DISTRICT BOARD OF CEtJTRAL CONTRA.
CQSTA SANITARY DISTRICT HELD ON
OCTOBEE 20J 1949
.The District Board of Central ContrR Costa Sanitary District
convened in special session at its regular place of meeting
located at 1822 Mt. Diablo Bou!evard, in the City o~ Walnut Creek,
Cou~ty of Contra Costa, State of California, at the hour of 8:00
o'clock p.m., October 20, 1949.
The meeting was called to order by President Wadsworth, and
the following roll was called:

READING OF MINUTES OF PREVIOUS MEETING
The Minutes cf the previous meeting were read by the Secretary,
and were approved as read.
SEWER CONNECTION FEE FOR EBMUD FILTER
PLANT IN ORINDA
It waS moved by Member Johnson, seconded by Member Smitten,
anð unanimously carried that the. Board accept the Manager's
recommendation and set the service charge for sewer connection of
East Bay Municipal Utility .District's Filter Plant in Orinda,
consisting of 8.80 acres of.land, at $2,000.00.
EXECUTING AGREEHENT WITH SOUTHERN PACIFIC
COMPANY J ENCROACHNENT L. 1. D. NO.8
It was moved by Member Johnson, seconded by Member Smitten,
and unanimously carried, that the Board authorize the President
and Secretary to enter into a lease agreement with the Southern
Pacific Company for an encroachment in the railroad's right of
way in Local Improvement District No.8, at a payment of $10.00
per annum r~ntal.
APPROVING ASSESSMENT DIAGRAM FOR
LOCAL IMPROVEMENT DISTRICT No.6
Member Toland, seconded by Member Weill, moved the adoption of
the following resolution:
RESOLUTION NO. 516
RESOLVED by the District Board of Central Co.ntra Costa. 5a.n itary ,
District of Contra Costa County, State of California, that the
Diagram, made by the District Engineer of said Sanitary District
and presented to said District Board, of the district to be assessed
for the costs and expenses of constructing sanitary sewers and
appurtenances in Local Improvement District No.6, and in the public
streets, drives, rights of way, easements and reserves therein, in
said Sanitary District, as provided in Resolution of Intention No.
. 398, adopted by said District Board on November 18, 1948, be and
the same is hereby approved, and the Secretary of said District
Board is hereby directe& to certify the fact and date hereof and so
notify said District Engineer.

LOCAL IMPROVEHENT DISTRICT NO. 12
Member Smitten, seconded by Member'Toland, moved the adoption of
the following resolution~
RESOLUTION NO. 517
RESOLVED by the District Board. of Central Contra Costa Sanitary
District of Contra Costa County, State of California, that the Dia-
gram, made by the District Engineer of said Sanitary Dlstrict and
presented to said District Board, of the district to be assessed for
the. cost s and expenses of constructing sEmi ta.ry s ewers and appurten-
ances in Local Improvement District No. l2, and in the public streets,
drives, rights of WB.y, ee,sements and reserves therein, in said Se,ni-
tary District, as provided in Resolution of Intention No. 439, adopted
by said District BoA.rd on April 7, 1949, be and thè same is hereby
approved, and the Secretary of said District Board is hereby directed
to certify the fact and date hereof and so notify said District
Engineer. .

INCIDENTAL EXPENSE FOR LOCAL IMPROV~¡ENT DISTRICT NO.1
It was moved by Member. Smitten, seconded by Member Tola.nd, and
unanimously carried, that $49,389.19 received from Clyde C. Kennedy,
said sum representing the incidental expenses incurred and not p~ev-
iously reimbursed to the Sanitary District, and the estimated balance
of incidental expenses to be further incurred, at the date of delivery.

which sum was paid to said .Clyde C. Kennedy upon delivery of said
warrant and assessment, be disbursed as approved by the District Man-
ager after receipt of bills duly rendéredas follows~
$ 5,836.24 to Clyde C. Kennedy for engineering services as final
payment pursuant to contract for such services;
$ 1,265.22 for legal services for Local Improvement District No.1
paid pursuant to contract therefor as follows:

