HomeMy WebLinkAboutBOARD MINUTES 11-21-57 lS9 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE DISTRICT BOARD CENTRAL CONTRA COSTA SANITARY D~STRICT HELD NOVEMBER 21, 1957 The District Board of Central Contra Costa Sanitary District convened in an Adjourned Regular Session at its regular place of meeting located at 1250 Springbrook Road, Walnut Creek, County of Contra Costa, State of California, on November 21,1957, at 8:00 o'clock P.M. The meeting was called to order by President Fisher. 1. ROLL CALL PRESENT: Members: Mitchell, Roemer, Salfingere and Fisher .', ABSENT: Member:' . Spie~Ü II. APPROVAL OF MINUTES The Minutes of the meeting of November 14, 1957, were approved 'as presented. III. APPROVAL OF BILLS None. LOCAL IMPROVEMENT DI STRICT NO. 34 CLAIMS Mr. Horstkotte, District Engineer for Local Improvement District No. 34, reported that the District had received a release of claim from Mr. Earl.A. Norton, Assessment Parcel #34-10-5. Mr. Horstkotte stated that he had evaluated the claim of Mr. and Mrs. John Barchfield, Assessment Parcel #34-10-1, and that he was satisfied that John H. McCosker, Inc., contractor for the work, had completed the work required of him and that damage to the house, in his opinion, was not the result of the Contractor's work. It was moved by Member Mitchell, seconded by Member Roemer, that the claim of Mr. and Mrs. John Barchfield be denied and that the matter'be referred to the Contractor's insurance carrier. Carried by the following vote: AYES: NOES: ABSENT: Members: Members: Member: Mitchell, Roemer, Salfingere and Fisher None Spiegl It was moved by Member Mitchell, seconded by Member Roemer, that the claim of Mr. and Mrs. Earl A. Norton be denied and the security deposited pending settlement of the Barchfield and Norton claims be released to John H. McCosker, Inc., contractor for the work. HEARINGS LOCAL IMPROVEMENT DISTRICT NO. 33 ASSESSMENTS President Fisher opened the Hearing and asked for written protests. Mr. and Mrs. Lyle A. Dean, Assessment Parcel #33-11-2. Claim read. After discussion, it was moved by Member Salfingere, seconded by Member Mitchell, that the claim of Mr. and Mrs. Lyle A. Dean be denied and the matter referred to the contractor's insurance carrier. Penn, Assessment Parcel #33-l2-12. Claim read. Mr. Penn stated that the claim for possible damage was filed now because any damage would not be known until next year. He placed a valuation of $500.00 on each tree. Mr. Horstkotte, Engineer for Local Improvement District No. 33, stated that the District .had consulted a pomo1ogist at the University at Davis relative to tree damage caused by excavations in the root area of the trees, and, in considering the probable damage in respect to this report, Mr. Horstkotte felt that no serious damage was done to the trees. Continued to the next meeting for a further report from Mr. Horstkotte. Mrs. Earl Long, Assessment Parcel #33-13-4, reported that her driveway had not been restored. Continued to the next meeting for a report from Mr. Horstkotte. Pacific Gas & Electric Co. protest of assessment read. After discussion and explanation of the assessment by Mr. Horstkotte, it was moved by Member Roemer, seconded by Member Salfingere, that the protest of the Pacific Gas & Electric Co. be denied. Smith, attorney for Mr. Curtiss, reviewed the use of the property and protested the assessments on five separate parcels. After discussion, it was moved by Member Mitchell, seconded by Member Roemer, that the protest of Mr. Curtiss be denied. Foster, Assessment Parcel #33-12-28. units of assessment read. Letter protesting two After discussion, it was moved by Member Spiegl, seconded by Member Roemer, that Mr. Foster's protest be continued to the next meeting; Mr. Nejedly, Counsel for the District, to determine and report what can be done regarding restricti~ns in dividing the lot. It was explained to Mr. and Mrs. Dunn that the matter to which they referred had been corrected. Mr. and Mrs. Arthur Young, Assessment Parcel #33-5-7. assessment read. Letter protesting After an explanation from Mr. Horstkotte, Engineer for Local Improvement District No. 33, it was moved by Member Spieg1, seconded by Member Salfingere, that the protest of Mr. and Mrs. Young be denied. After discussion of deed restrictions and an opinion from Mr. Nejed1y, Counsel for the District, it was moved by Member Spiegl, seconded by Member Mitchell, that the protest of Mr. and Mrs. Gannaw be denied. Mr. William J. Stewart, Assessment Parcel #33-13-8, protested his assessment. After discussion and explanation by Mr. Horstkotte, it was moved by Member Salfingere, seconded by Member Mitchell, that the protest of Mr. Stewart be denied. Carried by the following vote: AYES: . Members: NOES: Members: ABSENT: Members: Mitchell, Roemer, Sa1fingere, Spiegl and Fisher None None Mr. Laroy Kavert, Assessment Parcel #33-l0-16, asked questions relative to connection fees and responsibility for damage to other's property when connecting to sewer in easement located on the property. Mr. Horstkotte explained. There being no furthe~ protests, it was moved by Member Mitchell, seconded by Member Roemer, that the Hearing be closed as to protests and continued to November 25, 1957. REPORTS DISTRICT MANAGER ORDINANCE 25 PROCEOORE Mr. Horstkotte, District Manager, presented the Board Members with a memorandum relative to Ordinance 25 procedure and requested their comments at the first meeting in December. STATUS OF TREATMENT PLANT ENLARGEMENT WORK Mr. Horstkotte reported that the work at the Treatment Plant had arrived at a stage where the Board Members would find it of interest, and suggested a tour. It was suggested that the tour be made after Thanksgiving and a date be set at the first meeting in December. COUNSEL FOR THE DIS1RICT WALDEN AREA FLOOD DAMAGE LITIGATION Mr, Nejed1y, Counsel for the District, reported that they were wa~ting for a trial date to be set on the Walden Area Flood Damage case. -;<: .=; :.1 ,. .J:h. .l. 21 ,. :"".'i t)4 " ..~ I'~ ~l 1;:)"'- LI D BOND SERVICE ŒARGES It was moved by Member Roemer, seconded by Member Salfingere, that the Local Improvement District bond service charges be placed in an account to be known as.Reserve for Bond Costs.
