MINUTES OF A SPECIAL MEETING OF THE
DISTRICT BOARD OF CENTRAL CONTRA
COSTA SANITARY DISTRICT HELD O~
MARCH 23. 1950
The District Board of Central Contra Costa Sanitary District convened
in special session at its regular place of meeting located at 1822
Mt. Diablo Boulevard, in the City of Walnut Creek, County of Contra
Costa, State of California, at the hour of 8:00 o'clock p.m., on
Me.rch 23, 1950.
The meeting was called to order by President Wadsworth and the
following roll was called.:

READING OF MINUTES OF PREVIOUS MEETING
The Minutes of the previous meeting were read and were approved
as entered.
MORAGA MEADOWS - GLORIETTA AREA
By letter of March15, 1950,. the Moraga Meadows Association
requested that all permits for septic tanks in the Moraga Meadows-
Glorietta area be denied until the area is. sewered.
The County Health O.fficer' s letter of March 23 was read, in
which Dr. Blum requested the District to institute proceedings
immediately for installation of sewers in the Moraga Meadow Glor-
ietta area.
Mr~ Platt of Platt and Goheen requested that the Board grant
permits for septic tanks for 23 homes in the area.
Mr. Barnes stated that the Moraga Company wanted sewers installed
as quickly as possible, but in the meantime wanted permits for
temporary septic tanks, and they would connect to the sewers as
soon as they. were notified the sewers were available.
Dr. Wise and Messrs. Nicolaysen, Ayres, Davis, Bettencourt,
Murphy, Sigerson, Creighton, Doty and Polloczek were heard, requesting
that no permits for septic tanks be issued.
Mr. Murphy requested that no action be taken for two weeks to
give him an opportunity to call a meeting of the Glorietta Improve-
ment Club.
Dr. Wise stated that the Moraga Meadows Association would like
to proceed under private contract.
All persons present expressed the desire for sewers, but not all
wanted the construction started in 1950.
It was moved by Member Johnson, seconded by Member Smitten, and;
unanimously carried, that the Board grant Mr. Platt permission to
install individual septic tanks on 23 building units in Broadview
Tract.
It was moved by Member Johnson, . seconded by Member Smitten, and
unanimously carried, that on April 6, 1950, in the event that the
group of property owners generally represented at this meeting do
not have plans for private installation of sewers, t~e Board take
steps to initiate local improvement district proceedings for the
Moraga Meadows-Glorietta area.

EXTENSION OF TIME FOR STOLTE, INC.
LOCAL IMPROVEMENT DISTRICT NO.15
It was moved by 'Member Cornwall,eeconded by Member Smitten,
that the Board grant extension of time of 60 days to Stolte, Inc.
for work of Local Improvement District No. 15 as reque sted by
their letter of March 13,1950. Carried by the following vote:

EXTENSION OF SEWER IN L.I.D. 7

It was moved by Memb?r Cornwall, seconded by Member Smitten,
and unanimously carried, that the Board grant permission to Mr. C.
Jacuzzi to extend sewer from the end of work in Local Improvement
District No.7, and that no connection fee be charged for this
ins talla tion.
EXECUTING LICENSE AGRE~IENT WITH
PACIFIC GAS & ELECTRIC CO.
It was moved by Member Smitten, seconded by Member Cornwall,
and unanimously carried that the Board authorize the President
and Secretary to execute license agreement with the Pacific Gas
and Electric Company for change of location of work in Local
Improvement District No. 14.
MORAGA PUMP STATION NO.2 & FORCE MAIN
Member Johnson, Seconded by Member Toland, moved the adoption
of Resolution No. 549:

RESOLUTION AND ORDER OF THE DISTRICT BOARD OF CENTRAL
CONTRA COSTA SANITARY DISTRICT APPROVING PLANS AND
SPECIFICATIONS FOR MORAGA pmtp STATION NO.2 AND SEWERS
FOR THE CENTRAL CONTRA COSTA SANITARY DISTRICT.
RESOLVED, that Plans and Specifications on the Moraga Pump
Station No.2 and sewers be approved, and the President and
Secretary are hereby authorized and directed to signify this
approval by placing their signatures upon said Plans and Spec-
ifications.

