MINUTES OF THE REGULAR MEETING OF THE
DISTRICT BOARD OF CENTRAL CONTRA COSTA
SANITARY. DISTRICT HELD AUGUST 4.1949
The District. Board of Central Contra Costa Sanitary District
convened in regular session B.t its regular place of meeting located
at 1822 Mt. Diablo Boulevard, in the City of Walnut Creek, County
of Contra Costa, State of California, at the hour of 8:00 o'clock
p.m.
The meeting was called to order by President Wadsworth, and the
following roll was called:

READING OF MINUTES OF PREVIOUS MEETING
The Minutes of the previous meeting were read by the Secretary
and were corrected as follows:
Name of bidder for work of Local Improvement District No. 16 was

The Minutes were approved as correc~ed.

COMMUNICATIONS TO THE DISTRICT BOARD
The Secretary read letters from Ina. Schmid, Marco Martin and
H. W. Hough, regarding work of Loèal Improvement District No.3,
and letter from E. W. Hickman claiming damage for work of Local
Improvement District No.2. The letters were answered by the Manager~
and the Attorney.
HEARING ON LOCAL IMPROVEMENT DISTRICT
. NO.7. RESOLUT ION OF INTENTION
The Secretary read letters of protest against the work of Local
Improvement District No.7, from the following: Lydell Peck, Dan
L. Ferrari; a request for postponement until April, 19.50 from the
Happy Ve.lley Improvement Asso.ciation; requests for exclusion from
E. C. Murray and Norman ¥acauley, and ~. H. Lassagne.
. Request from R. J. Sanderson, C. E. Peters, R. A. Fairbairn,
F. Trimlett, Alice M. Smith, Pauline Baker, M~,A. Gragnskin, Gladys
Lundgren, R. A. Young, Mrs. C. R. Disharoon, l'lrs. G. R..,Ellis, R.F.
Ouer, W. R. Sheehan, R. L. Saxton, M. A. Vittaly, Cora rtarvey, Ruth

A letter from James K. Beat~y requesting immediate construction.
A Letter from the County Health Department was read by Mr. T.
McMorrow, requesting the Board to install the sewer before wet weather
delays the work.
Supervisor H. L. Cummings stated that the County had prepared an
ordinance which would be passed August 8, makin~ the County Surveyor
responsible for repaving of side sewer cuts.
The District Engineer stated that the construction should be
completed within two months. Mr. Wakefield Taylor said it was the
responsibility of the contractor, and therefore ultimately the respon-
sibility of the Sanitary District to restore the roads to their
"proper condition". Any work incident to the construction would not
be limited to the trench cut, but it would be very difficult to
determine the County's responsibility of normal wear and tear.
After discussion, and explanations to the protestants by Messrs.
Kennedy and Harrison, Member Smitten, seconded by Member Toland, moved
the adoption of the following resolution:
RESOLUTION NO. 490
RESOLUTION ORDERING WORK, DETEF~ININGPREVAILING
RATE OF WAGES, AND DIHECTTIJG NOTICE TO BIDDERS
IN LOCAL IMPROVEMENT DISïRICT NO.7
WHEREAS the District Board of Central Contra Costa Sanitary District,
County of Contra Costa, State of California, passed and adopted, on
July 7,1949, its Resolution of Intention No. 478, to do the work and
improvement th~~ein described; and
WHEREAS all written protests filed in relation to said proceedings
were duly considered by said District Board;
RESOLVED by said District Board ths.t said protests be and the same
~re hereby ove~ruled, and
RESOLVED tpat the public interest and convenience require, and
said District aoard hereby orders, that said work and improvement be
done ~s set forth in said Resolution of Intention, and according to
Plans and Specifications heretofore adopted therefor, reference to
which.Resolution of Intention and Plans and Specifications is hereby
made for a description of said work and improvement and the terms and
conditions under which the same is to be done;

