staff of the District, together with materials supplied by the
District to the Local Improvement District and the administrative
costs of supplying such engineering services, labor and material.
Together with the services of Mr. John A. Nejedly who is herewith
directed to prepare all proceedings in connection with said Local
Improvement District the expense of which similarly shall be charged
to the Local Improvement District. As all of such costs shall be
determined by the District Board to be devoted to such Local Improve-
ment District.
RESOLVED further that such costs shall be included as incidental
expenses and be charged to the Local Improvement District as the
charges of engi neering and lege.l services au thori zed by law.

SECTION 2. All said improvement and work shall be done of the
sizes, dimensions, and materials and in the positions and locations
and to the grades as shown upon. and all in accordance with, the
Plans and'Specifications therefor heretofore adopted by said Dist-
rict Board and now on file with the Secretary of said Boarc, which
said Plans and Specifications are hereby referred to and made a
pprt hereof by reference.
That the improvements herein described shall be constructed to
the grades and elevations as shown on said plans and specifications
which grades and elevations are hereby adopted and established as
the official grades therefor, and all such work shall be done to
the lines and grades as shown on such pla.ns and specifications.
SECTION 3. That in the opinion of said Board, said work is of
more than local or ordinary public benefit. and said Board hereby
orders that the cost and expenses of said work and improvement
shall be chargeable and charged upon a district, which district is
hereby de~lared to be the district benefited by said work and im-
provement and which is to be assessed to pay the cost and expenses
thereof.
The exterior boundaries of said.assessment district and the ex-
tent of the territory included ther~in are shown upon the map of said
district and described in description of said territory approved and
adopted by said Board on the 6th day of April, 1950, and now on file
in the office of the Secretary of said Board, to which map reference
is h8reby made for a particular description of said boundaries and

sons having any objection to the proposed work and improvement. the
grades thereof, or to the extent of the district to be assessed, or .