of Resolution No. 550:

WHEREAS, in pursuance of Section 1773 of the Labor Code of
the State of California, before the District Board of the Central

Contra Costa Sanitary District may award any. contra.ct for public
work. on behalf of Sanitary Distriot, the Di strict Boe.rd must ascer-
tain. the general prevailing rate of per diem wages in the locality
in which the work is to be performed, to-wit: within the limits of
the Central Contra Costa Sanitary District for each craft or type
of workman or mechanic needed to execute the contract, and must
specify in the call, for bids for said contract and in the contract
itself what'the.general prevailing rate of per diem wages in said
locality is for, each craft or type of workman or mechanic needed to
execute the contract and also the general prevailing rate for legal
holiday and over-time work;
NOW, THEREFORE, BE IT RESOLVED, that the said general prevailing
rate, of per diem wages and the general prevailing rate of per diem
wages for legal holiday and overtime work within the limits of said
Sanitary District for each craft or type of workman or mechanic
needed to execute a contract for the construction of Moraga Pump
Station No.2 and sewers and shall be and the same are hereby
ascertained, approved and adopted by this District Board after a
full investigation to be as follows: '

Overtime and Saturday work shall be paid for at double the
, normal hourly rate except as noted below for Cement Finishers and
Truck Drivers and work on Sundays and Holidays shall be paid for
at double the normal hourly rate. The foregoing schedule of pre-
vailing rates of wages, and rates for overtime, Sunday and Legal
Holidays, is based, unless otherwise specified, upon a working day
of 8. hours.
Overtime and Saturday rates for Trucl Drivers shall be at one
and one-half (li> times the normal hourly rate.
The first two hours overtime, after a normal 8 hour day, for
Cement Finishers shall be at one and one-half (Ii> times the
normal rate and further overtime shall be at double the normal
rate. Saturday,.work for Cement Finishers shall be at one and one-
half. (It> times the normal rate for the first 8 hour~ worked and
at double the normal rate for all further time worked on Saturdays.
Notice is also hereby given bidders 'that it shall be mandatory
upon. the contractor to whom the contract is awarded, and upon all
subcontractors under him, to pay not less than said general pre-
vai11~ rates of per diem wages, as above listed, to all laborers,
workmen and mechanics employed in the execution of the contract.
Anything to. the contrary in the above wage scale notwithstand-
ing,. the Contractor and all Subcontractors under him shall pay all
their laborers,. workmen," mechanics and employees on said work a
salary or wage at least equal to the prevailing salary or wage
for the same qualityct service rendered to private person.s, firms
or corporations under similar employment, within the Central Contra
Costa Sanitary District. '.
The per diem wage rate is the hourly rate hereinabove men-
tioned established multiplied by the number of hours hereinabove
mentioned as constituting the working day for the particular craft
or type of workman.

of Resolution No. 551:
RESOLUTION NO. 55~
wHEREAS, in the judgment of the District Board of the Central
Contra Costa Sanitary District it is necessary to secure all labor,
materials, equipment, mechanical workmanship, transportation and
services required for the construction of the Moraga Pump Station
No. 2.and sewers ,in accordance with the plans and specifications
for the same prepared by the District Engineer which are on file
in the Office of.the Sanitary District located at 1822 Mt. Diablo
Boulevard, Walnut Creek, California;
NOW, THEREFORE, BE IT RESOLVED, that the general prevailing
rates of wages as heretofore ascertained and determined by this
. Board.in its Resolution No. 550 adopted on the 23rd day of March,
1950, .in pursuance to the Labor Code of the State of California
-shall be the general prevailing rates of per diem wages for each
craft .or type of workman or mechanic needed for the construction
of said Moraga Pump Station No.2 and sewers; and,

BE IT FURTHER RESOLVED, that the Secretary of this Board be
and is hereby authorized to advertise for proposals for the construc-
tion and completion of said work by publishing the same once in the
Walnut Kernel, a newspaper of general circulation published in the
Central Contra Costa Sanitary District.
BE IT FURTHER RESOLVED, that the Notice inviting Sealed Pro-
posals shall be in the form as follows:

Contra Costa Sanitary District, Walnut Creek, California, invites
and will receive .sealed proposals until 8:00 o'clock p.m., April 20th,
1950, for furnishing all labor, materials and services for the con-
struc~ion of Moraga Pump Station No.2 and sewers for the Central
Contra Costa Sanitary District, in accordance with the plans and
specitications adopted therefor.