RESOLVED that said District Board hereby determines the general
prevailing rate of per diem wages, and ratss for overtime and legal
holidays, in the locality in which said work is to be performed, .
for eaoh craft or type of workman or mechanic needed to -execute the
rontract therefor, to be as stated in the Notioe ~o Bidders herein-
after set forth to be posted.and published; and
RESOLVED that the Secretary of said District Board shall post
conspicuously for five (.5) days, on or near the main entrance door
to the regular meeting place of said Board at 1822 Mt. Diablo Boule-
vard, Walnut Creel~, California., a Notice to Bidders, in the form
hereinafter stated, inviting sealed proposals or bids for doing said
work and referring to said Plans and Specifications on file; and
shall publish said Notice twice in the Courter-Journal, a newspaper
published and circulated in Central Contra Costa Sanitary District
and hereby designated for that purpose.
All such proposals or bids shall be submitted, received, and
publicly opened, examined and declared, and shall be accompanied by
a certified chec.k or bond, all as stated in se.id Notice to Bidders,
which Notice .shall be as follows:
NOTICE TO BIDDERS
Pursuant to law and Resolution No. 490 of the District Board of
Central Contra Costa Sanitary District of Contra Costa County, State
of California, passed and adopted August 4, 1949, Ordering Work,
Determining Prevailing Rates of Wages, and Directing this Notice,
. said District Board invites sealed proposals or bids for the follow-
ing work to be done, to-wit: The construction of sanitary sewers
and appurtenances for the area,' to the extent, with the materials
and in the manner set forth in Resolution of Intention No. 478 passed
and adopted by said District Board July 7, 1949, and in accordance
with Plans and Specifications adopted therefor, to which Resolution
of Intention, Ple.ns and Specifications, and Resolution Ordering Work
reference is hereby made for a description of said work and improve-
ment and the terms and conditions under which the same is to be done.
The Plans and Specifications for the proposed work may be seen
and examined at the office of Central Contra Costa Sanitary District,
1822 Mt. Diablo Boulevard, Walnut Creek, California, or at the
Engineering Office of Clyde C. Kennedy, Room .504, 604 Mission Street,
San Francisco, California, or may be secured at the Engineering.
Office of Clyde C. Kennedy by making a payment of TWENTY AND NO/IOOTHS
($20.00). There will be no refund on returned Plans a.nd Specifica- .
tions.
Pursuant to law, the District Board of Central Contra Costa Sani-
ta.ry District has determined the general prevailing rate of per diem
wages, and rates for overtime and legal holidays, in the locality in
which thœ work is to be performed, for each craft or type of workman
or mechanic needed to execute the contract. The prevailing rates so
determined are as follows:

Overtime and Saturday work shall be paid for at double the normal
hourly rate except as noted below for Cement Finishers B.nd Truck
Drivers, and work on Sundays and Holidays shall be paid for at double
the normal hourly rate.
The foregoing schedule of prevailing rates of wages, and rates
for overtime, Sunday and Legal Holidays, is based, unless otherwise
specified, upon a working day of eight (8) hours.
Overtime and Saturday rates for Truck Drivers shall be a.t one
and one-half (It) times the normal hourly rate.
The first two hours overtime, after a normal eight (8) hour day,
for Cement Finishers shall be at one and one-half (Ii) times the
normal rate and further overtime shall be at double the normal rate.
Saturday work for Cement Finishers shall be at one and one-half (It)
times the normal rate for the first eight (8) hours worked and at
double the normal rate for all further time worked on Saturdays.
NOTICE IS ALSO HEREBY GIVEN BIDDERS that it shall be mandatory
upon the contractor to whom the contract is awarded, and upon all.
subcontractors under him, to pay not less than said general prevail-
ing rates. of per diem wages, as above listed, to all laborers, workmen,
and mechanics employed in the execution of the contract.
Before submitting proposals, the bidder shall be licensed in
accordance with the provisions of Chapter 9, Division III, of the
Business and Professions Code, Chapter 37 of the Statutes of 1939,
as amended, of the State of California, which provides for the regis-
tration and licensing of contractors.

Each bidder must submit with his proposal a statement of his
financial resp.onsibili ty, technical ability and experience on the
form to be furnished prospective bidders, and a statement as to
whethBr the bidder is an individual, a partnership, a joint venture,
or a corpora t1.on.
Each bidder shall submit with his bid, on the form provided, the
name and address of each subcontractor, including the principal
suppl.iers of m.aterials, and the portion of the work which each sub-
contractor wil.l do. If the contractor fails to name the subcontract-
ors in his proposal, he shall be deemed to have agreed to perform
such portion of the work himself and shall not be permitted to sub-
contr.8ct se.id portion of work without previous written permis sion
of the Sanitary District Board.
ALL PROPOSALS or BIDS must be delivered to the undersigned.