$42,287.73 the balance of said sum for incidental expenses to be
deposited to the credit of the Running Expense Fund of
Central Contra Costa Sanitary.District to reimburse said
fund for monies heretofore advanced for incidental ex-
penses incurred by the Sanitary District for Local Im-
provement District No.1 and for which the Sanitary
District has not previouÐly received paym5nt; and to pe.y
further costs for incidental expenses for Local Improve-
ment District No.1 B.S bills for such ex'Oenses are
received and authorized for payment by the District Board
after approval by the District Manager and audit by the
Board. .
The President and Secretary are hereby authorized and directed to

AUTHORIZING PEID1ANENT RECORD
It was moved by Member Smitten, seconded by Member Toland, and
unAnimously carried, that the Ma.nager be authori2'.ed to obtain van-
dyke prints of all original tracings in the possession of the
District Engineer, at a cost not to exceed $400.00.
REQUEST FOR ADDITIONAL l;lORK IN
LOCAL IMPROVEMENT DIST~ICT NO.8
Messrs. Delp, Rhodenhamel, Crp.ndell and McCoy requested an
extension of sewer in Local Improvement District No.8. Mr.
Harrison recommended that the Board not consider additional work
under this procesding.
REQUEST FOR CHANGE OF LINE IN
LOCAL. IMPROVEMENT DI6TRICT NO.8
It wes moved by Member Toland, seconded by Member Smitten, that
the District Engineer be instructed to extend line A-2-j of Loca.l
Improvement District No.8 approximately 200 feet in La Vista Road
as work to be done at the unit prices specified in the contract on
the receipt of signed request from the affected property owners,
with their consent to the assessment of the cost against their
propert ies, and with the fur'ther consent of the contractor to' per-
form this work. Ca.rried unanimously.
REQUEST FOR CHANGE OF LINE IN .
LOCAL IMPRO~1ENT DISTRICT NO. 14
It was moved by Member Smitten, seconded by Member Toland,
and unanimously carried, that the District Engineer be instructed
. to have line N-2-a of Local Improvement District No. 14 omitted
and a line installed in the property of George Sanborn extending
southerly from Sanborn Road, upon the written consent of the
affected property owners, upon consent of contractor, upon receipt
of Deed of Easement to the District for the new installation, and
upon consent .of the affected property owners to the assessment of
the cost against their properties.
PROPOSED ANNEXATION OF ALAMO DANVILLE
DIABLO TERRI'l'ORY
The Ma.nager informed the BoÐrd that the Petition for Annexa-
tion of the Alamo-Danville~Diablo area was to be published on Oct-
ober 24 and 31, 1949, and the hearing date on the Petition was set
for November 10, 1949.
Member Johnson requested that the Menager p¡"epaI'e a Ille-p of the
area of the proposed annexation, showing the proposed sewer lines,
and assessed valuation of the properties, with a breakdown of the
estimate of the cost.
RESIGNATION OF W. H. BRAILSFORD. JR.
HI'. 11. H. Brailsford, Jr., tendered his l"esignation from the
Se,nitar.v District to be effective Januery 1, 1950, which was
accepted by the Board, with regret.
APPOIN~1ENT OF JOHN A. NEJ£DLY
It WaS moved by Member Johnson, seconded by Member Smitten, and
unanimously carried, that the Board, as of. January 2, 1950, appoint
Mr. John ~ Nejedly as Counsel for the Board, he to serve for a
salary of $750.00 per month, and take care of all matters of the
Dl~trict, includin~ local improvement proceedings.
RESIGNATION OF LAWSON H. WEILL
President Wadsworth read a letter of resignation from Board
Member Lawson H. Weill.

It waS moved by Member Johnson, seconded by Member Smitten
that Mr. Weill's resignation be accepted with regret. Carried
~y the following vote:

Membsr Weill did not vote.
APPOINTMENT OF. NEILL C. CORNWALL
It was moved by Member Johnson, seconded by Member Smi~ten
thp...t the Board appoint Hr. Ne ill C. Cornwall to f ill the vacancy
created by the resignation of Member Weill. Carried by the follow-
ing vote:

Members Johnson, Smitten, Toland and Wadsworth
NOES:
Members - None.
Member Cornwall took the oath of office.
RESIGNATION OF NEILL C. CORNWALL
AS SECRETARY
Mr. Neill C. Cornwall offered his resignation as Secretary
to the District Board effective immediately. The resignation was
accepted with re~ret.
APPOINTMENT OF H. I-I. SMITTEN
AS SECRETARY
Member Toland nominated H. M. Smitten, and moved that he be
appointed Secretary to the DiBtrict Board and that he he compensated