Tpe plans and specifications far the proposed work may be seen
and e~amined at the office of the Central Contra Costa Sanitary
Distr~ct, l822 Mt. Diablo Boulevard, Walnut Creek, California, and
may b~ secured by making payment of Ten and no/lOOths dollars. There
will be no refund on returned plans and specifications.
PURSUANT TO THE STATUTES OF THE State of California, the District
Board.of the Central Contra Costa Sanitary District has ascertained
and determmned the general prevailing rate of per diem wages and
rates .for overtime and legal holidays in the locality in which this
work is to be performed for each craft or type of mechanic needed to
execute the contract.

The foregoing schedu¡e of prevailing rates of wages, and rates
for overtime, Sunday and Legal Holidays, is based, unless otherwise
specified, upon a working day of eight (8) hours.

times the normal rate 'for the first eight (8) hours worked and at
double the. normal rate for all further time worked on Saturdays.
NOtICE IS ALSO HEREBY GIVEN BIDDERS that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all
subcontractors under him, to pay not less than said general prevail-
ing rates of per diem wages, as above listed, to all laborers, work-
men and mechanics employed in the execution of the contract.
Before submitting proposalsthe bidder shall be licensed in
accordance with the provisions of ,Chapter 9 Division III of the
Business and Professions Code, Chapter 37 of the Statutes of 1939,
as amended, of theState of California, which provides for the regis-
tration and licensing of contractors. '
Each bidder must submit with his proposal, a statement of his
financial responsibility, technical ability and experience on the
form to be furnished prospective bidders.
Each bidder shall submit with his bi' on the form provided, the
nam~ and addressof each subcontractor including the principal sup-
pliers of ma,terials, and the portion of the work which each subcon-
tractor will do. If the contractor fails to bame the subcontractors
in his proposal, he shall be deemed to have agreed to perform such
portion of the work himself and shall not be permitted to subcontract
said portion of work. without previous written permission of the
District Board.
:The proposal shall be made out on the form to be furnished pros-
pective bidders, a copy of which is incorporated with the specifica-
tions and must be accompanied by a certified or cashier's check or
bidder's bond for an amount not less than ten (lO) per cent of the
aggregate of the proposal, made payable to the Central Contra Costa
Sanitary District, sealed and filed with the Secretary thereof on or
before the day and hour first above set forth, and thereafter will be
pubiicly opened and read before said District Board.
-The above mentioned check or bond shall be given as a guarantee
that the bidder or his heirs will enter into contract if awarded the
work, within ten (10) days after notice of the award has been sent
to him by mail at the address given by him in his proposal and said
cheçk or bond shall be declared forfeited if the bidder refuses or
neg¡ects to enter into said contract within said time.
,The successful bidder will be required to furnish labor and
material bonds in the amount of Fifty (50) per cent of the contract
price and a faithful performance bond in an amount equal to one
hundred (100) per cent of the contract price.
:The District Board reserves the right to reject any or all
proposals and to waive any informality in proposals received.

SEWERS FOR COUNTY JUVENILE HOME
The Board instructed the Attorney to work out the wording of
an agreement for sewer connection for the County Juvenile Home.

Member Toland, seconded by Member Smitten, moved the adoption
of Resolution No. 552:

WHEREAS, ERNEST M. BIASOTTI and CHRISTINA F. BIASOTTI, his
wife, as joint tenants, granted a Deed of Dedication for Sewer
Eas~ment over a portion of Lot 4 of Portion of Acalanes Rancho,
and.
RESOLUTION NO. 552
WHEREAS, subsequently the Central Contra Costa Sanitary Dist-
rict changed the location of the sewer line, and has no need for
the easement,
.. NOW, THEFEFORE, BE IT RESOLVED that the aforesaid easement be
conveyed to the Grantors.