Boulevard, Walnut Creek, California, on the 25th day of August, 1949,
up to. the hour. of 8: 00 0 I clock p. m., on which day at the hour of
.8:1.5 o'clock p.m., in said office of said District Board said pro-
posals or bids. shall be publicly opened, examined and declared, and
each proposal or bid must be accompanied by a check c~rtified without
qualification by a responsible bank, payable to Central Contra Costa
Sanitary District for an amount not less than TEN PER CENT (10%) of
the aggregate of the proposal or by a bond for said amount and so
payable signed by the Bidder and two Sureties, all as prescribed by
law.

of the following resolution:

RESOLUTION OF AWARD OF CONTRACT FOR WORK
IN LOCAL IMPROVEMENT DISTRICT NO. 14
RESOLVED that the District Board of Central Contra Costa Sanitary
District, Contra Costa County, State of California, having in open
session on the 4th day of August, 1949, publicly opened, examined,
and declared all sealed proposals' or bids offered for doing the work
hereinafter mentioned;
HEREBY rejects all of said Bids except that hereinafter mentioned,
and hereby awards the Contract to the lowest, regular responsible
Bidder, to-wit:
To UNDERGROUND CONSTRUCTION COMPANY, at the prices specified in
their proposal for doing said work now on file.
The work herein referred to is the construction of sanitary sewers
and appurtenances for that area, and to the extent, with the materials,
and in the manner set forth in Resolution of Intention No. 470, adopted
by said, District Board on the 23rd day of June, 1949, reference to
which said Resolution of Intention is hereby made for a description of
said work and improvement and the terms and conditions under which the
same is to be done. .
The Secretary of said District Board is hereby directed to publish
notice of this Award twice in the Courier-Journal, a newspaper published
and circulated in said Sanitary District as required by law.

Kennedy, said sum representing the incidental expenses incurred to
date of June 30,1949 on Local Improvement District No.8 and which
is to be advanced by the successful bidder, P. & J. Artukovich, Inc.,
and Bebek and Brkich for doing the work authorized in Local Improve-
ment District No.8, the following amounts, as approved by the District
Manager, be disbursed from said sum for such incidental expenses, as
follows:

doing the work authorized in Local Improvement District No. 16, the

CONNECTION FEE FOR HAPPY VALLEY GLEN UNIT 2
.Mr. M. F. Hallmark, Attorney for the owners of Happy Valley Glen
Unit 2 objected to any further assessment or connection .fees to be
levied against lots in. Happy Valley Glen Unit 2, on the basis of their
having paid certain fees when issued a permit to construct sewers.
,It was explained to Mr.' Hallmark that the amounts paid at the
time the permit was issued were inspection fees, that every property
pays an assessment, and permit inspection fees.
.It waS moved by Member Smitten, seconded by Member Johnson, that
a charge of $60.00 per lot be placed on Happy Valley Glen Unit 2
for use of Local Improvement District No.3 sewers between the
point of their connection and the main trunk sewer. Cs.rried by the
following vote: .

MASTER PLUMBERS' ASSOCIATION REQUEST
FOR PERMITS
.The Master Plumbers' Association requested that the District
issue permits to allow installation of side sewers from house to
property line, to be later connected to the lateral.
It was moved by Member Smitten, seconded by Member Toland that
the Board deny the request, that permits not be issued for side
sewers until connection to the laterals is available. Carried
unanimously.

WHEREAS, subsequently the Central Contra Costa Sanitary District
changed the location of the sewer line~ and has no need for the
easement,
NOW, THEF.EFORE, BE IT RESOLVED that the aforesaid easement be
conveyed to the Grantors.

REQUEST FOR EXTENSION OF TIME
DOWNER CORPORATION
Under date of August :3, 1949, the Downer Corporation again
requested an extenßion of time for completion of Local Improvement
District No. :3 of 90 days from completion date, July 7, 1949.
The Board instructed the Engineer to notify Downer Corporation
that an extension of 60 days from date of completion pursuant to
the terms incorporated in C. C. Kennedy's letter dated July $, 1949
and to request a reply from Downer Corporation accepting such terms.
REFUND OF DEPOSITS TO C & G CO~œANY
The Secretary read a letter dated July 15, 1949 .from C. & G.
Company.by L. J. Cuneo requesting that refundable deposits for
Haulaway Company and Gabriel Construction Company be mailed to C.
& G. Company.
The Attorney advised the Board that it would be in order to
refund deposits to C & G Company which that company had advanced for
Haulaway Company and Gabriel Construction Company.

terms requested by Broadmoor Improvem?nt Company for easements
requested through their properties in Local Improvement District No.
14. The Board instructed the Manager to write a letter to Senator
Breed arranging a meeting.

The Board instructed the Engineer to revise the easement granted
