HomeMy WebLinkAboutBOARD MINUTES 07-10-58 1 MINUTES OF A SPECIAL MEETING OF mE DISTRICT BOARD CEN1RAL CamtA COSTA SANITARY DISTRICT HELD JULY 10,1958 [J The District Board of Central Contra Costa Sanitary District convened in a Special Session at its regular place of meeting located at 1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of California, on July 10, 1958, at 8s00 o'clock P.M. The meeting was called to order by President Fisher. ROIL CALL PRESENT: Members: Mitchell, Roemer, Sa1fingere, Spiegl and Fisher ABSENTs Members: None DIsœSSIŒ OF MATl'ER OF UGAL CaJNSEL FOR '1HB ,DISTRICT Member Spiegl stated that the Board was meeting to determine the circum- stances for retaining Counsel for the District and that he mayor may not be interested in making application. He stated that his application would be dependent upon the circuutances under which Coünsel would be retained. He felt he was disqualified and asked to be excused from the discussion. He further stated that he wanted to resign from the Board but was asked to stay on because of other District matters on which he was working that were not completed. n L .. President Fisher and Member Roemer stated that Member Spieg1 had given a lot of thought and work to the problem, as set forth in his memorandum on the matter, and they would like to have his comments. Member Spiegl said he would sit in and give' factual information without expressing an opinion on any matters. Member Roemer discussed the Spiegl report, stating that Plan 3 had merit but for the present he was inclined toward Plan 2, in which the District Attorney's office would handle the assessment proceedings with Counsel retained by the District on a reduced retainer who would handle the general District legal matters. ' Considerable discussion was given to the legal cost of assessment work as to the amount charged to the Local Improvement District for legal services including a legal opinion acceptable to the bond buyer in relation to the actual cost of this service to the District. Mr. Nejedly, District Attorney elect and present Counsel for the Såaitåry District, was asked for his estimate of the CÐst of providing services for assessment districts and general legal counsel for the District by the District Attorney's office. Mr. Nejedly gave his opinion as to what these services would probably cost. 0 After discussion, President Fisher outlined the several plans presented, which were as follows: 1. Counsel fo provide general legal services at a reduced retainer with a fee of 3' for all assessment proceedings work including acceptable legal opinion. 2. District Attorney's office to provide assessment proceedings work with separate District counsel for general legal work at a reduced retainer. 3. District Attorney's office to provide all legal services to the District. 4. Legal Counsel for the District to provide all legal services re- quired by the District. 01 10 ,58 2 The District Board agreed that the foregoing Plans 2 and 4 would ,be the most economical for the District: Plan 2 would be the most economical during periods of low assessment district work; Plan 4 during periods of heavy assessment District work. Mr. Lynch of the Pleasant Hill Civic Council stated that further investi- gation should be made relative to using the District Attorney's office. Mr. Wendel Parker of the Pleasant Hill Civic Council stated that their purpose was to see that the District considered the District Attorney's office in discussions regarding legal Counsel for the District. The Members of the Board selected from the list of applicants those they determined met their requirements, and directed Mr. Horstkotte and Mr. Nejedly to send those applicants a letter informing them that certain work would be eliminated, as compared to the work performed by the present Counsel for the District, and the retainer would be a redùcedamount. All applicants to whom letters are sent are to be asked to reply whether interested or not. ADJœRNMENT At 10:30 o'clock P.M., the meeting was adjourned by President Fisher to July 17, 1958.
