The District Board of Central Contra Costa Sanitary District convened
in a Regular Session at its regular place of meeting located at 1250
Springbrook Road, Walnut Creek, County of Contra Costa, State of California,
on january 7,1960, at 8:00 o'clock P.M.
The meeting was called to order by President FiSher.

It was moved by Member Mitchell, seconded by Member Roemer, that the
Minutes of the December 3,1959, meeting be approved subject to correcting
the District Manager-Engineer's Report on "STAtUS OF OUTFALL SEWER SCHBDULB
II JOB" to read as follows:
'.Although the M. Miller Co. has consistently defaulted in performance,
in consideration of Resolution No. 1196, M. Miller Co. has, during the past
week, met the requirements called for therein."

APPROV AI. OF BIlLS
Prior to the approval of the bills, Mr. HOrstkotte requested authorization
to spend Sewer Construction Bond Funds in the amount of $1,434.23 for the
installation of an Armco gate on the Outfall Sewer. He stated this was neces-
sary at the present time and also required after the Flood Control work has
been completed in the area.
It was moved by Member Salfingere, seconded by Member Roemer, that
$1,434.23 be authorized from Sewer Construction Bond Funds for the installation
of an Armco gate on the Outfall Sewer. Carried by the following vote: '

It was moved by Member Mitchell, seconded by Member Roemer, that the bills

4539 to 4700, inclusive. Carried by the following vote:

President Fisher opened the Hearing on the Bdmeades withdrawal from the
District and asked for any protests.

. There being no prOtests, it was moved by Member Roemer, seconded by
Member Mitchell, that the Hearing as to protests for the withdrawal of the
Bdmeades property from the District be closed and that action on the:
Resolution be continued to January 21,1960, at which time action will
be taken if evidence is presented that the Bdmeades have made arrangements
for annexation to the Mt. View Sanitary District. Carried by the following

Mr. Horstkotte, District Manager-Engineer, reported that, due to a flaw
in the material or backfiring of the engine, an anchor bolt had Sheared on one
of the right angle{gears at the Treatment Plant. He: requested an authorization
of $900.00 from Sewer COnstruction General FUnds to repair the: damage.
It was moved by Member Mitchell, seconded by Member Roemer, that $900.00

Mr. Horstkotte, District Manager-Bngineer, read a letter from Stone lit
Youngberg suggesting that the next sale of bonds by the District be discussed
at the January 21,1960, meeting.
Continued to January 21,1960, at which time a representative from
Stone lit Youngberg will be present.

John H. Everett, W. R. Odenthal, Robert J. Oakes, Lucinda D. Rissotto and First
Assembly of God Church of Walnut Creek, and H. G. Parrott be accepted and their

Mr. Horstkotte, District Manage r-Bng ineer , repo rted that he had accepted
the Thompson Road Parallel Sewer and Schedule I, Line A, work and was filing'
Notices of Completion on each job.

Mr. Horstkotte reported that Line A was 5l~ complete in 2S~ of the
contract time.
AUTHORIZATION TO SBLL $-500.000.00 OF UNITED STAT.BS 'l'RBMURY BILLS -
Mr. Horstkotte explained that, due to the good weather, payments on con-
tracts have been larger than anticipated and requested a*thorization to sell
$500,000.00 invested in United States Treasury Bills due March 22, 1960.
It was moved by Member Roemer, seconded by Member Mitchell, that,
$500,000.00 of United States Treasury Bills due March 22, 1960, be sold and
the proceeds returned to the Sewer Construction Fund. Carried by the following

DAMAGB TO SEWERS CAUSED BYTRBES AND SHRUBS
Mr. Horstkotte stated that certain trees and shrubs were causing consider-
able damage and expense to the District ~en planted in the area of easements.

The District Board agreed that this was a problem that required some form
of restriction.
Mr. Horstkotte stated that, in certain areas where stoppages due to root
problems are repeating, property o.ners should install overflow devices for
their protèction. He queationed whether this coUld be handled in such a manner
as to avoid District liability for deficiencies in the system.
Mr. Bohn, Counsel for the District, felt that a proper letter could be
prepared, in ~ich the Board concurred.
SEWERS IN WATERSHED 24 AREA
Mr. Horstkotte reported that the Flood Control District was lining the
creek channel in the area of Watershed 24 and a considerable saving could be
achieved if sewers planned for the area could be installed along with their

work. He estimated the cost at $60,000.00. He stated he planned on contacting
the property owners in the area to explain the lower cost if the sewer installa-
tion was done at the time of the Flood Control District work.
Mr. Horstkotte stated he was. going to hold meetings in the Ygnacio Valley'
area relative to the planned sewers for the area to determi~e the interest of
the property owners.
VINYL TILE FLOOR FOR DIGESTER SERVICE WILDING
Mr. HolStkotte requested authorization to spend $1,078.40 for a vinyl
tile floor for the digester service building.
It was moved by Member Mitchell that the request be denied.

Mr. Horstkotte reported that Line J is 90% complete and 42% of the con-
tract time has elapsed.

Mr. Horstkotte reported that the Orinda Crossroads and Moraga Pumping
Stations were now above ground level.

Mr. Bohn, Counsel for the District, reported that the Macauley easement
condemnation had been concluded.
TlDMPSON FLOOD DAMAGB
Mr. Bohn reported that the Thompson flood damage suit had been settled by
the insurance company.
CLAIM AGAINST CHARLES HARNBY
Mr. Bohn reported that the final claim against Charles Harney, contractor
for the Walnut Creek Bypass, would approximate $10,000.00.
M. MILLER CO. LITIGATION
Mr. Bohn briefly discussed the M. Miller Co. litigation.
Mr. Bohn reported that M. Miller Co. requested that the District release
$42,280.00 by joint payment to M. Miller Co. and the Western Concrete Pipe Co.
on account of their claim.
Mr. Bohn stated he would reject the request as there are other withhold
notices filed and the final funds available are unknown.
